5552 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5653 SECTION 1. AMENDATORY 74 O.S. 2021, Section 213.2, is
5754 amended to read as follows :
5855 Section 213.2 A. There is hereby created in the Office of the
5956 State Auditor and Insp ector a Performance Audit Division, subject to
6057 the discretion of the State Auditor and Inspector. An Assistant
6158 State Auditor and In spector may be appointed to direct the
6259 operations of the Division, subject to the supervision and control
6360 of the State Auditor and Inspector at all times.
6461 B. The State Auditor and Inspector, deputi es and agents of the
6562 Performance Audit Division may examin e all books and accounts of all
63+public officers, institutions and other governmental entities

93-public officers, institutions and other governmental entities
9490 specified in Sections 212 thro ugh 227.9 of this title to instruct
9591 the proper officers thereof in the per formance of their duties and
9692 to prescribe cost-effective methods of operating such governmental
9793 entities; provided, however, the State Auditor and Inspector shall
9894 perform the examinations authorized in this subsection upon
9995 receiving a written request to do so by the Governor, Speaker of the
10096 Oklahoma House of Repr esentatives, President Pro Tempore of the
10197 Oklahoma State Senate, the chief executive officer of a governmenta l
10298 entity or pursuant to a joint or concurrent resolution of the
10399 Legislature. A copy of the examination shal l be given to the
104100 examined entity. A c opy of any examination conducted pursuant to
105101 this subsection shall be submitted to the Governor, the Speaker of
106102 the House of Representatives, the President Pro Tempore of the
107103 Senate, the appropriations and budget chai rs of the House of
108104 Representatives and the Senate, and the Minority Leader of the House
109105 of Representatives and of the Senate.
110106 C. The cost of the e xaminations authorized pursuant to
111107 subsection B of this section shall be borne by the examined agency
112108 in an amount not to exceed the actual costs of the examination.
113109 Prior to the start of such an examination, the State Auditor and
114110 Inspector shall prepare in writing and present to the affected state
115111 agency an estimate of the cost of the examination. If the estim ate
116112 requires revision, the State Audito r and Inspector shall notify the
113+agency in a prompt manner. Except as otherwise provided, the State

144-agency in a prompt manner. Except as otherwise provided, the State
145140 Auditor and Inspector shall recover its costs for the examination
146141 pursuant to monthly progress billings presented by the State Auditor
147142 and Inspector to the Office of Management and Enterprise Services
148143 detailing current monthly costs for each examination. In addi tion,
149144 the State Auditor and Inspector shall provide a copy of the billing
150145 to the affected state agency. The Office of Management and
151146 Enterprise Services may deduct the amounts billed from the next
152147 subsequent allotment for the corresponding state agency an d transfer
153148 the funds to the State Auditor and Inspector Revolving Fund.
154149 D. The salaries and traveling expens es of the Assistant State
155150 Auditor and Inspector, deputies and agents of the Performance Audit
156151 Division and the costs of material, supplies and equ ipment for the
157152 Division shall be paid from funds made available through
158153 appropriation by the Legislature.
159154 E. The State Auditor and Inspector shall s ubmit an annual
160155 report of the Performance Audit Division to the Governor, the
161156 President Pro Tempore of the Senate, the Speaker of the House of
162157 Representatives, appropriations and budget chairs of the House of
163158 Representatives and the Senate, and the Minorit y Leader of the
164159 Senate and of the House of Representatives.
165160 SECTION 2. This act shall become effective July 1, 2023.
166161 SECTION 3. It being immediately necessary for the preservation
167162 of the public peace, health or safety, an emergency is hereby
