77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 70 O.S. 2021, Section 2603, is
79	79	amended to read as follows:
80	80	Section 2603. A. Except as otherwise provided for in
81	81	subsection B of this section and elsewhere in this section, to be
82	82	eligible to participate in the Oklahoma Higher Learning Access
83	83	Program and to qualify for an award which includes payment of an
84	84	amount equivalent to resident tuition or other tuition pursuant to
85	85	Section 2604 of this title for the first semester or other academic
86	86	unit of postsecondary enrollment, a student shall:
87	87	1. Be a resident of this state or be enrolled in a school
88	88	district located in this state that serves students who reside in

141	141	authorized in Section 5 -117.1 of this title;
142	142	2. Be a United States citizen or lawfully present in the United
143	143	States. A student who is not a United States citizen or lawfully
144	144	present in the United States shall not be eligible to participate in
145	145	the Oklahoma Higher Learning Access Program and to qualify for an
146	146	award notwithstanding t he provisions of Section 3242 of this title.
147	147	The provisions of this paragraph shall not apply to any student who
148	148	was enrolled in the Oklahoma Higher Learning Access Program prior to
149	149	the end of the 2006-2007 school year;
150	150	3. Have a record of satisfactory c ompliance with agreements
151	151	executed pursuant to Section 2605 of this title;
152	152	4. a. have graduated within the previous three (3) years
153	153	from a high school accredited by the State Board of
154	154	Education, or the Oklahoma School of Science and
155	155	Mathematics with a mini mum 2.5 cumulative grade point
156	156	average on a 4.0 scale for all work attempted in
157	157	grades nine through twelve,
158	158	b. have graduated within the previous three (3) years
159	159	from a high school not accredited by the State Board
160	160	of Education with a minimum 2.5 cumulativ e grade point
161	161	average on a 4.0 scale for all work attempted in
162	162	grades nine through twelve and have achieved a
163	163	composite score of 22 or higher on the ACT test, or

216	216	three (3) years an educational program th at was
217	217	provided through a means other than a public or
218	218	private school and have achieved a composite score of
219	219	22 or higher on the ACT test;
220	220	5. Have completed the curricular requirements for admission to
221	221	an institution within The Oklahoma State System of Hi gher Education
222	222	and one additional unit or set of competencies in a course that
223	223	meets college admission requirements ; or have completed the core
224	224	curriculum and is seeking admission to a technology center school
225	225	overseen by the State Board of Career and Tech nology Education. The
226	226	curriculum requirements for admission to an institution within the
227	227	Oklahoma State System of Higher Education shall include two units or
228	228	sets of competencies in foreign or non -English language or
229	229	technology courses that meet the colle ge admission requirements and
230	230	one unit or set of competencies of a fine arts course. Students
231	231	shall also have attained a 2.5 grade point average in the core
232	232	curriculum courses. Students who attended a high school which did
233	233	not offer all the core curricul um courses or students who were
234	234	educated by other means and were not offered all the core curriculum
235	235	courses shall be allowed to satisfy this curriculum requirement by
236	236	participating in a program approved by the Oklahoma State Regents
237	237	for Higher Education for remediation of high school curricular
238	238	deficiencies;

292	292	students for the appropriate type of institution, or, if attending a
293	293	private institution, have satisfied admission standards as
294	294	determined by the private institution. No student participating in
295	295	the Oklahoma Higher Learning Access Program shall be admitted into
296	296	an institution of higher education by special admission standards;
297	297	7. Have secured admission to, and enrolled in, an institu tion
298	298	which is a member of The Oklahoma State System of Higher Education,
299	299	a postsecondary vocat ional-technical program offered by a technology
300	300	center school that meets the requirements to be eligibl e for federal
301	301	student financial aid, or a private instituti on of higher learning
302	302	located within this state and accredited pursuant to Section 4103 of
303	303	this title; and
304	304	8. a. have established financial need according to the
305	305	provisions of subsection D of Secti on 2605 of this
306	306	title and standards and provisions promulga ted by the
307	307	Oklahoma State Regents for Higher Education,
308	308	b. if the student was adopted between birth and twelve
309	309	(12) years of age while in the permanent custody of
310	310	the Department of Human Services, in the court-ordered
311	311	custody of a licensed private nonprofi t child-placing
312	312	agency, or federally recognized Indian tribe, as
313	313	defined by the federal Indian Child Welfare Act, have

378	378	promulgated by the Oklahoma State Regents for Higher
379	379	Education.
380	380	B. 1. A student shall be eligible to participate in the
381	381	Oklahoma Higher Learning Access Progr am and to qualify for an award
382	382	which includes payment of an amount equivalent to resident tuition
383	383	or other tuition pursuant to Section 2604 of this title for the
384	384	first semester or other academic unit of postsecondary enrollment if
385	385	the student meets all of the following criteria:
386	386	a. is a child of any person killed after January 1, 2000,
387	387	in the line of duty in any branch of the United States
388	388	Armed Forces or who died after January 1, 2000, as a

441	441	duty in any branch of the United States Armed Forces
442	442	and the person who wa s killed or died filed an
443	443	individual or joint Oklahoma income tax return for the
444	444	tax year prior to the year during which the person was
445	445	killed or died,
446	446	b. is a resident of this state or is enrolled in a school
447	447	district located in this state that serves stu dents
448	448	who reside in both this state and an adjacent state
449	449	pursuant to a contract as authorized in Section 5 -
450	450	117.1 of this title,
451	451	c. enrolls in an institution within The Oklahoma State
452	452	System of Higher Education prior to reaching the age
453	453	of twenty-one (21),
454	454	d. has satisfied admission standards as determined by the
455	455	Oklahoma State Regents for Higher Education for first -
456	456	time-entering students for the appropriate type of
457	457	institution, or, if attending a p rivate institution,
458	458	has satisfied admission standards as de termined by the
459	459	private institution. No student participating in the
460	460	Oklahoma Higher Learning Access Program shall be
461	461	admitted into an institution of higher education by
462	462	special admission standard s,

515	515	institution which is a member of The Oklahoma State
516	516	System of Higher Education, a postsecondary
517	517	vocational-technical program offered by a technology
518	518	center school that meets the requirements to be
519	519	eligible for federal student financial aid, or a
520	520	private institution of higher learning located within
521	521	this state and accredited pursuant to Section 4103 of
522	522	this title, and
523	523	f. executes an agreement pursuant to subsection C of
524	524	Section 2605 of this title.
525	525	2. A student who is eligible to participate in the program
526	526	pursuant to this subsection shall not be required to meet the
527	527	eligibility requirements set forth in subsection A of this section.
528	528	C. To retain eligibility while pursuing the program of higher
529	529	learning in which enrolled, the student shall:
530	530	1. Meet the requirement s for retention and degree completion as
531	531	established by the institution in which the student is enrolled;
532	532	2. Maintain good academic standing and satisfactory academic
533	533	progress according to standar ds of the Oklahoma State Regents for
534	534	Higher Education;
535	535	3. Maintain satisfactory academic progress as required for
536	536	eligibility for federal Title IV student financial aid programs.

590	590	4. Comply with the standards related to mainte nance of
591	591	eligibility as promulgated by the Oklahoma State Regents for Higher

593	593	5. Refrain from conduct that leads to expulsion or suspension
594	594	of more than one semester from an institut ion of higher education.
595	595	A student who violates the provis ions of this paragraph shall
596	596	permanently lose eligibility for program benefits. The provisions
597	597	of this paragraph shall become effective January 1, 2008.
598	598	D. The Oklahoma State Regents for Higher E ducation and the
599	599	State Board of Career and Technology Educa tion shall promulgate
600	600	rules relating to maintenance of eligibility under the Oklahoma
601	601	Higher Learning Access Act by a student.
602	602	E. It is the intent of the Legislature that students in the
603	603	ninth grade for the 1992-93 school year who are determined to be
604	604	eligible Oklahoma Higher Learning Access students pursuant to the
605	605	Oklahoma Higher Learning Access Act shall be the first students
606	606	eligible for benefits from the Oklahoma Higher Learning Access Trust
607	607	Fund.
608	608	F. The Oklahoma State Regents for Higher Education ar e
609	609	authorized to study, develop and propose criteria for determining
610	610	award eligibility based upon the completion of seven semesters of
611	611	high school coursework by a student.
