7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 74 O.S. 2021, Section 1221, is
8181 amended to read as follows:
8282 Section 1221. A. The State of Oklahoma acknowledges federal
8383 recognition of Indian tribes recognize d by the Department of
8484 Interior, Bureau of Indian Affairs.
8585 B. The State of Oklahoma recognizes the unique status of Indian
8686 tribes within the federal government and shall work in a spirit of
8787 cooperation with all federally recognized Indian tribes in
8888 furtherance of federal policy for the be nefit of both the State of
8989 Oklahoma and tribal governments.

141141 C. 1. The Governor is authorized to negotiate and enter into
142142 cooperative agreements on behalf of this state with federally
143143 recognized Indian tribal governments within this state to address
144144 issues of mutual interest. The Governor may elect to name a
145145 designee who shall have authority to n egotiate and enter into
146146 cooperative agreements on behalf of the state with federally
147147 recognized Indian tribes as provided for in this section. Except as
148148 otherwise provided by this subsection, such agreements shall become
149149 effective upon approval by the Joi nt Committee on State -Tribal
150150 Relations.
151151 2. If the Governor or the Governor's designee and the federally
152152 recognized Indian tribal government are unable to negotiate and
153153 enter into a cooperative agreement within seven (7) days, the
154154 Governor shall extend an offer and make a good faith effort to meet
155155 with the federally recognized Indian tribal government at least once
156156 every month for six (6) months to continue negotiations. If, after
157157 six (6) months, the Governor and the federally recognized Indian
158158 tribal government are unable to negotiate and enter into a
159159 cooperative agreement , the Governor shall extend the offer to meet
160160 with the tribal government once every month for an additional six
161161 (6) months to continue negotiations .
162162 3. If the cooperative agreements spec ified and authorized by
163163 paragraph 1 of this subsection involve trust responsibilitie s,

217217 3. 4. Any cooperative agreement specified and authorized by
218218 paragraph 1 of this subsection invo lving the surface water and/or
219219 groundwater resources of this state or which in whole or in part
220220 apportions surface and/or groundwater ownership s hall become
221221 effective only upon the consent of the Oklahoma Legislature
222222 authorizing such cooperative agreement.
223223 D. 1. The governing board of a political subdivision of this
224224 state is authorized to negotiate and enter into intergovernmental
225225 cooperative agreements in behalf of the political subdivision, with
226226 a federally recognized Indian tribal government within thi s state to
227227 address issues of mutual interest. Except as otherwise provided by
228228 this subsection, such agreements shall be effective upon approval by
229229 the Joint Committee on State -Tribal Relations and the Governor, or
230230 the designee of the Governor.
231231 2. Agreements for juvenile detention facilities made pursuant
232232 to Section 2-3-103 of Title 10A of the Oklahoma Statutes shall
233233 become effective upon approval by the board of county commissioners.
234234 3. Any cooperative agreement specified and authorized by
235235 paragraph 1 of this subsection involving the surface water and/or
236236 groundwater resources of this state shall become effective only upon
237237 the consent of the Oklah oma Legislature authorizing such cooperative
238238 agreement.

290290 4. Agreements between the Military Department of the S tate of
291291 Oklahoma and an Indian tribe for the management or operation of a
292292 juvenile facility shall not be subject to the requirements of this
293293 section.
294294 5. Agreements between the Department of Transportation of the
295295 State of Oklahoma and an Indian tribe or th e Oklahoma Turnpike
296296 Authority and an Indian tribe for the maintenance and construction
297297 of transportation facilities, roads or bridges shall not b e subject
298298 to the requirements of this section.
299299 E. An executed original of every ag reement approved pursuant to
300300 this section shall be filed with the Secretary of State. A copy of
301301 every agreement shall be filed with the Office of Tribal Relations
302302 within the Oklahoma Historical Society.
303303 SECTION 2. This act shall become ef fective November 1, 2024.
