77	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78		SECTION 1. AMENDATORY 70 O.S. 2021, Section 2605, as
79	79		amended by Section 1, Chapter 400, O.S.L. 2022 (70 O.S. Supp. 2023,
80	80		Section 2605), is amended to read as follows:
81	81		Section 2605. A. Each school year, every fifth - through
82	82		eleventh-grade student in the public and private schools of this
83	83		state and students who are educated by other means and are in the
84	84		equivalent of the fift h through eleventh grade shall be apprised,
85	85		together with the parent, custodial parent , or guardian of the
86	86		student, of the opportu nity for access to higher learnin g under the
87	87		Oklahoma Higher Learning Access Program. The Oklahoma State Regents
88	88		for Higher Education and the State Board of Education shall deve lop,

140	140		promote, and coordinate a public awareness program to be utilized in
141	141		making students and parents aware of the Oklahoma Higher Learning
142	142		Access Program.
143	143		B. On a form provided by the Oklahoma State Reg ents for Higher
144	144		Education, every public school distr ict shall designate at least one
145	145		Oklahoma Higher Learning Access Program contact person, who shall be
146	146		a counselor or teacher, at each public school site in this state in
147	147		which eighth-, ninth-, tenth-, or eleventh-grade classes are taught.
148	148		When requested by the State Regents, the State Board of Education
149	149		shall assist the State Regents to ensure the designation of c ontact
150	150		persons. Private schools shall also designate at least one school
151	151		official as a contact person. For students who are educated by
152	152		other means, a parent or guardian or other person approved by the
153	153		State Regents shall be designated the contact person .
154	154		C. 1. Students who qualify on the basis of financial need
155	155		according to subsection D or E of this section or who meet the
156	156		eligibility qualific ation set forth in subparagraph a of paragraph 1
157	157		of subsection B of Section 2603 of this title prior to enterin g the
158	158		eleventh grade or prior to reaching the age of sixteen (16) and the
159	159		standards and provisions promulgated by the Oklahoma State Regents
160	160		for Higher Education shall be given the opportunity throughout the
161	161		eighth-, ninth-, tenth-, and eleventh-grade years, for students
162	162		enrolled in a public or private school, or between the ages of
163	163		thirteen (13) and sixteen (16), for students who are educated by

215	215		other means, to enter into participation in the program by agreeing
216	216		to, throughout the remainder of their school years or educational
217	217		program:
218	218		a. attend school or an educational program regularly and
219	219		do homework regularly,
220	220		b. refrain from substance abuse,
221	221		c. refrain from commission of crimes or delinquent acts,
222	222		d. have school work and school records reviewed by
223	223		mentors designated pursuant to the program,
224	224		e. provide information requested by the Oklahoma Stat e
225	225		Regents for Higher Education or the State Board of
226	226		Education, and
227	227		f. participate in program activities.
228	228		2. Students who meet the eligibility qualification set forth in
229	229		subparagraph a of paragraph 1 of subsection B of Section 2603 of
230	230		this title after com pleting the eleventh grade or after reaching the
231	231		age of seventeen (17) shall be given the opportunity prior to
232	232		reaching the age of twenty-one (21) to enter into participation in
233	233		the program and shall execute an agreement with provisions as
234	234		determined by the Oklahoma State Regents for Higher Education.
235	235		3. The contact person shall maintain the agreements, which
236	236		shall be executed on forms provided by the Oklaho ma State Regents
237	237		for Higher Education and managed according to regulations
238	238		promulgated by the Oklaho ma State Regents for Higher Education, and

290	290		the contact person shall monitor compliance of the student with the
291	291		terms of the agreement. The Oklahoma State R egents for Higher
292	292		Education are authorized to process student agreements and verify
293	293		compliance with the agreements. Students failing to comply with the
294	294		terms of the agreement shall not be eligible for the awar ds provided
295	295		in Section 2604 of this title.
296	296		D. Except as otherwise provided for in subsection E of this
297	297		section and except for students who qualif y pursuant to subsection B
298	298		of Section 2603 of this t itle, a student shall not be found to be in
299	299		financial need for purposes of the Oklahoma Higher Learning Access
300	300		Program if:
301	301		1. At the time the student applies for participation in the
302	302		program during the e ighth, ninth, or tenth grade for students
303	303		enrolled in a public or private school, or between the ages of
304	304		thirteen (13) and fifteen (15), for students who are educated by
305	305		other means, the income from taxable and nontaxable sources of the
306	306		student's parent(s) exceeds Fifty Thousand Dollars ($50,000.00) per
307	307		year;
308	308		2. Beginning with eighth -, ninth-, or tenth-grade students who
309	309		are enrolled in a public or private school or students between the
310	310		ages of thirteen (13) and fifteen (15) who are educated by other
311	311		means who apply for participation in the program in the 2 017-2018
312	312		school year, the federal adjusted gross income of the student's
313	313		parent(s) exceeds Fifty-five Thousand Dollars ($55,000.00) per year;

365	365		3. Beginning with eighth-, ninth-, tenth-, or eleventh-grade
366	366		students who are enrolled in a public or private sch ool or students
367	367		between the ages of thirteen (13) and sixt een (16) who are educated
368	368		by other means who apply for participation in the program in the
369	369		2021-2022 school year, the federal adjusted gross incom e of the
370	370		student's parent(s) exceeds Sixty Thousand Dollars ($60,000.00) per
371	371		year;
372	372		4. Beginning with eighth -, ninth-, tenth-, or eleventh-grade
373	373		students who are enrolled in a public or private school or students
374	374		between the ages of thirteen (13) and sixteen (16) who are educated
375	375		by other means who apply fo r participation in the program in the
376	376		2022-2023 school year:
377	377		a. the federal adjusted gross income of the student's
378	378		parent(s), who have two or fewer dependent children,
379	379		exceeds Sixty Thousand Dollars ($ 60,000.00) per year,
380	380		b. the federal adjusted gross inco me of the student's
381	381		parent(s), who have three or four depe ndent children,
382	382		exceeds Seventy Thousand Dollars ($70,000.00) per
383	383		year, or
384	384		c. the federal adjusted gross income of the student's
385	385		parent(s), who have five or more dependent children,
386	386		exceeds Eighty Thousand Dollars ($80,000 .00) per year;
387	387		5. At the time the student begins postsecondary education and
388	388		prior to receiving any Oklahoma Higher Learning Access Program

440	440		benefit award, the federal adjusted gro ss income of the student's
441	441		parent(s) exceeds One Hun dred Thousand Dollars ($100,000.00) per
442	442		year;
443	443		6. Beginning with the 2018-2019 academic year, prior to
444	444		receiving any Oklahoma Higher Learning Access Program benefit award
445	445		for any year during which the stu dent is enrolled in an institution
446	446		which is a member of The Oklahoma State System of Higher Education,
447	447		a postsecondary vocational-technical program offered by a technology
448	448		center school that meets the requirements to be eligible for federal
449	449		student financial aid or a private institution of higher learning
450	450		located within this state and accredited pursuant to Section 4103 of
451	451		this title, the federal adjusted gross i ncome of the student's
452	452		parent(s) exceeds One Hundred Thousand Dollars ($100,000.00) per
453	453		year.
454	454		The determination of financial qualification as set fo rth in
455	455		paragraphs 5 and 6 of this subsection s hall be based on the income
456	456		of the student, not the income of the parent(s), if a student:
457	457		a. is determined to be independent of the student 's
458	458		parents for federal financial aid purposes,
459	459		b. was in the permanent custody of the Department of
460	460		Human Services at the time the student enrolled in the
461	461		program, or
462	462		c. was in the court-ordered custody of a federally
463	463		recognized Indian tribe, as defined by the federal

515	515		Indian Child Welfare Act, at the time the student
516	516		enrolled in the program.
517	517		The provisions of this p aragraph shall apply to any student who
518	518		has received an Oklaho ma Higher Learning Access Program benefit
519	519		award after the 2017 -2018 school year; and
520	520		7. The Oklahoma State Regents for Higher Education shall review
521	521		the determination of financial qualifica tion as set forth in
522	522		paragraphs 1, 2, 3, and 4 of this subsection if the income from
523	523		taxable and nontaxable sources of the student 's parent(s) includes
524	524		income received from nontaxable military benefits or income receiv ed
525	525		from the federal Social Securit y Administration due to the death or
526	526		disability of the student 's parent(s). If the income from taxable
527	527		and nontaxable sources of the student 's parent(s), excluding incom e
528	528		received from nontaxable military benefits or inco me received from
529	529		the federal Social Security Administration due to the death or
530	530		disability of the student's parent(s), does not exceed the
531	531		limitations set forth by paragraphs 1, 2, 3, and 4 of this
532	532		subsection, the student shall be determined to have met th e
533	533		financial qualification set forth in paragraphs 1, 2, 3, and 4 of
534	534		this subsection.
535	535		8. If a tax credit claimed pursuant to the Oklahoma Parental
536	536		Choice Tax Credit Act is classified as taxable income by the
537	537		Oklahoma Tax Commission, the Oklahoma State Rege nts for Higher
538	538		Education shall not include the claimed tax credit as taxable or

591	591		student's parents as provided by this subsection.
592	592		E. 1. A student who was adopted between birth and twelve (12)
593	593		years of age while in the permanent custody of the Depa rtment of
594	594		Human Services, in the court-ordered custody of a licensed private
595	595		nonprofit child-placing agency, or federally recognized Indian
596	596		tribe, as defined by the federal Indian Child Welfare Act, shall not
597	597		be found to be in financial need for purposes o f the Oklahoma Higher
598	598		Learning Access Program if at the time the student begi ns
599	599		postsecondary education and prior to receiving any Oklahoma H igher
600	600		Learning Access Program benefit award, the federal adjusted gross
601	601		income of the student 's parent(s) exceeds O ne Hundred Fifty Thousand
602	602		Dollars ($150,000.00) per year. The provisions of this paragraph
603	603		shall not apply to any student who has received a n Oklahoma Higher
604	604		Learning Access Program benefit award prior to the 2012-2013 school
605	605		year.
606	606		2. A student who was a dopted between thirteen (13 ) and
607	607		seventeen (17) years of age while in the pe rmanent custody of the
608	608		Department of Human Services, in the court -ordered custody of a
609	609		licensed private nonprofit child-placing agency, or federally
610	610		recognized Indian tribe, as def ined by the federal Indian Child
611	611		Welfare Act, shall not be found to be in fi nancial need for purposes
612	612		of the Oklahoma Higher Learning Access Program if at the time the
613	613		student begins postsecondary education and prior to receiving any

665	665		Oklahoma Higher Learni ng Access Program benefit a ward, the federal
666	666		adjusted gross income of the st udent's parent(s) exceeds Two Hundred
667	667		Thousand Dollars ($200,000. 00) per year. The provisions of this
668	668		paragraph shall not apply to any student who has received an
669	669		Oklahoma Higher Learning Access Program ben efit award prior to the
670	670		2012-2013 school year.
671	671		3. Except for students who qualify pursuant to subsection B of
672	672		Section 2603 of this title, the determination of financial
673	673		qualification as set forth in this subsection shall be base d on the
674	674		income of the student, not the income of the parent(s), if the
675	675		student is determined to be i ndependent of the student's parent(s)
676	676		for federal financial aid purposes. A determination of financial
677	677		qualification shall not be required for the student who meets the
678	678		criteria set forth in this subsection at the time the studen t
679	679		applies for participatio n in the program. The provisions of thi s
680	680		paragraph shall not apply to any student who has received an
681	681		Oklahoma Higher Learning Access Program benefit awar d prior to the
682	682		2008-2009 school year.
683	683		F. The financial qualification of a student as set forth in
684	684		subsections D and E of this section shall be certified by the
685	685		contact person or by the Oklahoma State Regents for Higher Education
686	686		on the agreement form prov ided by the Oklahoma State Regents for
687	687		Higher Education. The form shall b e retained in the permanen t

739	739		record of the student and a copy forwar ded to the Oklahoma State
740	740		Regents for Higher Education.
741	741		G. Agreements shall be witnessed by the parent, custodial
742	742		parent, or guardian of the student, who shall further agree to:
743	743		1. Assist the student in achievin g compliance with the
744	744		agreements;
745	745		2. Confer, when requested to do so, with the school contact
746	746		person, other school personnel, and program mentors;
747	747		3. Provide information requested by the Oklahoma State Regents
748	748		for Higher Education or the State Board of Education; and
749	749		4. Assist the student in com pleting forms and reports required
750	750		for program participation, making applications to institutions and
751	751		schools of higher learning, and filing a pplications for student
752	752		grants and scholarships.
753	753		H. Students who are enrolled in a school district located in
754	754		this state that serves students who reside in both this state and an
755	755		adjacent state pursuant to a contract as authoriz ed in Section 5-
756	756		117.1 of this title, are in the eleventh and twelfth grades during
757	757		the 2006-2007 school year, and who were denied participati on in the
758	758		program shall be allowed to enter or reenter into participation in
759	759		the program by entering into agreement s as set forth in subsectio ns
760	760		C and D of this section by June 1, 200 8.

812	812		I. The Oklahoma State Regents for Higher Education shall
813	813		promulgate rules for the determination of student compliance with
814	814		agreements made pursuant to this section.
815	815		J. The Oklahoma State Regents for Higher Educ ation shall
816	816		designate personnel to coor dinate tracking of program records for
817	817		the years when students participatin g in the program are still in
818	818		the schools or are being educated by other means, provide staff
819	819		development for conta ct persons in the schools, and provide liaison
820	820		with the State Board of Education and local o rganizations and
821	821		individuals participating in the program.
822	822		K. The school district where an Oklahoma Higher Learning Access
823	823		Program student is enrolled when the stu dent begins participation i n
824	824		the program and any subsequent schoo l district where the stude nt
825	825		enrolls shall forward information regarding par ticipation by the
826	826		student in the program to a school to which the student transfers
827	827		upon the request of the school for the records of the stud ent.
828	828		L. Students participating in th e Oklahoma Higher Learning
829	829		Access Program shall provide their Social Security number or their
830	830		student identification number used by their school to the Oklahoma
831	831		State Regents for Higher Educat ion. The Regents shall kee p the
832	832		numbers confidential and use th em only for administrative purposes.
833	833		SECTION 2. This act shall become effective November 1, 2024.
