5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 63 O.S. 2021, Section 427. 8, is
5454 amended to read as follows:
5555 Section 427.8 A. The rights to pos sess the marijuana products
5656 set forth in Section 420 of Title 63 of the Oklahoma Statutes this
5757 title are cumulative and a duly licensed individual may possess at
5858 any one time the totalit y of the items listed therein and not be in
5959 violation of this act so long as the individual holds a valid
6060 medical marijuana patient license or caregiver license.
6161 B. Municipal and county governing bodies may not enact medic al
6262 marijuana guidelines which res trict or interfere with the rights of
6363 a licensed patient or caregiver to p ossess, purchase, cultivate or

9090 transport medical marijuana within the legal limits set forth in
9191 this act the Oklahoma Medical Marijuana and Patient Protection Act
9292 or Section Sections 420 et seq. of Title 63 of the Ok lahoma Statutes
9393 through 426.1 of this title or require patients or caregivers to
9494 obtain permits or licenses in addition to the state -required
9595 licenses provided herein.
9696 C. Nothing in this act the Oklahoma Medical Marijuana and
9797 Patient Protection Act or Section Sections 420 et seq. of Title 63
9898 of the Oklahoma Statutes through 426.1 of this title shall prohibit
9999 a residential or commercial property or business owner from
100100 prohibiting the consumption of medical marijuana or medi cal
101101 marijuana product by smoke or vaporization on the premises, within
102102 the structures of the premises or within ten (10) feet of the
103103 entryway to the premises . However, a medical marijuana patient
104104 shall not be denied the right to consume or use other medic al
105105 marijuana products which are otherwise legal and do not involve the
106106 smoking or vaporization of cannabis when lawfully recommended
107107 pursuant to Section 420 of Title 63 of the Oklahoma Statutes this
108108 title.
109109 D. A medical marijuana patient or caregiver licen see shall not
110110 be denied eligibility in public assistance programs includin g, but
111111 not limited to, Medicaid, Supplemental Nutrition Assistance Program
112112 (SNAP), Women, Infants, and Children Nutrition Program (WIC),
113113 Temporary Assistance for Needy Families (TANF ) or other such public

140140 assistance programs based solely on his or her stat us as a medical
141141 marijuana patient or caregiver licensee, unless required by federal
142142 law.
143143 E. A medical marijuana patient or caregiver licensee shall not
144144 be denied the right to own, p urchase or possess a firearm,
145145 ammunition, or firearm accessories based sol ely on his or her status
146146 as a medical marijuana patient or caregiver licensee. No state or
147147 local agency, municipal or county governing authority shall
148148 restrict, revoke, suspend or o therwise infringe upon the right of a
149149 person to own, purchase or possess a firearm, ammunition, or firearm
150150 accessories or any related firearms license or certification based
151151 solely on their status as a medical marijuana patient or caregiver
152152 licensee.
153153 F. A medical marijuana patient or caregiver in actual
154154 possession of a medical marijuana license shall not be subject to
155155 arrest, prosecution or penalty in any manner or deni ed any right,
156156 privilege or public assistance, under state law or municipal or
157157 county ordinance or resolution including without limitation a civil
158158 penalty or disciplinary action by a business, occupational or
159159 professional licensing board or bureau, for the medical use of
160160 marijuana in accordance with this act the Oklahoma Medical Marijuana
161161 and Patient Protection Act .

188188 G. A government medical assistance program shall not be
189189 required to reimburse a person for costs associated with the medical
190190 use of marijuana unless federal law requires reimbursement.
191191 H. Unless otherwise required by federal law o r required to
192192 obtain federal funding:
193193 1. No employer may refuse to hire, discipline, discharge or
194194 otherwise penalize an applicant or employee solely on the basis of
195195 such applicant's or employee's status as a medical marijuana
196196 licensee; and
197197 2. No employer may refuse to hire, discipline, discharge or
198198 otherwise penalize an applic ant or employee solely on the basis of a
199199 positive test for marijuana components or metabolites, unless:
200200 a. the applicant or employee is not in possessio n of a
201201 valid medical marijuana license,
202202 b. the licensee possesses, consumes or is under the
203203 influence of medical marijuana or medical marijuana
204204 product while at the place of employment or during the
205205 fulfillment of employment obligations, or
206206 c. the position is one involving safety -sensitive job
207207 duties, as such term is defined in subsection K of
208208 this section.
209209 I. Nothing in this act the Oklahoma Medical Marijuana and
210210 Patient Protection Act or Section Sections 420 et seq. of Title 63
211211 of the Oklahoma Statutes through 426.1 of this title shall:

238238 1. Require an employer to permit or accommodate the use of
239239 medical marijuana on the property or premises of any place of
240240 employment or during hours of employment;
241241 2. Require an employer, a government medical assistance
242242 program, private health insurer , worker's compensation carrier or
243243 self-insured employer providin g worker's compensation benefits to
244244 reimburse a person for costs associated with the use of medical
245245 marijuana; or
246246 3. Prevent an employer from having written policies regarding
247247 drug testing and impairment in accordance with the Oklahoma
248248 Standards for Workplace Drug and Alcohol Testing Act, Section 551 et
249249 seq. of Title 40 of the Oklahoma Statutes .
250250 J. Any applicant or employee aggrieved by a willful violation
251251 of this section shall have, as his or her exclusive remedy, the same
252252 remedies as provided for in the Oklahoma Standards for Workplace
253253 Drug and Alcohol Testing Act set forth in Section 563 of Title 40 of
254254 the Oklahoma Statutes.
255255 K. As used in this section:
256256 1. "Safety-sensitive" means any job that includes tasks or
257257 duties that the employer reasonably belie ves could affect the safety
258258 and health of the employee performing the task or others including,
259259 but not limited to, any of the following:
260260 a. the handling, packaging, processing, storage, disp osal
261261 or transport of hazardous materials,

288288 b. the operation of a m otor vehicle, other vehicle,
289289 equipment, machinery or power tools,
290290 c. repairing, maintaining or monitoring the performance
291291 or operation of any equipment, machinery or
292292 manufacturing process, th e malfunction or disruption
293293 of which could result in injury or pr operty damage,
294294 d. performing firefighting duties,
295295 e. the operation, maintenance or oversight of critical
296296 services and infrastructure including, but not limited
297297 to, electric, gas, and water ut ilities, power
298298 generation or distribution,
299299 f.
300300 e. the extraction, compression, processing,
301301 manufacturing, handling, packaging, storage, disposal,
302302 treatment or transport of potentially volatile,
303303 flammable, combustible materials, elements, chemicals
304304 or any other highly regulated component,
305305 g.
306306 f. dispensing pharmaceuticals,
307307 h.
308308 g. carrying a firearm, or
309309 i.
310310 h. direct patient care or direct child care; and

337337 2. A "positive test for marijuana components or metabolites "
338338 means a result that is at or above the cutoff c oncentration level
339339 established by the United States Department of Transpor tation or
340340 Oklahoma law regarding being under the influence, whichever is
341341 lower.
342342 L. All smokable, vaporized, vapable and e -cigarette medical
343343 marijuana product inhaled through vaporiz ation or smoked by a
344344 medical marijuana licensee are subject to the same re strictions for
345345 tobacco under Section 1-1521 through 1-1527 of Title 63 of the
346346 Oklahoma Statutes this title, commonly referred to as the "Smoking
347347 in Public Places and Indoor Workplace s Act".
348348 SECTION 2. This act shall become effective November 1, 2023.
