9595 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

150150 This act shall be known and may be cited as the "Administrative
151151 Hearings Reform Act".
152152 SECTION 2. AMENDATORY 75 O.S. 2021, Section 308a, is
153153 amended to read as follows:
154154 Section 308a. The provisions of Article II of the
155155 Administrative Procedures Act govern the hearing procedures of
156156 agencies, and does not grant jurisdiction, n ot otherwise provided by
157157 law. The Legislature reco gnizes that agencies take actions and make
158158 decisions, other than by through the individual proceedings for
159159 which the right to ju dicial review is intended to be exercised
160160 pursuant to other laws process.
161161 SECTION 3. NEW LAW A new section of law to be codified
162162 in the Oklahoma Statutes a s Section 308b of Title 75, unless there
163163 is created a duplication in numbe ring, reads as follows:
164164 A. No agency shall conduct an individual proceeding, quasi-
165165 judicial hearing, or other process of a judicial or quasi-judicial
166166 nature to resolve complaints between parties, to review decisions
167167 made by an agency against an individual , corporation, or entity, to
168168 review pending applications of an individual, corporation, or
169169 entity, or to hear evidence brought by affected parties to any
170170 proposed applications. All complaints between an agency and another
171171 party, or individual proceedings as prescribed by the Oklahoma
172172 Statutes, shall be filed and adjudicated in the applicable district
173173 court in accordance with the Oklahoma Statutes.

225225 B. All agencies are proh ibited from hiring administrative law
226226 judges or hearing examiners to conduct proceedings and hearings as
227227 described by this section or to resolve disputes between parties.
228228 C. Oklahoma district courts shall have exclusive jurisdiction
229229 over all disputes arising from or related to state agency actions.
230230 D. Unless otherwise provided by law, individual proceedin gs or
231231 other administrative disputes as described in this section shall be
232232 filed in the district court of the county in which the alleged
233233 decision, conduct, or violation occurred.
234234 E. District courts shall issue final orders in accordance with
235235 Section 312 of this title.
236236 F. All parties involved in a n administrative dispute shall have
237237 the right to present their case before a judge and seek remedies
238238 available under applicable law.
239239 G. Any administrative judges or hearing examiners currently
240240 employed by state agencies shall b e reassigned to other roles within
241241 the respective agencies or phased o ut in accordance with existing
242242 employment policies.
243243 SECTION 4. AMENDATORY 75 O.S. 2021, Section 309, is
244244 amended to read as follows:
245245 Section 309. A. In an individual procee ding, all parties shall
246246 be afforded an opportunity for hearing after reasonable notice.
247247 B. The notice shall include:
248248 1. A statement of the time, place, and nature of the hear ing;

300300 2. A statement of the legal autho rity and jurisdiction under
301301 which the hearing is to be held;
302302 3. A reference to th e particular sections of the statutes and
303303 rules involved; and
304304 4. A short and plain statement of the matters asserted. If the
305305 agency or other party is unable to state the ma tters in detail at
306306 the time the notice is served, the initial notice may be limite d to
307307 a statement of the issues involved. Thereafter u pon application a
308308 more definite and detail ed statement shall be furnished.
309309 C. Opportunity shall be afforded all parties to respond and
310310 present evidence and argu ment on all issues involved.
311311 D. Deliberations by administrative heads, hearing examiners,
312312 and other persons authorized by law may be hel d in executive session
313313 pursuant to paragraph 8 of subsection B of Section 307 of Title 25
314314 of the Oklahoma Statutes.
315315 E. Unless precluded by law, informal dispo sition may be made of
316316 any individual proceeding by sti pulation, agreed settlement, consent
317317 order, or default.
318318 F. E. The record in an indiv idual proceeding shall include:
319319 1. All pleadings, motions , and intermediate rulings;
320320 2. Evidence received or consider ed at the individual
321321 proceeding;
322322 3. A statement of ma tters officially noticed;

380380 or administrative head district judge in connection with their
381381 consideration of the case, provided all parties have had access to
382382 such evidence.
383383 G. F. Oral proceedings shall be electronically recorded. Such
384384 recordings shall be maintained for such time so as to protect the
385385 record through judicial review. Copies of the recordings shall be
386386 provided by the agenc y at the request of any party to the
387387 proceeding. Costs of transcription of the recordings shal l be borne
388388 by the party requesting the tra nscription. For judicial review,
389389 electronic recordings of an individual proce eding, as certified by
390390 the agency, may be submitted to the reviewing court by the agency as
391391 part of the record of the proceedings under review without
392392 transcription unless otherw ise required to be transcribed by the
393393 reviewing court. In such case, the expe nse of transcriptions shall
394394 be taxed and assessed against the nonprevailing party. Parties to
395395 any proceeding may have the proceedings t ranscribed by a court
396396 reporter at their ow n expense.

448448 H. G. Findings of fact shall be based exclusively on the
449449 evidence received and on matters officially noticed in the
450450 individual proceeding unless other wise agreed upon by the parties on
451451 the record.
452452 SECTION 5. AMENDATORY 75 O.S. 2021, Section 310 , is
453453 amended to read as follows:
454454 Section 310. In individual proceedings:
455455 1. Agencies District judges may admit and give probative effect
456456 to evidence which possesses probative value commonly accepted by
457457 reasonably prudent persons in the conduct of their affairs . They
458458 shall give effect to the rules of privilege recognized by law in
459459 respect to: self-incrimination; confidential communications between
460460 husband and wife during the subsistence of the marriage rela tion;
461461 communication between attorney and client, made in that relation;
462462 confessions made to a cl ergyman or priest in his or her professio nal
463463 capacity in the course of discipline enjoined by the c hurch to which
464464 he or she belongs; communications made by a pa tient to a licensed
465465 practitioner of one of the healing arts with reference to any
466466 physical or supposed physical disease or of knowledge g ained by a
467467 practitioner through a physical examination of a patient made in a
468468 professional capacity; records and files of any official or agency
469469 of any state or of the Unite d States which, by any statute of a
470470 state or of the United States are made confiden tial and privileged.
471471 No greater exclusionary effect shall be given any such rule or

523523 privilege than would obtain in an action in court. Agencies
524524 District judges may exclude incompetent, irrelevant, immaterial , and
525525 unduly repetitious evidence. Objections to evidentiary offers may
526526 be made and shall be noted in th e record. Subject to these
527527 requirements, when a hearing will be expedited and the interests of
528528 the parties will not be prejudiced substantially, any p art of the
529529 evidence may be received in written form;
530530 2. Documentary evide nce may be received in the form of copies
531531 or excerpts, if the original is not readily availa ble. Upon
532532 request, parties shall be given an opportun ity to compare the copy
533533 with the original;
534534 3. A party may conduct cross-examinations required for a full
535535 and true disclosure of the facts;
536536 4. Notice may be taken of judicially cognizable facts. In
537537 addition, notice may be taken of generally recognized te chnical or
538538 scientific facts within t he agency's specialized knowledge. Parties
539539 shall be notified either befor e or during the hearing, or by
540540 reference in preliminary reports or otherwise, of the materia l
541541 noticed to be proposed for judicial notice , including any staff
542542 memoranda or data, and they sh all be afforded an opportunity to
543543 contest the material so if noticed. The agency's experience,
544544 technical competence, and specialized knowledge may be utilized in
545545 the evaluation of the evidence.

597597 5. Any party shall at all times have the right to counsel,
598598 provided that such counsel must be duly licensed to practice law by
599599 the Supreme Court of Oklahoma, a nd provided further that counsel
600600 shall have the right to appe ar and act for and on behalf of the
601601 party represented.
602602 6. A party may request the exclusion of witnesses to the
603603 extent and for the purposes stated in Section 2615 of Title 12 of
604604 the Oklahoma Statutes. Exclusion of a witness shall not be a
605605 violation of the Oklahoma Open Meeting Act.
606606 SECTION 6. AMENDATORY 75 O.S. 2021, Section 312, is
607607 amended to read as follows:
608608 Section 312. A. A final agency order adverse to a party of
609609 the district court on an individual proceeding or other hearing
610610 under this act shall:
611611 1. Be in writing; and
612612 2. Include findings of fact and conclusions of law, separate ly
613613 stated. Findings of fac t, if set forth in st atutory language, shall
614614 be accompanied by a concise and explicit statem ent of the underlying
615615 facts supporting the findings. If, in accordance with agency rules,
616616 a party submitted proposed findings of fact, t he final agency order
617617 shall include a ruling upo n each proposed finding.
618618 B. Parties shall be notified either personall y or by certified
619619 mail, return receipt re quested, of any final agency order. Upon

671671 request, a copy of the order shall be delivered or mai led forthwith
672672 to each party and to his or her attorney of record.
673673 C. When the district judge issues a final order, that order
674674 shall be binding on all parties and becomes the final order of the
675675 applicable agency without further proceeding unless there is a
676676 request for rehearing, reo pening, or reconsider ation pursuant to
677677 Section 317 of this title.
678678 SECTION 7. AMENDATORY 75 O.S. 2021, Section 315, is
679679 amended to read as follows:
680680 Section 315. A. 1. The agency conducting any parties subject
681681 to an individual proceeding or agency investigation shall have p ower
682682 to require the furnishing of such information, th e attendance of
683683 such witnesses, and the pr oduction of such books, records, papers o r
684684 other objects as may be necessary and proper fo r the purposes of the
685685 proceeding or investigation.
686686 2. The agency, or any party to a proceeding before it, may take
687687 the depositions of witnesses, within o r without the state, in the
688688 same manner as is provided by law for the taking of depositions in
689689 civil actions in courts o f record. Depositions so taken shall be
690690 admissible in any procee ding affected by this act. P rovided,
691691 however, all or any part of the d eposition may be objected to at
692692 time of hearing, and may be received in evidence or excluded from
693693 the evidence by the agency or individual conducting the hearin g
694694 district court judge in accordance with the law with reference to

747747 record under the law of the State of Oklahoma.
748748 B. In furtherance of the powers gran ted by subsection A of this
749749 section, any agency, administrative h ead, hearing examiner or any
750750 other duly authorized member or empl oyee thereof, upon its own
751751 motion may, and upon the request of any party appearing in subject
752752 to an individual proceeding , or district judge shall may:
753753 1. Issue subpoenas for witnesses;
754754 2. Issue subpoenas duces tecum t o compel the production of
755755 books, records, papers or other objects, which may be served by the
756756 marshal of the agency or by any person in any manner prescribed for
757757 the service of a subpoena in a civil ac tion; or
758758 3. C. Quash The district judge may quash a subpoena or
759759 subpoenas duces tecum so issued; provided, prior to quashing a
760760 subpoena or subpoenas duces tecum the agency court shall give notice
761761 to all parties. A su bpoena or subpoenas duces tecum may not be
762762 quashed if any party objects.
763763 C. D. 1. In case of disobedience to any subpoena issued and
764764 served under this section or to any lawful a gency requirement for
765765 information, or of the refusal of any person to testify t o any
766766 matter regarding which he or she m ay be interrogated la wfully in a
767767 proceeding before an agency, the agency may apply t o the district or
768768 superior court of the county of such person 's residence or to any
769769 judge thereof for an order to compel compliance with the subpoena or

822822 Forthwith, the court or the judge shall cite the respondent to
823823 appear and shall hear the matter as expeditious ly as possible.
824824 2. If the disobedience or refusal is found to be unlawful, the
825825 court, or the judge, shall enter an order requi ring compliance.
826826 Disobedience of such an order shall be punish ed as contempt of court
827827 in the same manner and by the same procedu re as is provided for like
828828 conduct committed in the co urse of judicial proceedings.
829829 SECTION 8. AMENDATORY 75 O.S. 2021, Section 316, is
830830 amended to read as follows:
831831 Section 316. A hearing examiner or agency member district
832832 judge shall withdraw from any individual proceeding in which he
833833 cannot accord a fair and impartial hearing or consideration. Any
834834 party may request the disquali fication of a hearing examiner or
835835 agency member district judge, on the ground of his or her inability
836836 to give a fair and impartial hearing, by filing an affidavit a
837837 motion, promptly upon discovery of the alleged disqualificati on,
838838 stating with particularity the grounds upon which it is claimed that
839839 a fair and impartial he aring cannot be accorded. The issue shall be
840840 determined promptly by the administrative he ad of the agency, or, if
841841 it affects a member or members of the agency, by the remaining
842842 members thereof, if a quorum. Upon the entry of an order of
843843 disqualification affecting a hearing examiner, the agency shall
844844 assign another in his stead or shall conduc t the hearing itself.

896896 Upon the disqualification of a member of an age ncy, the agency shall
897897 proceed with the proceeding if a quorum remains. If a quorum no
898898 longer exists, by virtue of the member's disqualification, the
899899 Governor immediately shall appoint a member pro tempore to sit in
900900 place of the disqualified member in that proceeding. In further
901901 action, after the disqualific ation of a member of an agency, the
902902 provisions of Section 311 of this title shall apply. The
903903 disqualification shall be addressed in accordance with Rule 15 of
904904 Title 12 of the Oklahoma Statutes.
905905 SECTION 9. AMENDATORY 75 O.S. 20 21, Section 317, is
906906 amended to read as follows:
907907 Section 317. A. A final agency order issued by an
908908 administrative head of a n agency a district judge for an individual
909909 proceeding shall be subject to reh earing, reopening or
910910 reconsideration by such administrative head district judge. Any
911911 application or request for such rehearing, reopen ing or
912912 reconsideration shall be made by an y party aggrieved by the final
913913 agency order within ten (10) days from the date of the entry of such
914914 final agency order and shall state the grounds for the requested
915915 action. The grounds for such action shall be eit her:
916916 1. Newly discovered or newly available evidence, relevant to
917917 the issues;
918918 2. Need for additional evidence adequatel y to develop the facts
919919 essential to proper decision;

971971 3. Probable error committed by the agency judge in the
972972 proceeding or in its decis ion such as would be ground for reversal
973973 on judicial review of the final agency order appeal of the final
974974 order;
975975 4. Need for further consideration of the issues and the
976976 evidence in the public interest; or
977977 5. A showing that issues not previously considere d ought to be
978978 examined in order properly t o dispose of the matter.
979979 B. The order of the agency court granting or denying rehearing,
980980 reconsideration or review, or the petition of a party therefor,
981981 shall set forth the grounds which justify such action.
982982 C. Nothing in this section shall prevent rehea ring, reopening

988988 D. On reconsideration, reopening, or rehearing, t he matter may
989989 be heard by the agency, or it may be referred to a hearing examiner
990990 shall be heard by the district court judge who conduc ted the initial
991991 proceedings. The hearing shall be confined to those grounds upon
992992 which the reconsideration, reopening or rehearing was ordered.
993993 E. If an application for rehearing shall be timely filed, the

10481048 E. The filing of a proceedin g for reconsideration, reopening,
10491049 or rehearing shall not stay enforcement of the final order but the
10501050 court may order a stay upon such terms as it deems proper, and shall
10511051 do so whenever required by subsection F of this section.
10521052 F. In an individual proceeding in any court for the
10531053 reconsideration, reopening, or rehearing of a final order, upon the
10541054 filing of an applicat ion, supported by ver ified statements of
10551055 material fact establi shing that the enforcement of the order pending
10561056 review of the application would result in present, continuous, and
10571057 irreparable impairment of the constitutional rights of the
10581058 applicant, a stay of the enforce ment of such order and of the
10591059 accrual of penalties thereunder shall be entered upon the condition
10601060 that:
10611061 1. Injury to adverse parti es or to the public, as the case may
10621062 be, can be obviated through the furnishing of security ade quate to
10631063 compensate for any lo ss which may be suffered as a result of the
10641064 stay in the event the order is affirmed, in whole or in p art;
10651065 2. A supersedeas bond, in the amount and with sureties
10661066 prescribed and approved by the court, in its sound judicial
10671067 discretion, as adequate to meet requirement 1, be filed with such
10681068 court. If an application for supersedeas hereunder, accompanied by
10691069 a proposal for a supersedeas bond , is not acted upon by the court

11281128 SECTION 10. AMENDATORY 75 O.S. 2021, Section 323, is
11291129 amended to read as follows:
11301130 Section 323. An aggrieved party, or the agency, w ithout any
11311131 motion for a new trial, may secure a rev iew of any final order or
11321132 judgment of a district or superior court under this act by appeal to
11331133 the Supreme Court. Such appeal shall be taken in the manner and
11341134 time provided by law for appeal to the Suprem e Court from the
11351135 district court in civil actions. An agency taking an appeal shall
11361136 not be required to give bond.
11371137 SECTION 11. REPEALER 75 O.S. 2021, Section 311, is
11381138 hereby repealed.
11391139 SECTION 12. REPEALER 75 O.S. 2021, Section 311.1, is
11401140 hereby repealed.
11411141 SECTION 13. REPEALER 75 O.S. 2021, Section 311.2, as
