4040 An Act relating to driver licenses; amending 47 O.S.

6464 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6565 SECTION 1. AMENDATORY 47 O.S. 2021, Section 6 -124, as
6666 amended by Section 63, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 2022,
6767 Section 6-124), is amended to read as follows:
6868 Section 6-124. A. As a way to honor and recognize the veterans
6969 who have served our country, Service Oklahoma shall make space

9696 available in the upper lef t-hand corner of the front of the driver
9797 license and the identification card for a flag emblem and the word
9898 "veteran" to. Similarly, when applicable, Service Oklahoma shall,
9999 either on the front or back of the driver license or the
100100 identification card, include a numeric designation indicating a
101101 veteran's one-hundred-percent disability rating granted to t he
102102 veteran by the United States Department of Veterans Affairs. The
103103 veteran designations required by this subsection shall be designed
104104 by Service Oklahoma that will and shall serve as a notation of
105105 veteran status as well as a notation of the existence of a United
106106 States Department of Veterans Affairs disability rating as
107107 applicable. The current spouse of a one-hundred-percent disabled
108108 veteran or an unremarried surviving spouse of a deceased one-
109109 hundred-percent disabled veteran shall be entitled to receive a
110110 driver license or identification card indicating his or her status
111111 as an eligible current spouse or an eligible unremarried surviving
112112 spouse entitled to the sales tax exemption provided in Section 1357
113113 of Title 68 of the Oklahoma Statutes. Representation of ve teran
114114 status and disability rating on the driver license or the
115115 identification card shall be adequate confirmation for purposes of
116116 veterans benefits offered by public or private entities doing
117117 business within the State of Oklahoma and no further documenta tion
118118 shall be required except as specifically mandated by federal law .

145145 B. Upon application for issuance or renewal of the driver
146146 license or identification card and in addition to other
147147 documentation required by Service Oklahoma, persons requesting the
148148 flag emblem or the flag emblem and the disability notation shall be
149149 registered with the veterans registry Oklahoma Veterans Registry
150150 created by the Oklahoma Department of V eterans Affairs. Provided,
151151 that if the person requesting the flag emblem has previously
152152 received a flag emblem pursuant to this subsection, no registration
153153 with the veterans registry Oklahoma Veterans Registry shall be
154154 required to receive the flag emblem prior to the deadline
155155 established in subsection C of this section . Service Oklahoma shall
156156 promulgate any rule necessary to implement the provisions of this
157157 section.
158158 C. Service Oklahoma and the Oklahoma Department of Veterans
159159 Affairs shall implement a technology -based information exchange
160160 process whereby Service Oklahoma and all licensed operators are able
161161 to validate, upon application for issuance or renewal of the driver
162162 license or identification card, an applicant's claim of veteran
163163 status, veteran disability status, status as a current spouse of an
164164 eligible disabled veteran or status as an unremarried surviving
165165 spouse of an eligible, deceased disabled veteran as provided for in
166166 subsection A of this section. The requirements of this subsection
167167 shall be implemented no later than July 1, 202 4.

194194 D. Service Oklahoma, in consultation with the Oklahoma
195195 Department of Veterans Affairs , is authorized to promulgate any
196196 necessary rules to implement the provisions of this section.
197197 SECTION 2. This act shall become effective November 1, 2023.
