AS INTRODUCED 
 
An Act relating to water and water rights; amending 
82 O.S. 2021, Section 1020.17, which relates to 
spacing rules; providing additional spacing rules for 
water wells; and providing an effective date.  
 
 
 
 
BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     82 O.S. 2021, Section 1020.17, is 
amended to read as follows: 
Section 1020.17 A. 1.  Within bedrock groundwater basins or 
subbasins, no new or propo sed well(s) shall be permitt ed to be 
drilled and completed within one thousand three hundred twenty 
(1,320) feet of a permitted existing well or proposed well location 
on lands of another; provided, that the well on lands of another is 
capable of taking wat er from the same basin. 
2.  Within alluvium and terrace groundwater basins or subbasins, 
no new or proposed well(s) shall be authorized to be drilled and 
completed within six hundred s ixty (660) feet of a permitted 
existing well or proposed well locatio n on lands of another ;

provided, that the well on lands of another is capable of taking 
water from the same basin. 
B.  No new or proposed well(s) shall be authorized to be drilled 
and completed within three hundred (300) feet of the property 
boundary of the land on which t he well(s) are to be located. 
C. The Water Resource Board may promulgate rules under Article 
I of the Administrative Procedures Act which establish a proper 
spacing of wells which, in its judgment, is necessary to an orderly 
withdrawal of water in relation to the all ocation, by regular 
permits and temporary permits, of water to the land overlying the 
basin or subbasin.  The Board shall conduct at least one public 
hearing at a location within or in close proximity to each major 
basin or subbasin before adopting rules e stablishing well spacing 
for such basin or subbasin. 
SECTION 2.  This act shall become effective November 1, 2024.
