7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 43A O.S. 2021, Section 3-601, as
7979 amended by Section 2, Chapter 250, O.S.L. 2023 (43 A O.S. Supp. 2023,
8080 Section 3-601), is amended to read as follows:
8181 Section 3-601. A. Any Class II controlled dangerous substance,
8282 when used in this state by an opioid sub stitution treatment program
8383 for persons with a history of op ioid addiction to or physiologic
8484 dependence on controlled dangerous substances, shall only be u sed:
8585 1. In treating persons with a history of addiction;
8686 2. In treating persons with a one-year history of opioid

139139 substances, as defined by the Code of Federal Regulations, and
140140 documentation of attempting another type of treatment; or
141141 3. If clinically appropriate, the program physician may waive
142142 the requirement of a one-year history of opioid addiction for
143143 consumers within six (6) months of release from a penal institution,
144144 for consumers with a pregnancy verified by the program physician, or
145145 for consumers having previously received treatment for opioid
146146 addiction and within two (2) years of discharge from that treatment
147147 episode.
148148 B. Any conviction for a violation of the provis ions of this
149149 section or any rules promulgated pursuant to the provisions of this
150150 section shall be a felony.
151151 C. For the purposes of this section, "opioid substitution
152152 treatment program" means a person, private physician , or
153153 organization that administers or dispenses an opioid drug to a
154154 narcotic addict for the purposes of detoxification or maintenance
155155 treatment or provides, when necessary and appropriate, comprehensive
156156 medical and rehabilitation services. A private physician who
157157 administers buprenorphine wi th a waiver from the Drug Enforcement
158158 Administration shall not be considered an opioid substitution
159159 treatment program.
160160 D. An opioid substitution treatment program shall be certified
161161 by the Board of Mental Health and Subst ance Abuse Services, or the
162162 Commissioner of Mental Health and Substance Abuse Services upon

214214 delegation by the Board, and registered with the federal Drug
215215 Enforcement Administration for the use of an opioid d rug to treat
216216 narcotic addiction.
217217 E. The Board of Mental Health and Substance Abuse Se rvices
218218 shall promulgate rules and standards for the certification of all
219219 programs, private facilities, and organi zations which provide opioid
220220 substitution treatment dire cted to those physiologically dependent
221221 on or addicted to opioids. These facilities and organizations shall
222222 be known as "Opioid Substitution Treatment Programs". Only
223223 certified facilities may receiv e and assist opioid-dependent and
224224 addicted persons by pr oviding Class II controlled substances in
225225 opioid substitution treatment and rehabilitat ion.
226226 F. The Board of Mental Health and Substance Abuse Services
227227 shall promulgate rules and standards regulati ng the treatment and
228228 services provided by opioid substitut ion treatment programs.
229229 Failure to comply with rul es and standards promulgated by the B oard
230230 shall be grounds for revocation, suspension or nonrenewal of
231231 certification.
232232 G. An opioid substitution treatment program shall comply with
233233 all federal requirements for opioid treatment programs provided by
234234 42 C.F.R., Subpart C including but not limited to t he requirement to
235235 provide drug abuse testing services provided by 42 C.F.R., Section
236236 8.12(f)(6). Drug abuse testing shall may be directly observed by an
237237 employee or contractor of the opioid substitution treatment program.

289289 H. Opioid substitution treatment pro grams shall notify the
290290 Department of Mental Health and Substance Abuse Services of plans to
291291 close or relocate within a mi nimum of thirty (30) days prior to
292292 closure or relocation.
293293 I. Failure to comply with rules and standards promulgated by
294294 the Board of Mental Health and Substance Abuse Services pursuant to
295295 this section or failure to comply with the requirements of 42
296296 C.F.R., Subpart C shall be grounds for reprimand, suspension,
297297 revocation or nonrenewal of certification.
298298 SECTION 2. This act shall become effective November 1, 2024.
