6565 An Act relating to state government; prohibiting

7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statutes as Section 4271 of Title 74, unless there
8282 is created a duplication in numbering, reads as follows:
8383 A. A state agency shall not use appropriated money to employ,
8484 as a regular full-time or part-time or contract employee, a person
8585 who is required by the Oklahoma Ethics Commission to register as a
8686 lobbyist. A state agency shall not use any money under its control
8787 to employ or contract with an individual who is required by the
8888 Oklahoma Ethics Commission to register as a lobbyist.

140140 B. A state agency shall not use appropriated money to pa y, on
141141 behalf of the agency or an officer or employee of the agency,
142142 membership dues to an organization that pays part or all of the
143143 salary of a person who is required by the Oklahoma Ethics Commission
144144 to register as a lobbyist.
145145 C. A state agency that violates subsection A of this section is
146146 subject to a reduction of amounts appropriated for administration by
147147 the General Appropriations Act for the following fiscal year in
148148 which the violation occurs in an amount not to exceed One Hundred
149149 Thousand Dollars ($100,000.00) for each violation.
150150 D. A state agency administering a statewide retirement plan may
151151 enter into a contract to receive assistance or advice regarding the
152152 qualified tax status of the plan or on other federal matters
153153 affecting the administration of the state a gency or its programs if
154154 the contractor is not required by the Oklahoma Ethics Commission to
155155 register as a lobbyist.
156156 SECTION 2. NEW LAW A new section of law to be codified
157157 in the Oklahoma Statutes as Section 4272 of Title 74, unless there
158158 is created a duplication in numbering, reads as follows:
159159 A. A political subdivision or private entity that receives
160160 state funds shall not use the funds to pay:
161161 1. Lobbying expenses incurred by the recipient of the funds ;
162162 2. A person or entity tha t is required to register with the
163163 Oklahoma Ethics Commission ;

215215 3. Any partner, employee, employer, relative, contractor,
216216 consultant, or related entity of a person or entity described by
217217 paragraph 2 of this section; or
218218 4. A person or entity that ha s been hired to represent
219219 associations or other entities for the purpose of affecting the
220220 outcome of legislation, agency rules, ordinances, or other
221221 government policies.
222222 B. A political subdivision or private entity that violates
223223 subsection A of this section is not eligible to receive additional
224224 state funds.
225225 SECTION 3. This act shall become effective November 1, 2024.
