77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 74 O.S. 2021, Section 150.5, is
79	79	amended to read as follows:
80	80	Section 150.5 A. 1. Oklahoma State Bureau of Investigation
81	81	investigations not covered under Section 150.2 of this title shall
82	82	be initiated at the request of the following persons:
83	83	a. the Governor,
84	84	b. the Attorney General,
85	85	c. the Council on Judicial Complaints upon a vote by a
86	86	majority of the Council,
87	87	d. the chair of any Legislative Investigating Committee
88	88	which has been granted subpoena powers by re solution,

141	141	of the Committee Legislature,
142	142	e. the Director of the Department of Human Services, or
143	143	designee, as authorized by Section 1 -2-105 of Title
144	144	10A of the Oklahoma Statutes, or
145	145	f. a district court judge as authorized by Section 1 -2-
146	146	103 of Title 10A of the Oklahoma Statutes.
147	147	2. Requests for investigations shall be submitted in writing
148	148	and shall contain specific allegations of wrongdoing under the laws
149	149	of the State of Oklahoma.
150	150	B. The Governor may in itiate special background investigations
151	151	with the written consent of the person who is the subject of the
152	152	investigation.
153	153	C. The chair of any Senate committee which is fulfilling the
154	154	statutory responsibility for approving nominations made by the
155	155	Governor may, upon a vote by a majority of the committee and with
156	156	the written consent of the p erson who is to be the subject of the
157	157	investigation, initiate a special background investigation of any
158	158	nominee for the Oklahoma Horse Racing Commission as established by
159	159	Section 201 of Title 3A of the Oklahoma Statutes or any nominee for
160	160	the Board of Trustees of the Oklahoma Lottery Commission as
161	161	established by Section 704 of Title 3A of the Oklahoma Statutes.
162	162	The Bureau shall submit a report to the committee within thirty (30)
163	163	days of the receipt of the request. Any consideration by the

215	215	committee of a report from the Bureau shall be for the exclusive use
216	216	of the committee and shall be considered only in executive session.
217	217	D. 1. All records relating to any investigation b eing
218	218	conducted by the Bureau, including any records of laboratory
219	219	services provided to law enforcement agencies pursuant to paragraph
220	220	1 of Section 150.2 of this title, shall be confidential and shall
221	221	not be open to the public or to the Commission except as provided in
222	222	Section 150.4 of this title; provided, however, officers and agents
223	223	of the Bureau may disclose, at the discretion of the Director, such
224	224	investigative information to:
225	225	a. officers and agents of federal, state, county, or
226	226	municipal law enforcemen t agencies and to district
227	227	attorneys, in the furtherance of criminal
228	228	investigations within their respective jurisdictions,
229	229	b. employees of the Department of Human Services in the
230	230	furtherance of child abuse investigations, and
231	231	c. appropriate accreditation b odies for the purposes of
232	232	the Bureau's obtaining or maintaining accreditation.
233	233	2. Any unauthorized disclosure of any information contained in
234	234	the confidential files of the Bureau shall be a misdemeanor. The
235	235	person or entity authorized to initiate investi gations in this
236	236	section, and the Attorney General in the case of investigations
237	237	initiated by the Insurance Commissioner, shall be kept advised of
238	238	the progress of the re quested investigation and shall receive a

291	291	entity requesting the investigation may give that information only
292	292	to the appropriate prosecutorial officer or agency having statutory
293	293	authority in the matter if that action appears proper from the
294	294	information contained in the report , and shall not reveal or give
295	295	such information to any other person or agency. Violation hereof
296	296	shall be deemed willful neglect of duty and shall be grounds for
297	297	removal from office.
298	298	E. It shall not be a violation of this section to reveal
299	299	otherwise confidential information to outside agencies or
300	300	individuals who are providing interpreter services, questioned
301	301	document analysis, laboratory services, or other sp ecialized
302	302	services that are necessary in the assistance of Bureau
303	303	investigations. Individuals or a gencies receiving the confidential
304	304	and investigative information or records or results of laboratory
305	305	services provided to the Bureau by those agencies or ind ividuals,
306	306	shall be subject to the confidentiality provisions and requirements
307	307	established in subsec tion D of this section.
308	308	F. It shall not be a violation of this section to reveal for
309	309	training or educational purposes otherwise confidential information
310	310	from records relating to any investigation previously conducted by
311	311	the Bureau, including any records o f laboratory services provided to
312	312	law enforcement agencies pursuant to paragraph 1 of subsection A of

364	364	Section 150.2 of this title, so long as ten (10) or more years have
365	365	passed since the production of the information or record.
366	366	G. It shall not be a violation of this section to reveal
367	367	otherwise confidential information from records relating to any
368	368	investigation being conducted by the Bureau, including any records
369	369	of laboratory services provided to law enforcement agencies pursuant
370	370	to paragraph 1 of subsection A of Section 150.2 of this ti tle or to
371	371	the public, provided, release of the confidential information has
372	372	been authorized by the Director of the Bureau for the purposes of
373	373	developing or obtaining further information reasonably necessary to
374	374	the successful conclusion of a criminal invest igation being
375	375	conducted by the Bureau or authorized by the Director of the Bureau
376	376	for the purpose of advising crime victims or family representatives
377	377	of homicide victims regarding the status of a pending investigation.
378	378	H. The State Treasurer shall initiat e a complete background
379	379	investigation of the positions with the written consent of the
380	380	persons who are the subject of the investigation pursuant to
381	381	subsection I of Section 71.1 of Title 62 of the Oklahoma Statutes.
382	382	The Bureau shall advise the State Treasu rer and the Cash Management
383	383	and Investment Oversight Commission in writing of the results of the
384	384	investigation.
385	385	SECTION 2. This act shall become effective November 1, 2024.
