107-Section 18-114.15. A. Beginning with the 2023 -2024 school
108-year, certified personnel, as defined in Section 26 -103 of Title 70
109-of the Oklahoma Statutes this title, in the public schools of
110-Oklahoma this state shall receive in salary and/or fringe benefits

249-B. 1. When determining the Minimum Salary Schedule, “fringe
250-benefits” shall mean all or part of retirement benefits, excluding
251-the contributions made pursuant to subsection A of Section 17 -108.1
252-of Title 70 of the Oklahoma Statutes this title and the flexible
253-benefit allowance pursuant to Section 26 -105 of Title 70 of the
254-Oklahoma Statutes this title from the flexible benefit allowance
255-funds disbursed by the State Board of Education and the State Board
256-of Career and Technology Education pursuant to Se ction 26-104 of
257-Title 70 of the Oklahoma Statutes this title.
258-2. If a school district intends to provide retirement benefits
259-to a teacher such that the teacher’s salary would be less than the
260-amounts set forth in the minimum salary schedule specified in
261-subsection A of this section, the district shall be required to
262-provide written notification to the teacher prior to his or her
263-employment or, if already employed by the district, no later than
264-thirty (30) days prior to the date the district elects to provi de
265-retirement benefits such that the teacher’s salary would be less
266-than the minimum salary schedule.
267-C. Any of the degrees referred to in this section shall be from
268-a college recognized by the State Board of Education. The Board
269-shall accept teaching ex perience from out-of-state school districts
270-that are accredited by the State Board of Education state board of
271-education or appropriate state accrediting agency for the districts.

299-schools that are accredited or otherwise endorsed by the appropriate
300-national or regional accrediting or endorsement authority. Out -of-
301-country certification documentation in a language other than English
302-shall be analyzed by an educational credential evaluation servi ce in
303-accordance with industry standards and guidelines and approved by
304-the State Department of Education. The person seeking to have
305-credit granted for out -of-country teaching experience shall be
306-responsible for all costs of the analysis by a credential evaluation
307-service. The Board shall accept teaching experience from primary
308-and secondary schools that are operated by the United States
309-Department of Defense or are affiliated with the United States
310-Department of State.
311-D. For the purpose of state salar y increments and retirement,
312-no teacher shall be granted credit for more than five (5) years of
313-active duty in the military service or out -of-state or out-of-
314-country teaching experience as a certified teacher or its
315-equivalent. Nothing in this section sha ll prohibit boards of
316-education from crediting more years of experience on district salary
317-schedules than those allowed for state purposes.
318-E. The State Board of Education shall recognize, for purposes
319-of certification and salary increments, all the years of experience
320-of a:
321-1. Certified teacher who teaches in the educational program of
322-the Department of Corrections, beginning with fiscal year 1981;

349-2. Vocational rehabilitation counselor under the Department of
350-Human Services if the counselor was employe d as a certified teacher
351-by the State Department of Education when the Division of Vocational
352-Rehabilitation was transferred from the State Board of Career and
353-Technology Education or the State Board of Education to the Oklahoma
354-Public Welfare Commission o n July 1, 1968;
355-3. Vocational rehabilitation counselor which were completed
356-while employed by the Department of Human Services if such counselor
357-was certified as a teacher or was eligible for certification as a
358-teacher in Oklahoma this state;
359-4. Certified teacher which were completed while employed by the
360-Child Study Center located at University Hospital, if the teacher
361-was certified as a teacher in Oklahoma this state; and
362-5. Certified school psychologist or psychometrist which were
363-completed while empl oyed as a doctoral intern, psychological
364-assistant, or psychologist with any agency of the State of Oklahoma
365-this state if the experience primarily involved work with persons of
366-school- or preschool-age and if the person was, at the time the
367-experience was acquired, certified as, or eligible for certification
368-as, a school psychologist or psychometrist.
369-F. The provisions of this section shall not apply to teachers
370-who have entered into postretirement employment with a public school
371-in Oklahoma this state and are still receiving a monthly retirement
372-benefit.

399-G. If a person employed as certified personnel, as defined in
400-Section 26-103 of Title 70 of the Oklahoma Statutes this title, by a
401-school district during the 2022 -2023 school year was receiving a
402-salary above the step level indicated by the State Minimum Salary
403-Schedule for the 2022 -2023 school year, the person shall receive a
404-salary increase amount equal to the amount indicated in subsection A
405-of this section for the step level indicated for the person,
406-provided they remain employed by the same district, unless the hours
407-or the duties of the certified personnel are reduced
408-proportionately.
409-H. If For the fiscal year ending June 30, 2024, if a school
410-district does not receive receives either Foundation Aid or Salary
411-Incentive Aid or receives neither Foundation Aid nor Salary
412-Incentive Aid pursuant to Section 18 -200.1 of Title 70 of the
413-Oklahoma Statutes this title, funds appropriated for the financial
414-support of public schools shall be allocated by the Stat e Board
415-Department of Education to implement the salary increases indicated
416-in subsection A of this section.
417-I. Persons employed as classroom instructional employees of
418-technology center school districts supervised by the State Board of
419-Career and Technology Education shall receive a salary increase
420-amount equal to the amount indicated in subsection A of this section
421-for the step level indicated for the person persons, provided they
422-remain employed by the same technology center school district,

450-employees are reduced proportionately.
451-J. Persons employed as correctional teachers or vocational
452-instructors by the Department of Corrections pursuant to Section
453-510.6a of Title 57 of the Oklahoma Statut es or persons employed as
454-teachers by the Office of Juvenile Affairs shall receive a salary
455-increase amount equal to the amount indicated in subsection A of
456-this section for the step level indicated for the person persons,
457-provided they remain employed by the same Department of Corrections
458-or Office of Juvenile Affairs facility, unless the hours or the
459-duties of the correctional teachers, vocational instructors, or
460-teachers are reduced proportionately.
461-K. Persons employed as teachers by the State Departmen t of
462-Rehabilitation Services shall receive a salary increase amount equal
463-to the amount indicated in subsection A of this section for the step
464-level indicated for the person persons, provided they remain
465-employed by the State Department of Rehabilitation S ervices, unless
466-the hours or the duties of the teachers are reduced proportionately.
467-SECTION 2. It being immediately necessary for the preservation
468-of the public peace, health, or safety, an emergency is hereby
469-declared to exist, by reason whereof this act shall take effect and
470-be in full force from and after its passage and approval. ”

59889 B. 1. The Board shall issue a r equest for proposals for the
59990 selection of assessments to be administered to stude nts in grades
60091 three through twelve as a part of the statewide student as sessment
60192 system adopted by the Board pursuant to this section.
60293 2. The Board shall adopt assessments fr om the selected
60394 proposals that were su bmitted pursuant to pa ragraph 1 of this
60495 subsection. The adopted assessments shall be administered by the
60596 Board for a period that is in coordination with the six -year subject
60697 area textbook adoption cycle unless the ven dor does not fulfill the
60798 terms of the contract or fails to c omply with or violate s the terms
60899 of the contract. The Board shall administer the assessments
609100 beginning with the 2017 -2018 school year.
610101 C. The statewide student assessment system adopted by the B oard
611102 pursuant to this section shall in clude assessments that :
612103 1. Are aligned with the Oklahoma subject matter standards as
613104 adopted by the Board;
614105 2. Provide a measure of comparability among other states;
615106 3. Yield both norm-referenced scores and criterion -referenced

653144 through five, six th rough nine and ten through twelve; and

701192 administered to students in hi gh school at no cost t o
702193 the student.
703194 3. a. Beginning with the 2023-2024 school year, the
704195 statewide student assessment system m ay include:
705196 (1) a retest of the nati onally recognized college -
706197 and career-readiness assessment administered
707198 pursuant to subparagraph b of paragraph 2 of th is
708199 subsection, or
709200 (2) nationally recognized, portable career-readiness
710201 assessments that lead to a National Career
711202 Readiness Certificate.
712203 b. The assessments described in this paragraph shall be
713204 available for students in the fall sem ester of their
714205 twelfth grade year and shall be administered at no
715206 cost to students.
716207 F. 1. Beginning with students entering the ninth grade in the
717208 2017-2018 school year, each student shall take the assessment or

747238 All students shall take the assessment or assessments prior to
748239 graduation, unless otherwise exempt b y law.
749240 2. Beginning with students entering the ninth grade in the
750241 2017-2018 school year, each student, in addition to taking the
751242 assessment or assessments includ ed in the statewide student
752243 assessment system adopted by the Board pursuant to subsection A of
753244 this section, shall meet any other high school graduation
754245 requirements adopted by the Board pursuant to Section 5 of Enrolled
755246 House Bill No. 3218 of the 2nd Sess ion of the 55th Oklahoma
756247 Legislature in order to graduat e from a public high school with a
757248 standard diploma.
758249 3. For students who start the ninth grade prior to or during
759250 the 2016-2017 school year, school districts shall adopt a plan that
760251 establishes the assessment or assessments those students are
761252 required to take in order to graduate from a publi c high school with
762253 a standard diploma. The plan may also include any or all of the
763254 other high school graduation requirements adopted by the Board
764255 pursuant to Section 5 of Enrolled House Bill No. 3218 of the 2nd
765256 Session of the 55th Oklahoma Legislature tha t those students will be
766257 required to meet in order to graduate from a public high school with
767258 a standard diploma.

794285 4. The Board shall promulgate rules to ensure t hat students who
795286 transfer into an Oklahoma school distri ct from out-of-state after
796287 the junior year of high school shall not be denied the opportunity
797288 to be awarded a standard diploma due to differing testing
798289 requirements.
799290 G. In order to provide an indicat ion of the levels of
800291 competency attained by the student in a permanent record for
801292 potential future employers and instit utions of higher education,
802293 school districts shall report on the high school transcript of the
803294 student the highest-achieved score on the assessment or assessments
804295 included in the statewide stud ent assessment system adopted by the
805296 Board pursuant to subsecti on A of this section and any business- and
806297 industry-recognized endorsements attained.
807298 H. Students who do not perform at a proficiency le vel on
808299 assessments shall be remediated as established in the assessment
809300 requirements adopted b y the Board pursuant to S ection 5 of Enrolled
810301 House Bill No. 3218 of the 2nd Session of the 55th Oklahoma
811302 Legislature, subject to the availability of funding.
812303 I. 1. All assessments required by this section shall meas ure
813304 academic competencies in correlati on with the subject matte r
814305 standards adopted by the Board pursuant to Sections 11 -103.6 and 11-
815306 103.6a of this title and referred to as the Oklahoma Academic
816307 Standards. The State Board of Education shall evaluate the s ubject
817308 matter standards to ensure the competencies reflect high standards,

844335 are specific, well-defined, measurable, challenging, and will
845336 prepare elementary students for next -grade-level course work an d
846337 secondary students for postsecondary studies at instit utions of
847338 higher education or technolo gy center schools without the need for
848339 remediation. All subject matter standards shall reflect the goals
849340 as set forth in Section 11 -103.6 of this title and of im proving the
850341 state average ACT score.
851342 2. The State Department of Education shall annually eval uate
852343 the results of the a ssessments. The State Board of Education shall
853344 ensure that preliminary results for all statewide assessments are
854345 reported to districts n o later than June 20 of each year and are
855346 presented in a manner that yields detailed, diagnost ic information
856347 for the purpose of guiding instruction and student remediation. As
857348 improvements are made to the assessments required by this section,
858349 the Board shall seek to increase the depth of knowledge assessed for
859350 each subject. The State Board of Edu cation shall seek to ensu re
860351 that data yielded from the assessments required in this section are
861352 utilized at the school district level to inform instruction,
862353 professional development, school improvement and remediation for
863354 students.
864355 3. The Commission for E ducational Quality and Ac countability
865356 shall determine the cut scores for the performance levels on all
866357 statewide assessments. The Commission shall conduct an ong oing
867358 review to compare the statewide assessment content and performance
868359

896387 4. The State Board of Education, for the purposes of conduc ting
897388 reliability and validity studies, monitoring contra ctor adherence to
898389 professionally accep ted testing standards, an d providing
899390 recommendations for testing program improvement, shall retain the
900391 services of an established, independent agency or organizat ion that
901392 is nationally recognized for its technical expe rtise in educational
902393 testing but is not engaged in the developm ent of aptitude or
903394 achievement tests for elementary or secondary level grades. These
904395 national assessment experts shall annually conduct studies of the
905396 reliability and validity of the statewide assessments administered
906397 pursuant to this section. Validity s tudies shall include studies of
907398 decision validity and concurrent validity.
908399 J. 1. The State Board of Education shall promulgate rules
909400 setting the assessment window dates for each statewide ass essment so
910401 that the assessments are ad ministered according to r ecommended
911402 testing protocols, and so that the assessment results are reported
912403 back to school districts in a timely manner. The vendor sh all
913404 provide a final electronic data file of all school s ite, school
914405 district, and state result s to the State Department of Education and
915406 the Office of Educational Quality and Accountability prior to August
916407 20 of each year. The Department shall forward the final data files
917408 for each school district and each scho ol site in that district to

944435 the school district. The Board sha ll ensure the contract with the
945436 vendor includes a provision that the vendor report assessment
946437 results directly to the Office of Education al Quality and
947438 Accountability at the same time it is rep orted to the Board.
948439 2. State, district, and site level results of all assessments
949440 required in this section shall be disaggregated by gender, race,
950441 ethnicity, disability status, migrant status, Englis h proficiency,
951442 and status as economically disadvantaged, except that such
952443 disaggregation shall not be required in a cas e in which the number
953444 of students in a category is insufficient to yield statistically
954445 reliable information or the results would reveal p ersonally
955446 identifiable information about an individual s tudent. Each school
956447 site shall notify the student's parents of the school's performance
957448 levels in the Oklahoma School Testing Program as reported in the
958449 Oklahoma Educational Indicators Program at the end of each school
959450 year.
960451 K. The State Board of Educati on shall be responsible for the
961452 field-testing and validation of the statewide assessment system
962453 required in subsection A of this section.
963454 L. The State Board of Education shall develop, administer, an d
964455 incorporate as a part of the Oklahoma School Testing P rogram, other
965456 assessment programs or p rocedures, including appr opriate
966457 accommodations for the assessment of students with disabilities as

995486 M. For purposes of developing and administering alterna te
996487 assessments for studen ts with the most significant cognitive
997488 disabilities, the State Board of Education shall not be subject to
