	49	+	ABLE Commission; requiring the ABLE Commission to
	50	+	store seized alcoholic beverages ; and providing an

45	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
46	56		SECTION 1. AMENDATORY 22 O.S. 2021, Section 1261, is
47	57		amended to read as follows:
48	58		Section 1261. In all cases where wines, whiskey, beer or other
49	59		intoxicating liquors mentioned in the Constitution or laws of this
50	60		state or any personal property used for the purpose of violating any
51	61		of the prohibitory liquor laws or gambling laws of this state, shall
52	62		be seized by any officer or person with or without a search warrant,
53	63		such officer or person is hereby required within five (5) days to
54	64		make a written report under oath and file the same with the court
55	65		clerk of the proper or respective county where the same shall be so
56		-	seized, which report shall in detail state the name of the officer
57		-	or person making the seizure, the place whe re seized and an
58		-	inventory of the property, articles or intoxicating liquors so t aken

	93	+	seized, which report shall in detail state the name of the officer
	94	+	or person making the seizure, the place whe re seized and an
	95	+	inventory of the property, articles or intoxicating liquors so t aken
85	96		into possession, and within said five (5) days s aid person is hereby
86	97		required to deliver the same to the sheriff of the county Alcoholic
87	98		Beverage Law Enforcement (ABLE) Commission and take the sheriff's
88	99		ABLE's receipt therefor, in duplicate and such sheriff ABLE shall
89	100		retain the same and all thereof, un til the same shall be destroyed
90	101		pursuant to the orders of the court. In computing the time, five
91	102		(5) days, Sundays and ho lidays shall be excluded and not counted. A
92	103		duplicate copy of said receipt shall i mmediately be filed with said
93	104		court clerk, who shal l keep a record of same, provided the sheriff
94	105		and his deputies ABLE shall be required to make the affidavit and
95	106		issue the receipt and otherwise comply with the provisions of this
96		-	act. Provided, that all li quors so seized shall be preserved for
97		-	~~use~~ as evidence in the trial of any action growing out of such
98		-	~~seizure~~ and all officers seizing any such liquors are hereby
99		-	~~required to~~ mark the bottles or containers for identification by
100		-	~~writing thereon~~ the date of the seizure and the name of the person
101		-	~~from whom seized.~~ The sheriff ABLE shall be liable on his its bond
102		-	~~for the safe~~ keeping of all such property so turned over to him it
103		-	~~under the~~ provisions of this act.

104	115		SECTION 2. AMENDATORY 37A O.S. 2021 , Section 1-107, is

106		-	Section 1-107. A. The ABLE Commission shall have the following

	144	+	Section 1-107. A. The ABLE Commission shall have the following
	145	+	powers and duties:
134	146		1. To supervise, inspect and regulate every phase of the
135	147		business of manufacturing, importing, exporting, transporting,
136	148		storing, selling, distributing and possessing for the purpose of
137	149		sale, all alcoholic beverages which shall be necessary and proper to
138	150		carry out the purposes of the Oklahoma Alcoholic Beverage Control
139	151		Act;
140	152		2. To promulgate rules, in the manner herein provided , to carry
141	153		out the purposes of the Oklahoma Alcoholic Beverage Control Act;
142	154		3. To have the sole authority to issue any license provided for
143	155		in the Oklahoma Alco holic Beverage Control Act and except as
144	156		provided in Sections 101 4-104 and 102 4-105 of this act title with
145	157		respect to cities, towns and counties, and except as may be provided
146	158		under Title 68 of the Oklahoma Statutes with respect to the Oklahoma
147	159		Tax Commission, no other agency, instrumentality or political
148	160		subdivision of this state shall be authoriz ed to issue any license
149	161		or permit allowing any licensee to enga ge in any activity covered by
150	162		the Oklahoma Alcoholic Beverage Control Act anywhere within the
151	163		State of Oklahoma;
152	164		4. To refuse to issue any license provided for in the Oklahoma
153	165		Alcoholic Beverage Control Act for cause provided for in the
154	166		Oklahoma Alcoholic Beverage Control Act;
155		-	5. To revoke or suspend, for cause after hearing, any license
156		-	issued under the authority of the Oklahoma Alcoholic Beverage
157		-	Control Act;

	194	+	5. To revoke or suspend, for cause after hearing, any license
	195	+	issued under the authority of the Oklahoma Alcoholic Beverage
	196	+	Control Act;
184	197		6. To prescribe the forms of al l reports which it deems
185	198		necessary in administering the Oklahom a Alcoholic Beverage Control
186	199		Act;
187	200		7. To fix standards not in conflict with those prescribed by
188	201		any law of this state or of the United States, to secure the use of
189	202		proper ingredients and method s of manufacture and dispensing of
190	203		alcoholic beverages;
191	204		8. To make seizures of alcoholic beverages manufactured, sold,
192	205		possessed, imported or transported in vi olation of the Oklahoma
193	206		Alcoholic Beverage Control Act, and apply for the confiscation
194	207		thereof whenever required by the Oklahoma Alcoholic Beverage Control
195	208		Act, and cooperate in the prosecution of offenders before any court
196	209		of competent jurisdiction;
197	210		9. To submit to the Governor and members of the State
198	211		Legislature annual or semiannual reports upon request of the
199	212		Governor;
200	213		10. To inspect or cause to be inspect ed any premises where
201	214		alcoholic beverages are manufactured, stored, distributed, sold,
202	215		dispensed or served;
203	216		11. In the conduct of any hearing authorized to be held by the
204	217		ABLE Commission:

	245	+	a. to examine or cause to be examined, under oath, any
	246	+	person,
233	247		b. to examine or cause to be examined books and records
234	248		of any licensee,
235	249		c. to hear testimony and tak e proof material for the ABLE
236	250		Commission's information and the discharge of its
237	251		duties hereunder,
238	252		d. to administer or cause to be administered oaths, and
239	253		e. to issue subpoenas for the attendance of witnesses and
240	254		the production of books or records which sha ll be
241	255		effective in any part of the state. Any district
242	256		court or any judge thereof, either in te rm or
243	257		vacation, may by order duly entered require the
244	258		attendance of witnesses and the production of relevant
245	259		books or records subpoenaed by the ABLE Commission,
246	260		and the court or judge may compel obedience to the
247	261		order by proceedings for contempt;
248	262		12. To prescribe the kind and size of retail containers of
249	263		alcoholic beverages which may be purchased, possessed and sold by a
250	264		licensee;
251	265		13. To prescribe by rule, in a ddition to those herein required,
252	266		the kinds of records to be kept and reports to be rendered by
253	267		licensees, and the information to be shown therein; provided, t hat
254		-	the period for which all such records and reports be retained shall
255		-	not be less than five ( 5) years;

	295	+	the period for which all such records and reports be retained shall
	296	+	not be less than five (5) years;
282	297		14. To gather, compile and print such statistical data as may
283	298		in the opinion of the ABL E Commission be needed or useful, and
284	299		prescribe charges or fees to be collected from any person or company
285	300		to whom such data shall be provided. No reports shal l contain sales
286	301		information by name or license number;
287	302		15. To educate persons employed by licen sees to sell or serve
288	303		alcoholic beverages as to the provisions of Article XXVIIIA of the
289	304		Oklahoma Constitution and the Oklahoma Alcoholic Beverage Control
290	305		Act, with emphasis on recognizing and preventing intoxication and
291	306		particular emphasis on those provis ions prohibiting the selling or
292	307		serving of alcoholic beverages to minors. The ABLE Commission may
293	308		contract with one or more entities, including but not limited to the
294	309		Oklahoma Department of Mental Health and Substance Abuse Services,
295	310		to perform the duties specified in this paragraph;
296	311		16. To purchase motor vehicles n ecessary for use in its
297	312		operations. Such motor vehicles shall not be required to have any
298	313		type of identifying marking thereon;
299	314		17. To purchase insurance on the motor vehicles owned and
300	315		operated by the ABLE Commission in accordance with statutory
301	316		provisions, subject to the approval of the Risk Management
302	317		Administrator as provided for in Section 85.58 A of Title 74 of the
303	318		Oklahoma Statutes;
304		-	18. To approve or reject any official bond required to be filed
305		-	with the ABLE Commission; and

	347	+	with the ABLE Commission; and
332	348		19. To exercise all oth er powers and duties conferred by the
333	349		Oklahoma Alcoholic Beverage Control Act, and all powers inc idental,
334	350		convenient or necessary to enable it to administer or carry out any
335	351		of the provisions of the Oklahoma Alcoholic Beverage Control Act.;

337	353		20. To store seized alcoholic beverages pursuant to Section
338	354		1261 of Title 22 of the Oklahoma Statutes .
339	355		B. The ABLE Commission shall promulgate rules, pursuant to the
340	356		Administrative Procedures Act, to ca rry out the purposes of the
341	357		Oklahoma Alcoholic Beverage Control Act.
342	358		SECTION 3. This act shall become effective November 1, 2023.
