55	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
56	53		SECTION 1. AMENDATORY 74 O.S. 2021, Section 213.2, is
57	54		amended to read as follows :
58	55		Section 213.2 A. There is hereby created in the Office of the
59	56		State Auditor and Insp ector a Performance Audit Division, subject to
60	57		the discretion of the State Auditor and Inspector. An Assistant
61	58		State Auditor and In spector may be appointed to direct the
62	59		operations of the Division, subject to the supervision and control
63	60		of the State Auditor and Inspector at all times.
64	61		B. The State Auditor and Inspector, deputi es and agents of the
65	62		Performance Audit Division may examin e all books and accounts of all
	63	+	public officers, institutions and other governmental entities

94	90		specified in Sections 212 thro ugh 227.9 of this title to instruct
95	91		the proper officers thereof in the per formance of their duties and
96	92		to prescribe cost-effective methods of operating such governmental
97	93		entities; provided, however, the State Auditor and Inspector shall
98	94		perform the examinations authorized in this subsection upon
99	95		receiving a written request to do so by the Governor, Speaker of the
100	96		Oklahoma House of Repr esentatives, President Pro Tempore of the
101	97		Oklahoma State Senate, the chief executive officer of a governmenta l
102	98		entity or pursuant to a joint or concurrent resolution of the
103	99		Legislature. A copy of the examination shal l be given to the
104	100		examined entity. A c opy of any examination conducted pursuant to
105	101		this subsection shall be submitted to the Governor, the Speaker of
106	102		the House of Representatives, the President Pro Tempore of the
107	103		Senate, the appropriations and budget chai rs of the House of
108	104		Representatives and the Senate, and the Minority Leader of the House
109	105		of Representatives and of the Senate.
110	106		C. The cost of the e xaminations authorized pursuant to
111	107		subsection B of this section shall be borne by the examined agency
112	108		in an amount not to exceed the actual costs of the examination.
113	109		Prior to the start of such an examination, the State Auditor and
114	110		Inspector shall prepare in writing and present to the affected state
115	111		agency an estimate of the cost of the examination. If the estim ate
116	112		requires revision, the State Audito r and Inspector shall notify the
	113	+	agency in a prompt manner. Except as otherwise provided, the State

144		-	agency in a prompt manner. Except as otherwise provided, the State
145	140		Auditor and Inspector shall recover its costs for the examination
146	141		pursuant to monthly progress billings presented by the State Auditor
147	142		and Inspector to the Office of Management and Enterprise Services
148	143		detailing current monthly costs for each examination. In addi tion,
149	144		the State Auditor and Inspector shall provide a copy of the billing
150	145		to the affected state agency. The Office of Management and
151	146		Enterprise Services may deduct the amounts billed from the next
152	147		subsequent allotment for the corresponding state agency an d transfer
153	148		the funds to the State Auditor and Inspector Revolving Fund.
154	149		D. The salaries and traveling expens es of the Assistant State
155	150		Auditor and Inspector, deputies and agents of the Performance Audit
156	151		Division and the costs of material, supplies and equ ipment for the
157	152		Division shall be paid from funds made available through
158	153		appropriation by the Legislature.
159	154		E. The State Auditor and Inspector shall s ubmit an annual
160	155		report of the Performance Audit Division to the Governor, the
161	156		President Pro Tempore of the Senate, the Speaker of the House of
162	157		Representatives, appropriations and budget chairs of the House of
163	158		Representatives and the Senate, and the Minorit y Leader of the
164	159		Senate and of the House of Representatives.
165	160		SECTION 2. This act shall become effective July 1, 2023.
166	161		SECTION 3. It being immediately necessary for the preservation
167	162		of the public peace, health or safety, an emergency is hereby
