40	66		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

42	67		SECTION 1. NEW LAW A new section of law not to be
43	68		codified in the Oklahom a Statutes reads as follows:

52	102		State Highway 74, aimed at providing care and housing to families

57	106		codified in the Oklahoma Statutes reads as follows:

61		-	Fund of the State Treasury created in Enrolled House Bill No. 3349

68	115		SECTION 3. NEW LAW A new section of law not to be
69	116		codified in the Oklahoma Statutes reads as follows:

71	117		A. There is hereby created in the State Treasury a Statewide
72	118		Recovery Special Account for the State Department of Health for eac h
73	119		appropriation section of this act. The duration of such accou nts
74	120		shall continue for the perio d of time that monies related to the

75	147		American Rescue Plan Act of 2021 are being budgeted, expended, or
76	148		managed in the state. The ending of such period shall be determined
77	149		by the State Treasurer and shall result in the closi ng of such
78	150		accounts as a matter of law. Such accounts shall be continuing
79	151		accounts as otherwise provided in this section, not subject to
80	152		fiscal year limitations, and shall exclusively consist of monies
81	153		related to the relevant appropriations made in this a ct and as
82	154		otherwise directed by law. All monies deposited to the credit of
83	155		such accounts are hereby appropriated and may be budgeted and
84	156		expended by the State Department of Health in accordan ce with the
85	157		provisions of this act. Expenditures from such acco unts shall be
86	158		made upon warrants issued by the State Treasurer against claims
87	159		filed as prescribed by law with the Director of the Office of
88	160		Management and Enterprise Services for approval and payment.

90	161		B. The State Department of Health is authorized to req uest in
91		-	writing that the monies appropriated by the provisions of this act ~~ENR. H. B. NO. 2943 Page 3~~
	162	+	writing that the monies appropriated by the provisions of this act
92	163		be deposited or transferred to the accounts created pursuant to
93	164		subsection A of this section. No later than seven (7 ) calendar days
94	165		from the date of such request, the Director of t he Office of
95	166		Management and Enterprise Services shall comply with such request
96	167		and verify to the requesting agency that such deposit or transfer
97	168		has been completed.

99	169		SECTION 4. NEW LAW A new section of law not to be

102	197		The State Department of Health may enter into memorandums of
103	198		understanding with other agencies of the State of Oklahoma for the
104	199		auditing, documentation, eva luation, implementation, oversight,
105	200		reporting, and management of funds and associated efforts re lated to
106	201		the appropriations made in this act; provided, that no such
107	202		memorandum of understanding shall require or include, as an option
108	203		or condition, the direct or practical transfer or relinquishment of
109	204		control by the agenc y appropriated such funds to bud get, expend,
110	205		allocate, and request the distribution of the funds appropriated by
111	206		this act.

113	207		SECTION 5. NEW LAW A new section of law not t o be
114	208		codified in the Oklahoma Statutes reads as follows:

116	209		The State Department of Health may prom ulgate rules, utilize
117	210		existing rules, establish procedures, and utilize existing
118	211		procedures to implement the provisions of this act; provided, such
119	212		rules and procedures do not conflict with or impede the provisions
120	213		of this act.

122	214		SECTION 6. NEW LAW A new section of law not to be
123	215		codified in the Oklahoma Statutes reads as follows:

125	216		The State Department of Health shall retain no more than two
126	217		percent (2%) of the funds appropriated by this act to reimburse:

128	218		1. Costs incurred by the State Department of Health; or

130	219		2. Costs incurred on the agency’s behalf, associated with the
131	220		administration of the appropriated funds an d programming required by

136	250		SECTION 7. NEW LAW A new section of la w not to be
137	251		codified in the Oklahoma Statutes reads as follows:

139	252		A. The State Department of Healt h shall:

141	253		1. Submit to the Chairs of the Joint Committee on Pandemic
142	254		Relief Funding, or any successor Senate legislative or House of
143	255		Representatives legislati ve committee or joint committee, as
144	256		designated by the President Pr o Tempore of the Oklahoma State Senate
145	257		and the Speaker of the Oklahoma House of Representatives:

147	258		a. a written or electronic quarterly report detailing the
148	259		budgeting, expenditure, and manage ment of all monies
149	260		appropriated in this act, and
150		-
151	261		b. a copy of all memorandums of understa nding and
152	262		contracts with third p arties entered into by the State
153	263		Department of Health to facilitate, assist, or
154	264		administer powers and duties provided to the State
155	265		Department of Health under the provisions of this act;

158	267		2. At the Joint Committee on Pan demic Relief Funding’s request,
159	268		appear before the Joint Committee no later than six (6) months after
160	269		the effective date of this act, and as otherwise requested by the
161		-	Joint Committee, to provide a status update regarding the

164	298		B. The provisions of subsection A of this section shall remain
165	299		applicable for the period of time that monies appropriated under
166	300		this act are being bud geted, expended, or managed in the state. The
167	301		ending of such period shall be determined b y the State Treasurer,
168	302		and shall be reported to the G overnor, President Pro Tempore of the
169	303		Senate, and the Speaker of the House of Representatives.

171	304		SECTION 8. It being immediately necessary for the preservation
172	305		of the public peace, health or safety, an emergency is hereby
173	306		declared to exist, b y reason whereof this act shall take effect and
174	307		be in full force from and after its passage an d approval.
