139127 BE IT ENACTED BY THE PE OPLE OF THE STATE OF O KLAHOMA:
140128 SECTION 1. There is hereby appropriated to the State Board of
141129 Education from any monies not otherwise appropriated from the
142130 General Revenue Fund of the State Treasury for the fis cal year
143-ENGR. S. A. TO ENGR. H. B. NO. 2775 Page 3 1
131+beginning July 1, 2023, the sum of Five Hundred Million Dollars
132+($500,000,000.00) for the financial support of public schools .
133+These monies shall be used to implement the provisions of Section 2
134+of this act and to provide student supports. Monies appropriated
135+pursuant to this section shall not be used to provide a bonus or
136+salary increase to an administrator, as defined by Section 6 -101.3
137+of Title 70 of the Oklahoma Statutes.

178168 A. Beginning with the 2023-2024 school year, certified
179169 personnel, as defined in Sect ion 26-103 of Title 70 of the Oklahoma
180170 Statutes, in the public schools of Oklahoma shall receive in salary

317-B. 1. When determining the Minimum Salary Schedule, “fringe

322318 Statutes from the flexible benefit allowan ce funds disbursed by the
323319 State Board of Education and the State Board of Career and
324320 Technology Education pursuant to Section 26-104 of Title 70 of the
325321 Oklahoma Statutes.
326322 2. If a school district intends to provide retirement benefits
327323 to a teacher such tha t the teacher’s salary would be less than the
328324 amounts set forth in the minimum salary sc hedule specified in
329325 subsection A of this section, the district shall be required to
330326 provide written notification to the teacher prior to his or her
331327 employment or, if al ready employed by the district, no later than
332328 thirty (30) days prior to the date the dis trict elects to provide
333329 retirement benefits such that the teacher’s salary would be less
334330 than the minimum salary schedule.
335331 C. Any of the degrees referred to in this se ction shall be from
336332 a college recognized by the State Board of Education. The Board
337333 shall accept teaching experience from out-of-state school districts
338334 that are accredited by the State Board of Education or appropriate

335+state accrediting agency for the dis tricts. The Board shall accept
336+teaching experience from out-of-country schools that are accredited
337+or otherwise endorsed by the appropriate national or regional
338+accrediting or endorsement authority. Out -of-country certification

364-state accrediting agency for the dis tricts. The Board shall accept
365-teaching experience from out-of-country schools that are accredited
366-or otherwise endorsed by the appropriate national or regional
367-accrediting or endorsement authority. Out -of-country certification
368-documentation in a languag e other than English shall be analyzed by
369-an educational credential evaluation service i n accordance with
370-industry standards and guidelines and approved by the State
371369 Department of Education. The person seeking to have credit granted
372370 for out-of-country teaching experience shall be responsible for all
373371 costs of the analysis by a credential eval uation service. The Board
374372 shall accept teaching experience from primary and secondary schools
375373 that are operated by the United States Department of Defense or are
376374 affiliated with the United States Department of State.
377375 D. For the purpose of state salary in crements and retirement,
378376 no teacher shall be granted credit for more than five (5) years of
379377 active duty in the military service or out -of-state or out-of-
380378 country teaching experience as a certified teacher or its
381379 equivalent. Nothing in this section shall p rohibit boards of
382380 education from crediting more years of experience on district salary
383381 schedules than those allowed for state purposes.
384382 E. The State Board of Education shall recognize, for purposes
385383 of certification and salary increments, all the years of experience
386384 of a:

385+1. Certified teacher who teaches in the educational program of
386+the Department of Corrections, beginning with fiscal year 1981;
387+2. Vocational rehabili tation counselor under the Department of

412-1. Certified teacher who teaches in the educational program of
413-the Department of Corrections, beginning with fiscal year 1981;
414-2. Vocational rehabili tation counselor under the Department of
415-Human Services if the counselor was employed as a certified teacher
416-by the State Department of Education when the Division of Vocational
417-Rehabilitation was transferred from the State Board of Career and
418-Technology Education or the State Board of Education to the Oklahoma
419-Public Welfare Commission on Ju ly 1, 1968;
420420 3. Vocational rehabilitation counselor which were completed
421421 while employed by the Department of Human Services if such counselor
422422 was certified as a teacher or was eligible for certification as a
423423 teacher in Oklahoma;
424424 4. Certified teacher which were completed while employed by the
425425 Child Study Center located at University Hospital, if the teacher
426426 was certified as a teacher in Oklahoma; and
427427 5. Certified school psychologist or psychometrist which were
428428 completed while employed as a doctoral intern, psychological
429429 assistant, or psychologist with any agency of the State of Oklahoma
430430 if the experience primarily involved work with persons of school - or
431431 preschool-age and if the person was, at the time the experience was
432432 acquired, certified as, or eligible for certification as, a school
433433 psychologist or psychometrist.

434+F. The provisions of this section shall not apply to teachers
435+who have entered into postretirement employ ment with a public school
436+in Oklahoma and are still receiving a monthly retirement benef it.
437+G. If a person employed a s certified personnel, as defined in
438+Section 26-103 of Title 70 of the Oklahoma Statutes, by a school
439+district during the 2022 -2023 school year was receiving a salary
440+above the step level indicated by the State Minimum Salary Schedule
441+for the 2022-2023 school year, the person shall receive a salary
442+increase amount equal to the amount indicated in subsection A for
443+the step level indicated for the person, provided they remain
444+

462-G. If a person employed a s certified personnel, as defined in

465-above the step level indicated by the State Minimum Salary Schedule
466-for the 2022-2023 school year, the person shall receive a salary
467-increase amount equal to the amount indicated in subsection A for
468-the step level indicated for the person, provided they remain
469471 employed by the same district, unless the hours or the duties of the
470472 certified personnel are reduced proportionately.
471-H. Persons employed as classroom instructional employees of
472-technology center school districts supervised by the State Board of
473-Career and Technology Education shall receive a salary increase
474-amount equal to the amount indicated in subsection A of this section
475-for the step level indicated for the person, provided they remain
476-employed by the same technology center school district, unless the
477-hours or the duties of the classroom instructional employees are
478-reduced proportionately.
479-I. Persons employed as correctional teachers or vocational
480-instructors by the Department of Corrections pursuant to Section
481-510.6a of Title 57 of the Oklahoma Statutes or persons employed as
482-teachers by the Office of Juvenile Affairs shall receive a salary

475+Excellent Educators Revolving Fund created in Section 4 of this act
476+from any monies not otherwise appropriated from the General Revenue
477+Fund of the State Treasury for the fiscal year ending June 30, 2024,
478+the sum of Thirty Million Dollars ( $30,000,000.00).
479+SECTION 4. NEW LAW A new section of law to be codified
480+in the Oklahoma Statutes as Section 18 -126 of Title 70, unless there
481+is created a duplication in numbering, reads as follows:
482+There is hereby created in the State Treasury a revolving fund
483+for the State Board of Education to be designated the “Rewarding
484+Excellent Educators Revolving Fund ”. The fund shall be a continuing
485+fund, not subject to fiscal year limitations, and shall consist of
486+all monies received by the State Board of Education from state
487+appropriations. All monies accruing to the credit of the fund are
488+hereby appropriated and may be budgeted and expended by the State
489+Board of Education for the purpose of implementing the provisions of
490+Section 5 of this act. Expenditures from the fund shall be ma de
491+upon warrants issued by the State Treasurer against claims filed as
492+prescribed by law with the Director of the Office of Management and
493+Enterprise Services for approval and payment.

524+A. For the purposes of this act:
525+1. “Eligible teacher” means a certified person employed on a
526+full-time basis by a school district to serve as a teacher,
527+supervisor, counselor, librarian, or certified or registered nurse;
528+and
529+2. “Eligible support employee ” means a full-time employee of a
530+school district as determined by the standard period of labor which
531+is customarily understood to constitute full-time employment for the
532+type of services performed by the employee who is employed a minimum
533+of one hundred seventy -two (172) days and who provides those
534+services, not performed by professional educators or certified
535+teachers, which are necessary for the efficient and satisfactory
536+functioning of a school district and shall not include adult
537+education instructors or adult coordinators employed by technology
538+center school districts.

1185+because of a change in Fou ndation and/or Salary Incentive Aid
1186+factors during the last two (2) months of the preceding fiscal year
1187+shall be exempt from the penalties assessed in this subsection, if
1188+the penalty would occur sol ely as a result of receiving funds from
1189+the increase in State Aid.
1190+5. If a school district does not rece ive Foundation and/or
1191+Salary Incentive Aid during the preceding fiscal year, the State
1192+Board of Education may waive the penalty assessed in this subsec tion
1193+if the penalty would result in a loss of more than fo rty percent
1194+(40%) of the remaining State Aid to be allocated to the school
1195+district between April 1 and the remainder of the school year and if
1196+the Board determines the penalty will cause the school district not
1197+to meet remaining financial obligations.
1198+6. Any school district which receives gross produ ction revenue
1199+apportionment during the 2002-2003 school year or in any subsequent
1200+school year that is greater than the gross production revenue
1201+apportionment of the preceding school year shall be exempt from t he
1202+penalty assessed in this subsection, if the penalty would occur
1203+solely as a result of the gross production revenue apportionment, as
1204+determined by the State Board of Education.

1241+county pursuant to Section 1370 of Ti tle 68 of the Oklahoma Statutes
1242+during the 2003-2004 school year or the 2004 -2005 school year shall
1243+be exempt from the penalties assessed in this subsection, if the
11941244 penalty would occur solely as a result of receiving funds from the
1195-tax settlement.
1196-4. Any school district which re ceives an increase in State Aid

1289+funding shall not exceed the per pupil amount of State Aid as
1290+calculated in subsection D of this section per anticipated He ad

1292+be proportionately reduced from the monthly payments of the
1293+district’s State Aid payments during the last six (6) months of the
1294+same fiscal year.

1345+shall be reported by school district on forms developed by the S tate
1346+Department of Education.
1347+SECTION 7. AMENDATORY 70 O.S. 2021, Section 18-201.1, is

1336-2. Beginning July 1, 1997, the State Auditor and Inspector ’s
1337-Office, notwithstanding any provision of law to the contrary, shall
1338-report monthly to the State Department of Education the mo nthly
1339-apportionment of the pro ceeds of the county levy.
1340-3. Beginning July 1, 1996, the Commissioners of the Land
1341-Office, notwithstanding any provision of law to the contrary, shall
1342-report monthly to the State Department of Education the monthly
1343-apportionment of state apportionment.
1344-4. Beginning July 1, 1997, the county treasurers’ offices,
1345-notwithstanding any provision of law to the c ontrary, shall report
1346-monthly to the State Department of Education the ad va lorem tax
1347-protest amounts for each county.
1348-5. The information reported by th e Tax Commission, the State
1349-Auditor and Inspector’s Office, the county treasurers ’ offices, and
1350-the Commissioners of the Land Office, pursuant to this subsection
1351-shall be reported by school district on forms developed by the S tate
1352-Department of Education.
1353-SECTION 7. AMENDATORY 70 O.S. 2021, Section 18-201.1, is
1354-amended to read as f ollows:

1599+membership is less than 529 pupils. School districts which

1601+the Oklahoma School Voluntary Consolidation and Annexation

1742-Board deems necessary allow additional square miles to be used for
1743-the purposes of calculati ons used for the weighted district sparsity
1744-- isolation formula. Provided, that the additional square miles
1745-allowed for geographical barriers shall n ot exceed thirty percen t
1746-(30%) of the district ’s actual size.
1747-c. State Aid funds which a district is calcu lated to
1748-receive as a result of the weighted district
1749-calculation shall be restricted as follows:

19331951 SECTION 8. The provisions of this act shall not become
19341952 effective as law unless Enrolled House Bill No. 1935 of the 1st
19351953 Session of the 59th Oklahoma Legi slature becomes effective as law .
19361954 SECTION 9. This act shall become effective July 1, 2023.
19371955 SECTION 10. It being immediately necessary for the preservation
1938-of the public peace, health or safety, an emergency is hereby

2089-shall receive a salary increase in the amo unt of Two Thousand Five
2090-Hundred Dollars ($2,500.00) greater than his or her salary for the
2091-2022-2023 school year, provided the person remains employed by the
2092-same district and the hours or duties of the person are n ot reduced.
2093-SECTION 12. There is hereby appropriated to the Oklahoma
2094-Student Fund of the State Treasury created in Enrolled House Bill
2095-No. 1935 enacted by the 1st Session of the 59th Oklahoma Legislature
2096-from any monies not otherwise appropriated from the General Revenue

2131-Fund of the State Treasury for the fiscal year ending June 30, 2024,
2132-the sum of Three Hundred Million Dollars ($300,000,000.00) to be
2133-distributed to public school districts in t he state based on the
2134-weighted average daily membership of the preceding school year for
2135-the school district to be utilized as provided in this section, but
2136-in no event shall any district receive more than Two Million Dollars
2137-($2,000,000.00). The appropriated moni es may only be used for the

2139-1. Teacher and support staff salaries, not including salaries

2141-2. Programs and facilities related to instruction in science,
2142-technology, engineering, and mathematics;
2143-3. Textbooks, curriculum, or other instructional materials
2144-including, but not limited to, supplemental materials or associated
2145-online instruction applications or materials ;
2146-4. Computer hardware or other technological devices,
2147-educational software, and applications that a re used to meet
2148-curriculum needs and bolster academic outcomes of students;

2180-7. Fees for nationally standardized assessments inclu ding, but
2181-not limited to, assessments used to determine college admissio n and
2182-advanced placement examinations as well as tuition and fees for
2183-tutoring, remediation, or prepara tory courses for the assessments;
2184-8. Summer education programs and specialized a fter-school
2185-education programs; provided, however, that such expense sh all not
2186-include before-school or after-school child care;
2187-9. Student support services, including only health,
2188-psychological, guidance, therapy, and attendance services; and
2189-10. Tuition and fees for concurrent enroll ment at an
2190-institution within The Oklahoma State System of Higher Education
2191-only for amounts that are not paid by the Oklahoma State Regents fo r
2192-Higher Education.
2193-SECTION 14. NEW LAW A new section of la w not to be

2282-increase, in the amount of Two Thousand Five Hu ndred Dollars
2283-($2,500.00) per person for the 2023-2024 school year. If a person
2284-employed as provided in this subsection during the 2022-2023 school
2285-year was receiving a salar y greater than the step level indicated by
2286-the state or local Minimum Salary Sche dule for the 2022-2023 school
2287-year, the person shall receive a salar y increase in the amount of
2288-Two Thousand Five Hundred Dollars ($2,500.0 0) greater than his or
