6767 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6868 SECTION 1. NEW LAW A new section of law to be codified
6969 in the Oklahoma Statutes as Section 3001 of Title 18, unless there

9696 This act shall be known and may be cited as the "Oklahoma Social
9797 Media Transparency Act of 202 3".
9898 SECTION 2. NEW LAW A new section of law to be codified
9999 in the Oklahoma Statutes as Section 3002 of Title 18, unless there
100100 is created a duplication in numbering, reads as follows:
101101 As used in this act, the term:
102102 1. "Algorithm" means a mathematical set of rules that specifies
103103 how a group of data behaves and that will assist in ranking search
104104 results and maintaining order or that is us ed in sorting or ranking
105105 content or material based on relevancy or other fact ors instead of
106106 using published time or chronological order of such content or
107107 material;
108108 2. "Censor" includes any action taken by a social media platform
109109 to delete, regulate, restr ict, edit, alter, inhibit the publication
110110 or republication of, suspend a righ t to post, remove, or post an
111111 addendum to any content or material posted by a user. The term also
112112 includes actions to inhibit the ability of a user to be viewable by
113113 or to interact with another user of the social media platform ;
114114 3. "Deplatform" means the action or practice by a social me dia
115115 platform to permanently delete or ban a user or to temporarily
116116 delete or ban a user from the social media platform for more than
117117 fourteen (14) days;
118118 4. "Journalistic enterprise" means an entity doing business in
119119 Oklahoma that:

145145 a. publishes in excess of one hundred thousand ( 100,000)
146146 words available online with at least fifty thousand
147147 paid subscribers or one hundred thousand monthly
148148 active users,
149149 b. publishes one hundred (100) hours of audio or video
150150 available online with at least one hundred million
151151 viewers annually,
152152 c. operates a cable chann el that provides more than forty
153153 (40) hours of content per week to more t han one
154154 hundred thousand cable television subscribers, or
155155 d. operates under a broadcast license issued by the
156156 Federal Communications Commission;
157157 5. "Post-prioritization" means action by a social media
158158 platform to place, feature, or prio ritize certain content or
159159 material ahead of, below , or in a more or less prominent position
160160 than others in a newsfeed, a feed, a view, or in search results.
161161 The term does not include post-prioritization of content and
162162 material of a third party including other users, based on payments
163163 by that third party, to the social media platform ;
164164 6. "Shadow ban" means action by a social media platform ;
165165 through any means, whether the action is determined by a natural
166166 person or an algorit hm, to limit or eliminate the exp osure of a user
167167 or content or material posted by a user to other users of the social

193193 media platform. This term includes acts of shadow banning by a
194194 social media platform which are not readily apparent to a user ;
195195 7. "Social media platform" means any information service,
196196 system, Internet search engine, o r access software provider that:
197197 a. provides or enables computer access by multiple users
198198 to a computer server, including an Internet platform
199199 or a social media site ,
200200 b. operates as a sole proprietorship, par tnership,
201201 limited liability company, corporation , association,
202202 or other legal entity ,
203203 c. does business in the state , and
204204 d. satisfies at least on e of the following thresholds:
205205 (1) has annual gross revenues in excess of One
206206 Hundred Million Dollars ($100,000,000.00), as
207207 adjusted in January of each odd-numbered year to
208208 reflect any increase in the Consumer Price Index ,
209209 and
210210 (2) has at least one hundred million monthly
211211 individual platform participa nts globally,
212212 8. "User" means a person who resides or is domiciled in this
213213 state and who has an account on a social media platform, regardless
214214 of whether the person posts or has posted content or material to the
215215 social media platform.

241241 SECTION 3. NEW LAW A new section of law to be cod ified
242242 in the Oklahoma Statutes as Section 3003 of Title 18, unless there
243243 is created a duplication in numbering, reads as follows:
244244 A social media platform that fails to comply with any of the
245245 provisions of this section commits an unfair or deceptive act or
246246 practice:
247247 A. A social media platform must publish the stan dards,
248248 including detailed definitions, it uses or has used for determining
249249 which users to censor, deplatform, and shadow ban.
250250 B. A social media platform must apply censorship,
251251 deplatforming, and shadow banning standards in a consistent manner
252252 among its users on the platform.
253253 C. A social media platform must inform each user about any
254254 changes to its user rules, terms, and agreements be fore implementing
255255 the changes and may not make changes mo re than once every thirty
256256 (30) days.
257257 D. A social media platform ma y not censor or shadow ban a
258258 user's content or material or deplatform a user from the social
259259 media platform:
260260 1. Without notifying the user wh o posted or attempted to post
261261 the content or material; or
262262 2. In a way that violates this act.
263263 E. A social media platform must:

289289 1. Provide a mechanism that allows a user to request the number
290290 of other individual platform participants who were provided or shown
291291 the user's content or posts; and
292292 2. Provide, upon request, a user with the number of other
293293 individual platform participants who were provided or shown content
294294 or posts.
295295 F. A social media platform must:
296296 1. Categorize algorithms used for post -prioritization and
297297 shadow banning; and
298298 2. Allow a user to opt out of post-prioritization and shadow
299299 banning algorithm categories to allow sequential or chronological
300300 posts and content.
301301 G. A social media platform must provide users with an annual
302302 notice on the use of al gorithms for post-prioritization and shadow
303303 banning and reoffer annually the opt -out opportunity in paragraph 2
304304 of subsection F of this section.
305305 H. A social media platform may not apply or use post -
306306 prioritization or shadow banning algorithms for content and material
307307 posted by or about a user who is known by the social media platform
308308 to be a candidate, as defined as an individual running for public
309309 office beginning on the date of qualification and ending on the date
310310 of the election or the date the candidate ceases to b e a candidate.
311311 Post-prioritization of certain content or material from or about a
312312 candidate for office based on payments to the social media platform

338338 by such candidate for office or a third party is not a violation of
339339 this subsection. A social media platfo rm must provide each user a
340340 method by which the user may be identified as a qualified candi date
341341 and which provides sufficient information to allow the social media
342342 platform to confirm the user 's qualification by reviewing the
343343 website of the Oklahoma State Election Board or the website of the
344344 local supervisor of elections.
345345 I. A social media platform must allow a user who has been
346346 deplatformed to access or retrieve all of the user 's information,
347347 content, material, and data for at least sixty (60) days after the
348348 user receives the notice required under paragraph 1 of subsection D
349349 of this section.
350350 J. A social media platform may not take any action to censor,
351351 deplatform, or shadow ban a journalistic enterprise based on the
352352 content of its publication or broadcast. Post-prioritization of
353353 certain journalistic enterprise content based on payment s to the
354354 social media platform by such journalistic e nterprise is not a
355355 violation of this subsection. This subsection does not apply if the
356356 content or material is obscene as defin ed in paragraph 1 of
357357 subsection B of Section 1024 of Title 21 of the Oklahoma Statute s.
358358 SECTION 4. NEW LAW A new section of law to be codified
359359 in the Oklahoma Statutes as Section 3004 of Title 18, unless there
360360 is created a duplication in numbering, reads as follows:

386386 For purposes of paragraph 1 of subsection D of Section 3 of this
387387 act, a notification must:
388388 1. Be in writing;
389389 2. Be delivered via electronic mail or direct electron ic
390390 notification to the user within 7 days after the censoring action ;
391391 3. Include a thorough rationale explaining the reason that the
392392 social media platform censored the user; and
393393 4. Include a precise and thorough explanation of how the social
394394 media platform became aware of the censored content or material,
395395 including a thorough explanat ion of the algorithms used, if any, to
396396 identify or flag the user's content or material as objectionable.
397397 SECTION 5. NEW LAW A new section of law to be codif ied
398398 in the Oklahoma Statutes as Section 3005 of Title 18, unless there
399399 is created a duplication in numbering, reads as follows:
400400 Notwithstanding any other provisions of this Act, a social media
401401 platform is not require d to notify a user if the censored content or
402402 material is obscene as defined in paragraph 1 of subsection B of
403403 Section 1029.1 of Title 21 of the Okl ahoma Statutes.
404404 SECTION 6. NEW LAW A new section of l aw to be codified
405405 in the Oklahoma Statutes as Section 3006 of Title 18, unless there
406406 is created a duplication in numbering, reads as follows:
407407 If the Oklahoma Attorney General 's Office, by its own inquiry or
408408 as a result of a complain t, suspects that a viola tion of this act is
409409 imminent, occurring, or has occurred, the department may invest igate

435435 the suspected violation in accordance with this section. Based on
436436 its investigation, the department may bring a civi l or
437437 administrative action under this section.
438438 SECTION 7. NEW LAW A new section of law to be codified
439439 in the Oklahoma Statutes as Section 3007 of Title 18, unless there
440440 is created a duplication in numbering, reads as follows:
441441 A user may only bring a private cause of action for violat ions
442442 of subsection B of Section 3 of this act or paragraph 1 of
443443 subsection D of Section 3 of this act. In a private cause of action
444444 brought under subsection B of Section 3 of this act or paragraph 1
445445 of subsection D of Section 3 of this act, the court may award the
446446 following remedies to the user:
447447 1. Up to $100,000 in statutory damages per proven claim ;
448448 2. Actual damages;
449449 3. If aggravating factors are present, punitive damages ;
450450 4. Other forms of equitabl e relief, including injunctive
451451 relief; or
452452 5. If the user was deplatformed in violation of subsection B of
453453 Section 3 of this act, costs and reasonable attorney fees.
454454 SECTION 8. NEW LAW A new section of law to be codified
455455 in the Oklahoma Statutes as Section 3008 of Title 18, unless there
456456 is created a duplication in num bering, reads as follows:
457457 For purposes of bringing an action in accordance with this Act,
458458 each failure to comply with the individual provisions of Section 3

484484 of this act shall be treated as a separate violation, act, or
485485 practice. For purposes of bringing an action in accordance with this
486486 Act, a social media platform that censors, shadow bans, deplatforms,
487487 or applies post-prioritization algorithms to candidates and users in
488488 the state is conclusively presumed to be both engaged in substa ntial
489489 and not isolated activities within the state and operating,
490490 conducting, engaging in, or carrying on a business, and doing
491491 business in this state, and is therefore subject to the jurisdic tion
492492 of the courts of the state.
493493 SECTION 9. NEW LAW A new section of law to be codifi ed
494494 in the Oklahoma Statu tes as Section 3009 of Title 18, unless there
495495 is created a duplication in nu mbering, reads as follows:
496496 In an investigation by the Oklahoma Attorney General into
497497 alleged violations of this se ction, the Oklahoma Attorney General 's
498498 investigative powers includ e, but are not limited to, the ability to
499499 subpoena any algorithm used by a s ocial media platform related to
500500 any alleged violation.
501501 SECTION 10. NEW LAW A n ew section of law to be codified
502502 in the Oklahoma Statut es as Section 3010 of Title 18, unless there
503503 is created a duplication in numbering, reads as follows :
504504 This section may only be enforced to the exte nt not inconsistent
505505 with federal law and 47 U.S.C. Section 230(e)(3), notwithstanding
506506 any other provision of state law.

535535 If any provision of this act or the ap plication thereof to any
536536 person or circumstance is held invalid, the invalidity shall not
537537 affect other provisions or applicati ons of the act which can be
538538 given effect without the invalid provision or application, a nd to
539539 this end the provisions of this act are declared severable.
540540 SECTION 12. This act shall become effective November 1, 2023.
