4040 An Act relating to schools; defining terms; requiring

4242 allowing certain students to participate in certain
4343 activities; requiring publication of policy;
4444 providing eligibility criteria for participation;
4545 requiring compliance with academic standards;
4646 providing for agreed-upon method for evaluation of
4747 compliance; amending 70 O.S. 2021, Section 27 -103,
4848 which relates to the Oklahoma Ext racurricular
4949 Activities Accountability Act; requiring policy to
5050 allow participation of certain students in certain
5151 activities; providing for codification; providing an
5252 effective date; and declaring an emergency .

5858 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5959 SECTION 1. NEW LAW A new section of law to be codified
6060 in the Oklahoma Statutes as Section 8-201 of Title 70, unless there
6161 is created a duplication in numbering, reads as follows:
6262 A. As used in this section:
6363 1. "Resident district" means the public school district in
6464 which a student resides as defined in Section 1 -113 of Title 70 of
6565 the Oklahoma Statutes;

9292 2. "School athletic association " shall have the same meaning as
9393 defined in Section 27-102 of Title 70 of the O klahoma Statutes; and
9494 3. "Students who are educated by other means " means students
9595 who are educated pursuant to the other means of education exception
9696 provided for in subsectio n A of Section 10-105 of Title 70 of the
9797 Oklahoma Statutes.
9898 B. Beginning with the 202 4-2025 school year, each school
9999 district board of education shall adopt a policy allowing students
100100 who are educated by other means to participate in extracurricu lar
101101 activities offered by the student's resident district. The policy
102102 shall be published in the school district student handbook and
103103 posted on the school distri ct website.
104104 C. In order to participate in extracurricu lar activities
105105 pursuant to this section, students who are educated by other means
106106 shall:
107107 1. Register an intention to participate with the bo ard of
108108 education of the resident distric t no later than the July 1
109109 immediately preceding the school year in whic h participation is
110110 intended;
111111 2. Pay any participati on or activity fee in an amount equa l to
112112 any fee charged to a resident district participant;
113113 3. Adhere to the same standards of behavior, responsi bility,
114114 performance, and code of conduct as other partici pants of the
115115 resident district;

142142 4. Adhere to any rules and policies of a school athletic
143143 association which provides the coordination, supervision , and
144144 regulation of the extracurricular activities and contests of
145145 schools;
146146 5. Adhere to any physical exams o r drug testing provisions
147147 required by the board of e ducation of the resident district or the
148148 school athletic association which provides the coordination,
149149 supervision, and regulation of the extracurricular activities and
150150 contests of schools; and
151151 6. Adhere to the same academic standards as other partic ipants
152152 of the resident district pursuant t o the provisions of subsection D
153153 of this section.
154154 D. During the time period a student who is educated by other
155155 means participates in extracurricular activities pursuan t to the
156156 provisions of this section, the student sha ll meet academic
157157 standards by a method of evaluation agreed upon by the parent or
158158 legal guardian of the student and the superin tendent of the resid ent
159159 district. The method of evaluati on may include a review of the
160160 student's work by a certified t eacher employed by the resident
161161 district, the student's performance on a nationally recognized
162162 standardized test, or evaluation of grades earned through
163163 correspondence courses.
164164 SECTION 2. AMENDATORY 70 O.S. 2021, Section 27 -103, is

192192 Section 27-103. A public school or school district shall not be
193193 a member of any school athletic association unless that association
194194 has adopted a written policy that requires the following:
195195 1. All records of the a ssociation to be made accessible
196196 consistent with the prov isions of the Oklahoma Open Records Act;
197197 2. All meetings of the association to be open and conducted in
198198 a manner consistent with the provisions of the Oklahoma Open Meeting
199199 Act, including specifical ly the notice and age nda, voting and
200200 executive session re quirements; and
201201 3. An annual financial audit and a compliance audit of all
202202 funds of the association in accordance with the auditing standards
203203 set forth in the Oklahoma Public School Audit Law. In a ddition, the
204204 association shall have performance audits co nducted of the
205205 operations of the association. A performance audit shall be
206206 conducted no later than December 31, 2014, and by December 31 every
207207 five (5) years thereafter ; and
208208 4. A student who is educated pursuant to the other means
209209 exception provided for in subsection A of Section 10-105 of this
210210 title may participate in interscho lastic activities or contests
211211 offered by the student's resident district as defined in Section 1 -
212212 113 of this title. Student participation shall be subject to the
213213 provisions of Section 1 of this act.
214214 SECTION 3. This act shall become effective July 1, 2024.

241241 SECTION 4. It being immediately necessary for the preservation
242242 of the public peace, health or safety, an emergency is hereby
243243 declared to exist, b y reason whereof thi s act shall take effect and
244244 be in full force from and after its passage and approval.
