1544 O.S. 2021, Section 1 -2506.2, which relates to

1746 replacing naloxone with opioid antagonist; amending
1847 63 O.S. 2021, Section 2 -312.2, which relates to the
1948 sale or dispensation of naloxone; removing naloxone
2049 and replacing it with opioid antagonist; and

2855 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3056 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -2506.2, is
3157 amended to read as follows:

3358 Section 1-2506.2 A. Upon request, a provider may prescribe an
3459 opiate opioid antagonist to an individual for use by that individual
3560 when encountering a family member exhibiting signs of an opiate
3661 opioid overdose.

3862 B. When an opiate opioid antagonist is prescribed in accordance
3963 with subsection A of this section, the provider shall provide:

4164 1. Information on how to spot symptoms of an overdose;

4365 2. Instruction in basic resuscitation techniques;

5197 in a manner consistent with addressing opiate opioid overdose shall
5298 be covered under the Good Samaritan Act.

56101 overdose shall be covered under the Good Samaritan Act.

58102 SECTION 2. AMENDATORY 63 O.S. 2021, Section 2 -312.2, is
59103 amended to read as follows:

61104 Section 2-312.2 Naloxone, also known as Narcan , or any of its
62105 generic equivalents Any opioid antagonist that is approved by the
63106 United States Food and Drug Admini stration may be dispensed or sold
64107 by a pharmacy without a prescription; provided, however, it shall be
65108 dispensed or sold only by, or under t he supervision of, a licensed
66109 pharmacist. Naloxone An opioid antagonist may be prescribed and
67110 dispensed by a licens ed pharmacist; provided, however, it shall be
68111 dispensed only by, or under the supervision of, a licensed
69112 pharmacist. No dispensing protocol shall be required.

71113 SECTION 3. This act shall become effective November 1, 2023.
