8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. NEW LAW A new section of law to be codified
9191 in the Oklahoma Statutes as Section 109.7 of Title 43, unless there
9292 is created a duplication in numbering, reads as follows:
9393 1. a. As used in this section , "de facto custodian" means a

146146 evidence to have been the primary caregiver for, and
147147 financial supporter of, a child who has resided with
148148 the person for a perio d of six (6) months or more if
149149 the child is under three (3) years of age an d for a
150150 period of one (1) year or more if the child is three
151151 (3) years of age or older or has been placed by the
152152 Department of Human Services. Any period of time
153153 after a legal proceeding has been commenced by a
154154 parent seeking to regain custody of the child shall
155155 not be included in determining whether the ch ild has
156156 resided with the person for the required minimum
157157 period.
158158 b. A person shall not be a de facto custodian until a
159159 court determines by clear and convincing evidence that
160160 the person meets the definit ion of de facto custodian
161161 established in subsection 1. Once a court determines
162162 that a person meets the definition of de facto
163163 custodian, the court shall give the person the same
164164 standing in custody matters that is given to each
165165 parent under this section.
166166 2. The court shall determine custody in accordance w ith the
167167 best interests of the child and equal consideration shall be given
168168 to each parent and to any de facto custodian. Subject to Section 5
169169 of this act, there shall be a presumption, re buttable by a

221221 preponderance of evidence, that joint custody and equal ly shared
222222 parenting time is in the best interest of the child. If a deviation
223223 from equal parenting time is warranted, the court shall construct a
224224 parenting time schedule which maximizes t he time each parent or de
225225 facto custodian has with the child and is c onsistent with ensuring
226226 the child's welfare. The court shall consider all relevant factors
227227 including:
228228 a. the wishes of the chi ld's parent or parents, and any
229229 de facto custodian, as to his or her custody,
230230 b. the wishes of the chil d as to his or her custod ian,
231231 with due consideration given to the influence a parent
232232 or de facto custodian may have over the child 's
233233 wishes,
234234 c. the interaction and interrelationship of the child
235235 with his or her parent or parents, his or her
236236 siblings, and any other person who may significantly
237237 affect the child's best interests,
238238 d. the motivation of the adults participating in the
239239 custody proceeding,
240240 e. the child's adjustment and continuing proximity to his
241241 or her home, school, and community,
242242 f. the mental and physical health of all individuals

295295 g. finding by the court that domestic violence and abuse
296296 has been committed by one (1) of the parti es against a
297297 child of the parties or against another party. The
298298 court shall determine the extent to which the domestic
299299 violence and abuse has affected the child and the
300300 child's relationship to each party, with due
301301 consideration given to efforts made by a p arty toward
302302 the completion of any domestic violence treatment,
303303 counseling, or program ,
304304 h. the extent to which the child h as been cared for,
305305 nurtured, and supported by any de facto custodian,
306306 i. the intent of the parent or parents in placing the
307307 child with a de facto custodian,
308308 j. the circumstances under which the child was placed or
309309 allowed to remain in the custody of a de facto
310310 custodian, including whether the parent now seeking
311311 custody was previously prevented from doing so as a
312312 result of domestic viole nce and whether the child was
313313 placed with a de facto custod ian to allow the parent
314314 now seeking custody to seek employment, work, or
315315 attend school; and
316316 k. the likelihood a party will allow the child frequent,
317317 meaningful, and conti nued contact with the other
318318 parent or de facto custodian, except that the court

370370 shall not consider this likelihood if there is a
371371 finding that the other p arent or de facto custodian
372372 engaged in domestic violence and abuse against the
373373 party or a child and th at a continued relationship
374374 with the other parent will endanger the health or
375375 safety of either that party or the child .
376376 3. The abandonment of the family residence by a custodial party
377377 shall not be considered where said party was physically harmed or
378378 was seriously threatened with physical harm by his or her spouse,
379379 when such harm or threat of harm was causally related to the
380380 abandonment.
381381 4. If the court grants custody to a de facto custodian, the de
382382 facto custodian shall have legal custody under the laws of Oklahoma.
383383 SECTION 2. NEW LAW A new section of law to be codified
384384 in the Oklahoma Statutes as Section 109.8 of Title 43, unless there
385385 is created a duplication in numbering, reads as follows:
386386 A. A party to a custody proceeding may move for a temporary
387387 custody order. The motion must be supported by an affidavit. The
388388 court may award temporary custody after a hearing, or, if there is
389389 no objection, solely on the basis of the affidavi ts. If the parents
390390 or a de facto custodian joined under su bsection I of this section
391391 present a temporary custody agreement and mutually agreed plan for
392392 parenting time and the court confirms that the agreeme nt adequately

444444 provides for the welfare of the c hild, the agreement shall become
445445 the temporary custody ord er of the court.
446446 B. Subject to Section 5 of this act, in making an order for
447447 temporary custody, there shall be a presumption, rebuttable by
448448 preponderance of evidence, that it is in the best interest of the
449449 child for the parents or a de facto custodian joined under
450450 subsection I of this section to have temporary joint custody and
451451 share equally in parenting time.
452452 C. If a deviation from equal parenting tim e is warranted, the
453453 court shall construct a parenting time schedule which maximizes the
454454 time each parent or de facto custodian joined unde r subsection I of
455455 this section has with the child and is consistent with ensuring the
456456 child's welfare.
457457 D. Each temporary custody order shall include specific findings
458458 of fact and conclusions of law, except when the court confirms the
459459 agreement of the par ties.
460460 E. Any temporary custody order shall address the circumstance
461461 in which physical possession of the child will be exchanged.
462462 F. Modification of a temporary custody order may b e sought when
463463 there is a material and substantial change in the circumstan ces of
464464 the parents, de facto custodian, or child.
465465 G. If a proceeding for dissolution of marriage or legal
466466 separation is dismissed, any temporary custody order is vacated
467467 unless a parent or the child's custodian moves that the proce eding

519519 continue as a custody proceeding and the court finds, after a
520520 hearing, that the circumstances of the parents and the best
521521 interests of the child require that a custody decree be issued.
522522 H. If a custody proceeding commenced in the absence of a
523523 petition for dissolution of ma rriage or legal separation is
524524 dismissed, any temporary custody order is vacated.
525525 I. If a court determines by clear and convincing evidence that
526526 a person is a de fac to custodian, the court shall join that person
527527 in the action as a party needed for just ad judication.
528528 SECTION 3. NEW LAW A new section of law to be codified
529529 in the Oklahoma Statutes as Section 109.9 of Title 43, unless there
530530 is created a duplication in numbering, reads as follow s:
531531 A. A parent not granted custody of the child and not awarded
532532 shared parenting time under the presumption specified in paragraph 2
533533 of Section 1 of this act, subsection B of Section 2 of this act, or
534534 subsection F of Section 4 of this act is entitled to reasonable
535535 visitation rights unless the cour t finds, after a hearing, that
536536 visitation would seriously endanger the child's physical, mental,
537537 moral, or emotional h ealth. Upon request of either party, the court
538538 shall issue orders which are specific as to the frequency, timing,
539539 duration, conditions, an d method of scheduling visitation and which
540540 reflect the development age of the child.
541541 B. If domestic violence and abu se has been alleged, the court
542542 shall, after a hearing, determine the visitation arrangement, i f

594594 any, which would not seriously endanger the child's or the custodial
595595 parent's physical, mental, or emotional health.
596596 C. The court may modify an order granting or denying visitation
597597 rights whenever modification would serve the best interests of the
598598 child; but the court shall not restrict a parent's visitation rights
599599 unless it finds that the visitation would seriously endanger the
600600 child's physical, mental, moral, or emotional health.
601601 D. 1. Except as provided in paragraph 2 of this subsection,
602602 any court-ordered modification of a child visitation de cree, based
603603 in whole or in part on:
604604 a. the active duty of a parent or a de facto custodian as
605605 a regular member of the United States Armed Forces
606606 deployed outside the United States , or
607607 b. any federal active duty of a parent or a de facto
608608 custodian as a member of a state National Guard or a
609609 Reserve component,
610610 shall be temporary and shall revert to the previous child visitation
611611 decree at the end of the deployment outside the United States or the
612612 federal active duty, as appropriate.
613613 2. A parent or de facto custodian identified in paragraph 1 of
614614 this subsection may consent to a modification of a child visitation
615615 decree that continues past the end of the deployment outside the
616616 United States or the federal active duty, as appropriate.

668668 E. Under circumstances where the court finds, by clear and
669669 convincing evidence, that it is in the best interest of the child,
670670 any relative, by blood or affinity, that was previously granted
671671 temporary custody may be granted reasonable nonc ustodial parental
672672 visitation rights by a circuit court or family court as an
673673 intervenor or by original action. Once the relative has been
674674 granted visitation pursuant to this subsection, those rights shall
675675 not be adversely affected by the termination of cus todial or
676676 parental rights of an individual who has permanent custody of the
677677 child unless the court determines that termination of the vis itation
678678 rights are in the best interests of the child. The action shall be
679679 brought in the county in which the temporary or permanent custody
680680 order was entered or where the child resides.
681681 SECTION 4. NEW LAW A new section of law to be codified
682682 in the Oklahoma Statutes as Section 109.10 of Title 43, unless there
683683 is created a duplicati on in numbering, reads as follows:
684684 A. As used in this section, "custody" means sole or joint
685685 custody, whether ordered by a court or agre ed to by the parties.
686686 B. No motion to modify a custody decree shall be made earlier
687687 than two (2) years after its date , unless the court permits it to be
688688 made on the basis of affidavits that there is reason to believe
689689 that:
690690 1. The child's present environment may seriously endanger his
691691 or her physical, mental, moral, or emotional health; or

743743 2. The custodian appointed under the prior decree has placed
744744 the child with a de facto cus todian.
745745 C. If a court of this state has jurisdiction pursuant to the
746746 Uniform Child Custody J urisdiction Act, the court shall not modify a
747747 prior custody decree unless after hearing it finds, upon the ba sis
748748 of facts that have arisen since the prior decree o r that were
749749 unknown to the court at the time of entry of the prior decree, that
750750 a change has occurred in the circumstances of the child or his or
751751 her custodian, and that the modification is necessary to serve the
752752 best interests of the child. When determining if a change has
753753 occurred and whether a modification of custody is in the best
754754 interests of the child, the court shall consider the following:
755755 1. Whether the custodian agrees to the modification;
756756 2. Whether the child has been integrated into the family of the
757757 petitioner with consent of the custodian;
758758 3. Whether the child's present environment seriously endangers
759759 his or her physical, mental, moral, or emotional health;
760760 4. Whether the harm likely to be caused by a change of
761761 environment is outweighed by its advantages to him or her; and
762762 5. Whether the custodian has placed the child with a de facto
763763 custodian.
764764 D. In determining whether a child 's present environment may
765765 seriously endanger his or her physical, mental, moral, or em otional

817817 health, the court shall consider all relevant factors, including,
818818 but not limited to:
819819 1. The interaction and interrelationship of the c hild with his
820820 or her parent or parents, his or her de facto custodian, his or her
821821 siblings, and any other person who may significantl y affect the
822822 child's best interests;
823823 2. The mental and physi cal health of all individuals involved;
824824 3. Repeated or substantial failure, without good cause , of
825825 either parent to observe visitation, child support, or other
826826 provisions of the decree which aff ect the child, except that
827827 modification of custody orders shall not be made solely on the basis
828828 of failure to comply with v isitation or child support pr ovisions, or
829829 on the basis of which parent is more likely to allow visitation or
830830 pay child support; and
831831 4. If domestic violence and abuse is found by the court to
832832 exist, the extent to which the domestic violence and abuse has
833833 affected the child and the child's relationship to both parents.
834834 E. 1. Except as provided in paragraph 2 of this subsection,
835835 any court-ordered modification of a child custody decree, based in
836836 whole or in part on:
837837 a. the active duty of a parent or a de facto c ustodian as
838838 a regular member of the United States Armed Forces
839839 deployed outside the United States , or

891891 b. any federal active duty of a parent or a de facto
892892 custodian as a member of a state National Guard or a
893893 Reserve component,
894894 shall be temporary and shall revert to the previous child custody
895895 decree at the end of the deployment outside the United States or the
896896 federal active duty, as appropriate.
897897 2. A parent or de facto custodian identified in paragraph 1 of
898898 this subsection may consent to a modification of a child custody
899899 decree that continues past the end of the deployment outside the
900900 United States or the federal active duty, as a ppropriate.
901901 F. Subject to Section 5 of this act, if the court orders a
902902 modification of a child custody decree, there shall be a
903903 presumption, rebuttable by a preponderance of evidence, that it is
904904 in the best interest of the child for the parents to have j oint
905905 custody and share equally in parenting time. If a deviation from
906906 equal parenting time is warranted, the court sha ll construct a
907907 parenting time schedule which maximizes the time each parent or de
908908 facto custodian has with the child and is consistent wit h ensuring
909909 the child's welfare.
910910 G. Attorney fees and costs shall be assessed against a party
911911 seeking modification if the court finds that the modification action
912912 is vexatious and constitutes harassment.

964964 SECTION 5. NEW LAW A new s ection of law to be codified
965965 in the Oklahoma Statutes as Section 109.11 of Title 43, unless there
966966 is created a duplication in numbering, reads as follows:
967967 When determining or modifying a custody order pursuant to
968968 Section 1, 2, 4, or 6 of this act, the court shall consider the
969969 safety and well-being of the parties and of the children. If a
970970 domestic violence orde r is being or has been entered against a party
971971 by another party or on behalf of a child at issue in the custody
972972 hearing, the presumption that joint custody and equally shared
973973 parenting time is in the best interest of the child shall not apply
974974 as to the party against whom the domestic violence order is being or
975975 has been entered. The court shall weigh all factors set forth in
976976 paragraph 2 of Section 1 of this act in determining the best
977977 interest of the child.
978978 SECTION 6. NEW LAW A new s ection of law to be codified
979979 in the Oklahoma Statutes as Section 109.12 of Title 43, unless there
980980 is created a duplication in numbering, reads as follows:
981981 A. Following a hearing, if a court finds by a preponderance of
982982 the evidence that domestic violence a nd abuse has occurre d and may
983983 again occur, the court may issue a d omestic violence order:
984984 1. Restraining the adverse party from:
985985 a. committing further acts of domestic violence and

10421042 not to exceed five hundred (500) feet,
10431043 d. going to or within a specified distance of a
10441044 specifically described residence, s chool, or place of
10451045 employment or area where such a place is located , and
10461046 e. disposing of or damaging any of the property of the
10471047 parties;
10481048 2. Directing or prohibiting any other actions that the court
10491049 believes will be of assistance in eliminating future ac ts of
10501050 domestic violence and abuse, except that the court shall not order
10511051 the petitioner to take any affirmative action; and
10521052 3. Directing that either or both of the parties receive
10531053 counseling services av ailable in the community in domestic violence
10541054 and abuse cases.
10551055 B. In imposing a location restriction described in subparagraph
10561056 d of paragraph 1 of subsection A of this section, the court shall:
10571057 1. Afford the petitioner and respondent, if present, an
10581058 opportunity to testify on the issue of the locations an d areas from
10591059 which the respondent should or should not be excluded;

11111111 2. Only impose a location re striction where there is a
11121112 specific, demonstrable danger to the petitioner or other person
11131113 protected by the order;
11141114 3. Specifically describe in the order the l ocations or areas
11151115 prohibited to the respondent; and
11161116 4. Consider structuring a restriction so as to allow the
11171117 respondent transit through a n area if the respondent does not
11181118 interrupt his or her travel to harass, harm, or attempt to harass or
11191119 harm the petitioner.
11201120 C. When temporary child suppo rt is granted under this section,
11211121 the court shall enter an or der detailing how the child support is to
11221122 be paid and collected. Child support ordered under this section may
11231123 be enforced utilizing the same procedures as any other child support
11241124 order.
11251125 D. A domestic violence order shall be effective for a period of
11261126 time fixed by the court, not to exceed three ( 3) years, and may be
11271127 reissued upon expiration for subsequent periods of up to three (3)
11281128 years each. The fact that an order has not been violated since its
11291129 issuance may be considered by a court in hearing a request f or a
11301130 reissuance of the order.
11311131 SECTION 7. This act shall become effective November 1, 2024.
