6565 An Act relating to the Parents' Bill of Rights;
6666 amending 25 O.S. 2021, Section 2003, which relates to

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 25 O.S. 2021, Section 2003, is
7979 amended to read as follows:
8080 Section 2003. A. The board of education of a school district,
8181 in consultation with parents, teachers , and administrators, sh all
8282 develop and adopt a policy to promote the invo lvement of parents and
8383 guardians of children enrolled in the schools within the school
8484 district, including:
8585 1. A plan for parent participation in the schools which is
8686 designed to improve parent and teacher cooperation in such areas as
8787 homework, attendance and discipline;

139139 2. Procedures by which parents may learn about the course of
140140 study for their children and review learning materials, including
141141 the source of any supplemental educational materials;
142142 3. Procedures by which parents who object to any learnin g
143143 material or activity on the basis that it is harmful may withdraw
144144 their children from the activity or from the class or program in
145145 which the material is used. Objection to a learning material or
146146 activity on the basis that it is harmful includes objectio n to a
147147 material or activity because it questions beliefs or practices in
148148 sex, morality or religion;
149149 4. If a school district offers any sex education curricula
150150 pursuant to Section 11 -105.1 of Title 70 of th e Oklahoma Statutes or
151151 pursuant to any rules adopt ed by the State Board of Education,
152152 procedures to opt out of a school district from providing sex
153153 education instruction to a child if the child 's parent provides
154154 written objection to the child 's participation in the sex education
155155 curricula;
156156 5. Procedures by which parents will be notified in advance of
157157 and given the opportunity to withdraw their children from any
158158 instruction or presentations regarding sexuality in courses other
159159 than formal sex education curr icula pursuant to Section 11-105.1 of
160160 Title 70 of the Oklahoma Statutes;
161161 6. Procedures by which parents may learn about the nature and
162162 purpose of clubs and activities that are part of the school

215215 have been approved by the school; and
216216 7. Procedures by which parents may learn about parental rights
217217 and responsibilities under the laws of this state, including the
218218 following:
219219 a. the right to opt out of a sex education curriculum if
220220 one is provided by the school district,
221221 b. open enrollment rights,
222222 c. the right to opt out of assignments pursuant to this
223223 section,
224224 d. the right to be exempt from the immunization laws of
225225 the state pursuant to Section 1210.192 of Title 70 of
226226 the Oklahoma Statutes,
227227 e. the promotion requirements prescribed in Section
228228 1210.508E of Title 70 of the Oklahoma Statutes,
229229 f. the minimum course of study and competency
230230 requirements for graduation from high school
231231 prescribed in Section 11 -103.6 of Title 70 of the
232232 Oklahoma Statutes,
233233 g. the right to opt out of instruction on the acquire d
234234 immune deficiency syndrome pursuant to Section 11 -
235235 103.3 of Title 70 of the Oklahoma Statutes,
236236 h. the right to review test results,

288288 i. the right to participate in gifted programs pursuant
289289 to Sections 1210.301 through 1210.308 of Title 70 of
290290 the Oklahoma Statutes,
291291 j. the right to inspect instructional materials used in
292292 connection with any research or experimentation
293293 program or project pursuant to Section 11 -106 of Title
294294 70 of the Oklahoma Statutes,
295295 k. the right to receive a school report card,
296296 l. the attendance requirements prescribed in Section 10 -
297297 106 of Title 70 of the Oklahoma Statutes,
298298 m. the right to public review of courses of study and
299299 textbooks,
300300 n. the right to be excused from school attendance for
301301 religious purposes,
302302 o. policies related to parental involvement pursuant to
303303 this section,
304304 p. the right to participate in parent -teacher
305305 associations and organizations that are sanctioned by
306306 the board of education of a school district, and
307307 q. the right to opt out of any data collection instrument
308308 at the district level that would capture data for
309309 inclusion in the state longitudinal student data
310310 system except what is necessary and essential for
311311 establishing a student 's public school record.

363363 B. The board of educ ation of a school district may adopt a
364364 policy to provide to parents the information required by this
365365 section in an electronic form.
366366 C. A parent shall submit a written request for information
367367 pursuant to this section during regular business hours to either the
368368 school principal at the school site or the su perintendent of the
369369 school district at the office of the school district. Within ten
370370 (10) days of receiving the request for information, the school
371371 principal or the superintendent of the school district sh all either
372372 deliver the requested information to th e parent or submit to the
373373 parent a written explanation of the reasons for the denial of the
374374 requested information. If the request for information is denied or
375375 the parent does not receive the requested info rmation within fifteen
376376 (15) days after submitting the request for information, the parent
377377 may submit a written request for the information to the board of
378378 education of a school district, which shall formally consider the
379379 request at the next scheduled publi c meeting of the board if the
380380 request can be prope rly noticed on the agenda. If the request
381381 cannot be properly noticed on the agenda, the board of education of
382382 a school district shall formally consider the request at the next
383383 subsequent public meeting of the board.
384384 D. A parent may appeal a school district's denial of a request
385385 for information outlined in this section to the Sta te Board of

437437 Education through a standard appeals process established by the
438438 Board.
439439 SECTION 2. This act shall beco me effective July 1, 2024.
440440 SECTION 3. It being immediately necessary for the preservation
441441 of the public peace, health or safety, an emergency is hereby
442442 declared to exist, by reason w hereof this act shall take effect and
443443 be in full force from and after its passage and approval.
