4555 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4656 SECTION 1. AMENDATORY 22 O.S. 2021, Section 1261, is
4757 amended to read as follows:
4858 Section 1261. In all cases where wines, whiskey, beer or other
4959 intoxicating liquors mentioned in the Constitution or laws of this
5060 state or any personal property used for the purpose of violating any
5161 of the prohibitory liquor laws or gambling laws of this state, shall
5262 be seized by any officer or person with or without a search warrant,
5363 such officer or person is hereby required within five (5) days to
5464 make a written report under oath and file the same with the court
5565 clerk of the proper or respective county where the same shall be so
56-seized, which report shall in detail state the name of the officer
57-or person making the seizure, the place whe re seized and an
58-inventory of the property, articles or intoxicating liquors so t aken

93+seized, which report shall in detail state the name of the officer
94+or person making the seizure, the place whe re seized and an
95+inventory of the property, articles or intoxicating liquors so t aken
8596 into possession, and within said five (5) days s aid person is hereby
8697 required to deliver the same to the sheriff of the county Alcoholic
8798 Beverage Law Enforcement (ABLE) Commission and take the sheriff's
8899 ABLE's receipt therefor, in duplicate and such sheriff ABLE shall
89100 retain the same and all thereof, un til the same shall be destroyed
90101 pursuant to the orders of the court. In computing the time, five
91102 (5) days, Sundays and ho lidays shall be excluded and not counted. A
92103 duplicate copy of said receipt shall i mmediately be filed with said
93104 court clerk, who shal l keep a record of same, provided the sheriff
94105 and his deputies ABLE shall be required to make the affidavit and
95106 issue the receipt and otherwise comply with the provisions of this
96-act. Provided, that all li quors so seized shall be preserved for
97-use as evidence in the trial of any action growing out of such
98-seizure and all officers seizing any such liquors are hereby
99-required to mark the bottles or containers for identification by
100-writing thereon the date of the seizure and the name of the person
101-from whom seized. The sheriff ABLE shall be liable on his its bond
102-for the safe keeping of all such property so turned over to him it
103-under the provisions of this act.

144+Section 1-107. A. The ABLE Commission shall have the following
145+powers and duties:
134146 1. To supervise, inspect and regulate every phase of the
135147 business of manufacturing, importing, exporting, transporting,
136148 storing, selling, distributing and possessing for the purpose of
137149 sale, all alcoholic beverages which shall be necessary and proper to
138150 carry out the purposes of the Oklahoma Alcoholic Beverage Control
139151 Act;
140152 2. To promulgate rules, in the manner herein provided , to carry
141153 out the purposes of the Oklahoma Alcoholic Beverage Control Act;
142154 3. To have the sole authority to issue any license provided for
143155 in the Oklahoma Alco holic Beverage Control Act and except as
144156 provided in Sections 101 4-104 and 102 4-105 of this act title with
145157 respect to cities, towns and counties, and except as may be provided
146158 under Title 68 of the Oklahoma Statutes with respect to the Oklahoma
147159 Tax Commission, no other agency, instrumentality or political
148160 subdivision of this state shall be authoriz ed to issue any license
149161 or permit allowing any licensee to enga ge in any activity covered by
150162 the Oklahoma Alcoholic Beverage Control Act anywhere within the
151163 State of Oklahoma;
152164 4. To refuse to issue any license provided for in the Oklahoma
153165 Alcoholic Beverage Control Act for cause provided for in the
154166 Oklahoma Alcoholic Beverage Control Act;
155-5. To revoke or suspend, for cause after hearing, any license
156-issued under the authority of the Oklahoma Alcoholic Beverage
157-Control Act;

194+5. To revoke or suspend, for cause after hearing, any license
195+issued under the authority of the Oklahoma Alcoholic Beverage
196+Control Act;
184197 6. To prescribe the forms of al l reports which it deems
185198 necessary in administering the Oklahom a Alcoholic Beverage Control

187200 7. To fix standards not in conflict with those prescribed by
188201 any law of this state or of the United States, to secure the use of
189202 proper ingredients and method s of manufacture and dispensing of
190203 alcoholic beverages;
191204 8. To make seizures of alcoholic beverages manufactured, sold,
192205 possessed, imported or transported in vi olation of the Oklahoma
193206 Alcoholic Beverage Control Act, and apply for the confiscation
194207 thereof whenever required by the Oklahoma Alcoholic Beverage Control
195208 Act, and cooperate in the prosecution of offenders before any court
196209 of competent jurisdiction;
197210 9. To submit to the Governor and members of the State
198211 Legislature annual or semiannual reports upon request of the
199212 Governor;
200213 10. To inspect or cause to be inspect ed any premises where
201214 alcoholic beverages are manufactured, stored, distributed, sold,
202215 dispensed or served;
203216 11. In the conduct of any hearing authorized to be held by the
204217 ABLE Commission:
205-a. to examine or cause to be examined, under oath, any

245+a. to examine or cause to be examined, under oath, any

233247 b. to examine or cause to be examined books and records
234248 of any licensee,
235249 c. to hear testimony and tak e proof material for the ABLE
236250 Commission's information and the discharge of its
237251 duties hereunder,
238252 d. to administer or cause to be administered oaths, and
239253 e. to issue subpoenas for the attendance of witnesses and
240254 the production of books or records which sha ll be
241255 effective in any part of the state. Any district
242256 court or any judge thereof, either in te rm or
243257 vacation, may by order duly entered require the
244258 attendance of witnesses and the production of relevant
245259 books or records subpoenaed by the ABLE Commission,
246260 and the court or judge may compel obedience to the
247261 order by proceedings for contempt;
248262 12. To prescribe the kind and size of retail containers of
249263 alcoholic beverages which may be purchased, possessed and sold by a
250264 licensee;
251265 13. To prescribe by rule, in a ddition to those herein required,
252266 the kinds of records to be kept and reports to be rendered by
253267 licensees, and the information to be shown therein; provided, t hat
254-the period for which all such records and reports be retained shall
255-not be less than five ( 5) years;

295+the period for which all such records and reports be retained shall
296+not be less than five (5) years;
282297 14. To gather, compile and print such statistical data as may
283298 in the opinion of the ABL E Commission be needed or useful, and
284299 prescribe charges or fees to be collected from any person or company
285300 to whom such data shall be provided. No reports shal l contain sales
286301 information by name or license number;
287302 15. To educate persons employed by licen sees to sell or serve
288303 alcoholic beverages as to the provisions of Article XXVIIIA of the
289304 Oklahoma Constitution and the Oklahoma Alcoholic Beverage Control
290305 Act, with emphasis on recognizing and preventing intoxication and
291306 particular emphasis on those provis ions prohibiting the selling or
292307 serving of alcoholic beverages to minors. The ABLE Commission may
293308 contract with one or more entities, including but not limited to the
294309 Oklahoma Department of Mental Health and Substance Abuse Services,
295310 to perform the duties specified in this paragraph;
296311 16. To purchase motor vehicles n ecessary for use in its
297312 operations. Such motor vehicles shall not be required to have any
298313 type of identifying marking thereon;
299314 17. To purchase insurance on the motor vehicles owned and
300315 operated by the ABLE Commission in accordance with statutory
301316 provisions, subject to the approval of the Risk Management
302317 Administrator as provided for in Section 85.58 A of Title 74 of the
303318 Oklahoma Statutes;
304-18. To approve or reject any official bond required to be filed
305-with the ABLE Commission; and

346+18. To approve or reject any official bond required to be filed
347+with the ABLE Commission; and
332348 19. To exercise all oth er powers and duties conferred by the
333349 Oklahoma Alcoholic Beverage Control Act, and all powers inc idental,
334350 convenient or necessary to enable it to administer or carry out any
335351 of the provisions of the Oklahoma Alcoholic Beverage Control Act.;
336352 and
337353 20. To store seized alcoholic beverages pursuant to Section
338354 1261 of Title 22 of the Oklahoma Statutes .
339355 B. The ABLE Commission shall promulgate rules, pursuant to the
340356 Administrative Procedures Act, to ca rry out the purposes of the
341357 Oklahoma Alcoholic Beverage Control Act.
342358 SECTION 3. This act shall become effective November 1, 2023.
