5956 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6057 SECTION 1. NEW LAW A new section of law not to b e
6158 codified in the Oklahoma Statutes reads as follows:
6259 This act shall be known and may be cited as the "Emerson Kate
6360 Cole Act".
6461 SECTION 2. AMENDATORY 70 O.S. 2021, Section 1-116.3, is
6562 amended to read as follows:
6663 Section 1-116.3 A. Notwithstanding the provisions of Section
6764 1-116.2 of this title, the board of education of each school

95-district shall adopt a policy on or before September 1, 2008, that
9692 permits the self-administration of inhaled asthma medication by a
9793 student for treatment of asthma, the self-administration of
9894 anaphylaxis medication by a student for treatment of anaphylaxis ,
9995 and the self-administration of replacement pancreatic enzymes by a
10096 student for treatment of cystic fibrosis. The policy shall require:
10197 1. The parent or guardian of the student to authorize in
10298 writing the student's self-administration of medication;
10399 2. The parent or guardian of the student to provide to the
104100 school a written statement from t he physician treating the student
105101 that the student has asthm a, anaphylaxis, or cystic fibrosis and is
106102 capable of, and has been instructed in the proper method of, self -
107103 administration of medicat ion;
108104 3. The parent or guardian of the student to provide to th e
109105 school an emergency supply of the student 's medication to be
110106 administered pursuant to the provisions of Section 1 -116.2 of this
111107 title;
112108 4. The school district to inform the parent or guardian of the
113109 student, in writing, that the school district and its e mployees and
114110 agents shall incur no liability as a result of any injury arising
115111 from the self-administration of medication by the student; and
116112 5. The parent or guardian of the student to sign a statement
117113 acknowledging that the school district shall incur n o liability as a
114+result of any injury arising from the self -administration of
115+medication by the student.

147142 B. The school board of each school district that elects to
148143 stock Epinephrine injectors or inhalers shall amend the policy
149144 identified in subsection A of this section.
150145 1. The amended policy for Epinephrine injec tors shall require:
151146 a. the school district to inform the parent or guardian
152147 of each student, in writing, that a school nurse or
153148 school employee trained by a health care professional
154149 or trained in correlation with the State Department of
155150 Health's Diabetes Management Annual School Training
156151 Program may administer, with parent or guardian
157152 permission but without a health care provider order,
158153 an Epinephrine injection to a student whom the school
159154 nurse or trained school employee in good faith
160155 believes is having an anaphylactic reaction,
161156 b. a waiver of liability executed by a parent or guardian
162157 be on file with the school district prior to the
163158 administration of an Epinephrine injection pursuant to
164159 paragraph 1 of this subsection, and
165160 c. the school district to designat e the employee
166161 responsible for obtaining the Epinephrine injectors at
167162 each school site.
168163 2. The amended policy for inhalers shall req uire:
164+a. the school district to inform the parent or guardian
165+of each student, in writing, that a school nurse or

196-a. the school district to inform the parent or guardian
197-of each student, in writing, that a school nurse or
198192 school employee trained by a health care professional
199193 may administer an inhaler to a student whom the school
200194 nurse or trained school employee in good faith
201195 believes is having respiratory distress,
202196 b. the school district to designate the employee
203197 responsible for obtaining the inhalers and spacers or
204198 holding chambers at each school site, and
205199 c. the school district to notify the parent or guardian
206200 of a student after administration of an inhaler.
207201 C. The school district and its employees and agents shall incur
208202 no liability as a result of any injury arising pursuant to the
209203 discharge or nondischarge of the powers provided for pursuant to
210204 subparagraph a of paragraphs 1 and 2 of subsection B of this
211205 section.
212206 D. A licensed physician who has prescriptive authority may
213207 write a prescription for Epinephrine injectors and inhalers and
214208 spacers or holding chambers to the school district in the name of
215209 the district as a body corporate specified in Section 5 -105 of this
216210 title which shall be maintained at each school site. Such physic ian
217211 shall incur no liability as a result of any injury arising from the
218212 use of the Epinephrine injectors or the inhalers and spacers or
219213 holding chambers.

247-E. The school district may maintain at each school a minimum of
248-two Epinephrine injectors and two inh alers with spacers or holding
249242 chambers in a secure location. Provided, however, that nothing in
250243 this section shall be construed as c reating or imposing a duty on a
251244 school district to maintain Epi nephrine injectors or inhalers with
252245 spacers or holding chamb ers at a school site or sites.
253246 F. In the event a student is believed to be having an
254247 anaphylactic reaction or respiratory distress, a school employee
255248 shall contact 911 as soon as possible. If Epinephrine is
256249 administered to a student, a school employee sh all contact 911 as
257250 soon as possible. The school district shall notify the parent or
258251 guardian of any student who experiences a possible allergic reaction
259252 as soon as possible.
260253 G. The State Board o f Education, in consultation with the State
261254 Board of Health, shall develop model policies which school districts
262255 may use in compliance with this section. The model policies shall
263256 include, at a minimum, required annual training for teachers and
264257 school employees who are directly responsible for students on the
265258 topics of food allergies, recognizing anaphylaxis, and instruction
266259 on how to administer Epi nephrine. The training shall be completed
267260 before the school year begins or upon hiring the teacher or school
268261 employee. Documentation certifying completion of the requir ed
269262 training shall be retained in the personnel file for the teacher or
270263 school employee. The training may be provided online or in-person
264+by the school nurse or a recognized food allergy and anaphylaxis
265+training program.

300292 H. The State Board of E ducation, in consultation with the State
301293 Board of Health, shall promulgate rules to implement this section.
302294 I. As used in this section:
303295 1. "Medication" means a metered dose inhaler or a dry powder
304296 inhaler to alleviate asthmatic symptoms, prescribed by a physician
305297 and having an individual label, an anaphylaxis medication used to
306298 treat anaphylaxis including but not limited to Epinephrine injectors
307299 prescribed by a physician and having an individual label, or
308300 replacement pancreatic enzymes prescribed by a phy sician and having
309301 an individual label; and
310302 2. "Self-administration" means a student's use of medication
311303 pursuant to prescription or written direction from a physician.
312304 3. "Respiratory distress " means the perceived or actual
313305 presence of coughing, wheezing or shortness of breath; and
314306 4. "Inhaler" means a device that delivers a bronchodilator to
315307 alleviate symptoms of respiratory distress that is manufactured in
316308 the form of a metered -dose inhaler or dry-powder inhaler and that
317309 may include a spacer or holding chamber that attaches to the inhaler
318310 to improve the delivery of the bronchodilator.
319311 J. The permission for self -administration of asthma,
320312 anaphylaxis, or replacement pancreatic enzyme medication is
321313 effective for the school year for which it is granted and shall be
314+renewed each subsequent school year upon fulfillment of the
315+requirements of this section.

349-renewed each subsequent school year upon fulfillment of the
350-requirements of this section.
351342 K. A student who is permitted to self -administer asthma,
352343 anaphylaxis, or replacement pancreatic enzyme med ication pursuant to
353344 this section shall be permitted to possess and use a prescribed
354345 inhaler, anaphylaxis medication including but not limited to an
355346 Epinephrine injector, or replacement pancreatic enzyme medication at
356347 all times.
357348 SECTION 3. This act shall become effective July 1, 2024.
358349 SECTION 4. It being immediately necessary for the preservation
359350 of the public peace, health or safety, an emergency is hereby
360351 declared to exist, by reason whereof thi s act shall take effect and
361352 be in full force from and after its passage and approval.
