8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. NEW LAW A new section of law to be codified
8585 in the Oklahoma Statutes as Section 1085.66 of Title 82, unless
8686 there is created a duplication in numbering, reads as follows:
8787 A. To encourage municipalities to work to maintain and upgrade
8888 sewage treatment and delivery systems , as well as to conserve the
8989 resources of municipalities for such maintenance or to make such
9090 upgrades, including having adequate available funding to particip ate
9191 in grant or loan programs availa ble for such purposes through the

143143 Oklahoma Water Resources Board or other governmental avenues, there
144144 is hereby recognized that there shall be no right of recovery for
145145 personal injury from a sanitary s ewer overflow as long as the owner
146146 or operator of the municipal sanitary sewer system is working to
147147 maintain its sanitary sewage system in accordance with the
148148 guidelines and criteria promulgated by th e Oklahoma Water Resources
149149 Board to be eligible for a grant, loan, or other similar guidelines
150150 or criteria promulgated by a governmental entity i ncluding, but not
151151 limited to, an inter local cooperative created under Section 1001 et
152152 seq. of Title 74 of the Oklahoma Statutes. While those
153153 municipalities qualifying for relief und er this section shall be
154154 exempt from personal injury damage claims of annoyance and
155155 inconvenience associated with a sanitary sewer overflow th at alleges
156156 a nuisance-based cause of action , nothing herein shall otherwise
157157 prohibit a right of recovery for prope rty damages associated with a
158158 sanitary sewer overflow in accordance with the Governmental Tort
159159 Claims Act.
160160 B. To qualify for relief under this section as operating in
161161 conformance with recognized standards, the o perational standards
162162 promulgated by the Oklahoma Water Resources Board or other
163163 governmental entity may include any or all of the follow ing
164164 components as such components are determined by the governing body
165165 to be fiscally achievable considering available revenue streams to
166166 the public utility to fund the same:

218218 1. Have their municipal sanitary sewer system mapped and have a
219219 policy of recordkeeping for maintenance and operation of the
220220 municipal system.
221221 2. Have a policy of inspections, cleaning, and root control of
222222 municipal lines that contain the following elements:
223223 a. an inspection program of municipal lines to determine
224224 whether sewage flows are clear, moderately occluded or
225225 severely occluded,
226226 b. a program of routine maintenance of municipal lines,
227227 c. a cleaning or jetting program for those sections of
228228 municipal lines for which the municipality has notice
229229 of clogging or occlusion since the last routine
230230 cleaning, and
231231 d. a treatment program for municipal lines identified as
232232 having blockages due to root infiltration of which the
233233 municipality has notice with root control through
234234 either mechanical or chemical treatments.
235235 3. Have a policy of responding to calls for sanitary sewer
236236 overflows (SSO) to clear municipal sewer mains, flush with water and
237237 deodorize the land upon which SSO occurred, and remove SSO debris
238238 from land upon which SSO occurred.
239239 4. Have adopted a "Fats, Oils and Grease (FOG) Ordinance" that
240240 makes unlawful the introduction of any fats, o ils or grease from
241241 nonresidential entit ies that are connected to the municipal sanitary

293293 sewer system and incor porates pretreatment regulations ado pted by
294294 the Oklahoma Department of Environmental Qual ity. Periodically
295295 advise sewer system participants and dischargers of this
296296 restriction.
297297 5. Have adopted an ordinance that requires new construction or
298298 renovations of existing building to be connected t o the sanitary
299299 sewer system to include installation of a back flow prevention device
300300 on the lateral line connection to the structure to the s anitary
301301 sewer main line.
302302 6. Have adopted a polic y that will periodically advise a
303303 private residential property owne r who is connected to the municipal
304304 sanitary sewer system of the option to provide additional personal
305305 protection through the installation of a back flow prevention system
306306 on the private service line. At the discretion of the governing
307307 body after consideri ng available funding, p rivate residential
308308 property owners connected to the municipal sewer system may be
309309 offered public assistance with installing and in spection of backflow
310310 prevention devices.
311311 7. The governing body of the municipal sanitary s ewer system
312312 shall adopt a funding availability model that considers the
313313 following elements:
314314 a. identifies the total revenue from ratepayers that can
315315 reasonably be expected over a fiscal year,

367367 b. identifies other funding sources from municipal
368368 revenues that can reasona bly be expected to be
369369 contributed to the sanitary s ewer system operations,
370370 maintenance or capital improvements,
371371 c. identifies other sources of funding, such as local,
372372 state, or federal that could be available for sanitary
373373 sewer system operations, maintenance, or capital
374374 improvements,
375375 d. identifies bonding capacities , whether revenue bonds
376376 or general obligations bonds, that could be available
377377 for sanitary sewer system operations, maintenance, or
378378 capital improvements,
379379 e. funding availability models should be reviewed at
380380 least every five (5) years to include a "rate study"
381381 recommending reasonable r ates for those connected to
382382 the sanitary sewer system.
383383 8. The governing body of the municipal sanitary sewer system
384384 shall adopt a five-year capital improvement plan that considers
385385 dedication of funding available to the following :
386386 a. repair or replacement of municipal sanitary sewer
387387 lines that have been identified as severely occluded,
388388 b. repair or replacement of municipal sanitary sewer lift
389389 stations necessary for the continued operation of the

442442 c. access to or purchase of equipment for operation of
443443 the municipal sanitary sewer system serving the
444444 citizens of the municipality that is connected to the
445445 sanitary sewer system.
446446 9. Periodically advising as refer enced in paragraphs 4 and 6 of
447447 this subsection shall be satisfied by any one of the following:
448448 a. annual publication in a newspaper of general
449449 circulation within the county,
450450 b. at least annually posting on a municipal s ponsored
451451 website, or
452452 c. providing at least annual inserts in a monthly utility
453453 bill.
454454 C. 1. A municipality with a goal of completion and full
455455 implementation within five (5) years of the effec tive date of this
456456 measure shall be considered in conformance with recognized standards
457457 if the municipality is in the process of implementing the following
458458 policies:
459459 a. mapping and recordkeeping policy as set out in
460460 paragraph 1 of subsection B of this secti on,
461461 b. creating policies for regular inspections, cleaning,
462462 and root control as set out in paragraph 2 of
463463 subsection B of this section,
464464 c. funding availability models for operation and
465465 maintenance of their municipal sanitary sewer systems

519519 d. adopted a five (5) year capital improvement plan as
520520 set out in paragraph 8 of subsection B of this
521521 section.
522522 2. There shall be a moratorium against nuisance -based tort
523523 claims relating to the operation of m unicipal sanitary sewer systems
524524 for five (5) years from the effec tive date this act for those
525525 municipalities working towards implementing policies as set forth in
526526 paragraph 1 of this subsection.
527527 SECTION 2. This act shall become effective November 1, 2024.
