77	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78		SECTION 1. AMENDATORY 47 O.S. 2021, Section 6 -101, as
79	79		last amended by Section 5, Chapter 47, 1st Extraordinary Session,
80	80		O.S.L. 2023 (47 O.S. Supp. 2023, Section 6 -101), is amended to read
81	81		as follows:
82	82		Section 6-101. A. No person, except those hereinafter
83	83		expressly exempted in Sections 6-102 and 6-102.1 of this title,
84	84		shall operate any moto r vehicle upon a highway in this state unless
85	85		the person has a valid Oklahoma driver license for the class of
86	86		vehicle being operated under the provi sions of this title. No
87	87		person shall be permitted to possess more than one valid lice nse at

141	141		B. 1. No person shall operate a Class A commercial motor
142	142		vehicle unless the person i s eighteen (18) years of age or old er and
143	143		holds a valid Class A commercial license, ex cept as provided in
144	144		paragraph 5 of this subsection and subsection F of thi s section.
145	145		Any person holding a valid Class A commercial license shall be
146	146		permitted to operate motor vehicles in Classes A, B, C a nd D, except
147	147		as provided for in paragraph 4 of this subsection.
148	148		2. No person shall operate a Class B commercial motor vehicl e
149	149		unless the person is eighteen (18) years of age or older and holds a
150	150		valid Class B commercial license, except as provided in para graph 5
151	151		of subsection F of this section. Any perso n holding a valid Cl ass B
152	152		commercial license shall be permitted to operate motor vehicles in
153	153		Classes B, C and D, except as provided for in paragraph 4 of this
154	154		subsection.
155	155		3. No person shall operate a Clas s C commercial motor vehicle
156	156		unless the person is e ighteen (18) years of age or older and holds a
157	157		valid Class C commercial li cense, except as provided in subsection F
158	158		of this section. Any person holding a valid Class C c ommercial
159	159		license shall be permitte d to operate motor vehicles in Classes C
160	160		and D, except as provided for in paragraph 4 of this subsection.
161	161		4. No person under twenty-one (21) years of age shall be
162	162		licensed to operate any motor vehicle which is required t o be

214	214		placarded for hazardous materi als pursuant to 49 C.F.R., Part 172,
215	215		subpart F, except as provided in subsection F of this section;
216	216		provided, a person eighte en (18) years of age or older may be
217	217		licensed to operate a farm vehicle which is required to be placarded
218	218		for hazardous materials p ursuant to 49 C.F.R., Part 172, subpart F,
219	219		except as provided in subsection F of this section.
220	220		5. A person at least seventee n (17) years of age who
221	221		successfully completes all examinations required by law may be
222	222		issued by Service Oklahoma:
223	223		a. a restricted Class A commercial license which shall
224	224		grant to the licensee the privilege to operate a Class
225	225		A or Class B commercial motor v ehicle for harvest
226	226		purposes or a Class D motor vehicle, or
227	227		b. a restricted Class B commercial li cense which shall
228	228		grant to the licensee the privilege to operate a Class
229	229		B commercial motor vehicle for harvest purposes or a
230	230		Class D motor vehicle.
231	231		6. No person shall operate a Class D motor vehicle unless the
232	232		person is sixteen (16) years of age or older and holds a valid Class
233	233		D license, except as provided for in Section 6 -102 or 6-105 of this
234	234		title. Any person holding a valid Class D license shall be
235	235		permitted to operate motor vehicles in Class D only.

287	287		C. Any person issued a driver license pursuant to this section
288	288		may exercise the priv ilege thereby granted upon all streets and
289	289		highways in this state.
290	290		D. No person shall operate a motorcycle or motor -driven cycle
291	291		without having a valid Class A, B, C or D license with a motorcycle
292	292		endorsement. Except as otherwise provided by law, any new applicant
293	293		for an original driver license shall be required to successfully
294	294		complete a written examination, vision examinatio n and driving
295	295		examination for a motorcycle as prescribed by the Department of
296	296		Public Safety, in conjunction with Service Oklahoma, and a certified
297	297		state-approved motorcycle basic rid er course approved by the
298	298		Department, in conjunction with Service Oklahoma , if the applicant
299	299		is seventeen (17) years of age or younger to be eligible for a
300	300		motorcycle endorsement thereon. The written exam ination and driving
301	301		examination for a motorcycle sh all be waived by Service Oklahoma
302	302		upon verification that the person has su ccessfully completed a
303	303		certified Motorcycle Safety Foundation rider course approved by the
304	304		Department, in conjunction with Service Oklahoma.
305	305		E. Except as otherwise provided by law, any person who lawfully
306	306		possesses a valid Oklahoma driver license which is eligible for
307	307		renewal shall be required to successfully complete a written
308	308		examination, vision e xamination and driving examination for a
309	309		motorcycle as prescribed by the Department, i n conjunction with
310	310		Service Oklahoma, and a certified state -approved motorcycle basic

362	362		rider course approved by the Department, in conjunction with Service
363	363		Oklahoma, if the person is seventeen (17) years of age or younger to
364	364		be eligible for a motorcycle endo rsement. The written examination
365	365		and driving examination for a motorcycle shall be waived by Service
366	366		Oklahoma upon verification that the person has successfully
367	367		completed a certified Motorcycle Safety Fou ndation rider course
368	368		approved by the Department, in conjunction with Service Oklahoma.
369	369		F. 1. Any person eighteen (18) years of age or older may apply
370	370		for a restricted Class A, B or C commercial learner permit. Service
371	371		Oklahoma or an Oklahoma Department of Career and Technology
372	372		Education location contracted wit h Service Oklahoma, after the
373	373		applicant has passed all parts of the examination for a Class D
374	374		license and has successfully passed all parts of the examination for
375	375		a Class A, B or C commercial license other than the driving
376	376		examination, may issue to the applicant a com mercial learner permit
377	377		which shall entitle the person having immediate lawful posses sion of
378	378		the commercial learner permit and a valid Oklahoma driver l icense or
379	379		provisional driver license pursuant to Section 6-212 of this title
380	380		to operate a Class A, B or C commercial motor vehicle upon th e
381	381		public highways solely for the purpose of behind -the-wheel training
382	382		in accordance with rules promulgated by the Depa rtment.
383	383		2. This commercial learner permit shall be issued for a period
384	384		as provided in Section 6 -115 of this title of one hundred eighty
385	385		(180) days, which may be renewed one time for an add itional one

437	437		hundred eighty (180) days; provided, such commercial le arner permit
438	438		may be suspended, revoked, canceled, denied or disqualified at the
439	439		discretion of the Departm ent, with notice to Service Oklah oma, for
440	440		violation of the restrictions, for failing to give the required or
441	441		correct information on the application or for violation of any
442	442		traffic laws of this state pertaining to the operation of a motor
443	443		vehicle. Except as otherwise provided, the lawful possessor of a
444	444		commercial learner permit who has be en issued a commercial learner
445	445		permit for a minimum of fourteen (14 ) days may have the restriction
446	446		requiring an accompanying driver removed by satisfactorily
447	447		completing a driver's examination; provided, th e removal of a
448	448		restriction shall not authorize the operation of a Class A, B or C
449	449		commercial motor vehicle if such ope ration is otherwise prohibited
450	450		by law.
451	451		3. No person shall apply for and Service Oklahoma shall not
452	452		issue an original Class A, B or C driv er license until the person
453	453		has been issued a comme rcial learner permit and held the permit for
454	454		at least fourteen (14) days. Any person who currently holds a Class
455	455		B or C license and who wishes to apply for another class o f
456	456		commercial driver license shall be required to apply for a
457	457		commercial learner perm it and to hold the permit for at least
458	458		fourteen (14) days before ap plying for the Class A or B license, as
459	459		applicable. Any person who currently holds a Class A, B or C
460	460		license and who wishes to add an end orsement or remove a restriction

513	513		apply for a commercia l learner permit and to hold the permit for at
514	514		least fourteen (14) days before applying for the endorseme nt.
515	515		4. A commercial learner perm it shall be issued by Service
516	516		Oklahoma or an Oklahoma Department of Career and Technology
517	517		Education location contracte d with Service Oklahoma as a separate
518	518		and unique document which shall be valid only in conjunction with a
519	519		valid Oklahoma driver license or provisional driver license pursuant
520	520		to Section 6-212 of this title, both of which shall be in the
521	521		possession of the person to whom they have been issued whenever that
522	522		person is operating a commercial motor vehicle as provided i n this
523	523		subsection.
524	524		5. After one renewal of a commercial learner permit, as
525	525		provided in paragraph 2 of this subsection, a commercia l permit
526	526		shall not be renewed again. Any person wh o has held a commercial
527	527		learner permit for the initial issuance period and one renewal
528	528		period shall not be eligible for and Service Oklahoma shall not
529	529		issue another renewal of the permit; provided, the per son may
530	530		reapply for a new commercial learner permit , as provided for in this
531	531		subsection.
532	532		6. Service Oklahoma shall promulgate rules to allow Oklahoma
533	533		Department of Career and Technology Education locations contracted
534	534		with Service Oklahoma to provide commercial driver training the

587	587		facilities.
588	588		G. 1. For purposes of this title:
589	589		a. "REAL ID Compliant Driver License" or "Identification
590	590		Card" means a driver license or identification card
591	591		issued by this state that has been certified by the
592	592		United States Department of Ho meland Security (USDHS)
593	593		as compliant with the requirements of the REAL ID Act
594	594		of 2005, Public Law No. 109-13. A REAL ID Compliant
595	595		Driver License or Identification Card and the process
596	596		through which it is issued incorporate a variety of
597	597		security measures designed to protect the integrity
598	598		and trustworthiness of the license or card. A REAL ID
599	599		Compliant Driver License or Identification Card wi ll
600	600		be clearly marked on the face indicating th at it is a
601	601		compliant document, and
602	602		b. "REAL ID Noncompliant Driver Licen se" or
603	603		"Identification Card" means a driver license or
604	604		identification card issued by this state that has not
605	605		been certified by the United States Department of
606	606		Homeland Security (USDHS) as being compli ant with the
607	607		requirements of the REAL ID Act of 2005. A REAL ID
608	608		Noncompliant Driver License or Identification Card
609	609		will be clearly marked o n the face indicating that it

662	662		and is not acceptable for official federal purposes.
663	663		The driver license or identification ca rd will have a
664	664		unique design or color indicator that clearly
665	665		distinguishes it from a compliant license or card.
666	666		2. Original Driver License and Identification Card Issuance:
667	667		a. Application for an original REAL ID Compliant or REAL
668	668		ID Noncompliant Driver Li cense or Identification Card
669	669		shall be made to Service Oklahoma.
670	670		b. Service Oklahoma employees shall perform all do cument
671	671		recognition and other requirements needed for approval
672	672		of an original REAL ID Compliant or REAL ID
673	673		Noncompliant Driver License or Ident ification Card
674	674		application.
675	675		c. Upon approval of an original REAL ID Compliant o r REAL
676	676		ID Noncompliant Driver Licen se or Identification Card
677	677		application, the applicant may take the appro ved
678	678		application document to a licensed operator to receive
679	679		a temporary driver license or identification card.
680	680		d. The licensed operator shall process t he approved REAL
681	681		ID Compliant or REAL ID Noncompliant Driver License or
682	682		Identification Card application an d upon payment shall
683	683		provide the applicant a temporary driver license o r

737	737		privileges otherwise granted by the specific class of
738	738		driver license or identificat ion card for the period
739	739		of time listed on the temporary driver license or
740	740		identification card or the period of time prior to the
741	741		applicant receiving a REAL ID Compliant or REAL ID
742	742		Noncompliant Driver License or Identification Card,
743	743		whichever time period is shorter.
744	744		3. REAL ID Compliant Driver License and Identification Card
745	745		Renewal and Replacement:
746	746		a. Application for renewal or replacement of a REAL ID
747	747		Compliant Driver License or Identi fication Card may be
748	748		made to Service Oklahoma or to a licensed operator ;
749	749		provided, such licensed operator is authorized to
750	750		process application for REAL ID Compliant Driver
751	751		Licenses and Identification Cards. A licensed
752	752		operator may process the voluntary do wngrade of a REAL
753	753		ID Compliant Commercial Driver License to any lower
754	754		class license upon request of the licensee; provided,
755	755		no additional endorsements or restrictions are placed
756	756		on the license.
757	757		b. Service Oklahoma employe es or authorized licensed
758	758		operators shall perform all document recognition and
759	759		other requirements needed f or approval of a renewal or

813	813		c. Upon approval of a renewal or replace ment REAL ID
814	814		Compliant Driver Licens e or Identification Card
815	815		application, the applicant may receive a tempo rary
816	816		driver license or identification card from Service
817	817		Oklahoma or an authorized licensed operator.
818	818		d. A temporary driver license or identification card
819	819		acquired under the provisions o f this paragraph shall
820	820		afford the holder the privileges otherwise grant ed by
821	821		the specific class of driver license or identification
822	822		card being renewed or replaced for the period of time
823	823		listed on the temporary driver li cense or
824	824		identification card or the p eriod of time prior to the
825	825		applicant receiving a REAL ID Compliant Driv er License
826	826		or Identification Card, whichever time period is
827	827		shorter.
828	828		e. For purposes of this title, an application for a REAL
829	829		ID Compliant Driver L icense or Identification Card by
830	830		an individual with a valid Oklahoma-issued driver
831	831		license or identification card shall be considered a
832	832		renewal of a REAL ID Compliant Driver Licens e or
833	833		Identification Card.

886	886		Renewal and Replacement:
887	887		a. Application for renewal or replacement of a REAL ID
888	888		Noncompliant Driver License or Identification Card may
889	889		be made to Service Oklahoma or to a licensed operator.
890	890		A licensed operator may process the voluntary
891	891		downgrade of a REAL ID Noncompliant Commerc ial Driver

1191	1191		the Trauma Care Assi stance Revolving Fund created in Se ction 1-
1192	1192		2530.9 of Title 63 of the Oklahoma Statutes;
1193	1193		2. Six Dollars and seventy-five cents ($6.75) of a 4 -year
1194	1194		license or Thirteen Dollars and fifty cents ($ 13.50) of an 8-year
1195	1195		license shall be deposited to the Departmen t of Public Safety
1196	1196		Computer Imaging System Revolving Fund to be used solely for the
1197	1197		purpose of administrat ion and maintenance of the computerized
1198	1198		imaging system of the Department through Octobe r 31, 2022.
1199	1199		Beginning November 1, 2022, Six Dollars and sevent y-five cents
1200	1200		($6.75) of a 4-year license or Thirteen Dollars and fifty cents
1201	1201		($13.50) of an 8-year license shall be deposited to the Service
1202	1202		Oklahoma Computer Imaging System Revolving Fund to b e used solely

1267	1267		N. All original and renewal driver licenses shall expire as
1268	1268		provided in Section 6 -115 of this title.
1269	1269		O. 1. Through May 31, 2025, any person sixty-two (62) to
1270	1270		sixty-four (64) years of age during the calendar year of issuance or
1271	1271		renewal of a Class D license or motorcycle endorsement shall be
1272	1272		charged the following pr orated fee:

1335	1335		Forces of the United States to be a disabled veteran in receipt of
1336	1336		compensation at the one-hundred-percent rate for a permanent
1337	1337		disability sustained through m ilitary action or accident resulting
1338	1338		from disease contracted while in such active servi ce and registered
1339	1339		with the veterans re gistry created by the Oklahoma Department of
1340	1340		Veterans Affairs shall be charged a fee for the issuance,
1341	1341		replacement or renewal of an Oklahoma driver license; provided, that
1342	1342		if a veteran has been previously exempt from a fee pursuant to this
1343	1343		subsection, no registration with the veterans registry shall be
1344	1344		required.
1345	1345		Q. In accordance wi th the provisions of subsection G of this
1346	1346		section, Service Oklahoma is authorized to promulgate rules for the
1347	1347		issuance and renewal of driver licenses authorized pursuant to the
1348	1348		provisions of Sections 6-101 through 6-309 of this title; provided,
1349	1349		that no such rules applicable to the issuance or renewal of REAL ID
1350	1350		Noncompliant Driver Licenses shall create more stringent standards
1351	1351		than such rules applicable as of January 1, 2017, unl ess directly
1352	1352		related to a specific change in statutory law concerning standards
1353	1353		for REAL ID Noncompliant Driver Licenses. Applicati ons, upon forms
1354	1354		approved by Service Oklahoma, for such licenses shall be handled, in
1355	1355		accordance with the provisions of subse ction G of this section, by
1356	1356		the licensed operator; provided, Service Oklahoma i s authorized to

1415	1415		each license or renewal applicat ion accepted through June 30, 2023 .
1416	1416		Beginning July 1, 2022, and ending on June 30, 2023, each motor
1417	1417		license agent or licensed operator acce pting applications for driver
1418	1418		licenses for individuals over the age of sixty-five (65) years or
1419	1419		for applications for drivers pursuant to subsection P of this
1420	1420		section shall receive Six Dollars ($6.00) for a 4-year driver
1421	1421		license or Twelve Dollars ($12.00) f or an 8-year driver license to
1422	1422		be deducted daily by the motor license agent or licensed operator
1423	1423		receipts. Beginning July 1, 2023, these fees shall be retained by
1424	1424		the licensed operator pursuant to subsection E of Section 1141.1 of
1425	1425		this title. The fees received by the licensed operator, auth orized
1426	1426		by this subsection, shall be used for operating expenses. The
1427	1427		amount retained pursuant to this subsection shall not be retai ned by
1428	1428		any state agency. The fees received by the licensed operator,
1429	1429		authorized by this subsection, shall be used for opera ting expenses.
1430	1430		For purposes of this subsection, "licensed operator" shall mean an

1491	1491		Treasurer to be deposited in the General Revenue Fund of the State
1492	1492		Treasury.
1493	1493		The next Five Hundred Thousand Dollars ($500,000.00) of monies
1494	1494		collected pursuant to this section shall be paid by the Tax
1495	1495		Commission to the State Treasure r to be deposited each fiscal year
1496	1496		under the provisions of this section to the credit of the Department
1497	1497		of Public Safety Restricted Revolvin g Fund for the purpose of the
1498	1498		Oklahoma Law Enforcement Telecommunications System. All other
1499	1499		monies collected in exc ess of Five Hundred Sixty Th ousand Dollars
1500	1500		($560,000.00) each fiscal year shall be app ortioned as provided in
1501	1501		Section 1104 of this title, except as otherwise provided in this
1502	1502		section.
1503	1503		S. Service Oklahoma shall retain the images displayed on
1504	1504		licenses and identification cards issued p ursuant to the provisions
1505	1505		of Sections 6-101 through 6-309 of this title which may be used

1568	1568		computerized images may obtain them through OLETS or through NLETS.
1569	1569		Photographs or computerized images may be obtained by law
1570	1570		enforcement one inquiry at a time.
1571	1571		The computer system and related equipment acquired for this
1572	1572		purpose must conform to industry standar ds for interoperability and
1573	1573		open architecture. The Department of Pu blic Safety may promulgate
1574	1574		rules to implement the provisions o f this subsection.
1575	1575		T. No person may hold more than one state-issued or territory-
1576	1576		issued REAL ID Compliant Driver License or R EAL ID Compliant
1577	1577		Identification Card from O klahoma or any other stat e or territory.
1578	1578		Service Oklahoma shall not issue a REAL ID Co mpliant Driver License
1579	1579		to a person who has been previously issued a REAL ID Com pliant
1580	1580		Driver License or REAL ID Compliant Iden tification Card until such
1581	1581		license or identification card has been s urrendered to Service
