30	154		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

32	155		SECTION 1. AMENDATORY 70 O.S. 2021, Section 3247, as
33	156		amended by Section 1, Chapter 210, O.S.L. 2022 (70 O.S. Supp. 2022,
34	157		Section 3247), is amended to read as follow s:

36	158		Section 3247. A. A student shall be eligible for in -state
37	159		status regardless of the residency of the student if the student is
38	160		a:

40	161		1. Dependent child or spou se of a person currently serving as a
41	162		member of the active uniformed services of the United S tates on
42	163		full-time active duty status of more than thirty (30) d ays and for
43	164		whom Oklahoma is the home of record;

46	192		member of the military reserve on act ive duty orders of more than
47	193		thirty (30) days and for whom Oklahoma is the home of record;

50	195		serving as a member of the uniformed services of the United States
51	196		who is on full-time active duty for a period of more than thirty
52	197		(30) days and is stationed or temporarily present in Oklahoma
53	198		through military orders;

55	199		4. Person, or spouse or dependent child of a person, who was
56	200		discharged or released f rom a period of not fewer than ninety (90)
57	201		days of active uniformed service , less than ten (10) years before
58	202		the date of enrollment in the course(s) concerne d and for whom
59	203		Oklahoma is the home of record ; or
60		-
61	204		5. Person who is participating in or has receive d a partial or
62	205		full scholarship from the Air Force R eserve Officers' Training
63	206		Corps, Army Reserve Officers' Training Corps or the Navy/Marines
64	207		Reserve Officers' Training Corps.

66	208		B. To be eligible for in -state status as provided for in
67	209		subsection A of this section and to maintain eligibility, the
68	210		student shall:

70	211		1. Satisfy admission and retention s tandards as determined by
71	212		the Oklahoma State Regents for Higher Education for an institution
72	213		within The Oklahoma State System of Higher Education; and

74	240		2. Have secured admission to and enrolls full -time or part-time
75	241		in a program of study at an institution within The Oklahoma State
76	242		System of Higher Education.

78	243		C. A student who files with the institution within The Oklahoma
79	244		State System of Higher Education at which th e student intends to
80	245		register a letter of intent to establish residence in the state and
81	246		who resides in the state while enrolled in the institution shall be
82	247		eligible for in-state status, regardless of the residency of the
83	248		student or home of record, if the student:

85	249		1. Is a person who:

87	250		a. was discharged or released from a period of not fewer

89	252		service, less than five (5) years before the date of
90	253		enrollment in the course(s) concerned, and

92	254		b. is pursuing a course of education with educational
93	255		assistance under Chapter 30 or, 31, 33, or 35 of Title
94	256		38 of the United States Code while living in this
95	257		state; or

97	258		2. Is a person who:

99	259		a. is entitled to assistance under Section 3311(b)(9) or
100	260		3319 of Title 38 of the United Stat es Code by virtue
101	261		of a relationship to a person who was discharged or
102	262		released from a period of not fewer than ninety (90)
103	263		days of active duty uniformed serv ices, and

110	294		D. To be eligible for in -state status as provided for in
111	295		subsection C of this section and to maintain eligibility, the
112	296		student shall:

114	297		1. Satisfy admission and retention standards as determined by
115	298		the Oklahoma State Regents for Higher Ed ucation for an institution
116	299		within The Oklahoma State System of Higher Education; and

118	300		2. Have secured admission to and enrolls full -time or part-time
119	301		in a program of study at an institution within The Oklahoma Sta te
120	302		System of Higher Education.

122	303		E. A student who meets the eligibility requirements for in -
123	304		state status shall maintain in-state status if the student remains
124	305		continuously enrolled at an institution within The Oklahoma State
125	306		System of Higher Education after the student:

127	307		1. As described in paragraphs paragraph 1, 2 or, 3, or 4 of
128	308		subsection A or paragraph 1 or 2 of subsection C of this section is
129	309		discharged or released from active duty service;

131	310		2. As described in paragraph 4 of subsection A of this section

142	345		3311(b)(9) or 3319 of Title 38 of the United Stat es Code.

144	346		F. For purposes of this section, "home of record" means the
145	347		place where one was living when the person enlisted or was
146	348		commissioned into the military or reenlisted in the military.

148	349		G. The State Regents for Higher Education shall develop
149	350		policies and procedures necessary to imple ment the provisions of
150	351		this section.

152	352		SECTION 2. It being immediately necessary for the preservation
153	353		of the public peace, health or safety, an emergency i s hereby
154	354		declared to exist, by reason whereof this a ct shall take effect and
155	355		be in full force from and after its passage and approval.
