49	49	requirements for certain paperwork; requiring certain
50	50	notice; authorizing the promulgation of rules;

60	60	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
61	61	SECTION 1. NEW LAW A ne w section of law to be codified
62	62	in the Oklahoma Statutes as Section 580.3 of Title 47, unless there
63	63	is created a duplication in numbering, reads as follows:
64	64	A. A new motor vehicle dealer may fill in the blanks on
65	65	standardized forms in connection with the sale or lease of a new or
66	66	a used motor vehicle if the motor vehicle dealer does not charge for

94	94	preparing documents.
95	95	B. 1. A motor vehicle deale r may charge a service and handling
96	96	fee in connection with the sale or lease of a new or a used motor
97	97	vehicle for:
98	98	a. the handling, processing, and storage of documents ,
99	99	and
100	100	b. other administrative and clerical services.
101	101	2. The service and handling fee may be charged to allow c ost
102	102	recovery for motor vehi cle dealers. A portion of the service and
103	103	handling fee may result in profit to the motor vehicle dealer.
104	104	C. 1. The Oklahoma New Motor Vehicle Commission shall
105	105	determine by rule the amount of the service and handling fee that
106	106	may be charged by a new motor vehicle dealer. The service and
107	107	handling fee shall be no more than One Hundred Twenty-Nine Dollars
108	108	($129.00).
109	109	2. If a service and handling fee is charged under t his section,
110	110	the service and handling fee shall be charged to all retail
111	111	customers and shall be disclosed on the retail buyer 's order form as
112	112	a separate itemized charge.
113	113	D. A preliminary worksheet on which a sale price is com puted
114	114	and that is shown to the purchaser, a ret ail buyer's order form from
115	115	the purchaser, or a retail installment contrac t shall include in

143	143	and handling fee authorized by this section is disclosed:
144	144	1. The amount of the service and han dling fee; and
145	145	2. A notice in type that is bold-faced, capitalized,
146	146	underlined, or otherwise conspicuously set out from the surrounding
147	147	written material. The notice shall read:
148	148	"A SERVICE AND HANDLING FEE IS NOT AN OFFICIAL FEE. A SERVICE
149	149	AND HANDLING FEE IS NOT REQUIRED BY LAW BUT MAY BE CHARGED TO THE
150	150	CUSTOMER FOR PERFORMIN G SERVICES AND HANDLING DOCUMENTS RELATING TO
151	151	THE CLOSING OF A SALE OR LEASE. THE SERVICE AND HANDLING FEE MAY
152	152	RESULT IN PROFIT TO THE DEALER. THE SERVICE AND HANDLING FEE DOES
153	153	NOT INCLUDE PAYMENT FOR THE PREPARATION OF LEGAL DOCUMENTS. THIS
154	154	NOTICE IS REQUIRED BY LAW."
155	155	E. The Oklahoma New Motor Vehicle Commission is authorized to
156	156	promulgate rules to ef fectuate the provisions of this section.
