24	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

26	56		SECTION 1. AMENDATORY 2 O.S. 2021, Section 3 -220, is
27	57		amended to read as follows:
28		-
29	58		Section 3-220. A. 1. The plants musk thistle (Carduus nutans
30	59		L.), Scotch thistle (Onoprodum acanthium L.), and Canada thistle
31	60		(Cirsium arvense), poison hemlock (Conium maculatum) , and Kudzu
32	61		(Pueraria montana) are designated as noxious weeds. The Legislature
33	62		finds that these thistles and poison hemlock and Kudzu are a public
34	63		nuisance in all counties across this state.

36	64		2. It shall be the duty of every landowner in each county to
37	65		treat, control, or eradicate all Canada thistles, musk thistles, or

38	93		Scotch thistles, poison hemlock, and Kudzu growing on the
39	94		landowner's land every year as shall be sufficient to prevent these
40	95		thistles, poison hemlock, and Kudzu from going to seed.

42	96		3. The Department of Tr ansportation, the boards of county
43	97		commissioners, and any other public, private, or corporate entity
44	98		who shall maintain rights -of-way in the State of Oklahoma shall be
45	99		responsible for removing any thistle , poison hemlock, and Kudzu
46		-	infestation that occurs within their jurisdic tion. ENR. H. B. NO. 3186 Page 2

48	101		4. Failure of the landowner to treat, eradicate, or control all
49	102		musk thistle, Canada thistle, or Scotch thistle, poison hemlock, or
50	103		Kudzu may result in a fine not to exceed One Thousand Dollars
51	104		($1,000.00) for each violation per day.

53	105		5. Upon written complaint, the State Department of Agriculture
54	106		shall inspect the type of thistle , poison hemlock, or Kudzu
55	107		infestation, assess the nature and extent of the thistle , poison
56	108		hemlock, or Kudzu infestation on the property of the landowne r and
57	109		determine the most appropriate thistle or weed treatment, control,
58	110		or eradication method available for the type of thistle , poison
59	111		hemlock, or Kudzu and location of the property.

61	112		B. The State Board of Agriculture shall:

63	113		1. Promulgate rules setting categories or degrees of
64	114		infestation which would require specified treatment, control, or
65	115		eradication;

67	143		2. Include musk thistles, Scotch thistles, and Canada thistles,
68	144		poison hemlock, and Kudzu as prohibited noxious weed and weed seed
69	145		pursuant to the Depar tment's authority and responsibility under
70	146		Article 8 of the Oklahoma Agricultural Code;

72	147		3. By November 1, 2000, and annually thereafter prior to the
73	148		growing season of musk thistles, Scotch thistles, and Canada
74	149		thistles, poison hemlock, and Kudzu, complete an annual survey
75	150		detailing the degree of infestation of these thistles , poison
76	151		hemlock, and Kudzu across the state. The results of these surveys
77	152		shall be reported to Oklahoma State University; and

79	153		4. In all counties of this state, provide information to
80	154		newspapers of general circulation stating that musk thistles, Scotch
81	155		thistles, and Canada thistles, poison hemlock, and Kudzu are a
82	156		public nuisance and that it is the duty of every public, private, or
83	157		corporate landowner to treat, control, or eradicate th ese thistles,
84	158		poison hemlock, and Kudzu growing on any property owned by the
85	159		landowner. The information shall be provided at the beginning of
86	160		the cycle of growth of the musk thistles, Scotch thistles, and
87	161		Canada thistles, poison hemlock, and Kudzu and at other times as
88	162		necessary to inform landowners of the provisions of this subsection.
89	163		The information material shall also include:

91	164		a. information detailing the process by which an
92	165		interested landowner may receive assistance pursuant

96	195		b. the telephone number of the Department, and

98	196		c. a statement informing t he landowner that failure to
99	197		remove musk thistles, Scotch thistles, and Canada
100	198		thistles, poison hemlock, and Kudzu may subject the
101	199		landowner to legal action requiring the treatment,
102	200		control, or eradication of these thistles , poison
103	201		hemlock, and Kudzu.

105	202		C. Upon request of the landowner or the Department, the
106	203		designated Oklahoma State University extension agent for a
107	204		particular county shall evaluate or, if there is no extension agent
108	205		for a particular county, the Department shall inspect the type of
109	206		thistle, poison hemlock, or Kudzu infestation, assess the nature and
110	207		extent of the thistle , poison hemlock, or Kudzu infestation on the
111	208		property of the landowner, and determine the most appropriate
112	209		thistle, poison hemlock, or Kudzu treatment, control, or eradication
113	210		method available for the type of thistle , poison hemlock, or Kudzu
114	211		and location of the property.

116	212		SECTION 2. This act shall become effective November 1, 2024.
