7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 74 O.S. 2021, Section 840 -2.10, is
7777 amended to read as follows:
7878 Section 840-2.10 A. There is hereby created a State Empl oyee
7979 Assistance Program within the Department of Men tal Health and
8080 Substance Abuse Services. All functions, powers, duties, funds a nd
8181 obligations of the Office of M anagement and Enterprise Services in
8282 administration of the State Employee Assistance Progra m shall be
8383 transferred to the Department. The progr am may provide assistance
8484 to state agencies in their management of employees who se personal
8585 problems may have a n egative impact on job performance. The program
8686 may also provide for assessment, referral, consultation, and problem
8787 resolution assistance to s tate employees and their family members

139139 seeking corrective help with medical or mental health problems,
140140 including alcohol or drug abuse and emotional, marital, familial,
141141 financial or other personal proble ms. Participation in the State
142142 Employee Assistance Program shall be on a voluntary basis.
143143 B. The Department may enter into contrac ts which are necessary
144144 and proper to carry out the purposes and functions of the State
145145 Employee Assistance Program and estab lish standards and criteria
146146 which shall be met by en tities to be eligible to contract with the
147147 Department.
148148 C. The Commissioner of t he Department is hereby directed to:
149149 1. Promulgate rules necessary for the administration of the
150150 State Employee Assistance Program and the maintenance and release of
151151 participant records; and
152152 2. Establish evaluation methods to assess the effectiveness of
153153 the State Employee Assistance Pro gram.
154154 D. Nothing in this act is intended to nullify any agency 's
155155 existing employee assista nce program or to prohibit any state agency
156156 from establishing its own employee assistance program; provided,
157157 however, such programs established by state agencies sha ll be
158158 subject to compliance with rules promulgated by the Commissioner of
159159 the Department to ensure equitable treatment of employees.
160160 E. Records that relate to participation by an individual in the
161161 State Employee Assistance Program or an employee assistanc e program
162162 established by a state agency shall be maintained separate and apart

214214 from regular personnel records and shall not become part of an
215215 employee's personnel file. Such records relating to an individual 's
216216 participation in an employee assistance progr am shall be
217217 confidential and neither the records nor the testimony of an
218218 Employee Assistance Program professional shall be subject to
219219 subpoena unless a participant poses a threat to deliberately harm
220220 the participant or othe rs. Such determination shall be made by an
221221 Employee Assistance Program professional. A participant in an
222222 employee assistance program shall have a right of access to his or
223223 her own employee assistance program records.
224224 F. No provision of this section or t he rules promulgated
225225 pursuant to this section shall be construed to conflict with an
226226 appointing authority 's responsibility and authority to maintain
227227 discipline or to take disci plinary measures against employees for
228228 misconduct or unacceptable performance. Further, participation or
229229 nonparticipation in any state employee assistance program shall not
230230 excuse an employee from discip line or otherwise affect the terms and
231231 conditions of such employee's employment status or opportunities for
232232 advancement with the sta te.
233233 G. The Legislature and the j udicial branch of state government
234234 may utilize the services of the State Employee Assistanc e Program at
235235 their discretion.
236236 H. The Oklahoma Department of Mental Health and Substance Abuse
237237 Services is authorized to enter into agreements to serve as a vendor
