36107 SECTION 1. AMENDATORY 36 O.S. 2021, Section 123, as
37108 amended by Section 1 of Enrolled House Bill No. 1505 of the 2nd
38109 Session of the 59th Oklahoma Legislature, is amended to read as
39110 follows:

41111 Section 123. A. In this section, the following words shall
42112 have the following meanings:

44113 1. “Delivered by electronic means” includes:

47115 party has consented to receive notices or documents,

50117 b. posting on an electronic network or site accessible
51118 via the Internet, mobile application, computer, mobile
52119 device, tablet or any other electronic device,

54121 shall be provided by electronic mail to the address at
55122 which the party has consented to receive notice, or by
56123 any other delivery method that has been consented to
57124 by the party.;

59125 2. “Health benefit plan” means a health benefit plan as defined

62153 3. “Party” means any recipient of any notice or document
63154 required as part of an insurance transaction, including but not
64155 limited to an applicant, an insured, a policyholder , a covered
65156 person, or an annuity contract holder .; and

67157 4. “Plan sponsor” means a person, other than a regulated
68158 entity, who establishes, adopts, or maintains a health benefit plan
69159 that covers residents of this stat e, including a plan established,
70160 adopted, or maintained by an employer or jointly by an employer and
71161 one or more employee organizations, an association, a committee, a
72162 joint board of trustees, or any similar group of representatives who
73163 establish, adopt, or maintain a plan.

75164 B. Subject to the requirements of this section, any notice to a
76165 party or any other document required under applicable law in an
77166 insurance transaction, or that is to serve as evidence of insurance
78167 coverage, may be delivered, stored and p resented by electronic
79168 means, so long as it meets the requirements of the Uniform
80169 Electronic Transactions Act pursuant to Section 15 -101, et seq. of
81170 Title 12A of the Oklahoma Statutes.

83171 C. Delivery of a notice or document in accordance with this
84172 section shall be considered equivalent to any delivery method
85173 required under applicable law, including delivery by first class
86174 mail; first class mail, postage prepaid; certified mail; certificate
87175 of mail; or certificate of mailing.

89202 D. A notice or document may be de livered by electronic means by

100210 any time, and any conditions or consequences imposed

151300 E. 1. The plan sponsor of a health benefit plan may, on behalf
152301 of covered persons enrolled in the plan, provide consent to the
153302 mailing of all communications related to the plan by electronic
154303 means otherwise required by paragraphs 1 and 2 of subsection D of
155304 this section.

157305 2. Before consenting on behalf of a covered person, a plan
158306 sponsor must:

160307 a. confirm that the covered person routinely uses
161308 electronic communications during the normal course of
162309 employment and is able to access and retain electronic
163310 communications that may be delivered by the insurer,
164311 and

166312 b. inform the party in any manner the plan sponsor deem s
167313 appropriate that such consent will be provided, and
168314 that notices and documents related to the plan may be
169315 delivered to the party’s work electronic mail address
170316 unless the party affirmatively opts out of delivery by
171317 electronic means or provides an alterna tive electronic
172318 mail address.

174319 3. Before providing delivery of a notice or document by
175320 electronic means pursuant to this subsection, the insurer for the
176321 health benefit plan must:

209398 party pursuant to this subsection, an insurer shall apprise the
210399 party of the significance of the notice or document when it is not
211400 otherwise reasonably evident and of the right to request and obtain
212401 a paper version of such notice or document.

214402 F. This section does not affect requirements related to content
215403 or timing of any notice or document required under applicable law.

217404 F. G. If a provision of this title or applicable law requiring
218405 a notice or document to be provided to a party expressly requires
219406 verification or acknowledgment of receipt of the notice or document,
220407 the notice or document may be delivered by electronic means only if
221408 the method used provides for verification or acknowledgment of

224410 G. H. The legal effectiveness, validity or enforceability of
225411 any contract or policy of insurance executed by a party may not be

230415 H. I. 1. A withdrawal of consent by a party does not affect
231416 the legal effectiveness, validity or enforceability of a notic e or

235445 2. A withdrawal of consent by a party is effective within a
236446 reasonable period of time after receipt of the withdrawal by the
237447 insurer.

239448 3. Failure by an insurer to comply with paragraph 5 of
240449 subsection D and subsection J of this section may be treated, at the
241450 election of the party, as a withdrawal of consent for purposes of
242451 this section.

244452 I. J. This section does not apply to a notice or document
245453 delivered by an insurer in an electronic form before the effective
246454 date of this act November 1, 2017, to a party who, before that date,
247455 has consented to receive notice or document in an electronic form
248456 otherwise allowed by law.

250457 J. K. If the consent of a party to r eceive certain notices or
251458 documents in an electronic form is on file with an insurer before
252459 the effective date of this act November 1, 2017, and pursuant to
253460 this section, an insurer intends to deliver additional notices or
254461 documents to such party in an ele ctronic form, then prior to
255462 delivering such additional notices or documents electronically, the
256463 insurer shall:

258464 1. Provide the party with a statement that describes:

260465 a. the notices or documents that shall be delivered by
261466 electronic means under this section that were not

271499 K. L. An insurer shall deliver a notice or document by any
272500 other delivery method permitted by law other than electronic means

275502 1. The insurer attempts to deliver the notice or document by
276503 electronic means and has a reasonable basis for believing that the
277504 notice or document has not been received by the party; or
278-
279505 2. The insurer becomes aware that the electronic mail address
280506 provided by the party is no longer valid.

282507 L. M. Notwithstanding subsection A of this section or any other
283508 law or regulation of this state requiring an insurer to provide,
284509 send, or deliver an insurance policy or endorsement to an insured,
285510 an insurer may elect to post a policy or endorsement that does not
286511 contain personally identifiable information on its website provided
287512 it complies with all of the following:

289513 1. The policy or endorsement is easily accessible on the
290514 website so long as it is in force;
291-
292515 2. The policy or endorsement is posted in a manner that enab les
293516 the insured to print and save it using programs or applications
294517 widely available on the Internet and free of charge to use;

301549 paper or electronic copy of the policy or endorsement, or an y
302550 changes to them, and the Internet address where the policy and
303551 endorsement are posted;

305552 4. The insurer provides all of the following information on
306553 each declarations page, or similar document as appropriate to the
307554 line of coverage, provided to the insure d at the time of issuance or
308555 renewal:

310556 a. a description of the exact policy and endorsement
311557 forms purchased by the insured,

321564 archives the expired policies or endorsements in accordance with the

718+Retirement Income Security Act of 1974.

868+mailing of all communications relat ed to the plan by electronic
869+means otherwise required by paragraphs 1 and 2 of subsection D of
870+this section.
871+2. Before consenting on behalf of a covered person, a plan
872+sponsor must:
873+a. confirm that the cover ed person routinely uses
874+electronic communicatio ns during the normal course of
875+employment and is able to access and retain electronic
876+communications that may be delivered by the insurer ,

904+b. inform the party in any manner the plan sponsor deems
905+appropriate that such consent will be provided, and
906+that notices and documents related to the plan ma y be
907+delivered to the party's work electronic mail address
908+unless the party affirmatively opts out of delivery by
909+electronic means or provides an alternati ve electronic
910+mail address.
911+3. Before providing deliver y of a notice or document by
912+electronic means pursuant to this subsection, the insurer for the
913+health benefit plan mus t:
914+a. provide the party with a clear and conspicuous
915+statement informing the perso n of all of the
916+following:
917+(1) the types of notices and documents that may
918+be delivered to the covere d person by
919+electronic means,
920+(2) the right of the party to withdraw consent
921+to have a notice or document delivered by
922+electronic means at any time without charge,
923+(3) the procedures the party must follow to
924+withdraw consent to have a notice or
925+document delivered by electronic means and
926+to update the person's electronic mail
927+address, and

954+(4) the right of the party to have any notice or
955+document delivered, up on request, in paper
956+form free of charge,
957+b. provide the party opportunity to opt out of delivery
958+by electronic means, and
959+c. document that the applicable provisions of the
960+conditions under the Uniform Electronic Transactions
961+Act, found at Section 15-101 et seq. of Title 12A of
962+the Oklahoma Statutes are satisfied.
963+4. When a notice or document is provided electronically to a
964+party pursuant to this subsection, an insurer shall apprise the
965+party of the significance of the notice or document when it is n ot
966+otherwise reasonably evident and of the right to request an d obtain
967+a paper version of such notice or document.
968+F. This section does not affect requirements related to content
969+or timing of any notice or document required under applicable law.
970+F. G. If a provision of this title or applicable law requiring
971+a notice or document to be provided to a party expressly requires
972+verification or acknowledgment of receipt of the notice or document,
973+the notice or document may be delivered by electronic means only if
974+the method used provides for verification or acknowledgment of
975+receipt.
976+G. H. The legal effectiveness, validity or enforceability of
977+any contract or policy of insurance executed by a party may not be
978+

1004+denied solely because of the failure to obtain electronic con sent or
1005+confirmation of consent of the party in accord ance with subparagraph
1006+b of paragraph 3 of subsection D of this section.
1007+H. I. 1. A withdrawal of consent by a party does not af fect
1008+the legal effectiveness, validity or enforceability of a notice or
1009+document delivered by electronic means to the party be fore the
1010+withdrawal of consent is effective.
1011+2. A withdrawal of consent by a party is effective within a
1012+reasonable period of tim e after receipt of the withdrawal by the
1013+insurer.
1014+3. Failure by an insu rer to comply with paragraph 5 of
1015+subsection D and sub section J of this section may be treated, at the
1016+election of the party, as a withdrawal of consent for purposes of
1017+this section.
1018+I. J. This section does not apply to a notice or document
1019+delivered by an insurer in an electronic form before the effective
1020+date of this act to a party who, before that date, has consented to
1021+receive notice or document in an electronic form otherwise allo wed
1022+by law.
1023+J. K. If the consent of a party to receive certain notices or
1024+documents in an electronic form is on file with an insurer before
1025+the effective date of this act, and pursuant to this section, an
1026+insurer intends to deliver additional notices or d ocuments to such

1054+additional notices or documents electronically, th e insurer shall:
1055+1. Provide the party with a statement that describes:
1056+a. the notices or documents that shall be delivered by
1057+electronic means under this section that were not
1058+previously delivered elec tronically, and
1059+b. the party's right to withdraw conse nt to have notices
1060+or documents delivered by electronic means, without
1061+the imposition of any condition or consequence that
1062+was not disclosed at the time of initial consent ; and
1063+2. Comply with paragraph 2 of subsection D of this section.
1064+K. L. An insurer shall deliver a notice or document by any
1065+other delivery method permitted by law other than electronic means
1066+if:
1067+1. The insurer attempts to deliver the notice or document by
1068+electronic means and has a reasonable basis for believing that the
1069+notice or document has not been received by the party; or
1070+2. The insurer becomes aware that the ele ctronic mail address
1071+provided by the party i s no longer valid.
1072+L. M. A producer shall not be subject to civil liabi lity for
1073+any harm or injury that occurs as a result of a party's election to
1074+receive any notice or document by electronic means or by an
1075+insurer's failure to deliver a notice or docume nt by electronic
1076+means.
