4040 An Act relating to prescription drugs; requiring the
4141 Oklahoma State Board of P harmacy adopt rules for
4242 limited English proficiency; allowing the Board to
4343 contract with a third party; providing for
4444 codification; and provi ding an effective date.

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. NEW LAW A new section of law to be codified
5252 in the Oklahoma Statutes as Section 1010.50 of Title 56, unless
5353 there is created a duplication in nu mbering, reads as fo llows:
5454 A. The Oklahoma State Board of Pharmacy shall adopt rules to
5555 require that, if a patient is of limited Englis h proficiency and the
5656 prescribing practitioner, patient or an authorized representative of
5757 the patient so requests, a prescription dr ug dispensed by a ph armacy
5858 bear a label in both English and in the language requested and, if
5959 authorized by the Board by rule, include an informational insert in
6060 both English and the language requested. The rules adopted under
6161 this section must:

8989 2. Determine the pharmacies to which the re quirements of this
9090 section apply, and include at least retail drug outlets and other
9191 drug outlets that dispense prescription drugs ;
9292 3. Determine for which prescription drugs it is appropriate to
9393 include an informational insert in addition to the label. In
9494 adopting rules under this paragraph, the Board shall consider the
9595 complexity and length of the directions for use of the prescription
9696 drug;
9797 4. a. require that labels and informational inserts shall be
9898 available in at least fourteen (14) languages other
9999 than English that are spoken in O klahoma by
100100 individuals who are of limited English proficiency, as
101101 determined by the most recent American Community
102102 Survey from the United States Census Bureau and in
103103 consultation with the O klahoma Health Care Authority
104104 and other necessary resources , and
105105 b. the Board shall reassess, and update as necessary, the
106106 languages described in subsection A of this section at
107107 least once every ten (10) years, in consultation with
108108 the Authority and other stakeholders.
109109 SECTION 2. NEW LAW A new section of law to be codified

138138 A. A pharmacy may contract with a third party for the
139139 translation of the labels and informational inserts required under
140140 Section 1 of this act.
141141 1. A pharmacy, pharmacist or pharmacy intern that dispenses a
142142 prescription drug in complia nce with the requireme nts of this act
143143 may not be held liable for injuries resulting from the actions of a
144144 third party if the pharmacy from which the label or informational
145145 insert was dispensed entered into a contract with the third party in
146146 good faith, and the pharmacy, pharmacis t or pharmacy intern was not
147147 negligent with regard to the alleged misconduct of the third party.
148148 B. This act does not apply to an institutional drug outlet.
149149 C. The Board may adopt other rules as necessary to carry out
150150 this act.
151151 D. The Board shall, in consu ltation with the Oklahoma Health
152152 Care Authority, adopt rules to require that a pharmacy post signage
153153 to provide notification of the right to free, competent oral
154154 interpretation and translation services for patients who are of
155155 limited English proficiency. Rules adopted under this subsection
156156 must comply with any relevant federal laws and regulations.
157157 SECTION 3. This act shall become effective November 1, 2023.
