6364 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6465 SECTION 1. AMENDATORY 70 O.S. 2021, Section 2603, is
6566 amended to read as follows:
6667 Section 2603. A. Except as otherwise provided for in
6768 subsection B of this section and elsewhere in this section, to b e

96+Program and to qualify for an award which includes payment of an
9797 amount equivalent to resident tuition or other tuition pursuant to
9898 Section 2604 of this title for the first semester or other academic
9999 unit of postsecondary enrollment, a student shall:
100100 1. Be a resident of this state or be enrolled in a school
101101 district located in this state that serves students who reside in
102102 both this state and an adjacent state pursuant to a contract as
103103 authorized in Section 5-117.1 of this title;
104104 2. Be a United States citizen or lawfully present in the United
105105 States. A student who is not a United States citizen or lawfully
106106 present in the United States shall not be eligible to participate in
107107 the Oklahoma Higher Learning Access Program and to qualify for an
108108 award notwithstanding the provisions of Section 3242 of this title.
109109 The provisions of thi s paragraph shall not apply to any student who
110110 was enrolled in the Oklahoma Higher Learning Access Program prior to
111111 the end of the 2006-2007 school year;
112112 3. Have a record of satisfactory compliance with agreements
113113 executed pursuant to Section 2605 of this tit le;
114114 4. a. have graduated within the previous three (3) years
115115 from a high school accredited by the State Board of
116116 Education, or the Oklahoma School of Science and
117117 Mathematics with a minimum 2.5 cumulative grade point
118118 average on a 4.0 scale for all work attempted in

148147 from a high school not accredited by the State Board
149148 of Education with a minimum 2.5 cumulative grade point
150149 average on a 4.0 scale for all work attempted in
151150 grades nine through twelve and have achieved a
152151 composite score of 22 or higher on the ACT test, or
153152 c. have satisfactorily completed within the previous
154153 three (3) years an educational program that was
155154 provided through a means other than a public or
156155 private school and have achieved a composite score of
157156 22 or higher on the ACT test;
158157 5. Have completed the curricular requirements for admission to
159158 an institution within The Oklahoma State System of Higher Education
160159 and one additional unit or set of competencies in a cour se that
161160 meets college admission requirements. The curriculum requirements
162161 shall include two units or sets of competencies in foreign or non -
163162 English language or technology courses that meet the college
164163 admission requirements and one unit or set of comp etencies of a fine
165164 arts course. Students shall also have attained a 2.5 grade point
166165 average in the core curriculum co urses. Students who attended a
167166 high school which did not offer all the core curriculum courses or
168167 students who were educated by other means a nd were not offered all
169168 the core curriculum courses shall be allowed to satisfy this
170169 curriculum requirement by participating in a program approved by the

200198 6. Have satisfied admission standards as determined by the
201199 Oklahoma State Regents for Higher Education for first -time-entering
202200 students for the appropriate type of institution, or, if attending a
203201 private institution, have satisfied admission standards as
204202 determined by the private institution. No student participating in
205203 the Oklahoma Higher Learning Access Program shall be admitted into
206204 an institution of higher education by special admission standard s;
207205 7. Have secured admission to, and enrolled in, an insti tution
208206 which is a member of The Oklahoma State System of Higher Education,
209207 a postsecondary vocational -technical program offered by a technology
210208 center school that meets the requirements to be eligible for federal

218216 b. if the student was adopted between birth and twelve
219217 (12) years of age while in the permanent custody of
220218 the Department of Human Services, in the court -ordered

251248 established financial need according to the provisions
252249 of paragraph 1 of sub section E of Section 2605 of this

254251 Oklahoma State Regents for Higher Education, or
255252 c. if the student was adopted between thirteen (13) and
256253 seventeen (17) years of age while in the permanent
257254 custody of the Department of Human Services, in the
258255 court-ordered custody of a licensed private nonprofit
259256 child-placing agency, or federally recognized Indian
260257 tribe, as defined by the federal Indian Child Welfare
261258 Act, have established financial need according to the
262259 provisions of paragraph 2 of subsection E of Section
263260 2605 of this title and standards and provisions
264261 promulgated by the Oklahoma State Regents for Higher
265262 Education, or
266263 d. if the student is the child of a certified classroom
267264 teacher, as provided for in paragraph 4 of subsection
268265 E of Section 2605 of this title. For t he purposes of
269266 this paragraph, “certified classroom teacher ” means
270267 any certified, full-time teacher who has been employed
271268 by a public school district in this state for a

300296 teacher shall not be required to hav e been employed by
301297 the same public school district for ten (10) years or
302298 been employed for ten (10) consecutive ye ars.
303299 B. 1. A student shall be eligible to participate in the
304300 Oklahoma Higher Learning Access Program and to qualify for an award
305301 which includes payment of an amount equivalent to resident tuition
306302 or other tuition pursuant to Section 2604 of this title for the
307303 first semester or other academic unit of postsecondary enrollment if
308304 the student meets all of the following criteria:
309305 a. is a child of any person killed after January 1, 2000,
310306 in the line of duty in any branch of the United States
311307 Armed Forces or who died after January 1, 2000, as a
312308 result of an injury sustained while in the line of
313309 duty in any branch of the United States Armed Forces
314310 and the person who was killed or died filed an
315311 individual or joint Oklahoma income tax return for the
316312 tax year prior to the year during which the person was
317313 killed or died,
318314 b. is a resident of this sta te or is enrolled in a school
319315 district located in this stat e that serves students
320316 who reside in both this state and an adjacent state
321317 pursuant to a contract as authorized in Section 5-
322318 117.1 of this title,

350345 c. enrolls in an institution within The Oklahoma State
351346 System of Higher Education prior to reaching the age
352347 of twenty-one (21),
353348 d. has satisfied admission standards as determined by the
354349 Oklahoma State Regents for Higher Education for first -
355350 time-entering students for the appropriate type of
356351 institution, or, if attending a private institution,
357352 has satisfied admissio n standards as determined by the
358353 private institution. No student participating in the
359354 Oklahoma Higher Learning Ac cess Program shall be
360355 admitted into an institution of higher education by
361356 special admission standards,
362357 e. has secured admission to, and enroll ed in, an
363358 institution which is a member of The Oklahoma State

400394 2. A student who is eligible to participate in the program
401395 pursuant to this subsection shall not be required to meet the
402396 eligibility requirements set forth in subsection A of this section.
403397 C. To retain eligibility while pursuing the program of hi gher
404398 learning in which enrolled, the student shall:
405399 1. Meet the requirements for retention and degree completion as
406400 established by the institution in which the student is e nrolled;
407401 2. Maintain good academic standing and satisfactory academic
408402 progress according to standards of the Oklahoma State Regents for
409403 Higher Education;
410404 3. Maintain satisfactory academic progress as required for
411405 eligibility for federal Title IV student financial aid programs.
412406 The provisions of this paragraph shall become effective fo r the
413407 2012-2013 school year;
414408 4. Comply with the standards related to maintenance of
415409 eligibility as promulgated by the Oklahoma State Regents for Higher
416410 Education; and
417411 5. Refrain from conduct that leads to expulsion or suspension
418412 of more than one semester from an institution of higher education.
419413 A student who violates the provisions of this paragraph shall
420414 permanently lose eligibility for program benefits. The provisions
421415 of this paragraph shall become effective January 1, 2008.
422416 D. The Oklahoma State Reg ents for Higher Education and the
423417 State Board of Career and Technology Education shall promulgate

451444 rules relating to maintenance of eligibility under the Oklahoma
452445 Higher Learning Access Act by a student.
453446 E. It is the intent of the Legislature that students in the
454447 ninth grade for the 1992 -93 school year who are det ermined to be
455448 eligible Oklahoma Higher Learning Access students pursuant to the
456449 Oklahoma Higher Learning Access Act shall be the first students
457450 eligible for benefits from the Oklahoma Higher Learni ng Access Trust
458451 Fund.
459452 F. The Oklahoma State Regents for Hi gher Education are
460453 authorized to study, develop , and propose criteria for determining
461454 award eligibility based upon the completion of seven semesters of
462455 high school coursework by a student.
463456 SECTION 2. AMENDATORY 70 O.S. 2021, Secti on 2605, as
464457 amended by Section 1, Chapter 400, O.S.L. 2022 (70 O.S. Supp. 2023,
465458 Section 2605), is amended to read as follows:
466459 Section 2605. A. Each school year, every fifth - through
467460 eleventh-grade student in the public and private schools of this
468461 state and students who are educated by other means and are in the
469462 equivalent of the fifth through eleventh grade shall be apprised,
470463 together with the parent, custodial parent, or guardian of the
471464 student, of the opportunity for access to higher learning under the
472465 Oklahoma Higher Learning Access Program. The Oklahoma State Regents
473466 for Higher Education and the State Board of Education shall develop,
474467 promote, and coordinate a public awareness program to be ut ilized in
475468

503495 Access Program.
504496 B. On a form provided by the Oklahoma State Regents for Higher
505497 Education, every public school district shall designate at least one
506498 Oklahoma Higher Learning Access Program contact person, who shall be
507499 a counselor or teache r, at each public school site in this state in
508500 which eighth-, ninth-, tenth-, or eleventh-grade classes are taught.
509501 When requested by the State Regents, the State Board of Education
510502 shall assist the State Regents to ensure the designation of contact
511503 persons. Private schools shall also designate at least one school
512504 official as a contact person. For students who are educated by
513505 other means, a parent or guardian or other person approved by the
514506 State Regents shall be designated the contact person.
515507 C. 1. Students who qualify on the basis of financial need
516508 according to subsection D or E of this section or who meet the
517509 eligibility qualification set forth in subparagraph a of paragraph 1
518510 of subsection B of Section 2603 of this title prior to entering the
519511 eleventh grade or prior to reaching the age of sixteen (16) and the
520512 standards and provisions promulgated by the Oklahoma State Regents
521513 for Higher Education shall be given the opportunity throughout the
522514 eighth-, ninth-, tenth-, and eleventh-grade years, for stude nts
523515 enrolled in a public or private school, or between the ages of
524516 thirteen (13) and sixteen (16), for students who are educated by
525517 other means, to enter into participation in the program by agreei ng

554545 program:
555546 a. attend school or an educational program regularly and
556547 do homework regularly,
557548 b. refrain from substance abuse,
558549 c. refrain from commission of crimes or delinquent acts,
559550 d. have school work and school records reviewed by
560551 mentors designated pursuant to the program,
561552 e. provide information requested by the Oklahoma State
562553 Regents for Higher Education or the State Board of
563554 Education, and
564555 f. participate in program activities.
565556 2. Students who meet the eligibility qualification set forth in
566557 subparagraph a of paragraph 1 of subsection B of Section 2603 of
567558 this title after completing the eleventh grade or aft er reaching the
568559 age of seventeen (17) shall be given the opportunity prior to
569560 reaching the age of twenty -one (21) to enter into participation in
570561 the program and shall execute an agreement with provisions as
571562 determined by the Oklahoma State Regents for Higher Education.
572563 3. The contact person shall maintain the agreements, which
573564 shall be executed on forms provided by the Oklahoma State Regents
574565 for Higher Education and managed according to regulations
575566 promulgated by the Oklahoma State Regents for Higher Educa tion, and
576567 the contact person shall monitor compliance of the student with the

604594 terms of the agreement. The Oklahoma State Regents for Higher
605595 Education are authorized to process student agreements and verify
606596 compliance with the agreements. Students failing to comply with the
607597 terms of the agreement shall not be eligible for the awards pro vided
608598 in Section 2604 of this title.
609599 D. Except as otherwis e provided for in subsection E of this
610600 section and except for students who qualify pursuant to subsection B
611601 of Section 2603 of this title, a student shall not be found to be in
612602 financial need for purposes of the Oklahoma Higher Learning Access
613603 Program if:
614604 1. At the time the student applies for participation in the
615605 program during the eighth, ninth, or tenth grade for students
616606 enrolled in a public or private school, or between the ages of
617607 thirteen (13) and fifteen (15), for students who are educated by
618608 other means, the income from taxable and nontaxable sources of the
619609 student’s parent(s) exceeds Fifty Thousand Dollars ( $50,000.00) per
620610 year;
621611 2. Beginning with eighth -, ninth-, or tenth-grade students who
622612 are enrolled in a public or private school or students b etween the
623613 ages of thirteen (13) and fifteen (15) who are educated by other
624614 means who apply for participation in the program in the 2017 -2018
625615 school year, the federal adjusted gross income of the s tudent’s
626616 parent(s) exceeds Fifty -five Thousand Dollars ($55 ,000.00) per year;

659648 student’s parent(s) exceeds Sixty Thousand Dollars ($60,000.00) per

661650 4. Beginning with eighth -, ninth-, tenth-, or eleventh-grade
662651 students who are enrolled in a public or private school or students
663652 between the ages of thirteen (13) and sixteen (16) who are educated
664653 by other means who apply for participation in the program in the
665654 2022-2023 school year:
666655 a. the federal adjusted gross income of the student ’s
667656 parent(s), who have two or fewer dependent children,
668657 exceeds Sixty Thousand Dollars ($60,000.00) per year,
669658 b. the federal adjusted gross income of the student ’s
670659 parent(s), who have three or four dependent children,
671660 exceeds Seventy Thousand Dollars ($70,000.00) per
672661 year, or
673662 c. the federal adjusted gross income of the student ’s
674663 parent(s), who have five or more dependent childre n,
675664 exceeds Eighty Thousand Dollars ($80,000.00) per year;
676665 5. At the time the student begins postsecondary education and
677666 prior to receiving an y Oklahoma Higher Learning Access Program

708696 6. Beginning with the 2018-2019 academic year, prior to
709697 receiving any Oklaho ma Higher Learning Access Program benefit award
710698 for any year during which the student is enrolled in an institutio n
711699 which is a member of The Oklahoma State System of Higher Education,
712700 a postsecondary vocational -technical program offered by a technology
713701 center school that meets the requirements to be eligible for federal
714702 student financial aid , or a private institution of higher learning
715703 located within this state and accredited pursuant to Section 4103 of
716704 this title, the federal adjusted gross income of the s tudent’s
717705 parent(s) exceeds One Hundred Thousand Dollars ($100,000.00) per
718706 year.
719707 The determination of financial qua lification as set forth in
720708 paragraphs 5 and 6 of this subsection shall be based on the income
721709 of the student, not the income of the parent(s), if a student:
722710 a. is determined to be independent of the student ’s
723711 parents for federal f inancial aid purposes,
724712 b. was in the permanent custody of the Department of
725713 Human Services at the time the student enrolled in the
726714 program, or
727715 c. was in the court-ordered custody of a federally
728716 recognized Indian tribe, as defined by the federal

759746 has received an Oklahoma Higher Learning Access Program benefit
760747 award after the 2017 -2018 school year; and
761748 7. The Oklahoma Stat e Regents for Higher Education shall review
762749 the determination of financial qualification as set forth in
763750 paragraphs 1, 2, 3, and 4 of this subsection if the income from
764751 taxable and nontaxable sources of the student ’s parent(s) includes
765752 income received from nontaxable military benef its or income received
766753 from the federal Social Security Administration due to the death or
767754 disability of the student ’s parent(s). If the inco me from taxable
768755 and nontaxable sources of the student ’s parent(s), excluding income
769756 received from nontaxable military benefits or income received from
770757 the federal Social Security Administration due to the death or
771758 disability of the student ’s parent(s), does not exceed the
772759 limitations set forth by paragraphs 1, 2, 3, and 4 of this
773760 subsection, the student shall be deter mined to have met the
774761 financial qualification set forth in paragraphs 1, 2, 3, and 4 of
775762 this subsection.
776763 E. 1. A student who was adopted bet ween birth and twelve (12)
777764 years of age while in the permanent custody of the Department of
778765 Human Services, in the court -ordered custody of a licensed private
779766 nonprofit child-placing agency, or federally recognized Indian

808794 be found to be in financial need for purposes of the Oklahoma Higher
809795 Learning Access Program if at the time the student begins
810796 postsecondary education and prior to receiving any Oklahoma Higher
811797 Learning Access Program ben efit award, the federal adjusted gross
812798 income of the student ’s parent(s) exceeds One Hun dred Fifty Thousand
813799 Dollars ($150,000.00) per year. The provisions of this paragraph
814800 shall not apply to any student who has received an Oklahoma Higher
815801 Learning Access Program benefit award prior to the 2012 -2013 school
816802 year.
817803 2. A student who was adopted between thirteen (13) and
818804 seventeen (17) years of age while in the permanent custody of the
819805 Department of Human Services, in the court -ordered custody of a
820806 licensed private nonprofit child -placing agency, or federally
821807 recognized Indian tribe, as defined b y the federal Indian Child
822808 Welfare Act, shall not be found to be in financial need for purposes
823809 of the Oklahoma Higher Learning Access Program if at the time the
824810 student begins postsecondary education and prior to receiving any
825811 Oklahoma Higher Learning Access Program benefit award, the federal
826812 adjusted gross income of the student ’s parent(s) exceeds Two Hundred
827813 Thousand Dollars ($200,000.00) per year. The provisions of this
828814 paragraph shall not apply to any student who has received an
829815 Oklahoma Higher Learni ng Access Program benefit award prior to the
830816 2012-2013 school year.

858843 3. Except for students who qualify pursuant to subsection B of
859844 Section 2603 of this title, the dete rmination of financial
860845 qualification as set forth in this subsection shall be based on the
861846 income of the student, not the income of the parent(s), if the
862847 student is determined to be independent of the student ’s parent(s)
863848 for federal financial aid purposes. A determination of financial
864849 qualification shall not be required for the student who m eets the
865850 criteria set forth in this subsection at the time the student
866851 applies for participation in the program. The provisions of this
867852 paragraph shall not apply to an y student who has received an
868853 Oklahoma Higher Learning Access Program benefit award prior to the
869854 2008-2009 school year.
870855 4. a. A determination of financial qualification is not
871856 required for a student who is the child of a certified
872857 classroom teacher at the time the student applies for
873858 participation in the Oklahoma Higher Learning Access
874859 Program and prior to receiving any Oklahoma Higher
875860 Learning Access Program benefit award for any year
876861 during which the student is enrolled in an institution
877862 which is a member of The Oklahoma State System of
878863 Higher Education, a postsecondary vocational -technical
879864 program offered by a techn ology center school that
880865 meets the eligibility requirements for federal student
881866 financial aid, or a private institution of higher

910894 pursuant to Section 4103 of this title. The Oklah oma
911895 State Regents for Higher Education shall verify the
912896 full-time employment status of the student ’s parent(s)
913897 prior to the student receiving any Oklahoma Higher
914898 Learning Access Program benefit award. The provisions
915899 of this paragraph shall apply to eighth -, ninth-,
916900 tenth-, or eleventh-grade students who are enrolled in
917901 a public or private school or students between the
918902 ages of thirteen (13) and fifteen (15) who are
919903 educated by other means who apply for participation in
920904 the program after the 2023 -2024 school year.
921905 b. For the purposes of this paragraph, “certified
922906 classroom teacher” means any certified, full -time
923907 teacher who has been employed by a public school
924908 district in this state for a minimum of ten (10)
925909 years. A certified classroom teacher shall not be
926910 required to have been emp loyed by the same public
927911 school district for ten (10) years or been employed
928912 for ten (10) consecutive years .
929913 F. The financial qualification o f a student as set forth in
930914 subsections D and E of this section shall be certified by th e
931915 contact person or by the Oklahoma State Regents for Higher Education
932916 on the agreement form provided by the Oklahoma State Regents for

961944 record of the student and a copy forwarded to the Oklahoma State
962945 Regents for Higher Education.
963946 G. Agreements shall be witnessed by the parent, custodial
964947 parent, or guardian of the student, who shall further agree to:
965948 1. Assist the student in achieving compliance with the
966949 agreements;
967950 2. Confer, when requested to do so, with the school contact
968951 person, other school personnel, and program mentors;
969952 3. Provide information requested by the Oklahoma State Regents
970953 for Higher Education or the State Board of Education; and
971954 4. Assist the student in completing forms and reports required
972955 for program participation, making applications to institutions and
973956 schools of higher learning, and filing applications for student
974957 grants and scholarsh ips.
975958 H. Students who are enrolled in a school district located in
976959 this state that serve s students who reside in both this state and an
977960 adjacent state pursuant to a contract as authorized in Section 5 -
978961 117.1 of this title, are in the eleventh and twelfth gr ades during
979962 the 2006-2007 school year, and who were denied participation in the
980963 program shall be allowed to enter or reenter into participation in
981964 the program by entering into agreements as set forth in subsections
982965 C and D of this section by June 1, 2008.

1010992 I. The Oklahoma State Regents for Higher Education shall
1011993 promulgate rules for the deter mination of student compliance with
1012994 agreements made pursuant to this section.
1013995 J. The Oklahoma State Regents for Higher Education shall
1014996 designate personnel to coordinat e tracking of program records for
1015997 the years when students participating in the program are still in
1016998 the schools or are being educated by other means, provide staff
1017999 development for contact persons in the schools, and provide liaison
10181000 with the State Board of Education and local organizations and
10191001 individuals participating in the program.
10201002 K. The school district where an Oklahoma Higher Learning Access
10211003 Program student is enrolled when the student begins participation in
10221004 the program and any subsequent school dist rict where the student
10231005 enrolls shall forward information regarding participation by the
10241006 student in the program to a school to which the student transfers
10251007 upon the request of the school for the records of the student.
10261008 L. Students participating in the Oklah oma Higher Learning
10271009 Access Program shall provide their Social Security number or their
10281010 student identification number used by their school to the Oklahoma
10291011 State Regents for Higher Education. The Regents shall keep the
10301012 numbers confidential and use them only for administrative purposes.
10311013 SECTION 3. This act shall become effective July 1, 2024.

10331015 of the public peace, health, or safety, an emergency is hereby
