81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. AMENDATORY Section 1, Chapter 291, O.S.L.
83	83	2023 (70 O.S. Supp. 2023, Section 6 -104.8), is amended to read as
84	84	follows:
85	85	Section 6-104.8 A. As provided in this section:
86	86	1. Full-time employees of a public school district in this
87	87	state who have been employed by the school district for at least one
88	88	year and have worked at least one thousand two hundred fifty (1,250)
89	89	hours during the preceding twelve-month period;

141	141	2. Persons employed full time as classroom instructional Full-
142	142	time employees of technology center school districts supervised by
143	143	the State Board of Career and Technology Education who have been
144	144	employed by the technology center school district for at least one
145	145	year and have worked at least one thousand two hundred fifty (1,250)
146	146	hours during the preceding twelve -month period;
147	147	3. Persons employed as teachers by the State Department of
148	148	Rehabilitation Services who have been employed by the State
149	149	Department of Rehabilitation Services for at least one year and have
150	150	worked at least one thousand two hundred fifty (1,2 50) hours during
151	151	the preceding twelve -month period;
152	152	4. Persons employed full time as correctional teachers or
153	153	vocational instructors by the Department of Corrections pursuant to
154	154	Section 510.6a of Title 57 of the Oklahoma Statutes who have been
155	155	employed by a Department of Corrections facility for at least one
156	156	year and have worked at least one thousand two hundred fifty (1,250)
157	157	hours during the preceding twelve-month period; and
158	158	5. Persons employed full time as teachers by the Office of
159	159	Juvenile Affairs who have been employed by a n Office of Juvenile
160	160	Affairs facility for at least one year and have worked at least one
161	161	thousand two hundred fifty (1,250) hours during the preceding
162	162	twelve-month period,;
163	163	shall be entitled to six (6) weeks of paid maternity leave f ollowing
164	164	the birth or adoption of the employee's newborn child. The six (6)

216	216	weeks of paid maternity leave shall be used immediate ly following
217	217	the birth of the school district employee's child or immediately
218	218	following the legal placement of the newborn with the employee
219	219	adopting the child.
220	220	B. 1. Paid maternity leave provided pu rsuant to paragraphs 1,
221	221	2, and 3 of subsection A of this section shall be in additio n to and
222	222	not in place of sick leave due to pregnancy, as authorized by
223	223	Section 6-104 of Title 70 of the Oklahoma Statutes this title.
224	224	2. Paid maternity leave provided purs uant to paragraph 4 of
225	225	subsection A of this section s hall be in addition to and not in
226	226	place of sick leave due to pregnancy, as authorized by Section
227	227	510.6a of Title 57 of the Oklahoma Statutes.
228	228	3. Paid maternity leave provided pursuant to paragraph 5 of
229	229	subsection A of this sect ion shall be in addition to and not in
230	230	place of sick leave due to p regnancy, as authorized by Section 2-7-
231	231	202 of Title 10A of the Oklahoma Statutes.
232	232	C. An employee who takes maternity leave pursuant to the
233	233	provisions of subsection A of this section shall not be deprived of
234	234	any compensation or other benefits to which the emp loyee is
235	235	otherwise entitled.
236	236	D. Each fiscal year, the Legislature s hall appropriate adequate
237	237	funding to the Public School Paid Maternity Leave Revolving Fund
238	238	created in Section 7 6-104.9 of this act title for the purpose of
239	239	providing paid maternity leave to eligible sc hool district employees

291	291	pursuant to paragraph 1 of subsection A of t his section. If the
292	292	Legislature does not appropriate adequate funding specifically for
293	293	the purpose of providing paid maternity leave to school district
294	294	employees, the State Board of Educa tion shall allocate from the
295	295	funds appropriated to the State Board o f Education for the support
296	296	of public school activities an amount to fully fund paid maternity
297	297	leave.
298	298	E. The State Board of Education, the State Board of Career and
299	299	Technology Education, the Commission for Rehabilitation Services,
300	300	the State Board of Corre ctions, and the Board of Juvenile Affairs
301	301	may promulgate rules to implement the provisions of this secti on.
302	302	SECTION 2. This act shall become effective July 1, 2024.
303	303	SECTION 3. It being immediately necessary for the preservation
304	304	of the public peace, health or safety, an emergency is hereby
305	305	declared to exist, by reason whereof this act shall take effect and
306	306	be in full force from and after its passage and approval.
