5956 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6057 SECTION 1. AMENDATORY 36 O.S. 2021, Section 942, is
6158 amended to read as follows:
6259 Section 942. Any insurance carrier that issues motor vehicle
6360 liability or collision insurance policie s in this state shall not
6461 establish or apply premium ra tes, increase premium rates, cancel a
6562 policy, or refuse to issue or renew a policy, based on any traffic
6663 record maintained by the Department of Public Safety, including, but
6764 not limited to, traffic complaints, traffic citations or other legal

95-forms of traffic charges, and accident reports, which covers a
9692 period of time more than three (3) years prior to the date the
9793 insurance carrier ma kes a determination to take any such action;
9894 provided, however, those offenses that are prov ided for in
9995 subsection C of Section 941 of this title and the offense of
10096 reckless driving as provided for in Section 11-901 of Title 47 of
10197 the Oklahoma Statutes may be considered by an insurance carrier for
10298 a period of not more than five (5) years.
10399 SECTION 2. AMENDATORY 36 O.S. 2021, Section 943, is
104100 amended to read as follows :
105101 Section 943. A. No insurance carrier who issues motor vehicle
106102 policies in this state shall use traffic complaints, traffic
107103 citations or other legal forms of traffic charges as a bas is for
108104 cancellation of a motor vehicle insurance policy, increasing premium
109105 rates for a motor vehicle insurance policy or refusing to issue o r
110106 renew a motor vehicle insurance policy, where:
111107 1. the The insured was acquitted of the charg e;
112108 2. the The insured was arrested and no charges were filed; or
113109 3. the The insured was arrested an d the charges were dismissed.
114110 B. No insurer shall cancel , refuse to renew or otherwise
115111 terminate, or increase the premium of a motor vehicle policy which
116112 has been in effect more than fo rty-five (45) days solely because the
117113 insured filed a first cla im against the policy. Nothing in this
118114 subsection shall be construed to prevent the can cellation,

146141 nonrenewal or other termination, or incr ease in premium for any of
147142 the following reasons:
148143 1. Nonpayment of premium;
149144 2. Discovery of fraud or material misrepresent ation in the
150145 procurement of the insurance or with respect to any c laims submitted
151146 thereunder;
152147 3. Offenses provided for in subsection C of Section 941 of this
153148 title;
154149 4. Offenses provided for in Se ction 11-901 of Title 47 of the
155150 Oklahoma Statutes; or
156151 5. A determination by the Insurance Commissioner that the
157152 continuation of the policy would place the insurer in violation of
158153 the insurance laws of this state.
159154 C. The Insurance Commissioner may suspend or revoke, after
160155 notice and opportunity for a hearing, the certificate of authority
161156 to transact insurance business in this sta te of any insurance
162157 carrier violating the provisions of this section or may censure the
163158 insurer or impose a fine.
164159 SECTION 3. This act shall become effective November 1, 2024.
