2655 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2856 SECTION 1. AMENDATORY 70 O.S . 2021, Section 3-101, is
2957 amended to read as foll ows:

3158 Section 3-101. A. The State Board of Education shall consist
3259 of seven (7) members. The State Superintendent of Public
3360 Instruction shall be a member and the chairperson of the Board. The
3461 remaining six members shall be appointed by the Governor by a nd with
3562 the advice and consent of the Senate. Except as otherwise provided
3663 for in subsection B of this section, upon assuming office each
3764 Governor shall appoint one member from each congressional district
3865 and one member from the state at large. Each appo intment shall be

3993 made to take effect on April 2. The term of each appointed member
4094 shall be four (4) years. Appointed members shall serve until a
4195 successor is appointed. Appointed members shall serve at t he
4296 pleasure of the Governor. Upon the occurrence of a vacancy the same
4397 shall be filled by the Governor, subject to confirmation by the
4498 Senate at the next session of the Legislature. The appointment to

46100 B. On the effective date of this act, all appoin ted positions
47101 of the current State Board of Education shall be deemed vacant and
48102 the terms of persons serving on the Board shall be deemed
49103 terminated. The Governor shall make initial appointments pursuant
50104 to the provisions of this subsection within thirty (30) days of the
51105 effective date of this act, with one member appointed from each
52106 congressional district and one member appointed from the state at
53107 large. The appointments shall be subject to confirmation b y the
54108 Senate at the next session of the Legislatu re. The terms for
55109 members appointed pursuant to this subsection shall terminate on
56110 April 2, 2015. Thereafter, members shall be appointed as provided
57111 for in subsection A of this section.

59112 C. No person shall be eligible to be appointed to serve on the
60113 State Board unless the person has been awarded a high school diploma
61114 or certificate of high school equivalency. No person shall be
62115 appointed to serve on the Board if the person serves on a board of
63116 education of a school district which is supervised by the Board

64144 pursuant to Section 3-104 of this title. Any member appointed to
65145 the State Board shall complete the workshop requirements of a new
66146 school board member pursuant to Section 5-110 of this title within
67147 thirteen (13) months following or preceding the appoin tment of the
68148 member. Notwithstanding any provision of law to the contrary, the
69149 State Department of Education shall not charge any member of the
70150 State Board of Education a fee for any workshop provided by th e
71151 Department for board members pursuant to Sectio n 5-110 of this title
72152 and shall not pay a fee to any organization or institution of higher
73153 education on behalf of a member of the State Board of E ducation, or
74154 reimburse any member of the Board for a fee paid to any organization
75155 or institution of higher edu cation, for attendance at a workshop or
76156 courses to satisfy the requirements of Section 5 -110 of this title.

78157 D. Members of the Board shall receive necessary traveling
79158 expenses while in the performance of their duties in accordance with
80159 the State Travel Rei mbursement Act.

82160 SECTION 2. This act shall become effective November 1, 2023.
