30154 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

32155 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3247, as
33156 amended by Section 1, Chapter 210, O.S.L. 2022 (70 O.S. Supp. 2022,
34157 Section 3247), is amended to read as follow s:

36158 Section 3247. A. A student shall be eligible for in -state
37159 status regardless of the residency of the student if the student is
38160 a:
39-
40161 1. Dependent child or spou se of a person currently serving as a
41162 member of the active uniformed services of the United S tates on
42163 full-time active duty status of more than thirty (30) d ays and for
43164 whom Oklahoma is the home of record;

45191 2. Dependent child or spouse of a person currentl y serving as a
46192 member of the military reserve on act ive duty orders of more than
47193 thirty (30) days and for whom Oklahoma is the home of record;

49194 3. Person, or spouse or dependent child of a person, currently
50195 serving as a member of the uniformed services of the United States
51196 who is on full-time active duty for a period of more than thirty
52197 (30) days and is stationed or temporarily present in Oklahoma
53198 through military orders;

55199 4. Person, or spouse or dependent child of a person, who was
56200 discharged or released f rom a period of not fewer than ninety (90)
57201 days of active uniformed service , less than ten (10) years before
58202 the date of enrollment in the course(s) concerne d and for whom
59203 Oklahoma is the home of record ; or

61204 5. Person who is participating in or has receive d a partial or
62205 full scholarship from the Air Force R eserve Officers' Training
63206 Corps, Army Reserve Officers' Training Corps or the Navy/Marines
64207 Reserve Officers' Training Corps.

66208 B. To be eligible for in -state status as provided for in
67209 subsection A of this section and to maintain eligibility, the
68210 student shall:

70211 1. Satisfy admission and retention s tandards as determined by
71212 the Oklahoma State Regents for Higher Education for an institution
72213 within The Oklahoma State System of Higher Education; and

74240 2. Have secured admission to and enrolls full -time or part-time
75241 in a program of study at an institution within The Oklahoma State
76242 System of Higher Education.

78243 C. A student who files with the institution within The Oklahoma
79244 State System of Higher Education at which th e student intends to
80245 register a letter of intent to establish residence in the state and
81246 who resides in the state while enrolled in the institution shall be
82247 eligible for in-state status, regardless of the residency of the
83248 student or home of record, if the student:

85249 1. Is a person who:
86-
87250 a. was discharged or released from a period of not fewer

251+than ninety (90) days of active duty uniformed
89252 service, less than five (5) years before the date of
90253 enrollment in the course(s) concerned, and
91-
92254 b. is pursuing a course of education with educational
93255 assistance under Chapter 30 or, 31, 33, or 35 of Title
94256 38 of the United States Code while living in this
95257 state; or
96-
97258 2. Is a person who:
98-
99259 a. is entitled to assistance under Section 3311(b)(9) or
100260 3319 of Title 38 of the United Stat es Code by virtue
101261 of a relationship to a person who was discharged or
102262 released from a period of not fewer than ninety (90)
103263 days of active duty uniformed serv ices, and

105290 b. enrolls in the course(s) concerned within five (5)
106291 years of the date the related perso n was discharged or
107292 released from a period of not fe wer than ninety (90)
108293 days of active duty un iformed services.

110294 D. To be eligible for in -state status as provided for in
111295 subsection C of this section and to maintain eligibility, the
112296 student shall:

114297 1. Satisfy admission and retention standards as determined by
115298 the Oklahoma State Regents for Higher Ed ucation for an institution
116299 within The Oklahoma State System of Higher Education; and

118300 2. Have secured admission to and enrolls full -time or part-time
119301 in a program of study at an institution within The Oklahoma Sta te
120302 System of Higher Education.

122303 E. A student who meets the eligibility requirements for in -
123304 state status shall maintain in-state status if the student remains
124305 continuously enrolled at an institution within The Oklahoma State
125306 System of Higher Education after the student:

127307 1. As described in paragraphs paragraph 1, 2 or, 3, or 4 of
128308 subsection A or paragraph 1 or 2 of subsection C of this section is
129309 discharged or released from active duty service;

131310 2. As described in paragraph 4 of subsection A of this section
132-or paragraph 1 and 2 of subsection C of thi s section exceeds the ENR. H. B. NO. 2663 Page 4
311+or paragraph 1 and 2 of subsection C of thi s section exceeds the
133312 five-year period after being discharged or released from active duty

136340 3. As described in paragraph 1 of subsection C of this section
137341 has exhausted education assistance prov ided under Chapter 30 or, 31,
138342 33, or 35 of Title 38 of the United States Code; or

140343 4. 3. As described in paragraph 2 of subsection C of this
141344 section has exhausted education assistance provided under Secti on
142345 3311(b)(9) or 3319 of Title 38 of the United Stat es Code.

144346 F. For purposes of this section, "home of record" means the
145347 place where one was living when the person enlisted or was
146348 commissioned into the military or reenlisted in the military.

148349 G. The State Regents for Higher Education shall develop
149350 policies and procedures necessary to imple ment the provisions of
150351 this section.

152352 SECTION 2. It being immediately necessary for the preservation
153353 of the public peace, health or safety, an emergency i s hereby
154354 declared to exist, by reason whereof this a ct shall take effect and
155355 be in full force from and after its passage and approval.
