7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 70 O.S. 2021, Section 2605, as
7979 amended by Section 1, Chapter 400, O.S.L. 2022 (70 O.S. Supp. 2023,
8080 Section 2605), is amended to read as follows:
8181 Section 2605. A. Each school year, every fifth - through
8282 eleventh-grade student in the public and private schools of this
8383 state and students who are educated by other means and are in the
8484 equivalent of the fift h through eleventh grade shall be apprised,
8585 together with the parent, custodial parent , or guardian of the
8686 student, of the opportu nity for access to higher learnin g under the
8787 Oklahoma Higher Learning Access Program. The Oklahoma State Regents

140140 promote, and coordinate a public awareness program to be utilized in
141141 making students and parents aware of the Oklahoma Higher Learning
142142 Access Program.
143143 B. On a form provided by the Oklahoma State Reg ents for Higher
144144 Education, every public school distr ict shall designate at least one
145145 Oklahoma Higher Learning Access Program contact person, who shall be
146146 a counselor or teacher, at each public school site in this state in
147147 which eighth-, ninth-, tenth-, or eleventh-grade classes are taught.
148148 When requested by the State Regents, the State Board of Education
149149 shall assist the State Regents to ensure the designation of c ontact
150150 persons. Private schools shall also designate at least one school
151151 official as a contact person. For students who are educated by
152152 other means, a parent or guardian or other person approved by the
153153 State Regents shall be designated the contact person .
154154 C. 1. Students who qualify on the basis of financial need
155155 according to subsection D or E of this section or who meet the
156156 eligibility qualific ation set forth in subparagraph a of paragraph 1
157157 of subsection B of Section 2603 of this title prior to enterin g the
158158 eleventh grade or prior to reaching the age of sixteen (16) and the
159159 standards and provisions promulgated by the Oklahoma State Regents
160160 for Higher Education shall be given the opportunity throughout the
161161 eighth-, ninth-, tenth-, and eleventh-grade years, for students
162162 enrolled in a public or private school, or between the ages of
163163 thirteen (13) and sixteen (16), for students who are educated by

215215 other means, to enter into participation in the program by agreeing
216216 to, throughout the remainder of their school years or educational
217217 program:
218218 a. attend school or an educational program regularly and
219219 do homework regularly,
220220 b. refrain from substance abuse,
221221 c. refrain from commission of crimes or delinquent acts,
222222 d. have school work and school records reviewed by
223223 mentors designated pursuant to the program,
224224 e. provide information requested by the Oklahoma Stat e
225225 Regents for Higher Education or the State Board of
226226 Education, and
227227 f. participate in program activities.
228228 2. Students who meet the eligibility qualification set forth in
229229 subparagraph a of paragraph 1 of subsection B of Section 2603 of
230230 this title after com pleting the eleventh grade or after reaching the
231231 age of seventeen (17) shall be given the opportunity prior to
232232 reaching the age of twenty-one (21) to enter into participation in
233233 the program and shall execute an agreement with provisions as
234234 determined by the Oklahoma State Regents for Higher Education.
235235 3. The contact person shall maintain the agreements, which
236236 shall be executed on forms provided by the Oklaho ma State Regents
237237 for Higher Education and managed according to regulations
238238 promulgated by the Oklaho ma State Regents for Higher Education, and

290290 the contact person shall monitor compliance of the student with the
291291 terms of the agreement. The Oklahoma State R egents for Higher
292292 Education are authorized to process student agreements and verify
293293 compliance with the agreements. Students failing to comply with the
294294 terms of the agreement shall not be eligible for the awar ds provided
295295 in Section 2604 of this title.
296296 D. Except as otherwise provided for in subsection E of this
297297 section and except for students who qualif y pursuant to subsection B
298298 of Section 2603 of this t itle, a student shall not be found to be in
299299 financial need for purposes of the Oklahoma Higher Learning Access
300300 Program if:
301301 1. At the time the student applies for participation in the
302302 program during the e ighth, ninth, or tenth grade for students
303303 enrolled in a public or private school, or between the ages of
304304 thirteen (13) and fifteen (15), for students who are educated by
305305 other means, the income from taxable and nontaxable sources of the
306306 student's parent(s) exceeds Fifty Thousand Dollars ($50,000.00) per
307307 year;
308308 2. Beginning with eighth -, ninth-, or tenth-grade students who
309309 are enrolled in a public or private school or students between the
310310 ages of thirteen (13) and fifteen (15) who are educated by other
311311 means who apply for participation in the program in the 2 017-2018
312312 school year, the federal adjusted gross income of the student's
313313 parent(s) exceeds Fifty-five Thousand Dollars ($55,000.00) per year;

365365 3. Beginning with eighth-, ninth-, tenth-, or eleventh-grade

367367 between the ages of thirteen (13) and sixt een (16) who are educated
368368 by other means who apply for participation in the program in the
369369 2021-2022 school year, the federal adjusted gross incom e of the
370370 student's parent(s) exceeds Sixty Thousand Dollars ($60,000.00) per
371371 year;
372372 4. Beginning with eighth -, ninth-, tenth-, or eleventh-grade
373373 students who are enrolled in a public or private school or students
374374 between the ages of thirteen (13) and sixteen (16) who are educated
375375 by other means who apply fo r participation in the program in the
376376 2022-2023 school year:
377377 a. the federal adjusted gross income of the student's
378378 parent(s), who have two or fewer dependent children,
379379 exceeds Sixty Thousand Dollars ($ 60,000.00) per year,
380380 b. the federal adjusted gross inco me of the student's
381381 parent(s), who have three or four depe ndent children,
382382 exceeds Seventy Thousand Dollars ($70,000.00) per
383383 year, or
384384 c. the federal adjusted gross income of the student's
385385 parent(s), who have five or more dependent children,
386386 exceeds Eighty Thousand Dollars ($80,000 .00) per year;
387387 5. At the time the student begins postsecondary education and
388388 prior to receiving any Oklahoma Higher Learning Access Program

440440 benefit award, the federal adjusted gro ss income of the student's
441441 parent(s) exceeds One Hun dred Thousand Dollars ($100,000.00) per
442442 year;
443443 6. Beginning with the 2018-2019 academic year, prior to
444444 receiving any Oklahoma Higher Learning Access Program benefit award
445445 for any year during which the stu dent is enrolled in an institution
446446 which is a member of The Oklahoma State System of Higher Education,
447447 a postsecondary vocational-technical program offered by a technology
448448 center school that meets the requirements to be eligible for federal
449449 student financial aid or a private institution of higher learning
450450 located within this state and accredited pursuant to Section 4103 of
451451 this title, the federal adjusted gross i ncome of the student's
452452 parent(s) exceeds One Hundred Thousand Dollars ($100,000.00) per
453453 year.
454454 The determination of financial qualification as set fo rth in
455455 paragraphs 5 and 6 of this subsection s hall be based on the income
456456 of the student, not the income of the parent(s), if a student:
457457 a. is determined to be independent of the student 's
458458 parents for federal financial aid purposes,
459459 b. was in the permanent custody of the Department of
460460 Human Services at the time the student enrolled in the
461461 program, or
462462 c. was in the court-ordered custody of a federally
463463 recognized Indian tribe, as defined by the federal

515515 Indian Child Welfare Act, at the time the student
516516 enrolled in the program.
517517 The provisions of this p aragraph shall apply to any student who
518518 has received an Oklaho ma Higher Learning Access Program benefit
519519 award after the 2017 -2018 school year; and
520520 7. The Oklahoma State Regents for Higher Education shall review
521521 the determination of financial qualifica tion as set forth in
522522 paragraphs 1, 2, 3, and 4 of this subsection if the income from
523523 taxable and nontaxable sources of the student 's parent(s) includes
524524 income received from nontaxable military benefits or income receiv ed
525525 from the federal Social Securit y Administration due to the death or
526526 disability of the student 's parent(s). If the income from taxable
527527 and nontaxable sources of the student 's parent(s), excluding incom e
528528 received from nontaxable military benefits or inco me received from
529529 the federal Social Security Administration due to the death or
530530 disability of the student's parent(s), does not exceed the
531531 limitations set forth by paragraphs 1, 2, 3, and 4 of this
532532 subsection, the student shall be determined to have met th e
533533 financial qualification set forth in paragraphs 1, 2, 3, and 4 of
534534 this subsection.
535535 8. If a tax credit claimed pursuant to the Oklahoma Parental
536536 Choice Tax Credit Act is classified as taxable income by the
537537 Oklahoma Tax Commission, the Oklahoma State Rege nts for Higher
538538 Education shall not include the claimed tax credit as taxable or

591591 student's parents as provided by this subsection.
592592 E. 1. A student who was adopted between birth and twelve (12)
593593 years of age while in the permanent custody of the Depa rtment of
594594 Human Services, in the court-ordered custody of a licensed private
595595 nonprofit child-placing agency, or federally recognized Indian
596596 tribe, as defined by the federal Indian Child Welfare Act, shall not
597597 be found to be in financial need for purposes o f the Oklahoma Higher
598598 Learning Access Program if at the time the student begi ns
599599 postsecondary education and prior to receiving any Oklahoma H igher
600600 Learning Access Program benefit award, the federal adjusted gross
601601 income of the student 's parent(s) exceeds O ne Hundred Fifty Thousand
602602 Dollars ($150,000.00) per year. The provisions of this paragraph
603603 shall not apply to any student who has received a n Oklahoma Higher
604604 Learning Access Program benefit award prior to the 2012-2013 school
605605 year.
606606 2. A student who was a dopted between thirteen (13 ) and
607607 seventeen (17) years of age while in the pe rmanent custody of the
608608 Department of Human Services, in the court -ordered custody of a
609609 licensed private nonprofit child-placing agency, or federally
610610 recognized Indian tribe, as def ined by the federal Indian Child
611611 Welfare Act, shall not be found to be in fi nancial need for purposes
612612 of the Oklahoma Higher Learning Access Program if at the time the
613613 student begins postsecondary education and prior to receiving any

665665 Oklahoma Higher Learni ng Access Program benefit a ward, the federal
666666 adjusted gross income of the st udent's parent(s) exceeds Two Hundred
667667 Thousand Dollars ($200,000. 00) per year. The provisions of this
668668 paragraph shall not apply to any student who has received an
669669 Oklahoma Higher Learning Access Program ben efit award prior to the
670670 2012-2013 school year.
671671 3. Except for students who qualify pursuant to subsection B of
672672 Section 2603 of this title, the determination of financial
673673 qualification as set forth in this subsection shall be base d on the
674674 income of the student, not the income of the parent(s), if the
675675 student is determined to be i ndependent of the student's parent(s)
676676 for federal financial aid purposes. A determination of financial
677677 qualification shall not be required for the student who meets the
678678 criteria set forth in this subsection at the time the studen t
679679 applies for participatio n in the program. The provisions of thi s
680680 paragraph shall not apply to any student who has received an
681681 Oklahoma Higher Learning Access Program benefit awar d prior to the
682682 2008-2009 school year.
683683 F. The financial qualification of a student as set forth in
684684 subsections D and E of this section shall be certified by the
685685 contact person or by the Oklahoma State Regents for Higher Education
686686 on the agreement form prov ided by the Oklahoma State Regents for
687687 Higher Education. The form shall b e retained in the permanen t

740740 Regents for Higher Education.
741741 G. Agreements shall be witnessed by the parent, custodial
742742 parent, or guardian of the student, who shall further agree to:
743743 1. Assist the student in achievin g compliance with the
744744 agreements;
745745 2. Confer, when requested to do so, with the school contact
746746 person, other school personnel, and program mentors;
747747 3. Provide information requested by the Oklahoma State Regents
748748 for Higher Education or the State Board of Education; and
749749 4. Assist the student in com pleting forms and reports required
750750 for program participation, making applications to institutions and
751751 schools of higher learning, and filing a pplications for student
752752 grants and scholarships.
753753 H. Students who are enrolled in a school district located in
754754 this state that serves students who reside in both this state and an
755755 adjacent state pursuant to a contract as authoriz ed in Section 5-
756756 117.1 of this title, are in the eleventh and twelfth grades during
757757 the 2006-2007 school year, and who were denied participati on in the
758758 program shall be allowed to enter or reenter into participation in
759759 the program by entering into agreement s as set forth in subsectio ns
760760 C and D of this section by June 1, 200 8.

812812 I. The Oklahoma State Regents for Higher Education shall
813813 promulgate rules for the determination of student compliance with
814814 agreements made pursuant to this section.
815815 J. The Oklahoma State Regents for Higher Educ ation shall
816816 designate personnel to coor dinate tracking of program records for
817817 the years when students participatin g in the program are still in
818818 the schools or are being educated by other means, provide staff
819819 development for conta ct persons in the schools, and provide liaison
820820 with the State Board of Education and local o rganizations and
821821 individuals participating in the program.
822822 K. The school district where an Oklahoma Higher Learning Access
823823 Program student is enrolled when the stu dent begins participation i n
824824 the program and any subsequent schoo l district where the stude nt
825825 enrolls shall forward information regarding par ticipation by the
826826 student in the program to a school to which the student transfers
827827 upon the request of the school for the records of the stud ent.
828828 L. Students participating in th e Oklahoma Higher Learning
829829 Access Program shall provide their Social Security number or their
830830 student identification number used by their school to the Oklahoma
831831 State Regents for Higher Educat ion. The Regents shall kee p the
832832 numbers confidential and use th em only for administrative purposes.
833833 SECTION 2. This act shall become effective November 1, 2024.
