75	75		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76		SECTION 1. AMENDATORY 69 O.S. 20 21, Section 1705, is
77	77		amended to read as follows:
78	78		Section 1705. The Oklahoma Turnpike Authority is hereby
79	79		authorized and empowered:
80	80		(a) To adopt bylaws for the regulation of its affairs and
81	81		conduct of its business.
82	82		(b) To adopt an official seal and alter the same at pleasure .
83	83		(c) To maintain an office at such place or places within the
84	84		state as it may designate.
85	85		(d) To sue and be sued in contract, reverse condemnation,
86	86		equity, mandamus and similar actions in its own name, plead and be
87	87		impleaded; provided, that any and all a ctions at law or in equity

139	139		against the Authority shall be brought in the county in which the
140	140		principal office of the Authority shall be located, or in the county
141	141		of the residence of the plaintiff, or the county where the cause of
142	142		action arose. All privile ges granted to the Authority and duties
143	143		enjoined upon the Authority by the provisions of Sections 1701
144	144		through 1734 of this title may be enforced in a court of competent
145	145		jurisdiction in an action in mandamus.
146	146		(e) To construct, maintai n, repair and operate turnpike
147	147		projects and highways, with their access and connecting roads, at
148	148		such locations and on such routes as it shall determine are
149	149		determined to be feasible and economically sound; provided, that
150	150		until specifically authorized by t he Legislature, the Authority
151	151		shall be authorized to construct and operate toll turnpikes only at
152	152		the following locations and routes:
153	153		(1) The Turner Turnpike between Oklahoma City and Tulsa.
154	154		(2) The Southwestern (H.E. Bailey) Turnpike between Oklahoma
155	155		City and Wichita Falls, Texas.
156	156		(3) The Northeastern (Will Rogers) Tu rnpike between Tulsa and
157	157		Joplin, Missouri.
158	158		(4) The Eastern (Indian Nation) Turnpike between Tulsa and
159	159		Paris, Texas, including all or any part thereof between McAlester
160	160		and the Red River so uth of Hugo.
161	161		(5) The Cimarron Turnpike between Tulsa and Interstate Highway
162	162		35 north of Perry, including a connection to Stillwater.

216	216		(7) All or any part of a n extension of the Muskogee Turnpike,
217	217		beginning at a point on Interstate Highway 40 near the present south
218	218		terminus of the Muskogee Turnpike, and extending in a southeasterly
219	219		direction on an alignment near Stigler, Poteau and Heavener to the
220	220		vicinity of the Arkansas State Line to furnish access to Hot
221	221		Springs, Texarkana, Shreveport and New Orleans.
222	222		(8) A tollgate on the Turner Turnpike in the vicinity of
223	223		Luther, Oklahoma, and in the vicinity of the intersection of State
224	224		Highway 33 and Turner Turnpike in Cr eek County, Oklahoma, or in the
225	225		vicinity of the intersection of State Highway 33 and Turner Turnpike
226	226		or U.S. Highway 66 in Creek County, Oklahoma, from any monies
227	227		available to the Authority.
228	228		(9) Add on the Will Rogers Turnpike a northbound automatic
229	229		tollgate onto State Highway 28 and a southbound on -ramp from State
230	230		Highway 28.
231	231		(10) A turnpike or any part or parts thereof beginning in the
232	232		vicinity of Duncan extending east to the vicinity of the City of
233	233		Davis, and extending in a northeasterly direction, by way of the
234	234		vicinity of the City of Ada, to a co nnection in the vici nity of
235	235		Henryetta or in the vicinity of the intersection of State Highway 48
236	236		and Interstate 40; and a turnpike or any part or parts thereof from
237	237		the vicinity of Snyder extending north to th e vicinity of Woodward.

290	290		point in the vicinity of Ponca City, or at a point on the Kansas -
291	291		Oklahoma state boundary line east of the Arkansas River and west of

298	298		the north part of Oklahoma City with the residential, industrial and
299	299		Will Rogers World Airport Complex in the south and southwest parts
300	300		of Oklahoma City.
301	301		(13) A turnpike (The Industrial Parkw ay) or any part or parts
302	302		thereof beginning at a point on the Oklahoma-Kansas state boundary
303	303		line between the point where U.S. Highway 66 intersects the boundary
304	304		line and the northeast corner of Oklahoma and ending by means of a
305	305		connection or connections wi th Shreveport, Louisiana, and Houston,
306	306		Texas, in southeastern Oklah oma and at no point to exceed thirty
307	307		(30) miles west of the Missouri or Arkansas border.
308	308		(14) A turnpike or any part or parts thereof beginning in the
309	309		vicinity of Velma or County Line to a point intersecting with
310	310		Interstate 35 in the a rea south of Davis.

374	374		(18) A tollgate on the Turner Turnpike in the vicinity of
375	375		Wellston, Oklahoma, from any monies available t o the Authority.
376	376		(19) A tollgate on the Muskogee Turnpike in the vicinity of
377	377		Brushy Mountain, Oklahoma, and in the vicinity of Elm Grove,
378	378		Oklahoma, from any monies available to the Authority.
379	379		(20) All or any part of an Oklahoma City Outer Loop expressway
380	380		system beginning in the vicinity of I-35 and the Turner Turnpike and
381	381		extending west into Canadian County and then south to I -40; and then
382	382		south and east to I-35 in the vicinity of Moore and Norman; and then
383	383		extending east and north to I -40 east of Tinker Field; and then
384	384		extending north to the Turner Turnpike to complete the Outer Loop.

447	447		the connection between State Highway 33 and U.S. 69 easterly to the
448	448		Arkansas State Line.
449	449		(24) A four-lane extension of the Muskogee Turnpike from
450	450		Interstate Highway 40 west of Webbers Falls to the Poteau vicinity.
451	451		(25) A new turnpike or any part or parts thereof beginning at a
452	452		point in the vicinity of northwest Tulsa, and extending in a
453	453		northwesterly direction, by means of a connection or connections
454	454		with the cities of Pawhuska and Newkirk, to a point intersecting in
455	455		the vicinity of US Highway No. 77 and the Kansas State Li ne.
456	456		(26) A full access interchange on the Indian Nation Turnpike
457	457		south of Interstate 40, in the vicinity of Henryetta, Oklahoma, and
458	458		in the vicinity of the proposed theme park, museum or an industrial

512	512		(27) A new turnpike beginning at a point directly west of the
513	513		Arkansas line and four -laning Highway 70 from that point to the
514	514		farthest western reach o f Highway 70 creating a southern route
515	515		through Oklahoma.
516	516		(28) A new turnpike and bridge or any parts thereof from a
517	517		point in the vicinity of the city of Mustang southerly across the
518	518		South Canadian River to the H.E. Bailey Turnpike in the vicinity of
519	519		the city of Tuttle; and then easterly across the Sou th Canadian
520	520		River to a point in the vicinity of the city of Norman.
521	521		(29) A new turnpike or any parts thereof beginning at a point
522	522		in the vicinity of the city of Altus and extending in a
523	523		northwesterly directio n to a point in the vicinity of the city of
524	524		Sayre.
525	525		(30) A new turnpike or any parts thereof beginning at a point
526	526		in the vicinity of the city of Enid and extending in a westerly
527	527		direction to a point in the vicinity of the city of Woodward.
528	528		(31) An on- and off-ramp or any parts thereof at Fletcher,
529	529		Oklahoma, in the vicini ty of the Interstate 44 and State Highway 277
530	530		intersection. Any existing on - or off-ramp or any parts thereof in
531	531		the vicinity of Fletcher, Oklahoma, shall not be removed and shall
532	532		be maintained pursuant to Section 1701 et seq. of this title.

584	584		(32) A new bridge crossing the Arkansas River between South
585	585		Delaware Avenue and Memorial Drive in Tulsa County. This project
586	586		shall commence upon a determination by the Oklahoma Transportation
587	587		Authority that such bridge shall be self -sufficient at some point
588	588		over a thirty-year time period from the toll charges associated with
589	589		the bridge project.
590	590		(33) An exit ramp or any parts thereof from the eastbound lane
591	591		of the Turner Turnpike at 96th Street in Tuls a.
592	592		(34) An on- and off-ramp or any parts there of on the Cimarron
593	593		Turnpike in the vicinity of the northside of the Glencoe, Oklahoma,
594	594		municipal limits.
595	595		(35) A new turnpike or any parts thereof beginning at
596	596		Interstate 44 at or near its intersection with 49 th West Avenue,
597	597		past State Highway 64/412, turn ing northeasterly, c rossing 41st West
598	598		Avenue, and continuing eastward to the L.L. Tisdale Expressway in
599	599		Tulsa, Oklahoma.
600	600		It is hereby declared to be the intent of the Legislature that
601	601		the Oklahoma Legislature, through duly enacted legislation, and not
602	602		the Authority, shall have the sole discretion to authorize and
603	603		determine the location and overall route of a toll turnpike in the
604	604		State of Oklahoma. The language set forth in any toll turnpike
605	605		location or route authorization in this subsection, or elsewhere in
606	606		this act, is to be construed according to its plain meaning as
607	607		mandatory, and not discretionary, for the Authority. All

659	659		directional and other limitations and descriptions contained in any
660	660		toll turnpike location or route authorization are hereby declared to
661	661		be mandatory limits on the Authority's turnpike project powers and
662	662		not discretionary guidelines for the Authority. The Authority shall
663	663		abide by the plain and ordinary language of such limits, and the
664	664		Authority shall not have the discretion or power to build turnpikes
665	665		in places, directions, or locations other than those expressly and
666	666		specifically authorized herein. Any rule of construction contained
667	667		in this act or elsewhere shall not be employed in varianc e or
668	668		conflict with the intent of the Legislature as expressed here in.
669	669		All access roads, interchanges, or lead roads connecting such
670	670		turnpikes with existing highways must be built by funds furnished by
671	671		the Authority.
672	672		The minimum and maximum wages for the co nstruction of the roads,
673	673		highways and projects provided for in Sec tions 1701 through 1734 of
674	674		this title shall be in accordance with the schedules of wages used
675	675		or adopted by the Commission in construction of state highways.
676	676		The Authority is hereby authoriz ed to enter into contracts or
677	677		agreements with agencies and instrum entalities of other states or
678	678		the national government for construction, maintenance and operation
679	679		of interstate turnpikes or highways.
680	680		The Authority is hereby required to construct and insta ll
681	681		automatic tollgates on the Will Rogers Turnpike at State Highwa y No.
682	682		28 near Adair.

734	734		(f) To issue turnpike revenue bonds of the Authority, payable
735	735		solely from revenues, including the revenues accruing t o the trust
736	736		fund created by Sections 1701 through 1 734 of this title, for the
737	737		purpose of paying all or any part of th e cost of any one or more
738	738		turnpike projects. Provided that any bonds issued for the
739	739		construction of the proposed turnpike referred to in s ubparagraphs
740	740		(10), (20), (21) and (22) of paragraph (e) of this section shall be
741	741		issued as one issue for all four of the proposed turnpikes and shall
742	742		be financed, constructed and operated under one bond indenture.
743	743		(g) To fix and revise from time to time t olls for the use of
744	744		any turnpike projects.
745	745		Any common carrier having authority at the time of opening any
746	746		turnpike project to operate upon a highway approximately paralleling
747	747		the turnpike project shall be granted without further showing
748	748		authority to operate over the turnpike project to all municipalities
749	749		which such carrier is serving at the time the turnpike project is
750	750		opened to traffic. But nothing herein shall be construed as
751	751		granting any new operation rights to any common carriers.
752	752		(h) To acquire, hold , and dispose of real and personal property
753	753		in the exercise of its powers and the performance of its duties.
754	754		(i) To acquire in the name of the Authority by purchase or
755	755		otherwise on such terms and conditions and in such manner as it may
756	756		deem proper, or by exercise of the right of condemnation in manner
757	757		hereinafter provided, such public or private lands, including public

809	809		parks, playgrounds, or reservations, or parts thereof or rights
810	810		therein, rights-of-way, property, rights, easements, and interests,
811	811		as it may deem necessary for carrying out the provisions o f Sections
812	812		1701 through 1734 of this title; provided, that all pub lic property
813	813		damaged in carrying out the powers granted by Sections 1701 through
814	814		1734 of this title shall be restored or repaired and place d in its
815	815		original condition as nearly as practicabl e.
816	816		(j) To designate, except as is provided for herein, the
817	817		location, and establish, limit and control such points of ingress to
818	818		and egress from each turnpike project as may be necessary or
819	819		desirable in the judgment of the Authority to insure ensure the
820	820		proper operation and maintenance of such project, and to prohibit
821	821		entrance to such project from any point or points not so designated.
822	822		Provided further, this subsection is not to be construed as an
823	823		independent or additional source of authority for the Autho rity to
824	824		construct a toll turnpike at any location or route other t han those
825	825		expressly and specifically authorized by the Legislature in
826	826		paragraph (e) of this section.
827	827		(k) To make and enter into all contracts and agreements
828	828		necessary or incidenta l to the performance of its duties and the

884	884		provided, that all such expenses shal l be payable solely from the
885	885		proceeds of turnpike revenue bonds issued under the provisions of
886	886		Sections 1701 through 1734 of this title or from revenues; provided,
887	887		further, no attorney employed by the Authority, nor any member of
888	888		any law firm of which the attorney may be connected, shall ever be
889	889		paid any fee or compensation for any special or extraordinary
890	890		services.
891	891		(l) To receive and accept from any federal agency grants for or
892	892		in aid of the construction of any turnpike project, provided, the
893	893		acceptance of such grants will not reduce the amount of federal aid
894	894		for the construction, repair, or maintenance of farm -to-market roads
895	895		and other highways and bridges in this state; and to re ceive and
896	896		accept aid or contributions from any source of either money,
897	897		property, labor, or other things of value, to be held, used, and
898	898		applied only for the purposes for which such grants and
899	899		contributions may be made.
900	900		(m) To adopt such rules, and to do a ny and all things necessary
901	901		to comply with rules, regulations, or requiremen ts of the Bureau of
902	902		Public Roads, Multistate Economic Development Regional Commission,
903	903		as defined in Sections 1151 through 1153, inclusive, of Title 74 of
904	904		the Oklahoma Statutes, Oz arka Region Commission or any other federal
905	905		agency administering any law ena cted by the Congress of the United
906	906		States to aid or encourage the construction of highways.

958	958		(n) To do all things necessary or convenient to carry out the
959	959		powers expressly granted in Sections 1701 through 1734 of this
960	960		title. The design standards for all p aving shall comply with the
961	961		design standards of the American Association of State Highway and
962	962		Transportation Officials as modified by the Oklahoma Department of
963	963		Transportation. All contracts for construction work on turnpike
964	964		projects shall be let to the l owest responsible bidder, or bidders,
965	965		after notice by publication in a newspaper published in the county
966	966		where the work is to be done in two consecutive weekly issues of the
967	967		newspaper. In all cases where more than eight (8) miles of
968	968		construction is let at the same time and is not an advertisement for
969	969		a surface-treatment-only project, such advertisement shall provide
970	970		for bids on sections of the turnpike not to exceed eight (8) miles .
971	971		If the project advertised is a surface -treatment-only project of
972	972		more than twenty (20) miles of road, the advertisement shall provide
973	973		for bids on sections of the road no longer than twenty (20) miles,
974	974		as well as bids on the project as a whole. Subject to the following
975	975		restrictions and limitations, the Authority shall, when con tracting
976	976		for construction work, divide such work into paving projects, bridge
977	977		projects, including underpasses and overpasses, and earthmoving or
978	978		miscellaneous projects, according t o the type of work to be done.
979	979		Each project shall be let under a separate c ontract or contracts and
980	980		no contract or project shall include more than one of such types of
981	981		construction work. Each contract for construction work shall

1033	1033		contain a provision that ninety percent (90%) of all labor employed
1034	1034		on the project shall be residents of Oklahoma. However, contracts
1035	1035		for bridges may include earthwork and structures for the approaches
1036	1036		thereto.
1037	1037		(o) It shall be unlawful for any member, officer or employee of
1038	1038		the Authority to transact with the Authority, either directly or
1039	1039		indirectly, any business for profit of such member, officer, or
1040	1040		employee; and any person, firm, or corporation knowingly
1041	1041		participating therein shall be equally liable for violation of this
1042	1042		provision.
1043	1043		The term "business for profit" shall include, but not be limited
1044	1044		to, the acceptance or payment of any fee, commission, gift, or
1045	1045		consideration to such member, officer, or employee.
1046	1046		Violation of this provision shall constitute a felony punishable
1047	1047		by incarceration in the State Penitentiary for a term not to exceed
1048	1048		five (5) years or a fine of not less than Five Hundred Dollars
1049	1049		($500.00) and not more than Five Thousand Dollars ($5,000.00), or
1050	1050		both such imprisonment and fine.
1051	1051		(p) In the event of a national emergency, the Authority,
1052	1052		subject to any vested rights or claims, may enter into contracts
1053	1053		with the federal government or any authorized agency thereof to
1054	1054		allow the federal government or agency thereof to use such turnpikes
1055	1055		partly or exclusively during the existence of such emergency,
1056	1056		provided, that the federal government agrees i n such contract to

1109	1109		added to any tolls collected, to meet all operating and maintenance
1110	1110		expenses, interest payments , and the minimum sinking fund and
1111	1111		reserve requirements of the trust agreeme nt for the turnpike covered
1112	1112		by the contract.
1113	1113		(q) All meetings of the Authority shall be open public
1114	1114		meetings, and all records shall be public records, except when
1115	1115		considering personnel or litigation.
1116	1116		SECTION 2. This act shall become effec tive November 1, 2024.
