57185 the classroom. In the past, calling the Oklahoma Department of
58186 Human Services statewide centralized hotline to make a mandated
59187 child welfare report was one of the only tools in the first
60188 responder's toolbox, but most children and teens do not meet the
61189 criteria for a child welfare report. Consequently, the children and
62190 teens are never identified , nor do they receive services, and they
63191 linger in traumatic situations without adequate support. These
64192 students have an increased risk for negative outcomes such as poor
65193 academic performance, truancy, dropping out of school, and
66194 delinquency.

68195 B. The Handle With Care Oklahoma Program Purpose.
69-
70196 Handle With Care (HWC) Oklahoma is a program designed to enh ance
71197 existing cross-agency communication and partnership between local
72198 law enforcement, community mental health serv ices and supports, and
73199 schools regarding children's exposure to traumatic events. The
74200 "Handle With Care" approach enables first responders to st art
75201 building trust and positive co nnections with children and teens they
76202 encounter at a traumatic scene and through a HWC notification, local
77203 schools and mental h ealth providers can provide trauma-sensitive
78204 support immediately as needed. HWC is aimed at ensuring that
79205 children who are exposed to crime, violence, and abuse receive
80206 appropriate interventions so they can succe ed in school to the best
81207 of their ability. Children must feel safe in order to learn.

83234 SECTION 2. NEW LAW A new s ection of law to be codified
84235 in the Oklahoma Statutes as Section 1210.164 of Title 70, unless
85236 there is created a duplicati on in numbering, reads as follows:

87237 A. The Legislature shall appropriate funds to support the
88238 implementation and operation of the Handle With Care (HWC) Oklahoma
89239 program, coordinated through the Oklahoma School Security Institute,
90240 a division of the Oklahoma Office of Homeland Security. HWC

92242 collaborations with key partners such as, but not limited to, other
93243 state and local first responder agencies, school districts,
94244 community coalitions, the State Department of Education, the

97247 The statewide HWC Oklahoma program shall enhance planning, training,
98248 implementation, and sustainability in all counti es in the state.
99249 The program shall give opportunities for local HWC initiatives to
100250 receive support from the stat e as needed.

102251 B. The HWC program shall enable a law enforcement officer or
103252 employee of a law enforcement agency to notify the program when a
104253 child, who may attend a public school or childcare agency in the
105254 state, is exposed to a traumatic event, is at the scene with a first
106255 responder, or another event occurs that may affect his or her
107256 ability to succeed at school including, but not limited to:

111284 2. Death of a member of the family or hou sehold of the child;

120289 6. Violence or mass shootings in the neighborhood where the

129294 10. Child is present at a first responder encounter.

131295 C. The HWC program shall work with local communities and key
132296 partners to administer a telephone hotline, email, or other
133297 appropriate method to allow a law enforcement officer or first
134298 responder agency to provide the notification described in subsection
135299 B of this section.

137300 D. Information submitted to the HWC program in the notification
138301 shall comply with the Oklahoma State Bureau of Investigation's
139302 dissemination laws and Victim's Bill of Rights. It shall only
140303 include, to the extent that it is available :

142304 1. The first, middle, and last name of the child;

144305 2. The grade and school or childcare agency where the child is
145306 enrolled; and

149334 The HWC notification shall not include any details about the
150335 traumatic event unless there is an imminent threat to the safety of
151336 the child or school safety.

153337 E. Upon receiving notificat ion as provided in subsection D of
154338 this section, the local HWC multi-disciplinary team (MDT) shall
155339 determine if the child attends a public school or childcare agency
156340 in this state. If the child attends a public school or childcare
157341 agency in the state, the local HWC MDT shall notify designated
158342 representatives where the child attends. The notice shall include
159343 that "the child referenced has been exposed to a traumat ic event in
160344 the last twenty-four (24) hours and could exhibit academ ic,
161345 emotional, and behavioral problems because of exposure to a
162346 traumatic event. Please handle the child with care."

164347 F. 1. The Oklahoma School Security Institute, in coordination
165348 with community coalitions and partner state and local first
166349 responder agencies, shall provide model protocol and training for
167350 the HWC Oklahoma program to first responder agencies and their
168351 employees who may respond to a trau matic event involving a child.

170352 2. The Department of Mental Health and Substance Abuse
171353 Services, in coordination with the State Depa rtment of Education and
172354 community coalitions, shall include model protocol and training for
173-the HWC Oklahoma program in existing efforts which promote universal
174-trauma-informed practices in school settings.

176383 G. The training required in subsection F of this section shall
177384 include, at a minimum:

179385 1. The criteria for sending a HWC notice;

181386 2. The procedure for notifying the HWC program when a child who
182387 may attend a public school or childcare agency is exposed to an
183388 event listed in subsection B of this section that may affect his or
184389 her ability to succeed at school and the information to include in
185390 the notification;

187391 3. Proper response to a notification received from th e program,
188392 including, without limitation, the manner in which to res pond to
189393 notification through early interventions; and
190-
191394 4. Collaboration with teachers and other members of the s taff
192395 of a school, students, family members of students, multi-
193396 disciplinary teams, other persons, and behavioral, social, and
194397 health providers, as appropriate, to reduce t he negative impact of
195398 the traumatic event on the affected student, appropriate
196399 interventions that may be available to assist the student, and the
197400 overall well-being of the student. Community coalitions shall be
198401 engaged to increase coordination of communit y services.

200402 H. The Oklahoma School Security Institute may promulgate rules
201403 to implement the provisions of this section with feedback from local
202404 first responder agencies, schools, and community coalitions.

204405 I. Nothing in this sect ion shall be construed to require a law

206433 provide notification pursuant to this section if the disclosure of
207434 information may compromise an ongoing investigation.

209435 J. In addition to funds appro priated by the legislat ure
210436 pursuant to subsection A of this sectio n, the HWC Oklahoma program
211437 shall apply for additional federal, state, local, and private funds
212438 to support the HWC Oklahoma program.

214439 K. The HWC Oklahoma prog ram shall submit an annual report of
215440 the program's progress, outcomes, and impact on students and
216441 communities to the Speaker of the Oklahoma House of Representatives,
217442 President Pro Tempore of the Oklahoma State Se nate, and the
218443 Governor.

220444 SECTION 3. This act shall become effe ctive November 1, 2023.
