52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 63 O.S. 2021, Section 427. 8, is
54	54	amended to read as follows:
55	55	Section 427.8 A. The rights to pos sess the marijuana products
56	56	set forth in Section 420 of Title 63 of the Oklahoma Statutes this
57	57	title are cumulative and a duly licensed individual may possess at
58	58	any one time the totalit y of the items listed therein and not be in
59	59	violation of this act so long as the individual holds a valid
60	60	medical marijuana patient license or caregiver license.
61	61	B. Municipal and county governing bodies may not enact medic al
62	62	marijuana guidelines which res trict or interfere with the rights of
63	63	a licensed patient or caregiver to p ossess, purchase, cultivate or

90	90	transport medical marijuana within the legal limits set forth in
91	91	this act the Oklahoma Medical Marijuana and Patient Protection Act
92	92	or Section Sections 420 et seq. of Title 63 of the Ok lahoma Statutes
93	93	through 426.1 of this title or require patients or caregivers to
94	94	obtain permits or licenses in addition to the state -required
95	95	licenses provided herein.
96	96	C. Nothing in this act the Oklahoma Medical Marijuana and
97	97	Patient Protection Act or Section Sections 420 et seq. of Title 63
98	98	of the Oklahoma Statutes through 426.1 of this title shall prohibit
99	99	a residential or commercial property or business owner from
100	100	prohibiting the consumption of medical marijuana or medi cal
101	101	marijuana product by smoke or vaporization on the premises, within
102	102	the structures of the premises or within ten (10) feet of the
103	103	entryway to the premises . However, a medical marijuana patient
104	104	shall not be denied the right to consume or use other medic al
105	105	marijuana products which are otherwise legal and do not involve the
106	106	smoking or vaporization of cannabis when lawfully recommended
107	107	pursuant to Section 420 of Title 63 of the Oklahoma Statutes this
108	108	title.
109	109	D. A medical marijuana patient or caregiver licen see shall not
110	110	be denied eligibility in public assistance programs includin g, but
111	111	not limited to, Medicaid, Supplemental Nutrition Assistance Program
112	112	(SNAP), Women, Infants, and Children Nutrition Program (WIC),
113	113	Temporary Assistance for Needy Families (TANF ) or other such public

140	140	assistance programs based solely on his or her stat us as a medical
141	141	marijuana patient or caregiver licensee, unless required by federal
142	142	law.
143	143	E. A medical marijuana patient or caregiver licensee shall not
144	144	be denied the right to own, p urchase or possess a firearm,
145	145	ammunition, or firearm accessories based sol ely on his or her status
146	146	as a medical marijuana patient or caregiver licensee. No state or
147	147	local agency, municipal or county governing authority shall
148	148	restrict, revoke, suspend or o therwise infringe upon the right of a
149	149	person to own, purchase or possess a firearm, ammunition, or firearm
150	150	accessories or any related firearms license or certification based
151	151	solely on their status as a medical marijuana patient or caregiver
152	152	licensee.
153	153	F. A medical marijuana patient or caregiver in actual
154	154	possession of a medical marijuana license shall not be subject to
155	155	arrest, prosecution or penalty in any manner or deni ed any right,
156	156	privilege or public assistance, under state law or municipal or
157	157	county ordinance or resolution including without limitation a civil
158	158	penalty or disciplinary action by a business, occupational or
159	159	professional licensing board or bureau, for the medical use of
160	160	marijuana in accordance with this act the Oklahoma Medical Marijuana
161	161	and Patient Protection Act .

188	188	G. A government medical assistance program shall not be
189	189	required to reimburse a person for costs associated with the medical
190	190	use of marijuana unless federal law requires reimbursement.
191	191	H. Unless otherwise required by federal law o r required to
192	192	obtain federal funding:
193	193	1. No employer may refuse to hire, discipline, discharge or
194	194	otherwise penalize an applicant or employee solely on the basis of
195	195	such applicant's or employee's status as a medical marijuana
196	196	licensee; and
197	197	2. No employer may refuse to hire, discipline, discharge or
198	198	otherwise penalize an applic ant or employee solely on the basis of a
199	199	positive test for marijuana components or metabolites, unless:
200	200	a. the applicant or employee is not in possessio n of a
201	201	valid medical marijuana license,
202	202	b. the licensee possesses, consumes or is under the
203	203	influence of medical marijuana or medical marijuana
204	204	product while at the place of employment or during the
205	205	fulfillment of employment obligations, or
206	206	c. the position is one involving safety -sensitive job
207	207	duties, as such term is defined in subsection K of
208	208	this section.
209	209	I. Nothing in this act the Oklahoma Medical Marijuana and
210	210	Patient Protection Act or Section Sections 420 et seq. of Title 63
211	211	of the Oklahoma Statutes through 426.1 of this title shall:

238	238	1. Require an employer to permit or accommodate the use of
239	239	medical marijuana on the property or premises of any place of
240	240	employment or during hours of employment;
241	241	2. Require an employer, a government medical assistance
242	242	program, private health insurer , worker's compensation carrier or
243	243	self-insured employer providin g worker's compensation benefits to
244	244	reimburse a person for costs associated with the use of medical
245	245	marijuana; or
246	246	3. Prevent an employer from having written policies regarding
247	247	drug testing and impairment in accordance with the Oklahoma
248	248	Standards for Workplace Drug and Alcohol Testing Act, Section 551 et
249	249	seq. of Title 40 of the Oklahoma Statutes .
250	250	J. Any applicant or employee aggrieved by a willful violation
251	251	of this section shall have, as his or her exclusive remedy, the same
252	252	remedies as provided for in the Oklahoma Standards for Workplace
253	253	Drug and Alcohol Testing Act set forth in Section 563 of Title 40 of
254	254	the Oklahoma Statutes.
255	255	K. As used in this section:
256	256	1. "Safety-sensitive" means any job that includes tasks or
257	257	duties that the employer reasonably belie ves could affect the safety
258	258	and health of the employee performing the task or others including,
259	259	but not limited to, any of the following:
260	260	a. the handling, packaging, processing, storage, disp osal
261	261	or transport of hazardous materials,

294	294	d. performing firefighting duties,
295	295	e. the operation, maintenance or oversight of critical
296	296	services and infrastructure including, but not limited
297	297	to, electric, gas, and water ut ilities, power
298	298	generation or distribution,
299	299	f.
300	300	e. the extraction, compression, processing,
301	301	manufacturing, handling, packaging, storage, disposal,
302	302	treatment or transport of potentially volatile,
303	303	flammable, combustible materials, elements, chemicals
304	304	or any other highly regulated component,
305	305	g.
306	306	f. dispensing pharmaceuticals,
307	307	h.
308	308	g. carrying a firearm, or
309	309	i.
310	310	h. direct patient care or direct child care; and

337	337	2. A "positive test for marijuana components or metabolites "
338	338	means a result that is at or above the cutoff c oncentration level
339	339	established by the United States Department of Transpor tation or
340	340	Oklahoma law regarding being under the influence, whichever is
341	341	lower.
342	342	L. All smokable, vaporized, vapable and e -cigarette medical
343	343	marijuana product inhaled through vaporiz ation or smoked by a
344	344	medical marijuana licensee are subject to the same re strictions for
345	345	tobacco under Section 1-1521 through 1-1527 of Title 63 of the
346	346	Oklahoma Statutes this title, commonly referred to as the "Smoking
347	347	in Public Places and Indoor Workplace s Act".
348	348	SECTION 2. This act shall become effective November 1, 2023.
