2455 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2656 SECTION 1. AMENDATORY 2 O.S. 2021, Section 3 -220, is
2757 amended to read as follows:

2958 Section 3-220. A. 1. The plants musk thistle (Carduus nutans
3059 L.), Scotch thistle (Onoprodum acanthium L.), and Canada thistle
3160 (Cirsium arvense), poison hemlock (Conium maculatum) , and Kudzu
3261 (Pueraria montana) are designated as noxious weeds. The Legislature
3362 finds that these thistles and poison hemlock and Kudzu are a public
3463 nuisance in all counties across this state.

3664 2. It shall be the duty of every landowner in each county to
3765 treat, control, or eradicate all Canada thistles, musk thistles, or

3893 Scotch thistles, poison hemlock, and Kudzu growing on the
3994 landowner's land every year as shall be sufficient to prevent these
4095 thistles, poison hemlock, and Kudzu from going to seed.

4296 3. The Department of Tr ansportation, the boards of county
4397 commissioners, and any other public, private, or corporate entity
4498 who shall maintain rights -of-way in the State of Oklahoma shall be
4599 responsible for removing any thistle , poison hemlock, and Kudzu

48101 4. Failure of the landowner to treat, eradicate, or control all
49102 musk thistle, Canada thistle, or Scotch thistle, poison hemlock, or
50103 Kudzu may result in a fine not to exceed One Thousand Dollars
51104 ($1,000.00) for each violation per day.

53105 5. Upon written complaint, the State Department of Agriculture
54106 shall inspect the type of thistle , poison hemlock, or Kudzu
55107 infestation, assess the nature and extent of the thistle , poison
56108 hemlock, or Kudzu infestation on the property of the landowne r and
57109 determine the most appropriate thistle or weed treatment, control,
58110 or eradication method available for the type of thistle , poison
59111 hemlock, or Kudzu and location of the property.

61112 B. The State Board of Agriculture shall:

63113 1. Promulgate rules setting categories or degrees of
64114 infestation which would require specified treatment, control, or
65115 eradication;

67143 2. Include musk thistles, Scotch thistles, and Canada thistles,
68144 poison hemlock, and Kudzu as prohibited noxious weed and weed seed
69145 pursuant to the Depar tment's authority and responsibility under
70146 Article 8 of the Oklahoma Agricultural Code;

72147 3. By November 1, 2000, and annually thereafter prior to the
73148 growing season of musk thistles, Scotch thistles, and Canada
74149 thistles, poison hemlock, and Kudzu, complete an annual survey
75150 detailing the degree of infestation of these thistles , poison
76151 hemlock, and Kudzu across the state. The results of these surveys
77152 shall be reported to Oklahoma State University; and
78-
79153 4. In all counties of this state, provide information to
80154 newspapers of general circulation stating that musk thistles, Scotch
81155 thistles, and Canada thistles, poison hemlock, and Kudzu are a
82156 public nuisance and that it is the duty of every public, private, or
83157 corporate landowner to treat, control, or eradicate th ese thistles,
84158 poison hemlock, and Kudzu growing on any property owned by the
85159 landowner. The information shall be provided at the beginning of
86160 the cycle of growth of the musk thistles, Scotch thistles, and
87161 Canada thistles, poison hemlock, and Kudzu and at other times as
88162 necessary to inform landowners of the provisions of this subsection.
89163 The information material shall also include:

91164 a. information detailing the process by which an
92165 interested landowner may receive assistance pursuant

96195 b. the telephone number of the Department, and

98196 c. a statement informing t he landowner that failure to
99197 remove musk thistles, Scotch thistles, and Canada
100198 thistles, poison hemlock, and Kudzu may subject the
101199 landowner to legal action requiring the treatment,
102200 control, or eradication of these thistles , poison
103201 hemlock, and Kudzu.

105202 C. Upon request of the landowner or the Department, the
106203 designated Oklahoma State University extension agent for a
107204 particular county shall evaluate or, if there is no extension agent
108205 for a particular county, the Department shall inspect the type of
109206 thistle, poison hemlock, or Kudzu infestation, assess the nature and
110207 extent of the thistle , poison hemlock, or Kudzu infestation on the
111208 property of the landowner, and determine the most appropriate
112209 thistle, poison hemlock, or Kudzu treatment, control, or eradication
113210 method available for the type of thistle , poison hemlock, or Kudzu
114211 and location of the property.
