4040 An Act relating to parental rights; amending 25 O.S.
4141 2021, Section 2003, which relates to parental
4242 involvement; providing that parent may submit written
4343 complaint to superintendent; providing that
4444 superintendent respond within certain amount of time;
4545 providing that parent may appeal actions; authorizing
4646 Board of Education to appoint a n investigative
4747 committee; providing t hat committee respond within
4848 certain amount of time; providi ng that parent or
4949 district attorney may file suit for violation ;

5858 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5959 SECTION 1. AMENDATORY 25 O.S. 2021, Section 2003, is
6060 amended to read as follows:
6161 Section 2003. A. The board of education of a school district,
6262 in consultation with parents, teachers and administrators, shall
6363 develop and adopt a policy to pr omote the involvement of parents and
6464 guardians of children enrolled in the schools within the school

9292 1. A plan for parent participation in the sch ools which is
9393 designed to improve parent and teacher cooperation in such areas as
9494 homework, attendance and discipline;
9595 2. Procedures by which parents may learn about the course of
9696 study for their children and review learning materials, including
9797 the source of any supplemental educational materials;
9898 3. Procedures by which parents who object to any learning
9999 material or activity on the basis that it is harmful may withdraw
100100 their children from the activity or from the class or program in
101101 which the material is used. Objection to a learning material or
102102 activity on the basis that it is harmful inc ludes objection to a
103103 material or activity because it questions beliefs or practices in
104104 sex, morality or religion;
105105 4. If a school district offers any sex education curr icula
106106 pursuant to Section 11 -105.1 of Title 70 of the Oklahoma Statutes or
107107 pursuant to any rules adopted by the State Board of Education,
108108 procedures to opt out of a school district from providing sex
109109 education instruction to a child if the child 's parent provides
110110 written objection to the child 's participation in the sex education
111111 curricula;
112112 5. Procedures by which parents will be notified in advance of
113113 and given the opportunity to withdraw their children from any
114114 instruction or presentations regarding sexua lity in courses other

141141 than formal sex education curricula pursuant to Section 11 -105.1 of
142142 Title 70 of the Oklahoma Statutes;
143143 6. Procedures by which parents may learn about the nature and
144144 purpose of clubs and activities that are part of the school
145145 curriculum, as well as extracurricular clubs and activities that
146146 have been approved by the schoo l; and
147147 7. Procedures by which parents may learn about parental rights
148148 and responsibilities under the laws of this state, including the
149149 following:
150150 a. the right to opt out of a sex education curriculum if
151151 one is provided by the school district,
152152 b. open enrollment rights,
153153 c. the right to opt out of assignments pursuant to this
154154 section,
155155 d. the right to be exempt from the immunization laws of
156156 the state pursuant to Section 12 10.192 of Title 70 of
157157 the Oklahoma Statutes,
158158 e. the promotion requirements prescribed in Section
159159 1210.508E of Title 70 of the Oklahoma Statutes,
160160 f. the minimum course of study and competency
161161 requirements for graduation from high school
162162 prescribed in Sectio n 11-103.6 of Title 70 of the

190190 g. the right to opt out of instruction on the acquired
191191 immune deficiency syndrome pursuant to Section 11 -
192192 103.3 of Title 70 of the Oklahoma Statutes,
193193 h. the right to review test results,
194194 i. the right to participate in gifted programs pursuant
195195 to Sections 1210.301 through 1210.308 of Title 70 of
196196 the Oklahoma Statutes,
197197 j. the right to inspect instructional materials used in
198198 connection with any research or experimentation
199199 program or project pursuant to Section 11 -106 of Title
200200 70 of the Oklahoma Statutes,
201201 k. the right to receive a school report card,
202202 l. the attendance requirements prescribed in Section 10 -
203203 106 of Title 70 of the Oklahoma Statutes,
204204 m. the right to public review of courses of study and
205205 textbooks,
206206 n. the right to be excused from school attendance for
207207 religious purposes,
208208 o. policies related to parental involvement pursuant to
209209 this section,
210210 p. the right to participate in parent -teacher
211211 associations and organizations that are sanctioned by
212212 the board of education of a school district, and

239239 q. the right to opt out of any data collection instrume nt
240240 at the district level that would capture data for
241241 inclusion in the state longitudinal student data
242242 system except what is necessary and essential for
243243 establishing a student's public school record.
244244 B. The board of education of a school district may adopt a
245245 policy to provide to parents the information required by this
246246 section in an electronic form.
247247 C. A parent shall submit a written request for information
248248 pursuant to this section during regular business hours to either the
249249 school principal at the school site or the superintendent of the
250250 school district at the office of the school district. Within ten
251251 (10) days of receiving the request for information, the school
252252 principal or the superintendent of the school district shall either
253253 deliver the requested inf ormation to the parent or submit to the
254254 parent a written explanation of the reasons for the denial of the
255255 requested information. If the request for information is deni ed or
256256 the parent does not receive the requested information within fifteen
257257 (15) days after submitting the request for information, the parent
258258 may submit a written request for the information to the board of
259259 education of a school district, which shall forma lly consider the
260260 request at the next scheduled public meeting of the board if the
261261 request can be properly noticed on the agenda. If the request
262262 cannot be properly noticed on the agenda, the board of education of

289289 a school district shall formally consider t he request at the next
290290 subsequent public meeting of the board.
291291 D. A parent may submit a written complaint detailing any
292292 violation of this section to the superintendent of th e school
293293 district. The parent shall be entitled to a meeting with the
294294 superintendent to discuss the complaint if desired by the parent.
295295 The superintendent shall investi gate the complaint and respond to
296296 the parent in writing within fourteen (14) days after receiving the
297297 complaint describing the actions the superintendent shall take to
298298 remedy the complaint.
299299 E. A parent may appeal the actions of the superintendent to the
300300 Board of Education by submitting a written complaint detailing the
301301 violation and a description of why the superintendent's response
302302 failed to remedy the complaint. The Board of Education shall
303303 appoint a committee to investigate any such complaints. The
304304 committee shall meet with the parent to discuss the complaint.
305305 Within thirty (30) days of receiving the complaint, the committee
306306 shall submit a recommended response and propos ed steps to remedy the
307307 complaint to the Board for action by the Board at the next regularly
308308 scheduled meeting.
309309 F. If the Board's action does not remedy a complaint, a parent
310310 or a district attorney with jurisdiction over the school district
311311 may file suit and assert a violation of this section as a claim
312312 against the school district.

339339 G. A parent or district attorney that successfully asserts a
340340 claim may recover:
341341 1. declaratory relief;
342342 2. injunctive relief to prevent or remedy a violation of this
343343 section or the effects of such a violation;
344344 3. reasonable attorneys ' fees and costs; and
345345 4. any other appropriate relief.
346346 SECTION 2. This act shall become effective November 1, 2023.
