52	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	60		SECTION 1. AMENDATORY 70 O.S. 2021, Section 6-204.2, is
54	61		amended to read as follows:
55	62		Section 6-204.2 A. The Oklahoma Commission for Teacher
56	63		Preparation Educational Quality and Accoun tability and the State
57	64		Board of Education are authori zed to establish the Educati on
58	65		Leadership Oklahoma program.
59		-	B. The purposes of the Education Leadership O klahoma program

	93	+	B. The purposes of the Education Leadership O klahoma program
	94	+	are to:
87	95		1. Provide teachers through out the state information about
88	96		National Board certification an d the Education Leadership Oklahoma
89	97		program services;
90	98		2. Provide technical assistance and National-Board-certified
91	99		mentors to all teachers s eeking National Board certification upon
92	100		request;
93	101		3. Reward teachers who are seeking National Board certification
94	102		by awarding them a portion of the a pplication processing charge and
95	103		assessment fee and a scholarship as provided in subsection D of this
96	104		section;
97	105		4. Reward teachers who are renewing their Nat ional Board
98	106		certification by awarding them a portion of the renewal application
99		-	fee as provided in subsection E of this ~~section~~; and
	107	+	fee as provided in subsection E of this subsect ion; and
100	108		4. 5. Provide recognition to National -Board-certified teachers.
101	109		C. To fulfill the objectives of the Education Leadersh ip
102	110		Oklahoma Act, the Oklahoma Commission for Teacher Preparation
103	111		Educational Quality and Accoun tability shall:
104	112		1. Inform teachers of the Education Leadership Oklahoma pro gram
105	113		and services it provides to teachers seeking National Board
106	114		certification, empha sizing recruiting efforts toward teachers at
107	115		high-poverty schools, schools identified as in need of improvement
108		-	and in counties with the lowest percentage of teachers who have
109		-	achieved National Board certification; and

	144	+	achieved National Board certification; and
136	145		2. Ensure that all teachers seeking National Board
137	146		certification receive adequate inform ation regarding the level of
138	147		commitment required to acquire National Board certification.
139	148		D. The Commission shall sele ct not more than one hundred (100)
140	149		applicants to participate in the program each fisc al year for whom
141	150		the Commission shall pay one-half (1/2) of the application
142	151		processing charge and assessment fee for National B oard
143	152		certification. The total amount paid by the Commission shall not
144	153		exceed One Thousand Three Hundred Dollars ($1,300.00) per applicant.
145	154		In addition the Commission shall a lso provide to the selected
146	155		applicants a scholarship in the amount of Five Hundre d Dollars
147	156		($500.00) to cover other expenses associated with obta ining National
148	157		Board certification.
149	158		E. The OEQA shall select not more than three hundred (300)
150	159		applicants to participate in the renewal program each fiscal year
151	160		for whom the OEQA shall pay a portion of the fee for National Board
152	161		certification renewal . The total amount paid by the OEQA shall not
153	162		exceed Seven Hundred Fi fty Dollars ($750.00) per applicant.
154	163		E. F. The Commission shall promulgate rules establishing a
155	164		process for accepting applications for the Education Leadership
156	165		Oklahoma program and for providing to applicants selected for the
157	166		program up-front payment of the application processing charge and
158		-	assessment fee and scholar ship. If a selected applicant who
159		-	receives the up-front payment does not complete National Board

	194	+	assessment fee and scholar ship. If a selected applicant who
	195	+	receives the up-front payment does not complete National Board
186	196		certification within three (3) year s, the applicant shall repay the
187	197		Commission the full amount paid by the Commission pursuant to
188	198		subsection D of this section . All selected applicants who do not
189	199		receive an up-front payment and successfully complete National Board
190	200		certification shall be rei mbursed by the Commission for the
191	201		application processing cha rge and assessment fee. The total amount
192	202		of reimbursement paid by the Commission shall not exceed One
193	203		Thousand Three Hundred Dollars ($1,300.00) per applicant.
194	204		F. G. It is the intent of the Legislature that the Oklahoma
195	205		Commission for Teacher Preparation Educational Quality and
196	206		Accountability contract with Southe astern Oklahoma State University
197	207		to establish Education Leadership Oklahoma program training in
198	208		higher education teacher preparation programs in the state to assist
199	209		teachers in meeting the require ments to obtain National Board
200	210		certification.
201	211		G. H. All teachers seeking National Board certification shall
202	212		be eligible to participate in Education Leadership Oklahoma program
203	213		training to assist them in meeting the requirements of the National
204	214		Board certification process, free of charge.
205	215		H. I. Subject to district bo ard of education policy or
206	216		collective bargaining agreement, addi tional professional leave days
207	217		may be granted to teachers seeking National Board certification for
208		-	National Board certification p ortfolio development. During the two
209		-	(2) days of the additiona l professional days granted to teachers for

	245	+	National Board certification p ortfolio development. During the two
	246	+	(2) days of the additiona l professional days granted to teachers for
236	247		National Board certi fication portfolio development, a substitute
237	248		teacher shall be provided by the school district at no cost to the
238	249		teacher.
239	250		I. J. 1. The State Board of Education shall provide to
240	251		teachers who attained National Board certification prior to June 30,
241	252		2013, a bonus in the amount of Five Thousand Dollar s ($5,000.00)
242	253		annually over a ten-year period, to be paid no later than January 31
243	254		each year. The Beginning July 1, 2023, the Board shall provide a
244	255		bonus in the amount of Five Thousand Dollars ($5,000.00) annually
245	256		over a five-year period, to be paid not later than January 31 each
246	257		year to any teacher who:
247	258		a. attains National Board certificat ion after June 30,
248	259		2013, if the teacher was selected for the Ed ucation
249	260		Leadership Oklahoma program before June 30, 2013, or
250	261		the teacher has submitted an application for National
251	262		Board certification to the National Board for
252	263		Professional Teaching Standards before June 30, 2013
253	264		July 1, 2023, or
254	265		b. attained National Board certification before July 1,
255	266		2023, and was receiving an additional salary increment
256	267		pursuant to the Minimum Salary Schedule in Section 18-
257		-	114.14 of this title, for the remaining time of the
258		-	ten-year period.

	296	+	ten-year period.
285	297		2. The teachers eligible to receive the annual bonus as
286	298		provided for in paragraph 1 of this subsection shall r eceive the
287	299		annual bonus for the ten-year five-year duration of their Nati onal
288	300		Board certification or for the remaining duration of their National
289	301		Board certification if they attained National Board certification
290	302		before July 1, 2023, and have less than ten (10) years remaining in
291	303		their certification and so long as they are teaching in the
292	304		classroom full-time in an Oklahoma public sch ool. No school or
293	305		school district shall be liable for payment of bonuses pursuant to
294	306		this section.
295	307		3. The bonus shall not be included in the calculation of the
296	308		teacher's salary for purposes of meeting the district or statutory
297	309		minimum salary schedule Minimum Salary Schedule , including instances
298	310		where the salary sch edule of the district exceeds the statutory
299	311		Minimum Salary Schedu le, or for purposes of compensating Oklahoma
300	312		Teachers' Retirement System contributions or benefits.
301	313		4. Teachers eligible to receive the annual bonus as provided
302	314		for in paragraph 1 of this subsection shall not be eligible to
303	315		receive the additional salary i ncrement for National Board
304	316		certification as set forth in the minimum salary schedule in Section
305	317		3 of this act.
306		-	5. Teachers who attain National Board certification after June
307		-	30, 2013, shall be eligible to receive the additional salary

	345	+	5. Teachers who attain National Board certification after June
	346	+	30, 2013, shall be eligible to receive the additional salary
334	347		increments for National Board certification as set forth in the
335	348		minimum salary schedule in Section 3 of this act.
336	349		6. The State Board of Edu cation shall promulgate rules for a
337	350		process by which a Nationa l-Board-certified teacher will verify
338	351		that:
339	352		a. the National Board certifi cation has not lapsed,
340	353		b. the teacher is still a full -time teacher, and
341	354		c. for teachers eligible for the bonus, the teach er has
342	355		not exceeded the limit of annual bonus payments as
343	356		provided for in paragraph 1 of this subsection.
344	357		J. K. It is the intent of th e Legislature that the Oklahoma
345	358		State Regents for Higher Education incorporate the National Board
346	359		certification portfolio de velopment into all programs i n education
347	360		leading to a master's level degree.
348	361		SECTION 2. AMENDATORY 70 O.S. 2021, Section 6-204.3, is
349	362		amended to read as follows:
350	363		Section 6-204.3 There is hereby created in the State Treasury a
351	364		revolving fund for the Oklahoma Commission for Teacher Preparation
352	365		Educational Quality and Accountability to be designated the
353	366		"Education Leadership Oklahoma Revolving Fund". The fund s hall be a
354	367		continuing fund, not s ubject to fiscal year limitations, and shall
355	368		consist of all monies appropriated or transferred to the fund by the
356		-	Legislature. All monies accruing to the credit of the fund are
357		-	hereby appropriated and may be budgeted and ex pended by the Oklahoma

	397	+	hereby appropriated and may be budgeted and ex pended by the Oklahoma
384	398		Commission for Teacher Preparation to provide assistance and
385	399		scholarships for candidates seeking National Board certifi cation and
386	400		renewal and to provide annual bonuses to qualified te achers pursuant
387	401		to the requirements of Section 6 -204.2 of this title. Expenditures
388	402		from the fund shall be made upon warrants iss ued by the State
389	403		Treasurer against claims filed as prescribed by law with the
390	404		Director of the Office of Management and Enterpri se Services for
391		-	approval and payment.

392	406		SECTION 3. AMENDATORY 70 O.S. 2021, Section 18 -114.14,
393	407		is amended to read as follows:
394	408		Section 18-114.14 A. Beginning with the 2018-2019 2023-2024
395	409		school year, certified personnel, a s defined in Section 26-103 of
396	410		this title, in the p ublic schools of Oklahoma shall r eceive in
397	411		salary and/or fringe benefits not less than t he amounts specified in
398	412		the following schedule:

536	553		B. 1. When determining the Mi nimum Salary Schedule, "fringe
537	554		benefits" shall mean all or part of retirement benefits, excluding
538	555		the contributions made pursuant to subsection A of Se ction 17-108.1
539	556		of this title and the flexible benefit allowance pursuant to Section
540	557		26-105 of this title from the flexible benefit allowan ce funds
541	558		disbursed by the State Board of Education and the State Board of
542	559		Career and Technology Education pursuant to Section 26-104 of this
543	560		title.
544	561		2. If a school district intends to provide retirement benefits
545	562		to a teacher such that the teacher 's salary would be less than the
546	563		amounts set forth in the minimum salary schedule Minimum Salary
547	564		Schedule specified in subsectio n A of this section, the district
548	565		shall be required to provide written notification to the teacher
549	566		prior to his or her employment or, if a lready employed by the
550	567		district, no later than thirty ( 30) days prior to the date the
551	568		district elects to provide retir ement benefits such that the
552	569		teacher's salary would be less than the minimum salary schedule
553	570		Minimum Salary Schedule.
554	571		C. Any of the degre es referred to in this section shall be from
555	572		a college recognized by the State Board of Education. The Bo ard
556		-	shall accept teaching experience from out-of-state school districts
557		-	that are accredited by the state board of edu cation or appropriate

	600	+	shall accept teaching experience from out-of-state school districts
	601	+	that are accredited by the state board of edu cation or appropriate
584	602		state accrediting agency for the districts. The Board shall accep t
585	603		teaching experience from out -of-country schools that are accredited
586	604		or otherwise endorsed by the appropriate nation al or regional
587	605		accrediting or endorsement authority . Out-of-country certification
588	606		documentation in a language other than English shall be analyzed by
589	607		an educational credential evaluation se rvice in accordance with
590	608		industry standards and guidelines and app roved by the State
591	609		Department of Education. The pe rson seeking to have credit grant ed
592	610		for out-of-country teaching experience shall be resp onsible for all
593	611		costs of the analysis by a credenti al evaluation service. The Board
594	612		shall accept teaching experience from primary and secondary schools
595	613		that are operated by the United States Departmen t of Defense or are
596	614		affiliated with the United States D epartment of State.
597	615		D. For the purpose of state sa lary increments and retirement,
598	616		no teacher shall be granted credit for more than five (5) years of
599	617		active duty in the military service or out -of-state or out-of-
600	618		country teaching experience as a certified t eacher or its
601	619		equivalent. Nothing in this section shall prohibit boards of
602	620		education from crediting more years of ex perience on district salary
603	621		schedules than those al lowed for state purposes.
604		-	E. The State Board of Education shall recognize, for purposes
605		-	of certification and salary increments, all the ye ars of experience

	649	+	E. The State Board of Education shall recognize, for purposes
	650	+	of certification and salary increments, all the ye ars of experience
	651	+	of a:
633	652		1. Certified teacher who teaches in the e ducational program of
634	653		the Department of Corrections , beginning with fiscal year 1981 ;
635	654		2. Vocational rehabilitation counselor under the Dep artment of
636	655		Human Services if the counselor was empl oyed as a certified teacher
637	656		by the State Department of Education w hen the Division of Vocational
638	657		Rehabilitation was t ransferred from the State Board o f Career and
639	658		Technology Education or the State Board of Education to the Oklahoma
640	659		Public Welfare Commissio n on July 1, 1968;
641	660		3. Vocational rehabilitation counselor which w ere completed
642	661		while employed by the Department of Human Services if such counselor
643	662		was certified as a teacher or was eligible for certifica tion as a
644	663		teacher in Oklahoma;
645	664		4. Certified teache r which were completed while employe d by the
646	665		Child Study Center lo cated at University Hospital, if the teacher
647	666		was certified as a teacher in Oklahoma; and

681	701		F. The provisions of this section shall not app ly to teachers
682	702		who have entered into postretirement employment with a public school
683	703		in Oklahoma and are still receiving a monthly retiremen t benefit.
684	704		G. If a person employed as certified personnel, as def ined in
685	705		Section 26-103 of this title, by a school d istrict during the 2017 -
686	706		2018 school year was receiving a salary above the step level
687	707		indicated by the State state Minimum Salary Schedule for the 2017-
688	708		2018 school year, the pe rson shall receive a salary in crease amount
689	709		equal to the amount indicated in subs ection A of this section for
690	710		the step level indicated for the person, provided they rema in
691	711		employed by the same district, unless the hours or the dutie s of the
692	712		certified personnel are reduced proportionate ly.
693	713		SECTION 4. This act shall become effective July 1, 2023.
694	714		SECTION 5. It being immediately necessary fo r the preservation
695	715		of the public peace, health or safety, an emergency is hereby
696	716		declared to exist, by reason whereof this act shall take effect and
697	717		be in full force from and after its passage and approval.
