4040 An Act relating to schools; amending 70 O.S. 2021,

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. AMENDATORY 70 O.S. 2021, Section 5 -200, is
5656 amended to read as follows:
5757 Section 5-200. A. As used in this section, "educational
5858 management organization " means a for-profit or nonprofit an
5959 organization that receives public funds to provide administration
6060 and management services for a charter school, statewide virtual
6161 charter school or traditional public schoo l.
6262 B. Beginning November 1, 2023, a charter school or virtual
6363 charter school that executes a new contract or renews a contract
6464 with an educational management orga nization shall only contract with

9191 an educational management organization that is a nonprofit
9292 organization or a benefit corporation organized pursuant to the
9393 Oklahoma Benefit Corporation Act. If a charter school or virtual
9494 charter school has an existing contract with an educational
9595 management organization that is not a nonprofit organization or
9696 benefit corporation on or before October 1, 2023 , the contract may
9797 remain in effect until the contract term expires , terminates, or is
9898 eligible for renewal.
9999 C. A charter school that contracts with an educational
100100 management organizati on shall use the Oklahoma Cost Accounting
101101 System (OCAS) to report the total am ount paid to an educa tional
102102 management organization as well as itemized expenditure information
103103 for the goods or services provided by the management organization as
104104 defined by OCAS expenditure codes, including the total compensation
105105 package of the superint endent including the base salary, insurance,
106106 retirement and other fringe benefits.
107107 C. D. Any owner of an educational management organization shall
108108 be required to disclose to the go verning board of the school in a
109109 public meeting any ownership position in a ny business that cont racts
110110 or proposes to contract with the same public school that the
111111 educational management organization is managing.
112112 D. E. Whenever any person shall enter into a c ontract with any
113113 school district or public charter school in the state t o teach in
114114 such school district or public charter school the contract shall be

141141 binding on the teacher and on the board of education until the
142142 teacher legally has been discharged from t he teaching position or
143143 released by the board of education from the cont ract. Except as
144144 provided in Section 5-106A of Title 70 of the Oklahoma Statutes,
145145 until such teacher has been thus discharged or released, the teacher
146146 shall not have authority to enter into a contract with any other
147147 board of education in Oklahoma for the s ame time covered by t he
148148 original contract. If upon written complaint by the board of
149149 education in a district any teacher is reported to have failed to
150150 obey the terms of the contract p reviously made and to have entered
151151 into a contract with another board of education, including a public
152152 charter school board of education, without having been released from
153153 the former contract except as provided in Section 5 -106A of Title 70
154154 of the Oklahoma Statutes, the teacher, upon being found to be
155155 employed full-time for another public school, including a public
156156 charter school in the state, at a hearing held before the State
157157 Board of Education, shall have such teacher 's certificate suspended
158158 for the remainder of the term for which the contract was made.
159159 SECTION 2. This act shall become effective November 1, 2023.
