5259 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5360 SECTION 1. AMENDATORY 70 O.S. 2021, Section 6-204.2, is
5461 amended to read as follows:
5562 Section 6-204.2 A. The Oklahoma Commission for Teacher
5663 Preparation Educational Quality and Accoun tability and the State
5764 Board of Education are authori zed to establish the Educati on
5865 Leadership Oklahoma program.

93+B. The purposes of the Education Leadership O klahoma program
94+are to:
8795 1. Provide teachers through out the state information about
8896 National Board certification an d the Education Leadership Oklahoma
8997 program services;
9098 2. Provide technical assistance and National-Board-certified
9199 mentors to all teachers s eeking National Board certification upon
92100 request;
93101 3. Reward teachers who are seeking National Board certification
94102 by awarding them a portion of the a pplication processing charge and
95103 assessment fee and a scholarship as provided in subsection D of this
96104 section;
97105 4. Reward teachers who are renewing their Nat ional Board
98106 certification by awarding them a portion of the renewal application
99-fee as provided in subsection E of this section; and
107+fee as provided in subsection E of this subsect ion; and
100108 4. 5. Provide recognition to National -Board-certified teachers.
101109 C. To fulfill the objectives of the Education Leadersh ip
102110 Oklahoma Act, the Oklahoma Commission for Teacher Preparation
103111 Educational Quality and Accoun tability shall:
104112 1. Inform teachers of the Education Leadership Oklahoma pro gram
105113 and services it provides to teachers seeking National Board
106114 certification, empha sizing recruiting efforts toward teachers at
107115 high-poverty schools, schools identified as in need of improvement
108-and in counties with the lowest percentage of teachers who have
109-achieved National Board certification; and

144+achieved National Board certification; and
136145 2. Ensure that all teachers seeking National Board
137146 certification receive adequate inform ation regarding the level of
138147 commitment required to acquire National Board certification.
139148 D. The Commission shall sele ct not more than one hundred (100)
140149 applicants to participate in the program each fisc al year for whom
141150 the Commission shall pay one-half (1/2) of the application
142151 processing charge and assessment fee for National B oard
143152 certification. The total amount paid by the Commission shall not
144153 exceed One Thousand Three Hundred Dollars ($1,300.00) per applicant.
145154 In addition the Commission shall a lso provide to the selected
146155 applicants a scholarship in the amount of Five Hundre d Dollars
147156 ($500.00) to cover other expenses associated with obta ining National
148157 Board certification.
149158 E. The OEQA shall select not more than three hundred (300)
150159 applicants to participate in the renewal program each fiscal year
151160 for whom the OEQA shall pay a portion of the fee for National Board
152161 certification renewal . The total amount paid by the OEQA shall not
153162 exceed Seven Hundred Fi fty Dollars ($750.00) per applicant.
154163 E. F. The Commission shall promulgate rules establishing a
155164 process for accepting applications for the Education Leadership
156165 Oklahoma program and for providing to applicants selected for the
157166 program up-front payment of the application processing charge and
158-assessment fee and scholar ship. If a selected applicant who
159-receives the up-front payment does not complete National Board

194+assessment fee and scholar ship. If a selected applicant who
195+receives the up-front payment does not complete National Board
186196 certification within three (3) year s, the applicant shall repay the
187197 Commission the full amount paid by the Commission pursuant to
188198 subsection D of this section . All selected applicants who do not
189199 receive an up-front payment and successfully complete National Board
190200 certification shall be rei mbursed by the Commission for the
191201 application processing cha rge and assessment fee. The total amount
192202 of reimbursement paid by the Commission shall not exceed One
193203 Thousand Three Hundred Dollars ($1,300.00) per applicant.
194204 F. G. It is the intent of the Legislature that the Oklahoma
195205 Commission for Teacher Preparation Educational Quality and
196206 Accountability contract with Southe astern Oklahoma State University
197207 to establish Education Leadership Oklahoma program training in
198208 higher education teacher preparation programs in the state to assist
199209 teachers in meeting the require ments to obtain National Board
200210 certification.
201211 G. H. All teachers seeking National Board certification shall
202212 be eligible to participate in Education Leadership Oklahoma program
203213 training to assist them in meeting the requirements of the National
204214 Board certification process, free of charge.
205215 H. I. Subject to district bo ard of education policy or
206216 collective bargaining agreement, addi tional professional leave days
207217 may be granted to teachers seeking National Board certification for
208-National Board certification p ortfolio development. During the two
209-(2) days of the additiona l professional days granted to teachers for

245+National Board certification p ortfolio development. During the two
246+(2) days of the additiona l professional days granted to teachers for
236247 National Board certi fication portfolio development, a substitute
237248 teacher shall be provided by the school district at no cost to the
238249 teacher.
239250 I. J. 1. The State Board of Education shall provide to
240251 teachers who attained National Board certification prior to June 30,
241252 2013, a bonus in the amount of Five Thousand Dollar s ($5,000.00)
242253 annually over a ten-year period, to be paid no later than January 31
243254 each year. The Beginning July 1, 2023, the Board shall provide a
244255 bonus in the amount of Five Thousand Dollars ($5,000.00) annually
245256 over a five-year period, to be paid not later than January 31 each
246257 year to any teacher who:
247258 a. attains National Board certificat ion after June 30,
248259 2013, if the teacher was selected for the Ed ucation
249260 Leadership Oklahoma program before June 30, 2013, or
250261 the teacher has submitted an application for National
251262 Board certification to the National Board for
252263 Professional Teaching Standards before June 30, 2013
253264 July 1, 2023, or
254265 b. attained National Board certification before July 1,
255266 2023, and was receiving an additional salary increment
256267 pursuant to the Minimum Salary Schedule in Section 18-
257-114.14 of this title, for the remaining time of the
258-ten-year period.

295+114.14 of this title, for the remaining time of the
296+ten-year period.
285297 2. The teachers eligible to receive the annual bonus as
286298 provided for in paragraph 1 of this subsection shall r eceive the
287299 annual bonus for the ten-year five-year duration of their Nati onal
288300 Board certification or for the remaining duration of their National
289301 Board certification if they attained National Board certification
290302 before July 1, 2023, and have less than ten (10) years remaining in
291303 their certification and so long as they are teaching in the
292304 classroom full-time in an Oklahoma public sch ool. No school or
293305 school district shall be liable for payment of bonuses pursuant to
294306 this section.
295307 3. The bonus shall not be included in the calculation of the
296308 teacher's salary for purposes of meeting the district or statutory
297309 minimum salary schedule Minimum Salary Schedule , including instances
298310 where the salary sch edule of the district exceeds the statutory
299311 Minimum Salary Schedu le, or for purposes of compensating Oklahoma
300312 Teachers' Retirement System contributions or benefits.
301313 4. Teachers eligible to receive the annual bonus as provided
302314 for in paragraph 1 of this subsection shall not be eligible to
303315 receive the additional salary i ncrement for National Board
304316 certification as set forth in the minimum salary schedule in Section
305317 3 of this act.
306-5. Teachers who attain National Board certification after June
307-30, 2013, shall be eligible to receive the additional salary

345+5. Teachers who attain National Board certification after June
346+30, 2013, shall be eligible to receive the additional salary
334347 increments for National Board certification as set forth in the
335348 minimum salary schedule in Section 3 of this act.
336349 6. The State Board of Edu cation shall promulgate rules for a
337350 process by which a Nationa l-Board-certified teacher will verify
338351 that:
339352 a. the National Board certifi cation has not lapsed,
340353 b. the teacher is still a full -time teacher, and
341354 c. for teachers eligible for the bonus, the teach er has
342355 not exceeded the limit of annual bonus payments as
343356 provided for in paragraph 1 of this subsection.
344357 J. K. It is the intent of th e Legislature that the Oklahoma
345358 State Regents for Higher Education incorporate the National Board
346359 certification portfolio de velopment into all programs i n education
347360 leading to a master's level degree.
348361 SECTION 2. AMENDATORY 70 O.S. 2021, Section 6-204.3, is
349362 amended to read as follows:
350363 Section 6-204.3 There is hereby created in the State Treasury a
351364 revolving fund for the Oklahoma Commission for Teacher Preparation
352365 Educational Quality and Accountability to be designated the
353366 "Education Leadership Oklahoma Revolving Fund". The fund s hall be a
354367 continuing fund, not s ubject to fiscal year limitations, and shall
355368 consist of all monies appropriated or transferred to the fund by the
356-Legislature. All monies accruing to the credit of the fund are
357-hereby appropriated and may be budgeted and ex pended by the Oklahoma

396+Legislature. All monies accruing to the credit of the fund are
397+hereby appropriated and may be budgeted and ex pended by the Oklahoma
384398 Commission for Teacher Preparation to provide assistance and
385399 scholarships for candidates seeking National Board certifi cation and
386400 renewal and to provide annual bonuses to qualified te achers pursuant
387401 to the requirements of Section 6 -204.2 of this title. Expenditures
388402 from the fund shall be made upon warrants iss ued by the State
389403 Treasurer against claims filed as prescribed by law with the
390404 Director of the Office of Management and Enterpri se Services for
391-approval and payment.

392406 SECTION 3. AMENDATORY 70 O.S. 2021, Section 18 -114.14,
393407 is amended to read as follows:
394408 Section 18-114.14 A. Beginning with the 2018-2019 2023-2024
395409 school year, certified personnel, a s defined in Section 26-103 of
396410 this title, in the p ublic schools of Oklahoma shall r eceive in

536553 B. 1. When determining the Mi nimum Salary Schedule, "fringe
537554 benefits" shall mean all or part of retirement benefits, excluding
538555 the contributions made pursuant to subsection A of Se ction 17-108.1
539556 of this title and the flexible benefit allowance pursuant to Section
540557 26-105 of this title from the flexible benefit allowan ce funds
541558 disbursed by the State Board of Education and the State Board of
542559 Career and Technology Education pursuant to Section 26-104 of this

544561 2. If a school district intends to provide retirement benefits
545562 to a teacher such that the teacher 's salary would be less than the
546563 amounts set forth in the minimum salary schedule Minimum Salary
547564 Schedule specified in subsectio n A of this section, the district
548565 shall be required to provide written notification to the teacher
549566 prior to his or her employment or, if a lready employed by the
550567 district, no later than thirty ( 30) days prior to the date the
551568 district elects to provide retir ement benefits such that the
552569 teacher's salary would be less than the minimum salary schedule
553570 Minimum Salary Schedule.
554571 C. Any of the degre es referred to in this section shall be from
555572 a college recognized by the State Board of Education. The Bo ard
556-shall accept teaching experience from out-of-state school districts
557-that are accredited by the state board of edu cation or appropriate

600+shall accept teaching experience from out-of-state school districts
601+that are accredited by the state board of edu cation or appropriate
584602 state accrediting agency for the districts. The Board shall accep t
585603 teaching experience from out -of-country schools that are accredited
586604 or otherwise endorsed by the appropriate nation al or regional
587605 accrediting or endorsement authority . Out-of-country certification
588606 documentation in a language other than English shall be analyzed by
589607 an educational credential evaluation se rvice in accordance with
590608 industry standards and guidelines and app roved by the State
591609 Department of Education. The pe rson seeking to have credit grant ed
592610 for out-of-country teaching experience shall be resp onsible for all
593611 costs of the analysis by a credenti al evaluation service. The Board
594612 shall accept teaching experience from primary and secondary schools
595613 that are operated by the United States Departmen t of Defense or are
596614 affiliated with the United States D epartment of State.
597615 D. For the purpose of state sa lary increments and retirement,
598616 no teacher shall be granted credit for more than five (5) years of
599617 active duty in the military service or out -of-state or out-of-
600618 country teaching experience as a certified t eacher or its
601619 equivalent. Nothing in this section shall prohibit boards of
602620 education from crediting more years of ex perience on district salary
603621 schedules than those al lowed for state purposes.
604-E. The State Board of Education shall recognize, for purposes
605-of certification and salary increments, all the ye ars of experience

649+E. The State Board of Education shall recognize, for purposes
650+of certification and salary increments, all the ye ars of experience
651+of a:
633652 1. Certified teacher who teaches in the e ducational program of
634653 the Department of Corrections , beginning with fiscal year 1981 ;
635654 2. Vocational rehabilitation counselor under the Dep artment of
636655 Human Services if the counselor was empl oyed as a certified teacher
637656 by the State Department of Education w hen the Division of Vocational
638657 Rehabilitation was t ransferred from the State Board o f Career and
639658 Technology Education or the State Board of Education to the Oklahoma
640659 Public Welfare Commissio n on July 1, 1968;
641660 3. Vocational rehabilitation counselor which w ere completed
642661 while employed by the Department of Human Services if such counselor
643662 was certified as a teacher or was eligible for certifica tion as a
644663 teacher in Oklahoma;
645664 4. Certified teache r which were completed while employe d by the
646665 Child Study Center lo cated at University Hospital, if the teacher
647666 was certified as a teacher in Oklahoma; and
648667 5. Certified school psychologist or psychometrist which were
649668 completed while employed as a doctoral intern, psychological
650669 assistant, or psychologist with any agency o f the State of Oklahoma
651670 if the experience primarily involved work with persons of sc hool- or
652671 preschool-age and if the person was, at the ti me the experience was
653-acquired, certified as, or el igible for certification as, a schoo l
654-psychologist or psychometris t.

681701 F. The provisions of this section shall not app ly to teachers
682702 who have entered into postretirement employment with a public school
683703 in Oklahoma and are still receiving a monthly retiremen t benefit.
684704 G. If a person employed as certified personnel, as def ined in
685705 Section 26-103 of this title, by a school d istrict during the 2017 -
686706 2018 school year was receiving a salary above the step level
687707 indicated by the State state Minimum Salary Schedule for the 2017-
688708 2018 school year, the pe rson shall receive a salary in crease amount
689709 equal to the amount indicated in subs ection A of this section for
690710 the step level indicated for the person, provided they rema in
691711 employed by the same district, unless the hours or the dutie s of the
692712 certified personnel are reduced proportionate ly.
693713 SECTION 4. This act shall become effective July 1, 2023.
694714 SECTION 5. It being immediately necessary fo r the preservation
695715 of the public peace, health or safety, an emergency is hereby
696716 declared to exist, by reason whereof this act shall take effect and
697717 be in full force from and after its passage and approval.
