58	58	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
59	59	SECTION 1. NEW LAW A new section of law to be codified
60	60	in the Oklahoma Statutes as Section 8-201 of Title 70, unless there
61	61	is created a duplication in numbering, reads as follows:
62	62	A. As used in this section:
63	63	1. "Resident district" means the public school district in
64	64	which a student resides as defined in Section 1 -113 of Title 70 of
65	65	the Oklahoma Statutes;

92	92	2. "School athletic association " shall have the same meaning as
93	93	defined in Section 27-102 of Title 70 of the O klahoma Statutes; and
94	94	3. "Students who are educated by other means " means students
95	95	who are educated pursuant to the other means of education exception
96	96	provided for in subsectio n A of Section 10-105 of Title 70 of the
97	97	Oklahoma Statutes.
98	98	B. Beginning with the 202 4-2025 school year, each school
99	99	district board of education shall adopt a policy allowing students
100	100	who are educated by other means to participate in extracurricu lar
101	101	activities offered by the student's resident district. The policy
102	102	shall be published in the school district student handbook and
103	103	posted on the school distri ct website.
104	104	C. In order to participate in extracurricu lar activities
105	105	pursuant to this section, students who are educated by other means
106	106	shall:
107	107	1. Register an intention to participate with the bo ard of
108	108	education of the resident distric t no later than the July 1
109	109	immediately preceding the school year in whic h participation is
110	110	intended;
111	111	2. Pay any participati on or activity fee in an amount equa l to
112	112	any fee charged to a resident district participant;
113	113	3. Adhere to the same standards of behavior, responsi bility,
114	114	performance, and code of conduct as other partici pants of the
115	115	resident district;

142	142	4. Adhere to any rules and policies of a school athletic
143	143	association which provides the coordination, supervision , and
144	144	regulation of the extracurricular activities and contests of
145	145	schools;
146	146	5. Adhere to any physical exams o r drug testing provisions
147	147	required by the board of e ducation of the resident district or the
148	148	school athletic association which provides the coordination,
149	149	supervision, and regulation of the extracurricular activities and
150	150	contests of schools; and
151	151	6. Adhere to the same academic standards as other partic ipants
152	152	of the resident district pursuant t o the provisions of subsection D
153	153	of this section.
154	154	D. During the time period a student who is educated by other
155	155	means participates in extracurricular activities pursuan t to the
156	156	provisions of this section, the student sha ll meet academic
157	157	standards by a method of evaluation agreed upon by the parent or
158	158	legal guardian of the student and the superin tendent of the resid ent
159	159	district. The method of evaluati on may include a review of the
160	160	student's work by a certified t eacher employed by the resident
161	161	district, the student's performance on a nationally recognized
162	162	standardized test, or evaluation of grades earned through
163	163	correspondence courses.
164	164	SECTION 2. AMENDATORY 70 O.S. 2021, Section 27 -103, is
165	165	amended to read as follows:

192	192	Section 27-103. A public school or school district shall not be
193	193	a member of any school athletic association unless that association
194	194	has adopted a written policy that requires the following:
195	195	1. All records of the a ssociation to be made accessible
196	196	consistent with the prov isions of the Oklahoma Open Records Act;
197	197	2. All meetings of the association to be open and conducted in
198	198	a manner consistent with the provisions of the Oklahoma Open Meeting
199	199	Act, including specifical ly the notice and age nda, voting and
200	200	executive session re quirements; and
201	201	3. An annual financial audit and a compliance audit of all
202	202	funds of the association in accordance with the auditing standards
203	203	set forth in the Oklahoma Public School Audit Law. In a ddition, the
204	204	association shall have performance audits co nducted of the
205	205	operations of the association. A performance audit shall be
206	206	conducted no later than December 31, 2014, and by December 31 every
207	207	five (5) years thereafter ; and
208	208	4. A student who is educated pursuant to the other means
209	209	exception provided for in subsection A of Section 10-105 of this
210	210	title may participate in interscho lastic activities or contests
211	211	offered by the student's resident district as defined in Section 1 -
212	212	113 of this title. Student participation shall be subject to the
213	213	provisions of Section 1 of this act.
214	214	SECTION 3. This act shall become effective July 1, 2024.
