7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 74 O.S. 2021, Section 150.5, is
7979 amended to read as follows:
8080 Section 150.5 A. 1. Oklahoma State Bureau of Investigation
8181 investigations not covered under Section 150.2 of this title shall
8282 be initiated at the request of the following persons:
8383 a. the Governor,
8484 b. the Attorney General,
8585 c. the Council on Judicial Complaints upon a vote by a
8686 majority of the Council,
8787 d. the chair of any Legislative Investigating Committee
8888 which has been granted subpoena powers by re solution,

140140 upon authorization by a vote of the majority a member
141141 of the Committee Legislature,
142142 e. the Director of the Department of Human Services, or
143143 designee, as authorized by Section 1 -2-105 of Title
144144 10A of the Oklahoma Statutes, or
145145 f. a district court judge as authorized by Section 1 -2-
146146 103 of Title 10A of the Oklahoma Statutes.
147147 2. Requests for investigations shall be submitted in writing
148148 and shall contain specific allegations of wrongdoing under the laws
149149 of the State of Oklahoma.
150150 B. The Governor may in itiate special background investigations
151151 with the written consent of the person who is the subject of the
152152 investigation.
153153 C. The chair of any Senate committee which is fulfilling the
154154 statutory responsibility for approving nominations made by the
155155 Governor may, upon a vote by a majority of the committee and with
156156 the written consent of the p erson who is to be the subject of the
157157 investigation, initiate a special background investigation of any
158158 nominee for the Oklahoma Horse Racing Commission as established by
159159 Section 201 of Title 3A of the Oklahoma Statutes or any nominee for
160160 the Board of Trustees of the Oklahoma Lottery Commission as
161161 established by Section 704 of Title 3A of the Oklahoma Statutes.
162162 The Bureau shall submit a report to the committee within thirty (30)
163163 days of the receipt of the request. Any consideration by the

215215 committee of a report from the Bureau shall be for the exclusive use
216216 of the committee and shall be considered only in executive session.
217217 D. 1. All records relating to any investigation b eing
218218 conducted by the Bureau, including any records of laboratory
219219 services provided to law enforcement agencies pursuant to paragraph
220220 1 of Section 150.2 of this title, shall be confidential and shall
221221 not be open to the public or to the Commission except as provided in
222222 Section 150.4 of this title; provided, however, officers and agents
223223 of the Bureau may disclose, at the discretion of the Director, such
224224 investigative information to:
225225 a. officers and agents of federal, state, county, or
226226 municipal law enforcemen t agencies and to district
227227 attorneys, in the furtherance of criminal
228228 investigations within their respective jurisdictions,
229229 b. employees of the Department of Human Services in the
230230 furtherance of child abuse investigations, and
231231 c. appropriate accreditation b odies for the purposes of
232232 the Bureau's obtaining or maintaining accreditation.
233233 2. Any unauthorized disclosure of any information contained in
234234 the confidential files of the Bureau shall be a misdemeanor. The
235235 person or entity authorized to initiate investi gations in this
236236 section, and the Attorney General in the case of investigations
237237 initiated by the Insurance Commissioner, shall be kept advised of
238238 the progress of the re quested investigation and shall receive a

290290 report of the results of the requested investi gation. The person or
291291 entity requesting the investigation may give that information only
292292 to the appropriate prosecutorial officer or agency having statutory
293293 authority in the matter if that action appears proper from the
294294 information contained in the report , and shall not reveal or give
295295 such information to any other person or agency. Violation hereof
296296 shall be deemed willful neglect of duty and shall be grounds for
297297 removal from office.
298298 E. It shall not be a violation of this section to reveal
299299 otherwise confidential information to outside agencies or
300300 individuals who are providing interpreter services, questioned
301301 document analysis, laboratory services, or other sp ecialized
302302 services that are necessary in the assistance of Bureau
303303 investigations. Individuals or a gencies receiving the confidential
304304 and investigative information or records or results of laboratory
305305 services provided to the Bureau by those agencies or ind ividuals,
306306 shall be subject to the confidentiality provisions and requirements
307307 established in subsec tion D of this section.
308308 F. It shall not be a violation of this section to reveal for
309309 training or educational purposes otherwise confidential information
310310 from records relating to any investigation previously conducted by
311311 the Bureau, including any records o f laboratory services provided to
312312 law enforcement agencies pursuant to paragraph 1 of subsection A of

364364 Section 150.2 of this title, so long as ten (10) or more years have
365365 passed since the production of the information or record.
366366 G. It shall not be a violation of this section to reveal
367367 otherwise confidential information from records relating to any
368368 investigation being conducted by the Bureau, including any records
369369 of laboratory services provided to law enforcement agencies pursuant
370370 to paragraph 1 of subsection A of Section 150.2 of this ti tle or to
371371 the public, provided, release of the confidential information has
372372 been authorized by the Director of the Bureau for the purposes of
373373 developing or obtaining further information reasonably necessary to
374374 the successful conclusion of a criminal invest igation being
375375 conducted by the Bureau or authorized by the Director of the Bureau
376376 for the purpose of advising crime victims or family representatives
377377 of homicide victims regarding the status of a pending investigation.
378378 H. The State Treasurer shall initiat e a complete background
379379 investigation of the positions with the written consent of the
380380 persons who are the subject of the investigation pursuant to
381381 subsection I of Section 71.1 of Title 62 of the Oklahoma Statutes.
382382 The Bureau shall advise the State Treasu rer and the Cash Management
383383 and Investment Oversight Commission in writing of the results of the
384384 investigation.
385385 SECTION 2. This act shall become effective November 1, 2024.
