32	58		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

34	59		SECTION 1. There is hereby amended Section 1 of Enrolled House
35	60		Bill No. 1022 of the 2nd Extraordinary Session of the 58th Oklahoma
36	61		Legislature, an appropriation to the Pandemic Relief Primar y Source
37	62		Revolving Fund, created in Enrolled House Bill No. 102 1 of the 2nd
38	63		Extraordinary Session of the 58th Oklahoma Legislature. There is
39	64		hereby appropriated to the Pandemic Relief Primary Source Revolving
40	65		Fund, created in Enrolled House Bill No. 1021 of the 2nd
41	66		Extraordinary Session of the 58th Oklahoma Legislature, from monies

50	100		Primary Source Revolving Fund, created in Enrolled House Bill No.
51	101		1021 of the 2nd Extraordinary Session of the 58th Oklahoma
52	102		Legislature, from interest monies not otherwise appropriated from
53	103		the Statewide Recovery Fund of the State T reasury created in
54	104		Enrolled House Bill No. 3349 of the 2nd Session of the 58th Oklahoma
55	105		Legislature, the sum of Ten Million Dollars ($10,000,000.00) in
56	106		interest funds to be administered in accordance with the provision s
57	107		of Enrolled House Bill No. 1021 of t he 2nd Extraordinary Session of
58	108		the 58th Oklahoma Legislature.

60	109		SECTION 3. There is hereby appropriated to the Oklahoma Water
61	110		Resources Board from any monies not otherwise appropriated from the
62	111		Statewide Recovery Fund of the State Treasury created in Enrolled
63	112		House Bill No. 3349 of the 2nd Session of the 58th Oklahoma
64	113		Legislature, the sum of Ten Million Dollars ($10,000,000.00) or so
65	114		much thereof as may be necessary to estab lish a grant program, and
66	115		to match tribal investment in rural water infrastructure projects.

68	142		SECTION 4. NEW LAW A new section of law not to be
69	143		codified in the Oklahoma Statutes reads as follows:

71	144		A. There is hereby created in the State Treasury a Statewide
72	145		Recovery Special Account for the Oklahoma Water Resources Board for
73	146		each appropriation section of this act. The duration of such
74	147		accounts shall continue for the period of time that monies related
75	148		to the American Rescue Plan Act of 2021 are being budgeted,
76	149		expended, or managed in the state. The ending of such period shall
77	150		be determined by the State Treasurer, and shall result in the
78	151		closing of such accounts as a matter of law. Such accounts shall be
79	152		continuing accounts as otherwise provided in this section, not
80	153		subject to fiscal year limitations , and shall exclusively consist of
81	154		monies related to the relevant appropriations made in this act and
82	155		as otherwise directed by law. All monies deposited to the credit of
83	156		such accounts are hereby appropriated and may b e budgeted and
84	157		expended by the Oklahom a Water Resources Board in accordance with
85	158		the provisions of this act. Expenditures from such accounts shal l
86	159		be made upon warrants issued by the State Treasurer against claims
87	160		filed as prescribed by law with the Direc tor of the Office of
88	161		Management and Enterprise Services for approval and payment.

90	162		B. The Oklahoma Water Resources Board is authorized to request
91	163		in writing that the monies appropriated by the provisions of this
92	164		act be deposited or transferred to the accou nts created pursuant to
93	165		subsection A of this section. No later than seven (7) calendar days

102	198		The Oklahoma Water Resources Board may enter into memorandums of
103	199		understanding with other agencies of the State of Okl ahoma for the
104	200		auditing, documentation, evaluation, implementation, oversight,
105	201		reporting, and management of f unds and associated efforts related to
106	202		the appropriations made in this act; provided, that no such
107	203		memorandum of understanding shall require or incl ude, as an option
108	204		or condition, the direct or practical transfer or relinquishment of
109	205		control by the agency appropriated such funds to budget, expend,
110	206		allocate, and request the distribution of the funds appropriated by
111	207		this act.

113	208		SECTION 6. NEW LAW A new section of law not to be
114	209		codified in the Oklahoma Statutes reads as follows:

116	210		The Oklahoma Water Resources Board may promulgate rules, utilize
117	211		existing rules, establish procedures, and utilize exis ting
118	212		procedures to implement the provi sions of this act; provided, such
119	213		rules and procedures do not conflict with or impede the provisions
120	214		of this act.

126	244		contracts with financial institutions and execute such instru ments
127	245		as may be necessary and convenient to hold and disseminate grant
128	246		funds in accordance with applicable fed eral and state regulations
129	247		and Board policies.

131	248		SECTION 8. NEW LAW A new section of law not to be
132	249		codified in the Oklahoma Statutes reads as follows:

134	250		From the funds appropriated by Section 3 of this act, the
135	251		Oklahoma Water Resources Board shall retain no more than four
136	252		percent (4%) of the funds appropriated by this act to reimburse:

138	253		1. Costs incurred by the Oklahoma Water Res ources Board; or

140	254		2. Costs incurred on the agency 's behalf,

142	255		associated with the administration of the appropri ated funds and
143	256		programming required by the Oklahoma Water Resources Board under the
144	257		provisions of this act; provided, that no funds shall be retai ned
145	258		that would be disallowable under the provisions of the American
146	259		Rescue Plan Act of 2021.

148	260		SECTION 9. NEW LAW A new section of law not to be

170	303		2. At the Joint Committee on Pandemic Relief Funding 's request,
171	304		appear before the Joint Committee no later than six (6) months after
172	305		the effective date of this act, and as otherwise requested by the
173	306		Joint Committee to provide a status update regarding the
174	307		implementation of the provisions of this act.

176	308		B. The provisions of subsection A of this section shall remain
177	309		applicable for the period of time that monies appropriated under
