4040 An Act relating to state government employees;

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 74 O.S. 2021, Section 4190, is
5454 amended to read as follows:
5555 Section 4190. A. The Director of the Office of Management an d
5656 Enterprise Services is authorized to approve and administer child
5757 care centers for minor dependents of state employees, and may
5858 provide consultation to state agencies regarding child care centers.
5959 B. The Office of Management and Enterprise Services, the
6060 Department of Human Services, and the Oklahoma State Department of
6161 Health are directed to assist the Director of the Office o f
6262 Management and Enterprise Services in the implement ation of Sections
6363 4190 through 4192 of this title.

9090 C. The Director is author ized to promulgate any rules necessary
9191 for the establishment and implementation of Sections 4190 through
9292 4192 of this title.
9393 D. Individuals employed by the State of Oklahoma who have minor
9494 dependents shall be eligible for the Child Care Subsidy Program
9595 administered by the Department of Human Services.
9696 E. Licensed spaces in the child care centers shall be open to
9797 all eligible children, including those individuals not employed by
9898 the State of Oklahoma and those financially eligible for Department
9999 of Human Services child care assistance. However, minor de pendents
100100 of state employees shall be given highest priority and children
101101 financially eligible for Department of Human Services chi ld care
102102 assistance second priority for all vacant spaces.
103103 E F. The Director shall approve rates for child care consistent
104104 with the rates of the industry within the geographic area.
105105 SECTION 2. This act shall become effective November 1, 2023.
