3354 BE IT ENACTED BY THE PE OPLE OF THE STATE OF OKLAHOMA:

3555 SECTION 1. NEW LAW A new section of law to be codified
3656 in the Oklahoma Statutes as Section 690.10 of Title 63, unless there
3757 is created a duplication in numbering, re ads as follows:

3958 A. There is hereby created in the State Treasury a revolving
4059 fund for the Oklahoma Department of Emergency Management to be
4160 designated the "State Assistance Dedicated for Disaster-impacted
4261 Local Economies Revolving Fund". The fund shall be a continuing
4362 fund, not subject to fiscal year limitations, and shall consist of
4463 all monies directed for deposit to the fund . All monies accruing to
4564 the credit of said fun d are hereby appropriated and may be budgeted

4691 and expended by the Oklahoma Department of Emergency Management for
4792 the purpose of providing advanced financial liquidity to
4893 governmental subdivisions directly impacte d by events attributing to

5194 a Federal Emergency Management Agency (FEMA) declared emergency or
5295 disaster, provided such governme ntal subdivision has entered into a
5396 qualifying repayment agreement with the Oklahoma Department of
5497 Emergency Management. Expenditures from said fun d shall be made
5598 upon warrants issued by the State Treasurer against claims filed as
5699 prescribed by law with t he Director of the Office of Managem ent and
57100 Enterprise Services for approval and payment .

59101 B. As used in this sect ion:

61102 1. "Advanced financial liquidity" means funding provided to
62103 fund gaps in mitigation of local and county revenue losses and
63104 operating deficits; infrastructure repair and rep lacement, including
64105 road, sewer, and water facilities; temporary housi ng and shelter
65106 made necessary by the result of the associated emergency or
66107 disaster; and to fund gaps in required matching funds for
67108 participation in, or the benefit of, programs administered or funded
68109 by the Federal Emergency Management Agency (FEMA); and

70110 2. "Qualifying repayment agreement " means a memorandum of
71111 understanding or legally binding agreement which identifies the
72112 purpose of use for such ad vanced financial liquidity, and which
73113 identifies the source of repayment by the governmental subdivision
74114 and a repayment timeline or standard for re payment.

76141 C. The Oklahoma Department of Emergency Management may
77142 promulgate rules as needed to implement the provisions of this
78143 section.

80144 SECTION 2. It being immediately necessary for the preservation
81145 of the public peace, health or safety, an emergency is hereby
82146 declared to exist, by reason whereof this act shall take effect and
83147 be in full force from and after its passage an d approval.
