5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. AMENDATORY 70 O.S. 2021, Section 6 -204.2, is
5858 amended to read as follows:
5959 Section 6-204.2 A. The Oklahoma Commission for Teacher
6060 Preparation Educational Quality and Accoun tability and the State
6161 Board of Education are authori zed to establish the Educati on
6262 Leadership Oklahoma program.
6363 B. The purposes of the Education Leadership O klahoma program

9191 1. Provide teachers throughout the state information about
9292 National Board certification and the Education Leadership Oklahoma
9393 program services;
9494 2. Provide technical assistance and National -Board-certified
9595 mentors to all teachers s eeking National Board certification upon
9696 request;
9797 3. Reward teachers who are seeking National Board certification
9898 by awarding them a portion of the a pplication processing charge and
9999 assessment fee and a scholarship as provided in subsection D of this
100100 section; and
101101 4. Provide recognition to National -Board-certified teachers.
102102 C. To fulfill the objectives of the Education Leadership
103103 Oklahoma Act, the Oklahoma Commission for Teacher Preparation
104104 Educational Quality and Accoun tability shall:
105105 1. Inform teachers of the Education Leadership Oklahoma pro gram
106106 and services it provides to teachers seeking National Board
107107 certification, emphasizing recruiting effort s toward teachers at
108108 high-poverty schools, schools identified as in need of improvement
109109 and in counties with the lowest percentage of teachers who have
110110 achieved National Board certification; and
111111 2. Ensure that all teachers seeking National Board
112112 certification receive adequate inform ation regarding the level of
113113 commitment required to acquire National Board certification.

140140 D. The Commission shall sele ct not more than one hundred
141141 applicants to participate in the program each fiscal year for whom
142142 the Commission shall pay one-half (1/2) of the application
143143 processing charge and assessment fee for National Board
144144 certification. The total amount paid by the Commission shall not
145145 exceed One Thousand Three Hundred Dollars ($1,300.00) per applicant.
146146 In addition the Commission shall also provide to the selected
147147 applicants a scholarship in the amount of Five Hundred Dollars
148148 ($500.00) to cover other expenses associated with obta ining National
149149 Board certification.
150150 E. The Commission shall promulgate rules establishing a pr ocess
151151 for accepting applications for the Education Leadership Oklahoma
152152 program and for providing to applicants selected for the program up -
153153 front payment of the a pplication processing charge and assessment
154154 fee and scholarship. If a selected applicant who r eceives the up-
155155 front payment does not complete National Board certification within
156156 three (3) years, the applicant shall repay the Commission the full
157157 amount paid by the Commission pursuant to subsection D of this
158158 section. All selected applicants who do no t receive an up-front
159159 payment and successfully complete National Board certification shall
160160 be reimbursed by the Commission for the application processing
161161 charge and assessment fee. The total amount of reimbursement paid
162162 by the Commission shall not exceed One Thousand Three Hundred
163163 Dollars ($1,300.00) per applicant.

190190 F. It is the intent of the Legislature that the Oklahoma
191191 Commission for Teacher Preparation Educational Quality and
192192 Accountability contract with Southe astern Oklahoma State University
193193 to establish Education Leadership Okl ahoma program training in
194194 higher education teacher preparation programs in the state to assist
195195 teachers in meeting the requirements to obtain National Board
196196 certification.
197197 G. All teachers seeking National Board certification sh all be
198198 eligible to participa te in Education Leadership Oklahoma program
199199 training to assist them in meeting the requirements of the National
200200 Board certification process, free of charge.
201201 H. Subject to district board of education policy or collective
202202 bargaining agreement, additional pr ofessional leave days may be
203203 granted to teachers seeking National Board certification for
204204 National Board certification portfolio development. During the two
205205 (2) days of the additional p rofessional days granted to teachers for
206206 National Board certification portfolio development, a substitute
207207 teacher shall be provided by the school district at no cost to the
208208 teacher.
209209 I. 1. The State Board of Education shall provide to teachers
210210 who attained National Board certification prior to Ju ne 30, 2013, a
211211 bonus in the amount of Five Thousand Dollars ($5,000.00) annually
212212 over a ten-year period, to be paid no later than January 31 each
213213 year. The Beginning July 1, 2023, the Board shall provide a bonus

240240 in the amount of Five Thousand Dollars ($5,000.00) annually over a
241241 five-year period, to be paid not later than January 31 each year to
242242 any teacher who:
243243 a. attains National Board certification after June 30,
244244 2013, if the teacher was selected for the Education
245245 Leadership Oklahoma program before June 30, 2013, or
246246 the teacher has submitted an application for National
247247 Board certification to the National Board for
248248 Professional Teaching Standards before June 30, 2013
249249 July 1, 2023,
250250 b. attained National Board cert ification before July 1,
251251 2023, and was receiving a bonus in the amount of Five
252252 Thousand Dollars ($5,000.00) annually, for the
253253 remaining time of the ten-year period, or
254254 c. attained National Board certification before July 1,
255255 2023, and was receiving an additional salary increment
256256 pursuant to the Minimum Salary Schedule in Section 18-
257257 114.14 of this title, for the remaining time of the
258258 ten-year period.
259259 2. The teachers eligible to receive the annual bonus as
260260 provided for in paragraph 1 of this subsection shall receive the
261261 annual bonus for the ten-year five-year duration of their Nat ional
262262 Board certification or for the remaining duration of their National
263263 Board certification if they attained National Board certification

290290 before July 1, 2023, and have less than ten (10) years remaining in
291291 their certification and so long as they are teaching in the
292292 classroom full-time in an Oklahoma public school. No school or
293293 school district shall be liable for payment of bonuses pursuant to
294294 this section.
295295 3. The bonus shall not be included in the calculation of the
296296 teacher's salary for purposes of meeting the district or statutory
297297 minimum salary schedule Minimum Salary Schedule or for purposes of
298298 compensating Oklahoma Teachers ' Retirement System contributions or
299299 benefits.
300300 4. Teachers eligible to receive the annual bonus as p rovided
301301 for in paragraph 1 o f this subsection shall not be eligible to
302302 receive the additional salary increment for National Board
303303 certification as set forth in the minimum salary schedule in Section
304304 3 of this act.
305305 5. Teachers who attain National Board cer tification after June
306306 30, 2013, shall be eligible to receive the additional salary
307307 increments for National Board certification as set forth in the
308308 minimum salary schedule in Section 3 of this act.
309309 6. The State Board of Education shall promulgate rules for a
310310 process by which a Nation al-Board-certified teacher will verify
311311 that:
312312 a. the National Board certification has not lapsed,
313313 b. the teacher is still a full -time teacher, and

340340 c. for teachers eligible for the bonus, the teacher has
341341 not exceeded the limit of annual bonus payments as
342342 provided for in paragraph 1 of this subsection.
343343 J. It is the intent of the Legislature that the Oklahoma State
344344 Regents for Higher Education incorporate the National Board
345345 certification portfolio development into all programs in ed ucation
346346 leading to a master's level degree.
347347 SECTION 2. AMENDATORY 70 O.S. 2021, Section 18 -114.14,
348348 is amended to read as follows:
349349 Section 18-114.14 A. Beginning with the 2018-2019 2023-2024
350350 school year, certified personnel, as d efined in Section 26 -103 of
351351 this title, in the public schools of Oklahoma shall r eceive in
352352 salary and/or fringe benefits not less than the amounts specified in
353353 the following schedule:

491491 B. 1. When determining the Minimum Salary Schedule, "fringe
492492 benefits" shall mean all or part of retirement benefits, exc luding
493493 the contributions made pursuant to subsection A of Section 17 -108.1
494494 of this title and the flexible benefit all owance pursuant to Section
495495 26-105 of this title from the flexible benefit allowan ce funds
496496 disbursed by the State Board of Education and the State Board of
497497 Career and Technology Education pursuant to Section 26 -104 of this
498498 title.
499499 2. If a school district in tends to provide retirement benefits
500500 to a teacher such that the teacher 's salary would be less than the
501501 amounts set forth in the minimum salary schedule Minimum Salary
502502 Schedule specified in subsection A of this section, the district
503503 shall be required to pr ovide written notification t o the teacher
504504 prior to his or her employment or, if a lready employed by the
505505 district, no later than thirty (30) days prior to the date the
506506 district elects to provide retirement benefits such that the
507507 teacher's salary would be le ss than the minimum salary schedule
508508 Minimum Salary Schedule.
509509 C. Any of the degre es referred to in this section shall be from
510510 a college recognized by the State Board of Education. The Bo ard
511511 shall accept teaching experience from out -of-state school distric ts
512512 that are accredited by th e state board of education or appropriate
513513 state accrediting agency for the districts. The Board shall accept

540540 teaching experience from out -of-country schools that are accredited
541541 or otherwise endorsed by the appropriate national or regional
542542 accrediting or endorsement authority. Out -of-country certification
543543 documentation in a language other than English shall be analyzed by
544544 an educational credential evaluation se rvice in accordance with
545545 industry standards and guidelines and approv ed by the State
546546 Department of Education. The person seeking to have credit grant ed
547547 for out-of-country teaching experience shall be responsible for all
548548 costs of the analysis by a credenti al evaluation service. The Board
549549 shall accept teaching experience fr om primary and secondary sch ools
550550 that are operated by the United States Departmen t of Defense or are
551551 affiliated with the United States Department of State.
552552 D. For the purpose of state sa lary increments and retirement,
553553 no teacher shall be granted credit fo r more than five (5) years o f
554554 active duty in the military service or out -of-state or out-of-
555555 country teaching experience as a certified teacher or its
556556 equivalent. Nothing in this section shall prohibit boards of
557557 education from crediting more years of exper ience on district salary
558558 schedules than those allowed for state purposes.
559559 E. The State Board of Education shall recognize, for purposes
560560 of certification and salary increments, all the ye ars of experience
561561 of a:
562562 1. Certified teacher who teaches in the educ ational program of
563563 the Department of Corrections, beginning with fiscal year 1981 ;

590590 2. Vocational rehabilitation counselor under the Department of
591591 Human Services if the counselor was empl oyed as a certified teacher
592592 by the State Department of Education when the Division of Vocational
593593 Rehabilitation was transferred from the State Board o f Career and
594594 Technology Education or the State Board of Education to the Oklahoma
595595 Public Welfare Commissio n on July 1, 1968;
596596 3. Vocational rehabilitation counselor which were completed
597597 while employed by the Department of Human Services if such counselor
598598 was certified as a teacher or was eligible for certification as a
599599 teacher in Oklahoma;
600600 4. Certified teache r which were completed while employed by the
601601 Child Study Center locat ed at University Hospital, i f the teacher
602602 was certified as a teacher in Oklahoma; and
603603 5. Certified school psychologist or psychometrist which were
604604 completed while employed as a doctoral intern, psychological
605605 assistant, or psychologist with any agency of t he State of Oklahoma
606606 if the experience primarily involved work with persons of sc hool- or
607607 preschool-age and if the person was, at the time the experience was
608608 acquired, certified as, or el igible for certification as, a school
609609 psychologist or psychometrist.
610610 F. The provisions of this s ection shall not apply to teachers
611611 who have entered into postretirement employment with a public school
612612 in Oklahoma and are still receiving a monthly retiremen t benefit.

639639 G. If a person employed as certified personnel, as define d in
640640 Section 26-103 of this title, by a school district during the 2017 -
641641 2018 school year was receiving a salary above the step level
642642 indicated by the State state Minimum Salary Schedule for the 2017-
643643 2018 school year, the person shall receive a salary incre ase amount
644644 equal to the amount indicated in subsection A of this section for
645645 the step level indicated for the person, provided they remain
646646 employed by the same district, unless the hours or the duties of the
647647 certified personnel are reduced proportionately.
648648 SECTION 3. This act shall become effective July 1, 2023.
649649 SECTION 4. It being immediately necessary for the preservation
650650 of the public peace, health or safety, an emergency is hereby
651651 declared to exist, by reason whereof th is act shall take effect and
652652 be in full force from and after its passage and approval.
