4540 An Act relating to crimes and punishments; defining

6560 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6661 SECTION 1. NEW LAW A new section of law to be codified
6762 in the Oklahoma Statutes as Section 1040.81 of Title 21, unless
6863 there is created a duplication in numbering, reads a s follows:
6964 As used in this act:
65+1. "Child pornography" shall have the same meaning as such term

97-1. "Child pornography" shall have the same meaning as such term
98-is defined in Section 1024.1 of Title 21 of the O klahoma Statutes;
9993 2. "Child sexual exploitation" shall have th e same meaning as

10296 3. "Commercial entity" includes corporations, limited liability
10397 companies, partnerships, limited partnerships, sole proprietorships,
10498 or other legally recognized entities;
10599 4. "Digitized identification card " means a data file available
106100 on any mobile device which has connectivity to the Internet through
107101 a state-approved application that allows the mobile device to
108102 download the data file from a state agency or an aut horized agent of
109103 a state agency that contains all of the data elements visibl e on the
110104 face and back of a license or identification card and displays the
111105 current status of the license or identification card;
112106 5. "Distribute" means to issue, sell, give, prov ide, deliver,
113107 transfer, transmit, circulate, or disseminate by any means ;
114108 6. "Harmful to minors" shall have the same mea ning as such term
115109 is defined in Section 1040.75 of Title 21 of the Oklahoma Statutes;
116110 7. "Internet" means the international computer n etwork of both
117111 federal and non-federal interoperable packet switched data net works;
118112 8. "Minor" means any person under eighteen (18) years of age;
119113 9. "News-gathering organization" means any of the following:
114+a. an employee of a newspaper, news publication , or news
115+source, printed or on an online or mo bile platform, of
116+current news and public interest, while operating as

147-a. an employee of a newspaper, news publication, or news
148-source, printed or on an online or mobile platform, of
149-current news and public interest, while operating as
150143 an employee as provided in this subparagraph, who can
151144 provide documentation of such employment with the
152145 newspaper, news publication, or ne ws source, or
153146 b. an employee of a radio broadcast station, television
154147 broadcast station, cable television operator, or wire
155148 service while operating as an employee a s provided in
156149 this subparagraph, who can provide documentation of
157150 such employment;
158151 10. "Obscene material" shall have the same meaning as such term
159152 is defined in Section 1024.1 of Title 21 of the Oklahoma Statutes;
160153 11. "Publish" means to communicate or ma ke information
161154 available to another person or entity on a publicly available
162155 Internet website;
163156 12. "Reasonable age verification methods " means verifying that
164157 the person seeking to access the material is eighteen (18) years of
165158 age or older by using any of the following methods:
166159 a. use of a digitized information card as defined in this
167160 section,
168161 b. verification through an independent, third -party age
169162 verification service that compares the personal
170163 information entered by the individual who is seeking
164+access to the material that is available from a
165+commercially available database, or aggregate of
166+databases, that is regularly used by government

198-access to the material that is availab le from a
199-commercially available database, or aggregate of
200-databases, that is regularly used by government
201193 agencies and businesses for the pur pose of age and
202194 identity verification , or
203195 c. any commercially reasonable method that relies on
204196 public or private transactional data to verify the age
205197 of the person attempting to access the material;
206198 13. "Subscriber" means a person who pays to receive or access a
207199 service;
208200 14. "Substantial portion" means more than thirty-three and one-
209201 third percent (33 1/3%) of total material on a websi te, which meets
210202 the definition of "material harmful to minors" as defined in this
211203 section; and
212204 15. "Transactional data" means a sequence of information that
213205 documents an exchange, agreement, or tr ansfer between an individual,
214206 commercial entity, or third p arty used for the purpose of satisfying
215207 a request or an event. Transactional data includes records from
216208 mortgage, education, and employment entities.
217209 SECTION 2. NEW LAW A n ew section of law to be codified
218210 in the Oklahoma Statutes a s Section 1040.82 of Title 21, unless
219211 there is created a duplication in numbering, reads as follows:
220212 A. Any commercial entity that know ingly and intentionally
221213 publishes or distributes obscene mate rial, or material that depicts
214+or promotes child pornography or child sexual exploitation, on the
215+Internet or any other type of electronic, digital, or print media,
216+may be held liable to an indiv idual for nominal damages, actual

250-Internet or any other type of electronic, digital, or print media,
251-may be held liable to an individual for nominal damages, actual
252243 damages, court costs , and reasonable attorney fees as ordered by the
253244 court.
254245 B. A commercial entity that has violated the provisions of this
255246 act in a manner that satisfies the standards fo r imposition of
256247 punitive damages elsewhere provided by law may be held liable to an
257248 individual for puniti ve damages.
258249 C. Individual claims that satisfy th e generally applicable
259250 standards for joinde r or class action elsewhere provided by law or
260251 rules of court, as applicable, may combine their claims in a single
261252 action.
262253 SECTION 3. NEW LAW A new section of law to be codified
263254 in the Oklahoma Statutes as Section 1040.83 of Title 21, unless
264255 there is created a duplication in numbering, rea ds as follows:
265256 A. Any commercial entity that knowingly and intentionally
266257 publishes or distributes materia l harmful to minors on the Internet
267258 from a website that contains a substantial portion of su ch material
268259 shall provide Internet service subscribers and cellular service
269260 subscribers the opportunity, before any individual using such
270261 services may access the material, to request that access to the
271262 material by subscription service be denied.
263+B. Upon such request by an Internet service subscriber or
264+cellular service subscriber, a commercial en tity shall, without
265+charge, block access to its website on an y device seeking to access
266+its website using the Internet service or cellular service

299-B. Upon such request by an Internet service subscriber or
300-cellular service subscriber, a commercial entity shall, without
301-charge, block access to its website on any device seeking to access
302-its website using the Internet service or cellular service
303293 subscription of the subscriber so that a minor does not receive
304294 material harmful to minors via that subscript ion.
305295 C. A commercial entity that fails to provide Internet service
306296 subscribers or cellular service subscribers an oppor tunity to
307297 request that access to the website of the commercial entity be
308298 blocked is in violation of the provisions of this act and may be
309299 held liable to the minor, by and through the parent or legal
310300 guardian of the minor, for nominal damages, actual damages, court
311301 costs, and reasonable attorney fee s as ordered by the court.
312302 D. A commercial entity that, after receipt of such request to
313303 block access, allows a minor to access material harmful to minors on
314304 its website is in violation of the provisions of this act and may be
315305 held liable to the minor, by and through the parent or legal
316306 guardian of the minor, for nominal damages, actual damages, court
317307 costs, and reasonable attorney fees as ordered by the court.
318308 E. A commercial entity that has violated the provisions of this
319309 act in a manner that satisfies the standards for imposition of
320310 punitive damages elsewhere provided by law may be held liable to the
321311 minor, by and through the parent or legal guardian of the minor, for
322312 punitive damages.
313+F. Individual claims tha t satisfy the generally applicable
314+standards for joinder or class action elsewhere provided by law or
315+rules of court, as applicable, may combine their claims in a single
316+action.

350-F. Individual claims that satisfy the generally applicable
351-standards for joinder or class action elsewhere provided by law or
352-rules of court, as applicable, may combine their claims in a single
353-action.
354343 G. A commercial entity shall not be held liable for allowing
355344 access to its website if the commercial entity performs reasonable
356345 age verification methods to verify that the individual attempting to
357346 access the material from its website is not a minor.
358347 H. A commercial entity or third p arty that performs the
359348 required age verification shall not retain any identifying
360349 information of the individual after access has been granted to the
361350 material.
362351 I. A commercial entity th at is found to have knowingly retained
363352 identifying information of the i ndividual, except as reasonably
364353 necessary to effectuate a block request under the provisions of this
365354 section, shall be liable to the indivi dual for damages resulting
366355 from retaining the identifying information, including nominal
367356 damages, actual damages, court costs, and reasonable attorney fees
368357 as ordered by the court.
369358 J. This section shall not a pply to any bona fide news or public
370359 interest broadcast, website v ideo, report, or event and shall not be
371360 construed to affect the rights of a news-gathering organization,
372361 unless the website of the organization contains a substantial
373362 portion of material har mful to minors.
363+K. No Internet service provide r, affiliate, or subsidiary of an
364+Internet service provider, search engine, or cloud service provider
365+shall be held to have violated the provisions of this section so lely

401-K. No Internet service provider, affiliate, or subsidiary of an
402-Internet service provider, search engine, or cloud service provider
403-shall be held to have violated the provision s of this section solely
404-for providing access or connection to or from a website or other
405393 information or content on the Internet, or a facility, system, or
406394 network not under the control of the provider, including
407395 transmission, downloading, storing, or providing access, to the
408396 extent that such provider is not responsib le for the creation of the
409397 content of the commu nication that constitutes obscene material or
410398 material harmful to m inors.
411399 SECTION 4. NEW LAW A new section of law to be codified
412400 in the Oklahoma Statutes as Section 1040.84 of Title 21, unless
413401 there is created a duplication in numbering, reads as foll ows:
414402 A. The Attorney General may seek injunctive and other equitable
415403 relief against a commercial entity that fails to comply with the
416404 provisions of this act.
417405 B. The Attorney General is aut horized and directed to develop
418406 and publish, consistent with the provisions of this act, guidance,
419407 or regulations as appropriate to assist commercial entities to
420408 comply with the provisions of this act.
421409 SECTION 5. This act shall become effe ctive November 1, 2024.
