76 | 76 | | SECTION 1. AMENDATORY 74 O.S. 2021, Section 840 -2.10, is |
---|
77 | 77 | | amended to read as follows: |

78 | 78 | | Section 840-2.10 A. There is hereby created a State Empl oyee |
---|
79 | 79 | | Assistance Program within the Department of Men tal Health and |
---|
80 | 80 | | Substance Abuse Services. All functions, powers, duties, funds a nd |
---|
81 | 81 | | obligations of the Office of M anagement and Enterprise Services in |
---|
82 | 82 | | administration of the State Employee Assistance Progra m shall be |
---|
83 | 83 | | transferred to the Department. The progr am may provide assistance |
---|
84 | 84 | | to state agencies in their management of employees who se personal |
---|
85 | 85 | | problems may have a n egative impact on job performance. The program |
---|
86 | 86 | | may also provide for assessment, referral, consultation, and problem |
---|
87 | 87 | | resolution assistance to s tate employees and their family members |

142 | 142 | | Employee Assistance Program shall be on a voluntary basis. |
---|
143 | 143 | | B. The Department may enter into contrac ts which are necessary |
---|
144 | 144 | | and proper to carry out the purposes and functions of the State |
---|
145 | 145 | | Employee Assistance Program and estab lish standards and criteria |
---|
146 | 146 | | which shall be met by en tities to be eligible to contract with the |
---|
147 | 147 | | Department. |
---|
148 | 148 | | C. The Commissioner of t he Department is hereby directed to: |
---|
149 | 149 | | 1. Promulgate rules necessary for the administration of the |
---|
150 | 150 | | State Employee Assistance Program and the maintenance and release of |
---|
151 | 151 | | participant records; and |
---|
152 | 152 | | 2. Establish evaluation methods to assess the effectiveness of |
---|
153 | 153 | | the State Employee Assistance Pro gram. |
---|
154 | 154 | | D. Nothing in this act is intended to nullify any agency 's |
---|
155 | 155 | | existing employee assista nce program or to prohibit any state agency |
---|
156 | 156 | | from establishing its own employee assistance program; provided, |
---|
157 | 157 | | however, such programs established by state agencies sha ll be |
---|
158 | 158 | | subject to compliance with rules promulgated by the Commissioner of |
---|
159 | 159 | | the Department to ensure equitable treatment of employees. |
---|
160 | 160 | | E. Records that relate to participation by an individual in the |
---|
161 | 161 | | State Employee Assistance Program or an employee assistanc e program |
---|
162 | 162 | | established by a state agency shall be maintained separate and apart |
---|

218 | 218 | | Employee Assistance Program professional shall be subject to |

219 | 219 | | subpoena unless a participant poses a threat to deliberately harm |
---|
220 | 220 | | the participant or othe rs. Such determination shall be made by an |
---|
221 | 221 | | Employee Assistance Program professional. A participant in an |
---|
222 | 222 | | employee assistance program shall have a right of access to his or |
---|
223 | 223 | | her own employee assistance program records. |
---|
224 | 224 | | F. No provision of this section or t he rules promulgated |
---|
225 | 225 | | pursuant to this section shall be construed to conflict with an |
---|
226 | 226 | | appointing authority 's responsibility and authority to maintain |
---|
227 | 227 | | discipline or to take disci plinary measures against employees for |
---|
228 | 228 | | misconduct or unacceptable performance. Further, participation or |
---|
229 | 229 | | nonparticipation in any state employee assistance program shall not |
---|
230 | 230 | | excuse an employee from discip line or otherwise affect the terms and |
---|
231 | 231 | | conditions of such employee's employment status or opportunities for |
---|
232 | 232 | | advancement with the sta te. |
---|
233 | 233 | | G. The Legislature and the j udicial branch of state government |
---|
234 | 234 | | may utilize the services of the State Employee Assistanc e Program at |
---|
235 | 235 | | their discretion. |
---|
236 | 236 | | H. The Oklahoma Department of Mental Health and Substance Abuse |
---|
237 | 237 | | Services is authorized to enter into agreements to serve as a vendor |
---|
