4365 An Act relating to property; centralized mail
4466 delivery and centralized mail delivery devices in
4567 certain circumstances are prohi bited; providing
4668 exceptions; providing requirements for centralized
4769 mail delivery devices when installation is allowed;
4870 providing exemption for zoned historical districts;
4971 prohibiting local government or municipalities from
5072 adopting any additional requirem ents pertaining to
5173 centralized mail delivery or the installation of
5274 centralized mail delivery devices ; providing for
5375 codification; and providing an effective date.

5981 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6082 SECTION 1. NEW LAW A new section of law to be codified
6183 in the Oklahoma Statut es as Section 1201 of Title 60, unless there
6284 is created a duplication in numbering, reads as follows:
6385 A. Except as provided in this section, centralized mail
6486 delivery and centralized mail delivery devices in new one and two-
6587 family dwelling neighborhoods, as well as townhouse neighborhoods,
6688 are prohibited.

94-B. The following are not subject to the restrictions of this
95-section:
96142 1. Any existing neighborhood that has centralized delivery
97143 device prior to November 1, 2024;
98144 2. Any condominium or apartment develo pment;
99145 3. Any commercial property that does not contain one and two -
100146 family dwellings or townhouses ;
101147 4. Any one or two-family dwelling neighborhood or any
102148 townhouse neighborhood in which the developer or the majority of the
103149 residents have elected to i nstall centralized mail delivery ;
104150 provided, however, delivery to residents within the neighborhood
105151 shall not be withheld prior to or in the absence of such an
106152 election.
107153 Unless there exists an active owner's association whereby
108154 members will vote pursuant to this paragraph, only one resident of
109155 each dwelling, acting on behalf of any other residents of the
110156 dwelling, may cast a vote in any election under this paragraph; and
111157 5. Any installation by the United States Postal Service .
112158 C. Where installation is not proh ibited under this section or
113159 any other law, centralized mail delivery devices, not exceeding
114160 sixty-two (62) inches in height, may be located within any county,
115161 municipal right-of-way, or easement if doing so allows for the safe,
116162 convenient accessibility of the centralized mail delivery devices,
163+provided that the local or municipal government approves the
164+location of each installation within its right -of-way or easement.

144-provided that the local or municipal government approves the
145-location of each installation within i ts right-of-way or easement.
146216 D. Other than the enforcement of zoning requirements in a
147217 historic district and except as provided under this section, no
148218 local government or municipality shall adopt any additional
149219 requirements by ordinance or regulation pertaining to the
150220 establishment of centralized mail delivery or the installation of
151221 centralized mail delivery devices.
152222 SECTION 2. This act shall become effective November 1, 2024.
