15	44		2021, Section 1148.7, which relates to forcible entry
16	45		and detainer jury tr ials; removing the option of jury
17	46		trial for forcible entry and detainer actions;
18	47		retaining the option for a jury trial for other
19	48		actions; repealing 12 O.S. 2021, Section 1148.8,
20	49		which relates to procedure where no jury is
21	50		available; and providing an effect ive date.

28	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

30	56		SECTION 1. AMENDATORY 12 O.S. 2021, Section 1148.7, is
31	57		amended to read as follows:

33	58		Section 1148.7 If A jury trial shall only be an option for
34	59		claims for the collection of rent or damages to the premises, or
35	60		claims arising under the Oklahoma Residential Landlord and Tenant
36	61		Act, and shall not be an option for forcible entry and detention
37	62		actions. For suits with actions for the forcible entry and
38	63		detention, or detention only, of real property, a long with claims
39	64		for the collection of rent or damages to the premises, or claims
40	65		arising under the Oklahoma Residential Landlord and Tenant Act, and

41	93		a jury trial is requested , the suit for forcible entry and detention
42	94		shall be severed from the other claims in the suit and shall have
43	95		its own non-jury trial. For suits where a jury trial is an option ,
44	96		if neither party demands a jury trial on or before the day of trial,
45	97		the court shall try the cause.

47	98		SECTION 2. REPEALER 12 O.S. 2021, Section 1148.8, is
48	99		hereby repealed.
