8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY Section 1, Chapter 291, O.S.L.
8383 2023 (70 O.S. Supp. 2023, Section 6 -104.8), is amended to read as
8484 follows:
8585 Section 6-104.8 A. As provided in this section:
8686 1. Full-time employees of a public school district in this
8787 state who have been employed by the school district for at least one
8888 year and have worked at least one thousand two hundred fifty (1,250)

141141 2. Persons employed full time as classroom instructional Full-
142142 time employees of technology center school districts supervised by
143143 the State Board of Career and Technology Education who have been
144144 employed by the technology center school district for at least one
145145 year and have worked at least one thousand two hundred fifty (1,250)
146146 hours during the preceding twelve -month period;
147147 3. Persons employed as teachers by the State Department of
148148 Rehabilitation Services who have been employed by the State
149149 Department of Rehabilitation Services for at least one year and have
150150 worked at least one thousand two hundred fifty (1,2 50) hours during
151151 the preceding twelve -month period;
152152 4. Persons employed full time as correctional teachers or
153153 vocational instructors by the Department of Corrections pursuant to
154154 Section 510.6a of Title 57 of the Oklahoma Statutes who have been
155155 employed by a Department of Corrections facility for at least one
156156 year and have worked at least one thousand two hundred fifty (1,250)
157157 hours during the preceding twelve-month period; and
158158 5. Persons employed full time as teachers by the Office of
159159 Juvenile Affairs who have been employed by a n Office of Juvenile
160160 Affairs facility for at least one year and have worked at least one
161161 thousand two hundred fifty (1,250) hours during the preceding
162162 twelve-month period,;
163163 shall be entitled to six (6) weeks of paid maternity leave f ollowing
164164 the birth or adoption of the employee's newborn child. The six (6)

216216 weeks of paid maternity leave shall be used immediate ly following
217217 the birth of the school district employee's child or immediately
218218 following the legal placement of the newborn with the employee
219219 adopting the child.
220220 B. 1. Paid maternity leave provided pu rsuant to paragraphs 1,
221221 2, and 3 of subsection A of this section shall be in additio n to and
222222 not in place of sick leave due to pregnancy, as authorized by
223223 Section 6-104 of Title 70 of the Oklahoma Statutes this title.
224224 2. Paid maternity leave provided purs uant to paragraph 4 of
225225 subsection A of this section s hall be in addition to and not in
226226 place of sick leave due to pregnancy, as authorized by Section
227227 510.6a of Title 57 of the Oklahoma Statutes.
228228 3. Paid maternity leave provided pursuant to paragraph 5 of
229229 subsection A of this sect ion shall be in addition to and not in
230230 place of sick leave due to p regnancy, as authorized by Section 2-7-
231231 202 of Title 10A of the Oklahoma Statutes.
232232 C. An employee who takes maternity leave pursuant to the
233233 provisions of subsection A of this section shall not be deprived of
234234 any compensation or other benefits to which the emp loyee is
235235 otherwise entitled.
236236 D. Each fiscal year, the Legislature s hall appropriate adequate
237237 funding to the Public School Paid Maternity Leave Revolving Fund
238238 created in Section 7 6-104.9 of this act title for the purpose of
239239 providing paid maternity leave to eligible sc hool district employees

291291 pursuant to paragraph 1 of subsection A of t his section. If the
292292 Legislature does not appropriate adequate funding specifically for
293293 the purpose of providing paid maternity leave to school district
294294 employees, the State Board of Educa tion shall allocate from the
295295 funds appropriated to the State Board o f Education for the support
296296 of public school activities an amount to fully fund paid maternity
297297 leave.
298298 E. The State Board of Education, the State Board of Career and
299299 Technology Education, the Commission for Rehabilitation Services,
300300 the State Board of Corre ctions, and the Board of Juvenile Affairs
301301 may promulgate rules to implement the provisions of this secti on.
302302 SECTION 2. This act shall become effective July 1, 2024.
303303 SECTION 3. It being immediately necessary for the preservation
304304 of the public peace, health or safety, an emergency is hereby
305305 declared to exist, by reason whereof this act shall take effect and
306306 be in full force from and after its passage and approval.
