2653 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2854 SECTION 1. AMENDATORY 59 O.S. 2021, Section 1261.1, is
2955 amended to read as follows:

3156 Section 1261.1 A. To obtain a license under the Social
3257 Worker's Licensing Act, an applicant shall:

3458 1. Submit a written application in a form prescribed by the
3559 State Board of Licensed Social Workers;

3760 2. Have attained the age of majority;

3961 3. Have graduated and received a degree in social work from an
4062 approved social work program;

4263 4. Have completed any necessary post graduate experience and
4364 supervision in the practice of social work;

4894 6. Submit to a national criminal history record check, as
4995 defined by Section 150.9 of Title 74 of the Oklahoma Statutes. The
5096 costs associated with the national criminal history record check
5197 shall be paid by the applicant and submitted to the Board at the
5298 time of application. With the required fee, the applicant shall
5399 provide to the Board two classifiable sets of fingerprints to be
54100 provided to the Oklahoma State Bureau of Investigation.

56101 B. If the results of the national crim inal history record check
57102 required by subsection A of this section reveal that the applicant
58103 has been convicted of, or pled guilty or nolo contendere to, any
59104 felony crime that substantially relates to the occupation of a
60105 social worker and poses a reasonabl e threat to public safety, the
61106 individual's application for licensure may be disapproved and no
62107 further action shall be taken on the application.

64108 C. Upon certification by the Board, the Board shall authorize
65109 the issuance of social work licenses to persons who qualify as
66110 follows:

68111 1. As a licensed social work associate (LSWA) who has a
69112 baccalaureate degree in social work from an accredited institution
70113 or an approved social work program or both and has passed the
71114 examination provided for under these provisio ns or who has a
72115 doctoral or master's degree in social work from an institution with

74144 passed the examination provided for under these provisions;

76145 2. As a licensed master's social worker (LMSW) who has a
77146 master's degree in social work from an accredited institution or an
78147 approved social work program or both and has passed the examination
79148 provided for under the Social Worker's Licensing Act;

81149 3. As a licensed social worker (LSW) who has a master's degree
82150 in social work from an accredited institution or an approved social
83151 work program or both and ha s two (2) years of full -time three
84152 thousand (3,000) hours of postgraduate experience in the practice of
85153 social work under professional supervision of a p erson licensed
86154 under those provisions, and who has passed the examination provided
87155 for under the provisions of the Social Worker's Licensing Act;

89156 4. As a licensed clinical social worker (LCSW) who has a
90157 master's degree in social work from an accredited in stitution or an

92159 time three thousand (3,000) hours of postgraduate experience in the

98164 5. As a licensed social worker with administration specialty
99165 (LSW-ADM) who has a master's degree in social work from an
100166 accredited institution o r an approved social work program or both

104197 Social Worker's Licensing Act, and who has passed the examination
105198 provided for under the Social Worker's Licensing Act.

107199 D. Applicants who have been licensed as an LSWA, LMSW, LSW,
108200 LCSW or LSW-ADM in good standing in another state for a minimum of
109201 three (3) years continuall y since the time of initial full licensure
110202 post-provisional term and comply with all other state requir ements
111203 shall be licensed by the Board.

113204 E. No person may engage in the private practice of clinical
114205 social work unless that person:

116206 1. Is licensed under the Social Worker's Licensing Act as a
117207 licensed clinical social worker (LCSW); and

119208 2. Continues to meet continuing education requirements set by
120209 the Board.

122210 F. No person may engage in an independent social work practice
123211 unless that person:

125212 1. Is licensed under the Social Worker's Licensing Act as a
126213 licensed clinical social worker (LCSW), licensed social worker with
127214 administration specialty (LSW -ADM) or licensed social worker (LSW).
128215 This specifically and intentionally excludes licensed social work
129216 associates (LSWA) and licensed masters social workers (LMSW); and

131244 2. Continues to meet continuing education requirements set by

134246 G. Any qualified person who files by February 1, 2012, a sworn
135247 statement with the Board stating that the person has met t he
136-definition of a qualified person under this section shall, upon ENR. H. B. NO. 3015 Page 4

137249 approval of the statement by the Boa rd, be entitled to engage in the
138250 independent practice of social work without having to meet the two -
139251 year postgraduate supervision requirement specified i n paragraphs 3,
140252 4 and 5 of subsection C of this section.

142253 H. Any person seeking to pursue postgraduate supervision for
143254 the licensed social worker (LSW), licensed social worker with
144255 administration specialty (LSW -ADM), or licensed clinical social
145256 worker (LCSW) must hold licensure status of licensed social work
146257 associate (LSWA) or licensed masters social worke r (LMSW) prior to
147258 board approval of postgraduate supervision for licensure as
148259 specified in paragraphs 3, 4 and 5 of subsection C of this section.

150260 I. As used in this section, "qualified person" means a person
151261 who:

153262 1. Currently holds an active social worker license from the
154263 Board; and

156264 2. Has held a social worker license from the Board continuously
157265 during the ten-year period immediately prior to November 1 , 2011.

161294 1. "Substantially relates" means the nature of criminal conduc t
162295 for which the person was convicted has a direct bearing on the
163296 fitness or ability to perform one or more of the duties or
164297 responsibilities necessarily related to the occupation; and

166298 2. "Poses a reasonable threat" means the nature of criminal
167299 conduct for which the person was convicted involved an act or threat
168300 of harm against another and has a bearing on the fitness or ability
169301 to serve the public or work with others in the occupation.

171302 SECTION 2. This act shall become effective November 1, 2024.
