13	45		An Act relating to medical marijuana; directing

15	47		medical marijuana commercial growers to sell certain
16	48		medical marijuana products in pre -packaged form;

18	50		the display and smelling of marijuana; directing the
19	51		Oklahoma Medical Marijuana Authority to promulgate
20	52		certain rules; providing fo r codification; and

28	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

30	60		SECTION 1. NEW LAW A new section of law to be codified
31	61		in the Oklahoma Statutes as Section 431.1 of Title 63, unless there
32	62		is created a duplication in numbering, reads as follows:

34	63		A. Upon the effective date of this act, all medical marijuana
35	64		flower, trim, shake, kief, medical marijuana product, or other
36	65		flower-based product not defined as a concentrate, shall be sold by
37	66		licensed medical marijuana processors and licensed med ical marijuana
38	67		commercial growers to licensed medical marijuana dispensaries only

40	96		half (1/2) of one (1) gram to not more than three (3) ounces . The
41	97		Oklahoma Medical Marijuana Authority shall be authorized to
42	98		promulgate rules regarding the pre -packaging of medical marijuana
43	99		products as provided for in the provisions of this section.

45	100		B. Nonopaque materials may be used when packaging medical
46		-	marijuana flower, provided all other packaging and ~~labeling ENR. H. B. NO. 3361 Page 2~~

47	102		requirements for medical marijuana products sold in this state are
48	103		met and it is placed in an opaque container before leaving a
49	104		licensed medical marijuana dispensary.

51	105		C. The display and smelling of me dical marijuana shall be
52	106		allowed pursuant to Section 421 of Title 63 of the Oklahoma
53	107		Statutes.

55	108		D. The Oklahoma Medical Marijuana Authority shall promulgate
56	109		rules necessary to allow for products to be returned to the licensed
57	110		medical marijuana dispensary w hen found defective or hazardous to
58	111		the health of the patient. The Authority shall further promulgate
59	112		rules necessary to allow for the return of all medical marijuana and
60	113		medical marijuana products from a licensed medical marijuana
61	114		dispensary to a license d medical marijuana processor or licensed
62	115		medical marijuana commercial grower, from a licensed medical
63	116		marijuana processor to a licensed medical marijuana commercial
64	117		grower, or from any other licensed entity that transferred medical
65	118		marijuana products to a nother licensed entity.
