4267 SECTION 1. NEW LAW A new section of law not to be
4368 codified in the Oklahom a Statutes reads as follows:

70+from monies not otherwise appropriated from the Statewide Recovery

4797 Fund of the State Treasury created in Enrolled House Bill No. 3349
4898 of the 2nd Session of the 58th Oklahoma Legislature, the sum of Four
4999 Million Dollars ($4,000,0 00.00) or so much there of as may be

51101 residence building located North of State Highway 3 and West of
52102 State Highway 74, aimed at providing care and housing to families
53103 with children undergoing long-term care and treatment at medical

71117 A. There is hereby created in the State Treasury a Statewide
72118 Recovery Special Account for the State Department of Health for eac h

75147 American Rescue Plan Act of 2021 are being budgeted, expended, or
76148 managed in the state. The ending of such period shall be determined
77149 by the State Treasurer and shall result in the closi ng of such
78150 accounts as a matter of law. Such accounts shall be continuing
79151 accounts as otherwise provided in this section, not subject to
80152 fiscal year limitations, and shall exclusively consist of monies
81153 related to the relevant appropriations made in this a ct and as
82154 otherwise directed by law. All monies deposited to the credit of
83155 such accounts are hereby appropriated and may be budgeted and
84156 expended by the State Department of Health in accordan ce with the
85157 provisions of this act. Expenditures from such acco unts shall be
86158 made upon warrants issued by the State Treasurer against claims
87159 filed as prescribed by law with the Director of the Office of
88160 Management and Enterprise Services for approval and payment.

90161 B. The State Department of Health is authorized to req uest in
91-writing that the monies appropriated by the provisions of this act ENR. H. B. NO. 2943 Page 3
162+writing that the monies appropriated by the provisions of this act
92163 be deposited or transferred to the accounts created pursuant to
93164 subsection A of this section. No later than seven (7 ) calendar days
94165 from the date of such request, the Director of t he Office of
95166 Management and Enterprise Services shall comply with such request
96167 and verify to the requesting agency that such deposit or transfer
97168 has been completed.

102197 The State Department of Health may enter into memorandums of
103198 understanding with other agencies of the State of Oklahoma for the
104199 auditing, documentation, eva luation, implementation, oversight,
105200 reporting, and management of funds and associated efforts re lated to
106201 the appropriations made in this act; provided, that no such
107202 memorandum of understanding shall require or include, as an option
108203 or condition, the direct or practical transfer or relinquishment of
109204 control by the agenc y appropriated such funds to bud get, expend,
110205 allocate, and request the distribution of the funds appropriated by
111206 this act.

113207 SECTION 5. NEW LAW A new section of law not t o be
114208 codified in the Oklahoma Statutes reads as follows:

116209 The State Department of Health may prom ulgate rules, utilize
117210 existing rules, establish procedures, and utilize existing
118211 procedures to implement the provisions of this act; provided, such
119212 rules and procedures do not conflict with or impede the provisions
120213 of this act.

122214 SECTION 6. NEW LAW A new section of law not to be
123215 codified in the Oklahoma Statutes reads as follows:

125216 The State Department of Health shall retain no more than two
126217 percent (2%) of the funds appropriated by this act to reimburse:

128218 1. Costs incurred by the State Department of Health; or

130219 2. Costs incurred on the agency’s behalf, associated with the
131220 administration of the appropriated funds an d programming required by

133248 provided, that no funds shall be r etained that would be disallowable
134249 under the provisions of the American Rescue Plan Act of 2021.

141253 1. Submit to the Chairs of the Joint Committee on Pandemic
142254 Relief Funding, or any successor Senate legislative or House of
143255 Representatives legislati ve committee or joint committee, as
144256 designated by the President Pr o Tempore of the Oklahoma State Senate
145257 and the Speaker of the Oklahoma House of Representatives:

147258 a. a written or electronic quarterly report detailing the
148259 budgeting, expenditure, and manage ment of all monies
149260 appropriated in this act, and

151261 b. a copy of all memorandums of understa nding and
152262 contracts with third p arties entered into by the State
153263 Department of Health to facilitate, assist, or
154264 administer powers and duties provided to the State
155265 Department of Health under the provisions of this act;

158267 2. At the Joint Committee on Pan demic Relief Funding’s request,
159268 appear before the Joint Committee no later than six (6) months after
160269 the effective date of this act, and as otherwise requested by the
161-Joint Committee, to provide a status update regarding the

296+Joint Committee to provide a status update regarding the
162297 implementation of the provisions of this act.

164298 B. The provisions of subsection A of this section shall remain
165299 applicable for the period of time that monies appropriated under
166300 this act are being bud geted, expended, or managed in the state. The
167301 ending of such period shall be determined b y the State Treasurer,
168302 and shall be reported to the G overnor, President Pro Tempore of the
169303 Senate, and the Speaker of the House of Representatives.

171304 SECTION 8. It being immediately necessary for the preservation
172305 of the public peace, health or safety, an emergency is hereby
173306 declared to exist, b y reason whereof this act shall take effect and
174307 be in full force from and after its passage an d approval.
