79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 74 O.S. 2021, Section 1221, is
81	81	amended to read as follows:
82	82	Section 1221. A. The State of Oklahoma acknowledges federal
83	83	recognition of Indian tribes recognize d by the Department of
84	84	Interior, Bureau of Indian Affairs.
85	85	B. The State of Oklahoma recognizes the unique status of Indian
86	86	tribes within the federal government and shall work in a spirit of
87	87	cooperation with all federally recognized Indian tribes in
88	88	furtherance of federal policy for the be nefit of both the State of
89	89	Oklahoma and tribal governments.

141	141	C. 1. The Governor is authorized to negotiate and enter into
142	142	cooperative agreements on behalf of this state with federally
143	143	recognized Indian tribal governments within this state to address
144	144	issues of mutual interest. The Governor may elect to name a
145	145	designee who shall have authority to n egotiate and enter into
146	146	cooperative agreements on behalf of the state with federally
147	147	recognized Indian tribes as provided for in this section. Except as
148	148	otherwise provided by this subsection, such agreements shall become
149	149	effective upon approval by the Joi nt Committee on State -Tribal
150	150	Relations.
151	151	2. If the Governor or the Governor's designee and the federally
152	152	recognized Indian tribal government are unable to negotiate and
153	153	enter into a cooperative agreement within seven (7) days, the
154	154	Governor shall extend an offer and make a good faith effort to meet
155	155	with the federally recognized Indian tribal government at least once
156	156	every month for six (6) months to continue negotiations. If, after
157	157	six (6) months, the Governor and the federally recognized Indian
158	158	tribal government are unable to negotiate and enter into a
159	159	cooperative agreement , the Governor shall extend the offer to meet
160	160	with the tribal government once every month for an additional six
161	161	(6) months to continue negotiations .
162	162	3. If the cooperative agreements spec ified and authorized by
163	163	paragraph 1 of this subsection involve trust responsibilitie s,

217	217	3. 4. Any cooperative agreement specified and authorized by
218	218	paragraph 1 of this subsection invo lving the surface water and/or
219	219	groundwater resources of this state or which in whole or in part
220	220	apportions surface and/or groundwater ownership s hall become
221	221	effective only upon the consent of the Oklahoma Legislature
222	222	authorizing such cooperative agreement.
223	223	D. 1. The governing board of a political subdivision of this
224	224	state is authorized to negotiate and enter into intergovernmental
225	225	cooperative agreements in behalf of the political subdivision, with
226	226	a federally recognized Indian tribal government within thi s state to
227	227	address issues of mutual interest. Except as otherwise provided by
228	228	this subsection, such agreements shall be effective upon approval by
229	229	the Joint Committee on State -Tribal Relations and the Governor, or
230	230	the designee of the Governor.
231	231	2. Agreements for juvenile detention facilities made pursuant
232	232	to Section 2-3-103 of Title 10A of the Oklahoma Statutes shall
233	233	become effective upon approval by the board of county commissioners.
234	234	3. Any cooperative agreement specified and authorized by
235	235	paragraph 1 of this subsection involving the surface water and/or
236	236	groundwater resources of this state shall become effective only upon
237	237	the consent of the Oklah oma Legislature authorizing such cooperative
238	238	agreement.

290	290	4. Agreements between the Military Department of the S tate of
291	291	Oklahoma and an Indian tribe for the management or operation of a
292	292	juvenile facility shall not be subject to the requirements of this
293	293	section.
294	294	5. Agreements between the Department of Transportation of the
295	295	State of Oklahoma and an Indian tribe or th e Oklahoma Turnpike
296	296	Authority and an Indian tribe for the maintenance and construction
297	297	of transportation facilities, roads or bridges shall not b e subject
298	298	to the requirements of this section.
299	299	E. An executed original of every ag reement approved pursuant to
300	300	this section shall be filed with the Secretary of State. A copy of
301	301	every agreement shall be filed with the Office of Tribal Relations
302	302	within the Oklahoma Historical Society.
303	303	SECTION 2. This act shall become ef fective November 1, 2024.
