47	56		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
48	57		SECTION 1. AMENDATORY 56 O.S. 2021, Section 604, is
49	58		amended to read as follows:
50	59		Section 604. The Director of the Department of Human Services
51	60		shall, within the constraints of funding app ropriated to the
52	61		Department, maintain a Family Su pport Program for children with
53	62		severe developmental dis abilities who reside in their family homes
54	63		in accordance with the following criteria:
55	64		1. The family membe r resides with the family;
56		-	2. The family resides in the State of Oklahoma;
57		-	3. The gross adjusted income of the family for the year
58		-	immediately preceding the date of application for the assistance did

	92	+	2. The family resides in the State of Oklahoma;
	93	+	3. The gross adjusted income of the family for the year
	94	+	immediately preceding the date of application for the assistance did
85	95		not exceed Forty-five Thousand Dollars ($45,000.00) by seventy-five
86	96		percent (75%) of the amount as allowed by Public Law No. 104-193;
87	97		4. The family is headed by a biological parent, adoptive
88	98		parent, or legal guardian of the eligible family member; pr ovided,
89	99		however, that if the eligi ble family member lives w ith an adoptive
90	100		parent or parents who already re ceive adoption subsidy from any
91	101		source on behalf of the applicant, the family cannot receive family
92	102		support assistance authorized by this section; an d
93	103		5. The family or family member does not receive Medicaid Home
94	104		and Community-based Waiver Services.
95	105		SECTION 2. AMENDATORY 56 O.S. 2021, Section 606, is
96	106		amended to read as follows:
97	107		Section 606. If an application for family suppo rt assistance
98	108		pursuant to the Oklahoma Family Support Act i s approved by the
99	109		Department of Human Services and Developmental Disabilities Services
100	110		Division:
101	111		1. A family support assistance payment shall be paid to the
102	112		parent or legal guardian on behalf of a family member and shall be
103	113		considered a benefit to the fam ily member;
104	114		2. The family support assistance payment shall be used to meet
105	115		the special needs of the family associated with the family member.
106		-	Except as otherwise provided in the Oklahoma Family S upport Act,
107		-	this assistance payment is intended to compleme nt, not to supplant,

466	482		payment amount in paragraph 3 for a flat monthly payment of Four
467	483		Hundred Dollars ($400.00) .
468	484		5. Increases to this amount shall be determined annually by
469	485		legislative appropriation. In addition, the pare nt or legal
470	486		guardian of a family member who is in an out-of-home placement at
471	487		the time of applicatio n may receive a one-time, lump-sum advance
472	488		payment of twice the monthly family support assistance amount for
473	489		the purpose of meeting the special needs of the family to prepare
474	490		for the placement or return of the family member to in-home care.
475	491		4. 6. The parent or legal guardian who receives a family
476	492		support assistance payment shall report, in writing, at least the
477	493		following information to the Department:
478	494		a. not less than annually, a statement and any supporting
479	495		documentation requested by the Department that t he
480	496		family support assistance payment was used to meet the
481	497		special needs of the family,
482	498		b. immediately, if the parent or legal guardian requests
483	499		termination of the family support assistance,
484	500		c. immediately, upon the occurrence of any event listed
485	501		in Section 7 607 of this act title.
486	502		SECTION 3. This act shall become effective November 1, 2024.
