49	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
50	51		SECTION 1. AMENDATORY 17 O.S. 2021, Section 347, is
51	52		amended to read as follows:
52	53		Section 347. A. No person shall sell or offer for sale motor
53	54		fuel from a motor fuel dispenser supplied by a storage tank into
54	55		which motor fuel that contains a mixture of at least one percent
55	56		(1%) by volume of ethanol or methanol has been delivered within the
56	57		sixty-day period preceding the date of sale or offer of sale unless
57	58		the person prominently displays on the dispenser from which the
58	59		mixture is sold a label that complies with subsection B of this
59	60		section.
60		-	B. 1. A label as required in subsection A of this section

98	97		least one-half (1/2) inch high and one-fourth (1/4)

101	100		d. be displayed in a clear, conspicuous and prominent
102	101		manner, visible to customers using either side of the
103	102		dispenser.
104	103		2. If the motor fuel contains fifteen per cent (15%) ethanol, a
105	104		pump label as required in subsection A of this se ction shall meet
106	105		federal E15 labeling requirements as ruled by the Environmental
107	106		Protection Agency pursuant to 40 CFR Part 1090.1510 as it is written
108	107		on February 1, 2023.
109	108		C. If a motor fuel dispenser is supplied by a storage tank into
110	109		which motor fuel con taining at least ten percent (10%) ethanol by
111		-	volume or at least five percent (5%) me thanol by volume is delivered
112		-	in the sixty-day period preceding the date of the sale or offer of
113		-	sale, the sign as req uired in subsection A of this section shall

	136	+	in the sixty-day period preceding the date of the sale or offer of

141	138		also state the percentage of ethanol or methanol by volume, to the
142	139		nearest whole percent, of the motor fuel having the highes t
143	140		percentage of ethanol or methanol delivered into that storage tank
144	141		during that period.
145	142		D. On request by a motor fuel user , a person selling or
146	143		offering for sale motor fuel from a motor fuel dispenser shall
147	144		reveal:
148	145		1. The percentage of e thanol contained in the motor fuel being
149	146		sold;
150	147		2. The percentage of methanol contained in the mo tor fuel being
151	148		sold; and
152	149		3. If the motor fuel contains met hanol, the types and
153	150		percentages of associated cosolvents contained in the motor fuel
154	151		being sold.
155	152		E. The provisions of this section shall not prohibit the
156	153		posting of any other alcohol or additive information. Other alcohol
157	154		or additive information and an y relevant posting shall be subject to
158	155		regulation by the Corporation Commission.
159	156		F. The Corporation Commission shall promulgate rules as
160	157		necessary to implement the provisions of this section.
161	158		SECTION 2. This act shall become effective November 1, 2023.
