7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 69 O.S. 20 21, Section 1705, is
7777 amended to read as follows:
7878 Section 1705. The Oklahoma Turnpike Authority is hereby
7979 authorized and empowered:
8080 (a) To adopt bylaws for the regulation of its affairs and
8181 conduct of its business.
8282 (b) To adopt an official seal and alter the same at pleasure .
8383 (c) To maintain an office at such place or places within the
8484 state as it may designate.
8585 (d) To sue and be sued in contract, reverse condemnation,
8686 equity, mandamus and similar actions in its own name, plead and be
8787 impleaded; provided, that any and all a ctions at law or in equity

139139 against the Authority shall be brought in the county in which the
140140 principal office of the Authority shall be located, or in the county
141141 of the residence of the plaintiff, or the county where the cause of
142142 action arose. All privile ges granted to the Authority and duties
143143 enjoined upon the Authority by the provisions of Sections 1701
144144 through 1734 of this title may be enforced in a court of competent
145145 jurisdiction in an action in mandamus.
146146 (e) To construct, maintai n, repair and operate turnpike
147147 projects and highways, with their access and connecting roads, at
148148 such locations and on such routes as it shall determine are
149149 determined to be feasible and economically sound; provided, that
150150 until specifically authorized by t he Legislature, the Authority
151151 shall be authorized to construct and operate toll turnpikes only at
152152 the following locations and routes:
153153 (1) The Turner Turnpike between Oklahoma City and Tulsa.
154154 (2) The Southwestern (H.E. Bailey) Turnpike between Oklahoma
155155 City and Wichita Falls, Texas.
156156 (3) The Northeastern (Will Rogers) Tu rnpike between Tulsa and
157157 Joplin, Missouri.
158158 (4) The Eastern (Indian Nation) Turnpike between Tulsa and
159159 Paris, Texas, including all or any part thereof between McAlester
160160 and the Red River so uth of Hugo.
161161 (5) The Cimarron Turnpike between Tulsa and Interstate Highway
162162 35 north of Perry, including a connection to Stillwater.

220220 vicinity of the Arkansas State Line to furnish access to Hot
221221 Springs, Texarkana, Shreveport and New Orleans.
222222 (8) A tollgate on the Turner Turnpike in the vicinity of
223223 Luther, Oklahoma, and in the vicinity of the intersection of State
224224 Highway 33 and Turner Turnpike in Cr eek County, Oklahoma, or in the
225225 vicinity of the intersection of State Highway 33 and Turner Turnpike
226226 or U.S. Highway 66 in Creek County, Oklahoma, from any monies
227227 available to the Authority.
228228 (9) Add on the Will Rogers Turnpike a northbound automatic
229229 tollgate onto State Highway 28 and a southbound on -ramp from State
230230 Highway 28.
231231 (10) A turnpike or any part or parts thereof beginning in the
232232 vicinity of Duncan extending east to the vicinity of the City of
233233 Davis, and extending in a northeasterly direction, by way of the
234234 vicinity of the City of Ada, to a co nnection in the vici nity of
235235 Henryetta or in the vicinity of the intersection of State Highway 48
236236 and Interstate 40; and a turnpike or any part or parts thereof from
237237 the vicinity of Snyder extending north to th e vicinity of Woodward.

304304 line and the northeast corner of Oklahoma and ending by means of a
305305 connection or connections wi th Shreveport, Louisiana, and Houston,
306306 Texas, in southeastern Oklah oma and at no point to exceed thirty
307307 (30) miles west of the Missouri or Arkansas border.
308308 (14) A turnpike or any part or parts thereof beginning in the
309309 vicinity of Velma or County Line to a point intersecting with
310310 Interstate 35 in the a rea south of Davis.

375375 Wellston, Oklahoma, from any monies available t o the Authority.
376376 (19) A tollgate on the Muskogee Turnpike in the vicinity of
377377 Brushy Mountain, Oklahoma, and in the vicinity of Elm Grove,
378378 Oklahoma, from any monies available to the Authority.
379379 (20) All or any part of an Oklahoma City Outer Loop expressway
380380 system beginning in the vicinity of I-35 and the Turner Turnpike and
381381 extending west into Canadian County and then south to I -40; and then
382382 south and east to I-35 in the vicinity of Moore and Norman; and then
383383 extending east and north to I -40 east of Tinker Field; and then
384384 extending north to the Turner Turnpike to complete the Outer Loop.

449449 (24) A four-lane extension of the Muskogee Turnpike from
450450 Interstate Highway 40 west of Webbers Falls to the Poteau vicinity.
451451 (25) A new turnpike or any part or parts thereof beginning at a
452452 point in the vicinity of northwest Tulsa, and extending in a
453453 northwesterly direction, by means of a connection or connections
454454 with the cities of Pawhuska and Newkirk, to a point intersecting in
455455 the vicinity of US Highway No. 77 and the Kansas State Li ne.
456456 (26) A full access interchange on the Indian Nation Turnpike
457457 south of Interstate 40, in the vicinity of Henryetta, Oklahoma, and
458458 in the vicinity of the proposed theme park, museum or an industrial

511511 from any monies available to the Authority.
512512 (27) A new turnpike beginning at a point directly west of the
513513 Arkansas line and four -laning Highway 70 from that point to the
514514 farthest western reach o f Highway 70 creating a southern route
515515 through Oklahoma.
516516 (28) A new turnpike and bridge or any parts thereof from a
517517 point in the vicinity of the city of Mustang southerly across the
518518 South Canadian River to the H.E. Bailey Turnpike in the vicinity of
519519 the city of Tuttle; and then easterly across the Sou th Canadian
520520 River to a point in the vicinity of the city of Norman.
521521 (29) A new turnpike or any parts thereof beginning at a point
522522 in the vicinity of the city of Altus and extending in a
523523 northwesterly directio n to a point in the vicinity of the city of
524524 Sayre.
525525 (30) A new turnpike or any parts thereof beginning at a point
526526 in the vicinity of the city of Enid and extending in a westerly
527527 direction to a point in the vicinity of the city of Woodward.
528528 (31) An on- and off-ramp or any parts thereof at Fletcher,
529529 Oklahoma, in the vicini ty of the Interstate 44 and State Highway 277
530530 intersection. Any existing on - or off-ramp or any parts thereof in
531531 the vicinity of Fletcher, Oklahoma, shall not be removed and shall
532532 be maintained pursuant to Section 1701 et seq. of this title.

584584 (32) A new bridge crossing the Arkansas River between South
585585 Delaware Avenue and Memorial Drive in Tulsa County. This project
586586 shall commence upon a determination by the Oklahoma Transportation
587587 Authority that such bridge shall be self -sufficient at some point
588588 over a thirty-year time period from the toll charges associated with
589589 the bridge project.
590590 (33) An exit ramp or any parts thereof from the eastbound lane
591591 of the Turner Turnpike at 96th Street in Tuls a.
592592 (34) An on- and off-ramp or any parts there of on the Cimarron
593593 Turnpike in the vicinity of the northside of the Glencoe, Oklahoma,
594594 municipal limits.
595595 (35) A new turnpike or any parts thereof beginning at
596596 Interstate 44 at or near its intersection with 49 th West Avenue,
597597 past State Highway 64/412, turn ing northeasterly, c rossing 41st West
598598 Avenue, and continuing eastward to the L.L. Tisdale Expressway in
599599 Tulsa, Oklahoma.
600600 It is hereby declared to be the intent of the Legislature that
601601 the Oklahoma Legislature, through duly enacted legislation, and not
602602 the Authority, shall have the sole discretion to authorize and
603603 determine the location and overall route of a toll turnpike in the
604604 State of Oklahoma. The language set forth in any toll turnpike
605605 location or route authorization in this subsection, or elsewhere in
606606 this act, is to be construed according to its plain meaning as
607607 mandatory, and not discretionary, for the Authority. All

659659 directional and other limitations and descriptions contained in any
660660 toll turnpike location or route authorization are hereby declared to
661661 be mandatory limits on the Authority's turnpike project powers and
662662 not discretionary guidelines for the Authority. The Authority shall
663663 abide by the plain and ordinary language of such limits, and the
664664 Authority shall not have the discretion or power to build turnpikes
665665 in places, directions, or locations other than those expressly and
666666 specifically authorized herein. Any rule of construction contained
667667 in this act or elsewhere shall not be employed in varianc e or
668668 conflict with the intent of the Legislature as expressed here in.
669669 All access roads, interchanges, or lead roads connecting such
670670 turnpikes with existing highways must be built by funds furnished by
671671 the Authority.
672672 The minimum and maximum wages for the co nstruction of the roads,
673673 highways and projects provided for in Sec tions 1701 through 1734 of
674674 this title shall be in accordance with the schedules of wages used
675675 or adopted by the Commission in construction of state highways.
676676 The Authority is hereby authoriz ed to enter into contracts or
677677 agreements with agencies and instrum entalities of other states or
678678 the national government for construction, maintenance and operation
679679 of interstate turnpikes or highways.
680680 The Authority is hereby required to construct and insta ll
681681 automatic tollgates on the Will Rogers Turnpike at State Highwa y No.
682682 28 near Adair.

734734 (f) To issue turnpike revenue bonds of the Authority, payable
735735 solely from revenues, including the revenues accruing t o the trust
736736 fund created by Sections 1701 through 1 734 of this title, for the
737737 purpose of paying all or any part of th e cost of any one or more
738738 turnpike projects. Provided that any bonds issued for the
739739 construction of the proposed turnpike referred to in s ubparagraphs
740740 (10), (20), (21) and (22) of paragraph (e) of this section shall be
741741 issued as one issue for all four of the proposed turnpikes and shall
742742 be financed, constructed and operated under one bond indenture.
743743 (g) To fix and revise from time to time t olls for the use of
744744 any turnpike projects.
745745 Any common carrier having authority at the time of opening any
746746 turnpike project to operate upon a highway approximately paralleling
747747 the turnpike project shall be granted without further showing
748748 authority to operate over the turnpike project to all municipalities
749749 which such carrier is serving at the time the turnpike project is
750750 opened to traffic. But nothing herein shall be construed as
751751 granting any new operation rights to any common carriers.
752752 (h) To acquire, hold , and dispose of real and personal property
753753 in the exercise of its powers and the performance of its duties.
754754 (i) To acquire in the name of the Authority by purchase or
755755 otherwise on such terms and conditions and in such manner as it may
756756 deem proper, or by exercise of the right of condemnation in manner
757757 hereinafter provided, such public or private lands, including public

809809 parks, playgrounds, or reservations, or parts thereof or rights
810810 therein, rights-of-way, property, rights, easements, and interests,
811811 as it may deem necessary for carrying out the provisions o f Sections
812812 1701 through 1734 of this title; provided, that all pub lic property
813813 damaged in carrying out the powers granted by Sections 1701 through
814814 1734 of this title shall be restored or repaired and place d in its
815815 original condition as nearly as practicabl e.
816816 (j) To designate, except as is provided for herein, the
817817 location, and establish, limit and control such points of ingress to
818818 and egress from each turnpike project as may be necessary or
819819 desirable in the judgment of the Authority to insure ensure the
820820 proper operation and maintenance of such project, and to prohibit
821821 entrance to such project from any point or points not so designated.
822822 Provided further, this subsection is not to be construed as an
823823 independent or additional source of authority for the Autho rity to
824824 construct a toll turnpike at any location or route other t han those
825825 expressly and specifically authorized by the Legislature in
826826 paragraph (e) of this section.
827827 (k) To make and enter into all contracts and agreements
828828 necessary or incidenta l to the performance of its duties and the
829829 execution of its powers, and to e mploy consulting engineers,
830830 attorneys, accountants, construction and financial experts,
831831 superintendents, managers, and such other employees and agents as
832832 may be necessary in its ju dgment, and to fix their compensation;

884884 provided, that all such expenses shal l be payable solely from the
885885 proceeds of turnpike revenue bonds issued under the provisions of
886886 Sections 1701 through 1734 of this title or from revenues; provided,
887887 further, no attorney employed by the Authority, nor any member of
888888 any law firm of which the attorney may be connected, shall ever be
889889 paid any fee or compensation for any special or extraordinary
890890 services.
891891 (l) To receive and accept from any federal agency grants for or
892892 in aid of the construction of any turnpike project, provided, the
893893 acceptance of such grants will not reduce the amount of federal aid
894894 for the construction, repair, or maintenance of farm -to-market roads
895895 and other highways and bridges in this state; and to re ceive and
896896 accept aid or contributions from any source of either money,
897897 property, labor, or other things of value, to be held, used, and
898898 applied only for the purposes for which such grants and
899899 contributions may be made.
900900 (m) To adopt such rules, and to do a ny and all things necessary
901901 to comply with rules, regulations, or requiremen ts of the Bureau of
902902 Public Roads, Multistate Economic Development Regional Commission,
903903 as defined in Sections 1151 through 1153, inclusive, of Title 74 of
904904 the Oklahoma Statutes, Oz arka Region Commission or any other federal
905905 agency administering any law ena cted by the Congress of the United
906906 States to aid or encourage the construction of highways.

958958 (n) To do all things necessary or convenient to carry out the
959959 powers expressly granted in Sections 1701 through 1734 of this
960960 title. The design standards for all p aving shall comply with the
961961 design standards of the American Association of State Highway and
962962 Transportation Officials as modified by the Oklahoma Department of
963963 Transportation. All contracts for construction work on turnpike
964964 projects shall be let to the l owest responsible bidder, or bidders,
965965 after notice by publication in a newspaper published in the county
966966 where the work is to be done in two consecutive weekly issues of the
967967 newspaper. In all cases where more than eight (8) miles of
968968 construction is let at the same time and is not an advertisement for
969969 a surface-treatment-only project, such advertisement shall provide
970970 for bids on sections of the turnpike not to exceed eight (8) miles .
971971 If the project advertised is a surface -treatment-only project of
972972 more than twenty (20) miles of road, the advertisement shall provide
973973 for bids on sections of the road no longer than twenty (20) miles,
974974 as well as bids on the project as a whole. Subject to the following
975975 restrictions and limitations, the Authority shall, when con tracting
976976 for construction work, divide such work into paving projects, bridge
977977 projects, including underpasses and overpasses, and earthmoving or
978978 miscellaneous projects, according t o the type of work to be done.
979979 Each project shall be let under a separate c ontract or contracts and
980980 no contract or project shall include more than one of such types of

10331033 contain a provision that ninety percent (90%) of all labor employed
10341034 on the project shall be residents of Oklahoma. However, contracts
10351035 for bridges may include earthwork and structures for the approaches
10361036 thereto.
10371037 (o) It shall be unlawful for any member, officer or employee of
10381038 the Authority to transact with the Authority, either directly or
10391039 indirectly, any business for profit of such member, officer, or
10401040 employee; and any person, firm, or corporation knowingly
10411041 participating therein shall be equally liable for violation of this
10421042 provision.
10431043 The term "business for profit" shall include, but not be limited
10441044 to, the acceptance or payment of any fee, commission, gift, or
10451045 consideration to such member, officer, or employee.
10461046 Violation of this provision shall constitute a felony punishable
10471047 by incarceration in the State Penitentiary for a term not to exceed
10481048 five (5) years or a fine of not less than Five Hundred Dollars
10491049 ($500.00) and not more than Five Thousand Dollars ($5,000.00), or
10501050 both such imprisonment and fine.
10511051 (p) In the event of a national emergency, the Authority,
10521052 subject to any vested rights or claims, may enter into contracts
10531053 with the federal government or any authorized agency thereof to
10541054 allow the federal government or agency thereof to use such turnpikes
10551055 partly or exclusively during the existence of such emergency,
10561056 provided, that the federal government agrees i n such contract to

11131113 (q) All meetings of the Authority shall be open public
11141114 meetings, and all records shall be public records, except when
11151115 considering personnel or litigation.
11161116 SECTION 2. This act shall become effec tive November 1, 2024.
