155155 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
156156 SECTION 1. NEW LAW A new section of law not to be
157157 codified in the Oklahoma Statutes r eads as follows:
158158 This act shall be known and may be cited as the "Fines Assessed
159159 and Imposed Reasonably (FAIR) Act".
160160 SECTION 2. AMENDATORY 20 O.S. 2021, Section 1 313.2, is
161161 amended to read as follows:
162162 Section 1313.2 A. As used in this section:
163163 1. "Arrested" means taking custody of another for the purpose
164164 of holding or detaining him or her to answer a criminal charge;
165165 2. "Convicted" means any final adjudication o f guilt, whether
166166 pursuant to a plea of guilty or nolo contendere or otherwise, and
167167 any deferred or suspended sentence o r judgment;
168168 3. "Court" means any state or municipal court having
169169 jurisdiction to impose a criminal fine or penalty; and
170170 4. "DNA" means Deoxyribonucleic acid.
171171 B. Any person convicted of an offense includ ing traffic
172172 offenses but excluding parking and stan ding violations, punishable
173173 by a fine of Ten Dollars ($10.00) or more or by incarceration or any
174174 person forfeiting bond when charged with such an offense, shall by a
175175 city or county that conducts satellite CLEET academies, may be
176176 ordered by the court to pay Ten Dollars ($10.00) Two Dollars ($2.00)
177177 as a separate fee, which fee shall be in addition to and not in

230230 substitution for any and all fi nes and penalties otherwise provided
231231 for by law for such offense.
232232 C. 1. Any person convicted of any misdemeanor or fe lony
233233 offense shall pay a Laboratory Analysis Fee in the amount of One
234234 Hundred Fifty Dollars ($150.00) for each offense if forensic scienc e
235235 or laboratory services are rendered or administered by the Oklahom a
236236 State Bureau of Investigation (OSBI), by the Toxi cology Laboratory
237237 of the Office of the Chief Medical Examiner or by any municipality
238238 or county in connection with the case. This fee sha ll be in
239239 addition to and not a substitution for any and all fines an d
240240 penalties otherwise provided for by law for this offense.
241241 2. The court clerk shall cause to be deposited the amount of
242242 One Hundred Fifty Dollars ($150.00) as collected, for every
243243 conviction as described in this subsection. The court clerk shall
244244 remit the monies in the fund on a monthly basis directly e ither to:
245245 a. the OSBI who shall deposit the monies into the OSBI
246246 Revolving Fund provided for in Section 150.19a of
247247 Title 74 of the Oklaho ma Statutes for services
248248 rendered or administered by the OSBI,
249249 b. the Office of the Chief Medical Examiner who shall
250250 deposit the monies into the Chief Medical Examiner
251251 Revolving Fund provided for in Section 948 of Title 63
252252 of the Oklahoma Statutes for serv ices rendered or

306306 Examiner, or
307307 c. the appropriate municipality or county for services
308308 rendered or administered by a municipality or county.
309309 3. The monies from the Laboratory Analysis Fee Fund deposited
310310 into the OSBI Revolving Fund shall be used for the following:
311311 a. providing criminalistic laboratory services,
312312 b. the purchase and maintenance of equipment for use by
313313 the laboratory in performing analysis,
314314 c. education, training, and scientific development of
315315 OSBI personnel, and
316316 d. the destruction of seized property and chemicals as
317317 prescribed in Sections 2-505 and 2-508 of Title 63 of
318318 the Oklahoma Statutes.
319319 D. Upon conviction or bond forfeiture, the court shall collect
320320 the fee provided for in subsection B of thi s section and deposit it
321321 in an account created for that purpose. Ex cept as otherwise
322322 provided in subsection E of this section, monies shall be forwarded
323323 monthly by the court clerk to the Council on Law Enforcement
324324 Education and Training (CLEET). Beginnin g July 1, 2003, deposits
325325 shall be due on the fifteenth day of each m onth for the preceding
326326 calendar month. There shall be a late fee imposed for failure to
327327 make timely deposits; provided, CLEET, in its discretion, may waive
328328 all or part of the late fee. S uch late fee shall be one percent

381381 (1%) of the principal amount due p er day beginning from the tenth
382382 day after payment is due and accumulating until the late fee reaches
383383 one hundred percent (100%) of the principal amount due. Beginning
384384 on July 1, 1987, nin ety percent (90%) of the monies received by
385385 CLEET from the court cle rks pursuant to this section shall be
386386 deposited in the CLEET Fund, and ten percent (10%) shall be
387387 deposited in the General Revenue Fund. Beginning January 1, 2001,
388388 sixty and fifty-three one-hundredths percent (60.53%) of the monies
389389 received by CLEET from the court clerks pursuant to this section
390390 shall be deposited in the CLEET Fund created pursuant to subsection
391391 G of this section, five and eighty -three one-hundredths percent
392392 (5.83%) shall be deposited in the General Revenue Fund and thirty -
393393 three and sixty-four one-hundredths percent (33.64%) shall be
394394 deposited in the CLEET Training Center Revolving Fund created
395395 pursuant to Section 3311.6 of Title 70 of the Oklahoma Statutes.
396396 Along with the deposits required by this subsection, each court
397397 shall also submit a report stating the total amount of funds
398398 collected and the total number of fees imposed during the preceding
399399 quarter. The report may be made on computerized or manual
400400 disposition reports.
401401 E. Any municipality or county having a basic law enforcement
402402 academy approved by CLEET pursuant to the criteria dev eloped by
403403 CLEET for training law enforcement officers shall retain from monies
404404 collected pursuant to subsections A through D C of this section, Two

457457 Dollars ($2.00) from each fee. These monies shall be dep osited into
458458 an account for the sole use of the muni cipality or county in
459459 implementing its law enforcement training functions. Not more than
460460 seven percent (7%) of the monies shall be used for court and
461461 prosecution training. The court clerk of any such mun icipality or
462462 county shall furnish to CLEET the repo rt required by subsection D of
463463 this section.
464464 F. 1. Any person entering a plea of guilty or nolo contendere
465465 or is found guilty of the cr ime of misdemeanor possession of
466466 marijuana or drug paraphernalia sha ll be ordered by the court to pay
467467 a five-dollar fee, which shall be in addition to and not in
468468 substitution for any and all fines and penalties otherwise provided
469469 for by law for such offens e.
470470 2. The court clerk shall cause to be deposited the amount of
471471 Five Dollars ($5.00) as collected, for every adjudicat ed or
472472 otherwise convicted person as described in this subsection. The
473473 court clerk shall remit the monies in the fund on a monthly basis
474474 directly to the Bureau of Narcotics Drug Education Revolving Fund.
475475 G. E. There is hereby created in the State Treasury a fund for
476476 the Council on Law Enforcement Education and Training to be
477477 designated the "CLEET Fund". The fund shall be subject to
478478 legislative appropriation and shall consist of any monies received
479479 from fees and receipts collected pursuant to the Oklahoma Open
480480 Records Act, reimbursements for parts used in the repair of weapons

533533 of law enforcement officers attending the basic academies, gifts ,
534534 bequests, contributions, tuition, fees, devises and the assessment s
535535 levied pursuant to the fund pursuant to law.
536536 H. F. 1. Any person arrested or convicted of a felony offense
537537 or convicted of a misdemeanor offense of assault and battery,
538538 domestic abuse, stalking, possession of a controlled substance
539539 prohibited under Sch edule IV of the Uniform Controlled Dangerous
540540 Substances Act, outraging public decency, resisting arrest, escaping
541541 or attempting to escape, eluding a police officer, Peeping Tom,
542542 pointing a firearm, threatening an act of violence, breaking and
543543 entering a dwelling place, destruction of property, negligent
544544 homicide or causing a personal injury accident while driving under
545545 the influence of any intoxicating substance shall pay a DNA fee of
546546 One Hundred Fifty Dollars ($150.00). This fee shall not be
547547 collected if the person has a valid DNA sample in the OSBI DNA
548548 Offender Database at the time of sentencing.
549549 2. The court clerk shall cause to be deposited the amount of
550550 One Hundred Fifty Dollars ($150 .00) as collected for every felony
551551 arrest, felony conviction or ever y conviction for a misdemeanor
552552 offense of assault a nd battery, domestic abuse, stalking, possession
553553 of a controlled substance prohibited under the Uniform Controlled
554554 Dangerous Substances A ct, outraging public decency, resisting
555555 arrest, escaping or attempti ng to escape, eluding a police officer,
556556 Peeping Tom, pointing a firearm, threatening an act of violence,

610610 negligent homicide or causing a personal injury accident while
611611 driving under the influ ence of any intoxicating substance as
612612 described in this subsection. The court clerk shall remit the
613613 monies in the fund on a monthly basis directly to the OSBI who shall
614614 deposit the monies into the OSBI Revolving Fund provided for in
615615 Section 150.19a of Tit le 74 of the Oklahoma Statutes for services
616616 rendered or administered by the OSBI.
617617 3. The monies from the DNA sample fee deposited into the OSBI
618618 Revolving Fund shall be used for creating, staffing and maintaining
619619 the OSBI DNA Laboratory and OSBI Combined D NA Index System (CODIS)
620620 Database.
621621 I. G. It shall be the responsibility of the court clerk to
622622 account for and ensure the correctness and accuracy of payments made
623623 to the state agencies ide ntified in Sections 1313.2 through 1313.4
624624 of this title. Payments m ade directly to an agency by the court
625625 clerk as a result of different types of assessments and fees
626626 pursuant to Sections 1313.2 through 1313.4 of this title shall be
627627 made monthly to each s tate agency.
628628 SECTION 3. AMENDATORY 22 O.S. 2021, Section 988.9, is
629629 amended to read as follows :
630630 Section 988.9 A. Any offender sentenced to a community
631631 sentence pursuant to the Oklahoma Community Sentencing Act which
632632 requires supervision shall be required to pay a supervision fee.

685685 The supervising agency shall establish the fee amount, not to exce ed
686686 Forty Dollars ($40.00) per month, based upon the offender's ability
687687 to pay. In hardship cases the supervising agency may expressly
688688 waive all or part of the fee. No supervising agency participat ing
689689 in a local community sentencing system shall deny any offender
690690 supervision services for the sole reason that the offender is
691691 indigent. Fees collected for supervision services performed by th e
692692 Department of Corrections shall be paid directly to the Dep artment
693693 to be deposited in the Department of Corrections R evolving Fund.
694694 Supervision services performed by contracted providers other than
695695 the Department shall be paid directly to that contracte d provider.
696696 B. In addition to any supervision fee, eligible Eligible
697697 offenders participating in a local community sent encing system under
698698 a court-ordered community punishment shall be required to pay an
699699 administrative fee to support the local system which shall not
700700 exceed Twenty Dollars ($20.00) per month to be set by the court.
701701 Administrative fees when collected shall b e deposited with the
702702 Community Sentencing Division within the Department of Corrections
703703 and credited to the local community sentencing sy stem for support
704704 and expansion of the local community correct ions system. In the
705705 event the court fails to order the am ount of the administrative fee,
706706 the fee shall be Twenty Dollars ($20.00) per month.
707707 C. B. In addition to any supervision fee and administrative fee
708708 authorized by this section, the court shall asses s court costs, and

761761 may assess program reimbursement costs, restitution, and fines to be
762762 paid by the offender. With the exception of supervision fees, other
763763 fees, costs, fines, restitution, or mo netary obligations ordered to
764764 be paid by the offender shall n ot cease with the termination of
765765 active supervision and su ch obligations shall continue until fully
766766 paid and may be collected in the same manner as court costs.
767767 SECTION 4. AMENDATORY 22 O.S. 2021, Section 991c, is
768768 amended to read as follows:
769769 Section 991c. A. Upon a verdict or plea of g uilty or upon a
770770 plea of nolo contendere, but before a judgment of guilt, the court
771771 may, without entering a judgment of guilt and with the consent of
772772 the defendant, defer further proceedings upon the specific
773773 conditions prescribed by the court not to exceed a seven-year
774774 period, except as authorized under subsection B of this section.
775775 The court shall first consider restitution among the vari ous
776776 conditions it may prescribe. The court may also consider ordering
777777 the defendant to:
778778 1. Pay court costs;
779779 2. Pay an assessment in lieu of any fine authorized by law for
780780 the offense;
781781 3. Pay any other assessment or cost authorized by law;
782782 4. Engage in a term of community service without compensation,
783783 according to a schedule consistent with the employment and family
784784 responsibilities of the defendant;

837837 5. County jail confinement for a period not to exceed ninety
838838 (90) days or the maximum amount of jail ti me provided for the
839839 offense, if it is less than ninety (90) d ays;
840840 6. Pay an amount as reimbursement for reasonable att orney fees,
841841 to be paid into the court fund, if a court -appointed attorney has
842842 been provided to the defendant;
843843 7. Be supervised in the co mmunity for a period not to exceed
844844 eighteen (18) months, unle ss a petition alleging violation of any
845845 condition of deferred judgment is filed during the period of
846846 supervision. As a condition of any supervision, the defendant shall
847847 be required to pay a supe rvision fee of Forty Dollars ($40.00) per
848848 month. The supervision fee shall be waived in whole or part by the
849849 supervisory agency when the accused is indigent. Any fees collected
850850 by the district attorney pursuant to this paragraph shall be
851851 deposited in the General Revenue Fund of the State Treasury. No
852852 person shall be denied supervision based solely on the inability of
853853 the person to pay a fee ;
854854 8. Pay into the court fund a monthly amount not exceeding Forty
855855 Dollars ($40.00) per month during any period duri ng which the
856856 proceedings are deferred when the defendant is n ot to be supervised
857857 in the community. The total amount to be paid into the court fund
858858 shall be established by the court and shall not exceed the amount of
859859 the maximum fine authorized by law for the offense;

912912 9. Make other reparations to the community or v ictim as
913913 required and deemed appropriate by the court;
914914 10. 9. Order any conditions which can be imposed for a
915915 suspended sentence pursuant to paragraph 1 of subsection A of
916916 Section 991a of this t itle; or
917917 11. 10. Any combination of the above provisions.
918918 However, unless under the supervision of the district attorn ey,
919919 the offender shall be required to pay Forty Dollars ($40.00) per
920920 month to the district attorney during the first two (2) years of
921921 probation to compensate the district attorney for the costs incu rred
922922 during the prosecution of the offender and for the ad ditional work
923923 of verifying the compliance of the offender with the rules and
924924 conditions of his or her probation. The district attorney m ay waive
925925 any part of this requirement in the best interests o f justice. The
926926 court shall not waive, suspend, defer or d ismiss the costs of
927927 prosecution in its entirety. However, if the court determines that
928928 a reduction in the fine, costs and costs of prose cution is
929929 warranted, the court shall equally apply the same p ercentage

989989 to the termination or expi ration of the supervision period, order an
990990 extension of supervision for a period not to exceed three (3) years.
991991 C. In addition to any conditions of supervision provided for in
992992 subsection A of this section, the court shall, in the case of a
993993 person before the court for the offense of operating or being in
994994 control of a motor vehicle while the person was under the influence
995995 of alcohol, other intoxicating substance, or a combination of
996996 alcohol and another intoxicating substance, or who is before the
997997 court for the offense of operating a motor vehicle while the ability
998998 of the person to operate such vehicle was impaired due to the
999999 consumption of alcohol, require the person to participate in an
10001000 alcohol and drug substance abuse evaluation program offered by a
10011001 facility or qualified practitioner certified by the Department of
10021002 Mental Health and Substance Abuse Services for the purpose o f
10031003 evaluating the receptivity to treatment and prognosis of the person.
10041004 The court shall order the person to reimburse the facility or
10051005 qualified practitioner for the evaluation. The Department of Me ntal
10061006 Health and Substance Abuse Services shall establish a fee schedule,
10071007 based upon the ability of a person to pay, provided the fee for an
10081008 evaluation shall not exceed Seventy -five Dollars ($75.00). The
10091009 evaluation shall be conducted at a certified facilit y, the office of
10101010 a qualified practitioner or at another lo cation as ordered by the

10691069 Health and Substance Abuse Services sha ll solicit or refer any
10701070 person evaluated pursuant to this subsection for any treatment
10711071 program or alcohol and drug substance abuse service in which the
10721072 person, agency or facility has a vested int erest; however, this
10731073 provision shall not be construed to proh ibit the court from ordering
10741074 participation in or any perso n from voluntarily utilizing a
10751075 treatment program or alcohol and drug substance abuse service
10761076 offered by such person, agency or facility. Any evaluation report
10771077 submitted to the court pursuant to thi s subsection shall be handled
10781078 in a manner which will keep the report confidential from review by
10791079 the general public. Nothing contained in this subsection shall be
10801080 construed to prohibit the court from ordering judgment and sentence
10811081 in the event the defenda nt fails or refuses to comply with an order
10821082 of the court to obtain the evaluation required by this subsection.
10831083 As used in this subsection, "qualified practitioner" means a person
10841084 with at least a bachelor's degree in substance abuse treatment,
10851085 mental health or a related health care field and at least two (2)
10861086 years of experience in providing alcohol abuse treatment, other drug
10871087 abuse treatment, or both alcohol and other drug abuse treatment who

11411141 Substance Abuse Services to provide these assessments. Howev er, any
11421142 person who does not meet the requirements for a qualified
11431143 practitioner as defined herein, but who has been previously
11441144 certified by the Department of Mental Health and Substance Abuse
11451145 Services to provide alcohol or drug treatment or assessments, sha ll
11461146 be considered a qualified practitioner provided all education,
11471147 experience and certification requirements stated herein are met by
11481148 September 1, 1995. The court may also require the person to
11491149 participate in one or both of the following:
11501150 1. An alcohol and drug substance abuse course, pursuant to
11511151 Sections 3-452 and 3-453 of Title 43A of the Oklahoma Statutes; and
11521152 2. A victims impact panel program, as defined in subsection H
11531153 of Section 991a of this title, if such a program is offered in the
11541154 county where the judgment is rendered. The defendant shall be
11551155 required to pay a fee of Seventy -five Dollars ($75.00) as set by the
11561156 governing authority of the program and approved by the court to the
11571157 victims impact panel program to offset the cost of participation by
11581158 the defendant, if in the opinion of the court the defendant has the
11591159 ability to pay such fee.
11601160 D. Upon completion of the conditions of the de ferred judgment,
11611161 and upon a finding by the court that the con ditions have been met
11621162 and all fines, fees, and monetary as sessments have been paid as
11631163 ordered, the defendant shall be discharged without a court judgment

12191219 procedure to expunge the record of the defendant shall be as

12211221 1. All references to the name of the defendant shall be deleted
12221222 from the docket sheet;
12231223 2. The public index of the filing of the charge shall be
12241224 expunged by deletion, mark -out or obliteration;
12251225 3. Upon expungement, the court clerk shall keep a separate
12261226 confidential index of case n umbers and names of defendants which
12271227 have been obliterated pursuant to the provisions of this section;
12281228 4. No information concerning the confidential file shall be
12291229 revealed or released, except upon written order of a judge of the
12301230 district court or upon wri tten request by the named defendant to the
12311231 court clerk for the purpo se of updating the criminal history record
12321232 of the defendant with the Oklahoma State Bureau of Investigation;
12331233 and
12341234 5. Defendants qualifying under Section 18 of this title may
12351235 petition the court to have the filing of the indictment and the
12361236 dismissal expunged from the public index and docket sheet. This
12371237 section shall not be mutually exclusive of Section 18 of this title.

12951295 the necessity of a court order requesting the unsealing of such

12971297 E. The provisions of subsection D of this secti on shall be
12981298 retroactive.
12991299 F. Whenever a judgment has been deferred by the court according
13001300 to the provisions of this section, deferred jud gment may not be
13011301 accelerated for any technical violation unless a pe tition setting
13021302 forth the grounds for such accelerat ion is filed by the district
13031303 attorney with the clerk of th e sentencing court and competent
13041304 evidence justifying the acceleration of the ju dgment is presented to
13051305 the court at a hearing to be held for that pu rpose. The hearing
13061306 shall be held not more than twe nty (20) days after the entry of the
13071307 plea of not guilty to the petition, unless waived by both the state
13081308 and the defendant. Any accelera tion of a deferred sentence based on
13091309 a technical violation shall not exceed ninety (90) days for a first
13101310 acceleration or five (5) years for a second or subsequent
13111311 acceleration.
13121312 G. Upon any violation of the deferred judgment, other than a
13131313 technical violation, the court may enter a judgment of guilt and
13141314 proceed as provided in Section 991a of this title or may modify any

13691369 offense, the defendant shall not be allowed bail pending appeal.
13701370 H. The deferred judgment procedure described in this section
13711371 shall apply only to defendants who have not been previously
13721372 convicted of a felony offense and have not received more than one
13731373 deferred judgment for a felony offense within the ten (10) years
13741374 previous to the commission of the pending offense.
13751375 Provided, the court may waive this prohibition upon written
13761376 application of the district attorney. Both the application and the
13771377 waiver shall be made a pa rt of the record of the case.
13781378 I. The deferred judgment procedure de scribed in this section
13791379 shall not apply to defendan ts found guilty or who plead guilty or
13801380 nolo contendere to a sex offense required by law to register
13811381 pursuant to the Sex Offenders Registr ation Act.
13821382 J. All defendants who are supervised pursuant to this se ction
13831383 shall be subject to the sanction process as e stablished in
13841384 subsection D of Section 991b of this title.
13851385 K. Notwithstanding the provisions of subsections F and G of
13861386 this section, a person who is being considered for an acceleration
13871387 of a deferred judgment for an offense where the penalty has
13881388 subsequently been lowered to a misdemeanor shall only be subject to
13891389 a judgment and sentence that would have been applicable had he or
13901390 she committed the offense after July 1, 2017.

14451445 Section 991d. A. 1. When the court orders supervision by the
14461446 Department of Corrections, or the district attorney re quires the
14471447 Department to supervise any person pursuant to a deferred
14481448 prosecution agreement, t he person shall be require d to pay a
14491449 supervision fee of Forty Dollars ($40.00) per month during the
14501450 supervision period, unless the fee would impose an unnecessary
14511451 hardship on the person. In hardship cases, the Department shall
14521452 expressly waive all or part of the fee. The court sha ll make
14531453 payment of the fee a condition of the sentence which shall be
14541454 imposed whether the supervision is incident to the suspending of
14551455 execution of a sentence, incident to the suspending of imposition of
14561456 a sentence, or incident to the deferral of proceedin gs after a
14571457 verdict or plea of guilty. The Department shall determine methods
14581458 for payment of supervision fee, and may charge a reasonable user fee
14591459 for collection of supervision fees electronically. The De partment
14601460 is required to report to the sentencing co urt any failure of the
14611461 person to pay supervision fees and to report immediately if the
14621462 person violates any condition of the sentence.
14631463 2. When the court imposes a suspended or deferred sentence for
14641464 any offense and does not order s upervision by the Departme nt of

15321532 the victim by the office of the district att orney as provided in
15331533 Section 991f of this title or Section 991f -1.1 of this title.
15341534 B. The Pardon and Parole Board shall require a supervision fee
15351535 to be paid by the parolee as a condition of parole which shall be
15361536 paid to the Department of Corrections. The Department shall
15371537 determine the amount of the fee as provided for other persons under
15381538 supervision by the Department.
15391539 C. Upon acceptance of an offender by the Depa rtment of
15401540 Corrections whose probation or parole supervision was tran sferred to
15411541 Oklahoma through the Interstate Compact Agreement, or upon the

19051905 F. In addition to the amounts collected pur suant to paragraphs
19061906 1 through 6 of subsection A of this section, the sum of Three
19071907 Dollars ($3.00) shall be assessed and credited to the Office of the
19081908 Attorney General Victim Services Unit.
19091909 G. In addition to the amounts collected pursuant to paragraphs
19101910 1 through 6 of subsection A of this section, the sum of Three
19111911 Dollars ($3.00) shall be assessed and credited to the Child Abuse
19121912 Multidisciplinary Account. This fee shall not be used for purposes
19131913 of hiring or employing any law enforcement officers.
19141914 H. In addition to the amount collected pursuant to paragraphs 5
19151915 and 6 of subsection A of this section, the sum of Fifteen Dollar s
19161916 ($15.00) shall be assessed in every misdemeanor or felony case for
19171917 each offense of driving under the influence of alcohol or othe r

19731973 I. Prior to conviction, parties in criminal cases shall not be
19741974 required to pay, advance , or post security for the issuance or
19751975 service of process to obtain compul sory attendance of witnesses.
19761976 J. G. The amounts to be assessed as court costs upon filing of
19771977 a case shall be those amounts above -stated in paragraph 3 or 4 of
19781978 subsection A and subse ctions B, C, D and E of this section.
19791979 K. H. The fees collected pursuant t o this section shall be
19801980 deposited into the court fu nd, except the following:
19811981 1. A court clerk issuing a misdemeanor warrant is entitled to
19821982 ten percent (10%) of the sheriff's service fee, provided for in
19831983 paragraph 9 of subsection A of this section, collect ed on a warrant
19841984 referred to the contractor for the misdemeanor warrant notification
19851985 program governed by Sections 514.4 and 514.5 of Title 19 of the
19861986 Oklahoma Statutes. This ten -percent sum shall be deposited into the
19871987 issuing Court Clerk's Revolving Fund, c reated pursuant to Section
19881988 220 of Title 19 of the O klahoma Statutes, of the court clerk issuing
19891989 the warrant with the balance of the sheriff's service fee to be
19901990 deposited into the She riff's Service Fee Account, created pursuant

22082208 2. Upon receipt of a report fro m a district court of a failure
22092209 to comply with a wildlife citation or sentence as set forth in
22102210 paragraph 1 of this subsection the D epartment shall suspend or

22122212 held by the person until satis factory evidence of compliance with
22132213 the wildlife citation or sentence of the district court is furnished
22142214 to the Department by the d istrict court. Upon receipt of
22152215 notification of compliance from the distri ct court, the Department
22162216 shall terminate the suspen sion action, unless the suspension is
22172217 otherwise required.
22182218 B. Except as provided for in subsection C of this section, when
22192219 the district court notifies the Department of Wildlife Conservation

28062806 G. 1. Except as authorized by the Uniform Controlled Dangerous
28072807 Substances Act, it shall be unlawful for any person to manufacture
28082808 or attempt to manufacture any controlled dangerous substance or
28092809 possess any substance listed in Section 2 -322 of this title or any
28102810 substance containing any detectable amount of p seudoephedrine or its
28112811 salts, optical isomers or salts of optical isomers, iodine or its
28122812 salts, optical isomers or salts of optical isomers, hydriodi c acid,
28132813 sodium metal, lithium metal, anhydrous ammonia, phosphorus, or
28142814 organic solvents with the intent to u se that substance to
28152815 manufacture a controlled dangerous substance.
28162816 2. Any person violating the provisions of this subsection with
28172817 respect to the unlawful manufacturing or attempting to unlawfully
28182818 manufacture any controlled dangerous substance, or possessi ng any
28192819 substance listed in this subsection or Section 2 -322 of this title,
28202820 upon conviction, is guilty of a felony and shall be punished by
28212821 imprisonment for not less than seven (7) years nor more than life
28222822 and by a fine of not less than Fifty Thousand Dolla rs ($50,000.00),
28232823 which shall be in addition to other punishment provided by law and
28242824 shall not be imposed in lieu of other punishment. The possessio n of
28252825 any amount of anhydrous ammonia in an unauthorized container sh all
28262826 be prima facie evidence of intent to use such substance to
28272827 manufacture a controlled dangerous substance.

30383038 4. Any sentence to the cus tody of the Department of Corrections
30393039 for any violation of paragraph 3 of this subsection shall not be
30403040 subject to statutory provisions for suspended sentences, deferred
30413041 sentences, or probation. A person convicted of a secon d or
30423042 subsequent violation of the provisions of paragraph 3 of this
30433043 subsection shall be punished as a habitual offender pursuant to
30443044 Section 51.1 of Title 21 of the Oklahoma Statutes and shall be
30453045 required to serve a minimu m of eighty-five percent (85%) of th e
30463046 sentence received prior to bec oming eligible for state correctional
30473047 earned credits or eligibility for parole.
30483048 5. Any person who has been convicted of manufacturing or
30493049 attempting to manufacture methamphetamine pursuant to the provisions
30503050 of this subsection and who, after such conviction , purchases or
30513051 attempts to purchase, receive or oth erwise acquire any product,
30523052 mixture, or preparation containing any detectable quantity of base
30533053 pseudoephedrine or ephedrine shall, upon c onviction, be guilty of a
30543054 felony punishable by imprisonment in the c ustody of the Department

31093109 H. Any person convicted of any offense described in the Uniform
31103110 Controlled Dangerous Substances Act may, in addition to the fine
31113111 imposed, be assessed an amount not to e xceed ten percent (10%) of
31123112 the fine imposed. Such assessment shall be paid into a revolving
31133113 fund for enforcement of controlled dangerous substances created
31143114 pursuant to Section 2-506 of this title.
31153115 I. Any person convicted of any offense described in this
31163116 section shall, in addition to any fine imposed, pay a special
31173117 assessment trauma-care fee of One Hundred Dollars ($100.00) to be
31183118 deposited into the Trauma Care Assistance Rev olving Fund created in
31193119 Section 1-2522 of this title.
31203120 J. For purposes of this secti on, "public housing project" means
31213121 any dwelling or accommodations operated as a state or federally
31223122 subsidized multifamily housing project by any housing authority,
31233123 nonprofit corporation or municipal develo per or housing projects
31243124 created pursuant to the Okl ahoma Housing Authorities Act.
31253125 K. When a person is found guilty o f a violation of the
31263126 provisions of this section, the court shall order, in addition to
31273127 any other penalty, the defendant to pay a one -hundred-dollar
31283128 assessment to be deposited in the Drug Abu se Education and Treatment
31293129 Revolving Fund created in Section 2 -503.2 of this title, upon
31303130 collection.

32703270 B. Any person who violates this section with respect to:
32713271 1. Any Schedule I or II substance, except mari juana or a
32723272 substance included in subsection D of Section 2 -206 of this title,

37163716 holding an unrevoked license in the pro fessions of podiatry,
37173717 dentistry, medicine, nursing, optometry, osteo pathy, veterinary
37183718 medicine or pharmacy.
37193719 C. No person shall deliver, sell, possess or manufacture drug
37203720 paraphernalia knowing, or under circumstances where one reasonably
37213721 should know, that it will be used to plant, propagate, cultivate,
37223722 grow, harvest, manuf acture, compound, con vert, produce, process,
37233723 prepare, test, analyze, pack, repack, store, contain, conceal,
37243724 inject, ingest, inhale or otherwise introduce into the human body a
37253725 controlled dangerous substance in violation of the Uniform
37263726 Controlled Dangerous Substances Act.
37273727 D. Any person eighteen (18) years of age or over who violates
37283728 subsection C of this section by delivering or selling drug
37293729 paraphernalia to a person under eighteen (18) year s of age shall,
37303730 upon conviction, be guilty of a felony.
37313731 E. Any person who violates subsections subsection A, B or C of
37323732 this section shall, upon conviction, be guilty of a misdemeanor
37333733 punishable as follows:
37343734 1. For a first offense the person shall be punis hed by

38693869 substance by misrepresentation, fraud, forgery, dec eption or
38703870 subterfuge;
38713871 4. To furnish false or fraudulent material in formation in, or
38723872 omit any material information from , any application, report, or
38733873 other document required to be kept or filed under this act, or any
38743874 record required to be kept by Section 2 -101 et seq. of this title;
38753875 and
38763876 5. To make, distribute, or possess a ny punch, die, plate,
38773877 stone, or other thing designe d to print, imprint, or reproduce the
38783878 trademark, trade name, or other identifying mark, imprint, or device
38793879 of another or any likeness of any of the foregoing upon any drug or
38803880 container or labeling thereof so as to render such drug a
38813881 counterfeit controlled dangerous substance.
38823882 B. Any person who violates this section is guilty of a felony
38833883 punishable by imprisonment for not more than twenty ( 20) years or a
38843884 fine of not more than Two Hundred Fifty Thousand Doll ars

40184018 dangerous substance or a prescription for a controlled dangerous
40194019 substance of the same or similar therapeutic use from another
40204020 practitioner within the previous thirty (30) days.
40214021 B. Except as authorized by this act Section 2-101 et seq. of
40224022 this title, a person shall not manufacture, create, deliver, or
40234023 possess with intent to manufacture, create, or deliver or possess a
40244024 prescription form, an or iginal prescription form, or a counterfeit
40254025 prescription form. This shall not apply to th e legitimate
40264026 manufacture or delivery of prescription forms, or a person acting as
40274027 an authorized agent of the practitioner.
40284028 C. Information communicated to a physician in an effort
40294029 unlawfully to procure a controlled dangerous substance, or
40304030 unlawfully to procure the administration of any such drug, shall not
40314031 be deemed a privileged communication.
40324032 D. Any person who violates this section is guilty of a felony
40334033 punishable by imprisonment for not more than ten (10) years, by a
40344034 fine of not more than Ten Thousand Dollars ($10,000.00), or by both
40354035 such fine and imprisonment. A second or subsequent offense under
40364036 this section is a felony punishable by impri sonment for not less
40374037 than four (4) years nor more than twenty (20) years, by a fine of

41684168 C. The provisions of subsections A and B of this sectio n shall

41704170 1. The possession and use of a substance specified in
41714171 subsection A of this section which is used as part of the ca re or
41724172 treatment by a licensed physician of a disease, condition or i njury
41734173 or pursuant to a prescription of a licensed p hysician; and
41744174 2. The possession of a substance specified in subsection A of
41754175 this section which is used as part of a known manufacturing process
41764176 or industrial operation when the possessor has obtained a pe rmit
41774177 from the State Department of Health.
41784178 D. The State Board of Health shall promulgate rules and
41794179 regulations establishing procedures for the application, form and
41804180 issuance of a permit to legitimate manufacturing and industrial
41814181 applicants as provided for in subsection C of this section.
41824182 E. Any person convicted of violating any provision of
41834183 subsection A or B of this section shall be guilty of a misdemeanor
41844184 punishable by imprisonment in the county jail not to exceed ninety
41854185 (90) days or by the imposition of a fine not to exceed Five Hundred
41864186 Dollars ($500.00), or by both such imprisonment and fine. Each
41874187 violation shall be considered a separate offense.
41884188 F. Any person convicted of any offense described in this
41894189 section shall, in addition to any fine imposed, pa y a special

43334333 Any person who commits the conduct described in paragraph 1, 2
43344334 or 3 of this subsection and represents the quantity of the
43354335 controlled substance to be an amount described in subsection C o f
43364336 this section shall be punished under the provisions appropriate for
43374337 the amount of controlled substance represented, regardless of the
43384338 actual amount.
43394339 C. In the case of a vio lation of the provisions of su bsection B

49274927 not less than four ( 4) years nor more than life, for which the
49284928 person shall serve fifty percent (50%) of the sentence before being
49294929 eligible for parole consideration;
49304930 3. For trafficking, a third or subsequent violation of this
49314931 section, a term of imprisonment in the custody of the Department of
49324932 Corrections of not less than twenty (20) years no r more than life,
49334933 of which the person shall serve f ifty percent (50%) of the sentence
49344934 before being eligible for parole consideration.
49354935 Persons convicted of trafficking shall not be eligible for
49364936 earned credits or any other type of credits which have the effe ct of
49374937 reducing the length of sentence to less than fifty percent (50%) of
49384938 the sentence imposed; and
49394939 If the person is convicted of agg ravated trafficking, the person
49404940 shall serve eighty-five percent (85%) of such sentence before being
49414941 eligible for parole con sideration.
49424942 E. The penalties specified in subsecti ons C and D of this
49434943 section are subject to the enhancements enumerated in subsecti ons E
49444944 and F of Section 2-401 of this title.
