26	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

28	56		SECTION 1. AMENDATORY 70 O.S . 2021, Section 3-101, is
29	57		amended to read as foll ows:

31	58		Section 3-101. A. The State Board of Education shall consist
32	59		of seven (7) members. The State Superintendent of Public
33	60		Instruction shall be a member and the chairperson of the Board. The
34	61		remaining six members shall be appointed by the Governor by a nd with
35	62		the advice and consent of the Senate. Except as otherwise provided
36	63		for in subsection B of this section, upon assuming office each
37	64		Governor shall appoint one member from each congressional district
38	65		and one member from the state at large. Each appo intment shall be

39	93		made to take effect on April 2. The term of each appointed member
40	94		shall be four (4) years. Appointed members shall serve until a
41	95		successor is appointed. Appointed members shall serve at t he
42	96		pleasure of the Governor. Upon the occurrence of a vacancy the same
43	97		shall be filled by the Governor, subject to confirmation by the
44	98		Senate at the next session of the Legislature. The appointment to

46	100		B. On the effective date of this act, all appoin ted positions
47	101		of the current State Board of Education shall be deemed vacant and
48	102		the terms of persons serving on the Board shall be deemed
49	103		terminated. The Governor shall make initial appointments pursuant
50	104		to the provisions of this subsection within thirty (30) days of the
51	105		effective date of this act, with one member appointed from each
52	106		congressional district and one member appointed from the state at
53	107		large. The appointments shall be subject to confirmation b y the
54	108		Senate at the next session of the Legislatu re. The terms for
55	109		members appointed pursuant to this subsection shall terminate on
56	110		April 2, 2015. Thereafter, members shall be appointed as provided
57	111		for in subsection A of this section.

59	112		C. No person shall be eligible to be appointed to serve on the
60	113		State Board unless the person has been awarded a high school diploma
61	114		or certificate of high school equivalency. No person shall be
62	115		appointed to serve on the Board if the person serves on a board of
63	116		education of a school district which is supervised by the Board

64	144		pursuant to Section 3-104 of this title. Any member appointed to
65	145		the State Board shall complete the workshop requirements of a new
66	146		school board member pursuant to Section 5-110 of this title within
67	147		thirteen (13) months following or preceding the appoin tment of the
68	148		member. Notwithstanding any provision of law to the contrary, the
69	149		State Department of Education shall not charge any member of the
70	150		State Board of Education a fee for any workshop provided by th e
71	151		Department for board members pursuant to Sectio n 5-110 of this title
72	152		and shall not pay a fee to any organization or institution of higher
73	153		education on behalf of a member of the State Board of E ducation, or
74	154		reimburse any member of the Board for a fee paid to any organization
75	155		or institution of higher edu cation, for attendance at a workshop or
76	156		courses to satisfy the requirements of Section 5 -110 of this title.

78	157		D. Members of the Board shall receive necessary traveling
79	158		expenses while in the performance of their duties in accordance with
80	159		the State Travel Rei mbursement Act.

82	160		SECTION 2. This act shall become effective November 1, 2023.
