33	54		BE IT ENACTED BY THE PE OPLE OF THE STATE OF OKLAHOMA:

35	55		SECTION 1. NEW LAW A new section of law to be codified
36	56		in the Oklahoma Statutes as Section 690.10 of Title 63, unless there
37	57		is created a duplication in numbering, re ads as follows:

39	58		A. There is hereby created in the State Treasury a revolving
40	59		fund for the Oklahoma Department of Emergency Management to be
41	60		designated the "State Assistance Dedicated for Disaster-impacted
42	61		Local Economies Revolving Fund". The fund shall be a continuing
43	62		fund, not subject to fiscal year limitations, and shall consist of
44	63		all monies directed for deposit to the fund . All monies accruing to
45	64		the credit of said fun d are hereby appropriated and may be budgeted

46	91		and expended by the Oklahoma Department of Emergency Management for
47	92		the purpose of providing advanced financial liquidity to
48	93		governmental subdivisions directly impacte d by events attributing to

51	94		a Federal Emergency Management Agency (FEMA) declared emergency or
52	95		disaster, provided such governme ntal subdivision has entered into a
53	96		qualifying repayment agreement with the Oklahoma Department of
54	97		Emergency Management. Expenditures from said fun d shall be made
55	98		upon warrants issued by the State Treasurer against claims filed as
56	99		prescribed by law with t he Director of the Office of Managem ent and
57	100		Enterprise Services for approval and payment .

59	101		B. As used in this sect ion:

61	102		1. "Advanced financial liquidity" means funding provided to
62	103		fund gaps in mitigation of local and county revenue losses and
63	104		operating deficits; infrastructure repair and rep lacement, including
64	105		road, sewer, and water facilities; temporary housi ng and shelter
65	106		made necessary by the result of the associated emergency or
66	107		disaster; and to fund gaps in required matching funds for
67	108		participation in, or the benefit of, programs administered or funded
68	109		by the Federal Emergency Management Agency (FEMA); and

70	110		2. "Qualifying repayment agreement " means a memorandum of
71	111		understanding or legally binding agreement which identifies the
72	112		purpose of use for such ad vanced financial liquidity, and which
73	113		identifies the source of repayment by the governmental subdivision
74	114		and a repayment timeline or standard for re payment.

76	141		C. The Oklahoma Department of Emergency Management may
77	142		promulgate rules as needed to implement the provisions of this
78	143		section.

80	144		SECTION 2. It being immediately necessary for the preservation
81	145		of the public peace, health or safety, an emergency is hereby
82	146		declared to exist, by reason whereof this act shall take effect and
83	147		be in full force from and after its passage an d approval.
