19	48		certain schooling qualifications; and providing an

26	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

28	54		SECTION 1. AMENDATORY 59 O.S. 2021, Section 1261.1, is
29	55		amended to read as follows:
30		-
31	56		Section 1261.1 A. To obtain a license under the Social
32	57		Worker's Licensing Act, an applicant shall:
33		-
34	58		1. Submit a written application in a form prescribed by the
35	59		State Board of Licensed Social Workers;
36		-
37	60		2. Have attained the age of majority;
38		-
39	61		3. Have graduated and received a degree in social work from an
40	62		approved social work program;
41		-
42	63		4. Have completed any necessary post graduate experience and
43	64		supervision in the practice of social work;

45	92		5. Have passed the necessary examination and paid all fe es

	93	+	required by the Board; and
48	94		6. Submit to a national criminal history record check, as
49	95		defined by Section 150.9 of Title 74 of the Oklahoma Statutes. The
50	96		costs associated with the national criminal history record check
51	97		shall be paid by the applicant and submitted to the Board at the
52	98		time of application. With the required fee, the applicant shall
53	99		provide to the Board two classifiable sets of fingerprints to be
54	100		provided to the Oklahoma State Bureau of Investigation.

56	101		B. If the results of the national crim inal history record check
57	102		required by subsection A of this section reveal that the applicant
58	103		has been convicted of, or pled guilty or nolo contendere to, any
59	104		felony crime that substantially relates to the occupation of a
60	105		social worker and poses a reasonabl e threat to public safety, the
61	106		individual's application for licensure may be disapproved and no
62	107		further action shall be taken on the application.

64	108		C. Upon certification by the Board, the Board shall authorize
65	109		the issuance of social work licenses to persons who qualify as
66	110		follows:

68	111		1. As a licensed social work associate (LSWA) who has a
69	112		baccalaureate degree in social work from an accredited institution
70	113		or an approved social work program or both and has passed the
71	114		examination provided for under these provisio ns or who has a
72	115		doctoral or master's degree in social work from an institution with

76	145		2. As a licensed master's social worker (LMSW) who has a
77	146		master's degree in social work from an accredited institution or an
78	147		approved social work program or both and has passed the examination
79	148		provided for under the Social Worker's Licensing Act;

81	149		3. As a licensed social worker (LSW) who has a master's degree
82	150		in social work from an accredited institution or an approved social
83	151		work program or both and ha s two (2) years of full -time three
84	152		thousand (3,000) hours of postgraduate experience in the practice of
85	153		social work under professional supervision of a p erson licensed
86	154		under those provisions, and who has passed the examination provided
87	155		for under the provisions of the Social Worker's Licensing Act;

89	156		4. As a licensed clinical social worker (LCSW) who has a
90	157		master's degree in social work from an accredited in stitution or an

92	159		time three thousand (3,000) hours of postgraduate experience in the
93	160		practice of clinical social work under professional supervision of a
94	161		person licensed by the Social Worker 's Licensing Act, and who has
95	162		passed the examination provided for under the Social Worker's
96	163		Licensing Act; and

98	164		5. As a licensed social worker with administration specialty
99	165		(LSW-ADM) who has a master's degree in social work from an
100	166		accredited institution o r an approved social work program or both

104	197		Social Worker's Licensing Act, and who has passed the examination
105	198		provided for under the Social Worker's Licensing Act.

107	199		D. Applicants who have been licensed as an LSWA, LMSW, LSW,
108	200		LCSW or LSW-ADM in good standing in another state for a minimum of
109	201		three (3) years continuall y since the time of initial full licensure
110	202		post-provisional term and comply with all other state requir ements
111	203		shall be licensed by the Board.

113	204		E. No person may engage in the private practice of clinical
114	205		social work unless that person:
115		-
116	206		1. Is licensed under the Social Worker's Licensing Act as a
117	207		licensed clinical social worker (LCSW); and
118		-
119	208		2. Continues to meet continuing education requirements set by
120	209		the Board.

122	210		F. No person may engage in an independent social work practice
123	211		unless that person:

125	212		1. Is licensed under the Social Worker's Licensing Act as a
126	213		licensed clinical social worker (LCSW), licensed social worker with
127	214		administration specialty (LSW -ADM) or licensed social worker (LSW).
128	215		This specifically and intentionally excludes licensed social work
129	216		associates (LSWA) and licensed masters social workers (LMSW); and

134	246		G. Any qualified person who files by February 1, 2012, a sworn
135	247		statement with the Board stating that the person has met t he

137	249		approval of the statement by the Boa rd, be entitled to engage in the
138	250		independent practice of social work without having to meet the two -
139	251		year postgraduate supervision requirement specified i n paragraphs 3,
140	252		4 and 5 of subsection C of this section.

142	253		H. Any person seeking to pursue postgraduate supervision for
143	254		the licensed social worker (LSW), licensed social worker with
144	255		administration specialty (LSW -ADM), or licensed clinical social
145	256		worker (LCSW) must hold licensure status of licensed social work
146	257		associate (LSWA) or licensed masters social worke r (LMSW) prior to
147	258		board approval of postgraduate supervision for licensure as
148	259		specified in paragraphs 3, 4 and 5 of subsection C of this section.

150	260		I. As used in this section, "qualified person" means a person
151	261		who:

153	262		1. Currently holds an active social worker license from the
154	263		Board; and

156	264		2. Has held a social worker license from the Board continuously
157	265		during the ten-year period immediately prior to November 1 , 2011.

161	294		1. "Substantially relates" means the nature of criminal conduc t
162	295		for which the person was convicted has a direct bearing on the
163	296		fitness or ability to perform one or more of the duties or
164	297		responsibilities necessarily related to the occupation; and

166	298		2. "Poses a reasonable threat" means the nature of criminal
167	299		conduct for which the person was convicted involved an act or threat
168	300		of harm against another and has a bearing on the fitness or ability
169	301		to serve the public or work with others in the occupation.

171	302		SECTION 2. This act shall become effective November 1, 2024.
